Attending the meeting were Councilor Ken Woodland, Chair, Rules and Ordinances, Councilor Tony Palomba, Chair, Human Services, Councilor Michael Dattoli, Clerk, Human Services, Councilor Aaron Dushku,Vice Chair, Human Services and Secretary, Rules and Ordinances, and Councilor Lisa Feltner,Vice Chair, Rules and Ordinances. Also attending were Peter Centola, Director, Recreation Department, Deborah Rosati, Director, Health Department, and Mark Reich, Town Attorney. Members of the community included Dennis J. Duff, 33 Spruce Street, Sally Eyring, 16 Russell Avenue, Stephen Kennedy, 77 Marion Road, Elodia Thomas, 67 Marion Road, and Attorney Adam Costa representing Dan Isenberg, 475J Arsenal Court. There were two main discussions—concerns from residents about current situations and a review of the Town's existing ordinance pertaining to noise, Chapter 95: Noise Regulations and related issues. Concerns about the Current Situations: - Noise from church services on Russell Avenue has caused considerable problems for neighbors. The specific issue is the use of bass-heavy amplifiers turned up so high that an individual can experience acute physical ailments and the rattling of house items. It was suggested that the church keep all doors and windows shut throughout the year when electronic amplification is used when music is being played. - Noise from commercial lawn equipment used at Arsenal Court, the Commander's Mansion and a private school has been a problem for some. - The Health Department, which is responsible for enforcing the existing Noise Regulations, has responded to noise complaints from residents. To determine whether there is noise pollution, the Department uses a general noise meter to measure if the noise is level is ten decibels or more over background noise. Occasionally the Department has borrowed equipment from the State that measures tonal noise providing a more a more accurate determination of noise pollution. - The Health Department should be aware that it is possible for an individual to experience hearing loss from that are very low frequency noise. Noise can be cyclical in nature and not a constant frequency, so measurements should be made between peaks and lows. Review of the Town's Existin,2 Ordinance—Chapter 95: Noise Regulations and Related Issues - Chapter 95 states that all devices used in construction and demolition are prohibited from use during specific hours of certain days of the week. - Chapter 95 defines noise pollution as noise levels 10 decibels over background noise and, if the noise is judged to have a tonal sound, an increase of 5 decibels above background noise is sufficient to cause noise pollution. The threshold for noise pollution is established by the State as 10 dB above ambient sound and local ordinances, like Chapter 95, are used to establish more specific standards such as time of day, duration, etc. - Chapter 95 does include a number of exceptions: A) Emission of sound to alert persons of emergency or sound related to emergency work and related training exercises. B) Non-commercial public speaking and public assembly activities as guaranteed by state and federal constitutions. C) Domestic equipment, such as lawn mowers and power saws,between the hours of 7:00 AM and 9:00 PM. - State regulations and ordinances do not provide an exemption for commercial equipment nor does it explicitly preclude it. Commercial equipment used on public parks and spaces is not exempt and therefore when it exceeds 10 decibels above background noise, it is in violation of the ordinance. - Even though certain types of equipment are not specified in the ordinance, this should not remove them from being considered in violation of the ordinance. - One of the biggest issues is that the definitions in the ordinance are far too board and exemptions should have clear definitions, for example, to differentiate between commercial and domestic equipment. - There are a number of questions that Chapter 95 does not address, such as how can a resident easily determine or measure if a noise is in violation of the ordinance? If a possible violation is reported, how would law enforcement be able to measure the level of sound to determine a violation? If specialized equipment needs to be brought in at a later date in an attempt to determine the validity of the violation, what would happen in the meantime? Would the reporter have to tolerate the noise until such time that the noise levels would be able to be accurately measured to determine if it is in violation of the ordinance? - Proper equipment used to accurately measure sound levels can be expensive and difficult to obtain. There are apps for smart phones that can roughly determine the level of sound that is being heard. After being determined as to which app is the best, citizens and law enforcement could use such an app in order to reach a reasonable determination as to whether or not an occurrence is in violation of the regulations. - There are a number of communities with very comprehensive noise regulations/ordinances. The City of Somerville has one of the most comprehensive. It controls: ■ Level of noise ■ Time of day or night of noise ■ Duration of noise ■ Whether the noise is recurrent, intermittent, or constant ■ Whether the nature of voice is usual or unusual ■ Whether the origin of the noise is natural or unnatural ■ Level and intensity of the background noise (if any) ■ Proximity of noise to residential sleeping facilities ■ Density of inhabitation of area within which the noise emanates ■ Nature of zoning area within which the noise emanates - The enforcing bodies in many local ordinances are determined to be the chief of police, superintendent of inspectional services, and their duly authorized agents, officers, and employees. - We need to be aware of the potential harm to local businesses if the regulations are too strict. They could cause more harm than good. There was consensus among the members of the Committees as well as those in attendance that Watertown's Chapter 95: Noise Regulation is inadequate, at times contradictory, and generally outdated. Action Item Councilor Dattoli made the following motion: The Committees on Human Services and Rules and Ordinances asks that the Town Council request that the Town Manager instruct the Health Department, Code Enforcement, and other relevant departments in cooperation with the Town Attorney to update and make comprehensive Chapter 95: Noise Regulations.
