Note: Annie Sherwood, new Board member was not sworn in to vote at the meeting tonight and therefore will not vote on any issues. 1. Update from Police Chief re: Dogs Chief Koch and ACO-Lynda Brogden Burns were present. They stated that there were a lot of violators of the regulation in May and June and they mostly issued warnings to these people because the regulation was new. They felt that once the people were warned they did not return and get cited. They did say that there were issues with dogs on the flats, but that they cannot do much about that. There were no violations at Drummer Boy Park. They felt that it went smoothly. JH asked that the dates be corrected on the website with regards to when the dogs can and can't be on the beaches. 2. George Reilly-continued variance request for Hamilton Cartway Paul Revere, Attorney for the homeowner was present. NI handed out emails that came in late today from abutters and also gave the Board a letter from GR explaining about the proposed system. GR explained that with an I/A system they would be below 5ppm of nitrogen. He also spoke about the calculations and the fact that the Board is mainly concerned with the phosphorus going into the pond and that there are not really any systems our there that reduce it at this point in time although with pressure distribution you would get better phosphorus removal. He spoke about the ground water flow and the fact that it is going towards the septic system and not the wells. Lemuel Skidmore arrived at 7:20PM The abutter's emails were read into the record. At this point the Board is not in favor of granting the variance. GR and Attorney PR asked that it be continued until a date certain. Motion: KJ-continue until the January 8, 2013 BOH meeting. LS seconded. 4 yes. 3. Ryder &Wilcox-variance request for 106 Partridge Circle Judy Bersin presented this to the Board. The homeowner would like to be put a small addition onto the house and will be using the existing septic system. The septic tank will be moved but the SAS will remain where it is currently located. The variance request is to allow the existing SAS to be 14 feet from the proposed cellar wall. W W W.TO W N.BREWSTER.MA.US BOH 11/27/12 Minutes Page 2 Motion: MC-approve variance request. KJ seconded. 4 yes. 4. J.C. Ellis-variance request for 9 Prell Circle Jason Ellis stated to the Board that at his final inspection of the new septic that went in, it was noted that the tank was installed less than the required 10'from a detached garage slab foundation. He is asking the Board to allow for this tank to remain at 8.7' from the slab. Motion: MC-approve variance request. KJ seconded. 4 yes. 5. J.C. Ellis-variance request for 3750 Main Street KJ recused himself from this variance request. The following variances are being sought from the Brewster Animal Regulations: 1. Animal enclosure less than 25'to the abutter's lot line 2. Barn and enclosures less than 100' from wetlands JH read a letter from an abutter into the record. JE stated that they are going before the Conservation Commission on December 4th for a wetland determination. Because they had not been to Conservation yet, the Board continued this hearing until January 8, 2013. 6. J.M. O'Reilly-variance request for 42 Warren's Road Matt Farrell was present. The following variance is being requested: 1. SAS to be 201' from the pond. This is an existing house that is going to be renovated and a guest house that will be built. Conservation Commission approved this at their last meeting. There was discussion on the proximity to the pond. Motion: LS-approve the variance request with the condition that a drip irrigation system is installed. KJ seconded. 4 yes. 7. Arthur Stringer-variance request for 436 Satucket Road A variance request to allow the current system to stay within 300' of the pond is being sought. Motion: LS-approve the variance request. KJ seconded. 4 yes. 8. Horsley Witten Group-informal discussion for SWWTP at 1200 State Street Maureen Hickey-POAH (Preservation of Affordable Housing) and Joe Henderson from Horsley Witten were present. POAH has recently acquired this property and when septic inspections were done, 4 out of the 11 systems at this property were in failure. DEP has told them that they will need to put in a small wastewater treatment plant. BOH 11/27/12 Minutes Page 3 This is an informal discussion at this point. They will be asking for variances to the SWWTP Regulation at the December 4, 2012 meeting. It was noted that the site would be 5ppm with regards to the septic system. 9. Discuss Bedroom Definition The Board agreed to leave the regulation as is. 10. Information from Bennett Environmental on Cape Sand &Recycling NI spoke about the recent well results and that the level of arsenic was higher than the recommended level. It was suggested that a letter be sent to the surrounding homeowners who have wells telling them that they may want to have their water tested. Add on's NI spoke about the grant for nursing services from the County. The Planning Board asked for any comments on an application they have in process for existing wireless towers.
