Mayor Pro Tem Briggs called the regular meeting of the City Council to order at 7:40 P. M. Invocation was given by Rev. 2. Joe Coppinger of the Temple City Brethren Church, 5537 Temple 3. City Blvd. following which Mayor Pro Tem Briggs led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen- Briggs, Harker, Merritt, Tyrell ABSENT: Councilman - Beckley ALSO PRESENT: City Manager Koski; Asst. City Attorney Flandrick, V.Kobett, Recreation Director; Planning Director Dragicevich Mayor Pro Tem Briggs advised the Council that Mayor Beckley was at home ill and recommended he be excused for his absence. Councilman Harker so moved, Councilman Merritt seconded, and the motion carried unanimously. Mayor Pro Tem Briggs announced the public hearing, Zone: Case #67 -242 scheduled for Febr. 6, 1968, at 7:30 P. M. had been rescheduled for Thursday, Febr. 8, 1968, at 7:30 P. M., in the Council Chambers. 1PPROVAL:OF MINUTES: Regular meeting of Jan. 16, 1968. Councilman Harker moved to approve the minutes of the regular meeting of Jan. 16, 1968, Councilman Merritt seconded, and the motion carried unanimously. UNFINISHED BUSINESS: 6. ORDINANCE NO. 68 -258: 2nd read. Re Time extension for zone variances and conditional use permits once for a period of time not to exceed one year. Asst. City Attorney Flandrick presented Ordinance No. 68 -258 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 9231 OF THE TEMPLE CITY MUNICIPAL CODE for second reading. Council- man Harker moved to waive further reading, Councilman Merritt seconded and the motion carried unanimously. Councilman Harker moved to adopt Ordinance No. 68 -258, Councilman Merritt seconded, and the motion was carried by the following roll call vote: AYES: Councilmen- Harker, Merritt, Briggs NOES: Councilman- Tyrell ABSENT: Councilman - Beckley 7. ORDINANCE NO. 68 -259: 2nd read. Re Amendment to zoning code relative to,the zoning of car wash establishments Asst. City Attorney Flandrick presented Ordinance No. 68 -259 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING CERTAIN OF THE ZONING REGULATIONS OF THE CITY WITH REFERENCE TO AUTOMOBILE CAR WASHES for second reading. Coun- cilman Merritt moved to waive further reading and adopt, Coun- cilman Briggs seconded, and the motion carried unanimously. NEW BUSINESS: 8, APPEAL FROM PLANNING COMMISSION DECISION, ZONE VARIANCE CASE NO. 67 -238, DENIED: Thomas F. & Kathryn D. Minahan, 5430 N. Halifax Rd. Council Minutes, February 6, 1968, page 2 Planning Director Dragicevich presented the appeal from the denial of Variance Case No. 67 -238, Thomas F. & Kathryn D. Minahan, 5430 N. Halifax Rd. Councilman Merritt moved to set this appeal for public hearing before the Council on Febr. 20, 1968, at 7:30 P. M. in the Council Chambers, Councilman Harker seconded, and the motion was carried unanimously. 9. APPEAL FROM PLANNING COMMISSION DECISION CONDITIONAL USE PERMIT CASE NO. 67 -241, GRANTED: for batting cage at west side of Temple City Blvd., 160 ft. south of Lower Azusa Rd. to William Carroll. Appealed by Mary J. Laby, 9575 E. Bisby St., Temple City. Planning Director Dragicevich presented the above appeal. Coun- cilman Tyrell moved to set the appeal for public hearing on Febr. 20, 1968, at 7:30 P. M., in the Council Chambers, Council- man Merritt seconded, and the motion carried unanimously. 10. PARKS & RECREATION COMMISSION RECOMMENDATIONS: Meeting of Jan. 17, 1968. Item 7. Recommend request of Senior Citizens for co- sponsorship for the coming year by the City be granted. Recreation Director Kobett presented the above recommendation. Councilman Merritt moved to approve, Councilman Harker seconded, and the motion was unanimously carried. 11. PLANNING COMMISSION RECOMMENDATION: Meeting of Jan. 23, 1968. A. Recommend amendment to zoning regulations applicable to R -3 and R -4 zones having parcels with less than the requir- ed width. The Planning Director presented the above recommendation. Coun- cilman Tyrell moved to set for public hearing on Febr. 20, 1968, at 7:30 P. M. in the Council Chambers, Councilman Merritt second- ed and the motion carried unanimously. 12. SET PUBLIC HEARING: ASSESSMENT - CURB & GUTTERS: south side of Live Oak Ave. between Rosemead Blvd. and Eaton Wash. The City Manager presented the above to be set for public hearing. Councilman Tyrell moved to set the public hearing for Febr, 20, 1968, at 7:30 P. M. in the Council Chambers, Councilman Harker seconded, and the motion was unanimously carried. 13. TENNIS COURTS, LIVE OAK PARK: Acceptance of work City Manager Koski presented a letter from engineers Krelle & Lewis recommending acceptance of the work and authorization for payment with 10% retention to be paid 35 days after the Notice of Completion is recorded with the County Recorder. Ray Lewis, of Krelle & Lewis, gave a detailed report on the tennis courts. Norman Phillips, the contractor who constructed the courts spoke on his behalf regarding partial payment at this time. Councilman Tyrell did not feel that the concrete work was satis- factory as yet, and also as Councilman Beckley was concerned he felt this possibly should be held over for his consideration. Following a lengthy discussion regarding the surface texture and drainage problems the Council agreed to meet at 6:30 A. M., Thursday, Febr. 8, at Live Oak Park and look over the tennis courts together with the contractor, Krelle & Lewis, the City Manager and Public Works Director, and to reconsider the recomw..:. mendation at the Council meeting at 7:30 P. M. Febr, 8, 1968. Council Minutes, February 6, 1968, page 3 14. CITY ENTRANCE MARKERS ON BALDWIN AVE. & DOUBLE DRIVE: The City Manager advised this matter will be held over until a later date for more information. 15. RESOLUTION NO. 68 =800: Warrants & Demands City Manager Koski presented Resolution No. 68 -800 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $80,145.05, DEMAND NOS. 10524 THROUGH 10597. Councilman Tyrell moved to adopt Resolution No. 68 -800, Councilman Harker seconded, and the motion was unanimously carried. 16. COMMUNICATIONS: A. Request for Proclamation of March 3 -9 as Nursery Education Week. City Manager Koski presented a letter requesting the above proclamation from the Pre - School Assn. of Calif. Councilman Harker moved to so proclaim, Councilman Merritt seconded, and the motion carried unanimously. B. Request that week of Febr. 7 -11 be proclaimed as National Boy Scout Week. The City Manager presented a request from Theodore S. Hoffman, President, of Golden West Airlines, Inc., for the above procla- mation commemorating the 58th anniversary of the founding of the Boy Scouts of America. Councilman Tyrell moved to so pro- claim, Councilman Merritt seconded, and the motion carried un- animously. C. Request for use of intersection of Temple City Blvd. and Lower Azusa Ave. for making of Air Force Traffic Safety Film. City Manager Koski presented a request from Andrew Babbi:sh of 0. A. Kauffman & Associates, 866 United Nations Plaza, New York City, for the use of the above intersection for the making of this safety "defensive driving" film, and stating that during the use of this intersection their company absolves Temple City and the County of Los Angeles for any and all liabilities and insurance certificates will be furnished as required by the City and County regulations. Also any costs incurred in the use of police officers will be paid by them. Following discussion Councilman Merritt moved to approve, Councilman Tyrell seconded, and the motion carried unanimously. 17.. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward at this time to address the Council. 18. MATTERS FROM CITY OFFICIALS: Asst. City Attorney Flandrick presented two proposals for appraisals of 62 parcels involved in the street widening pro- ject of Temple City Blvd. between Lemon Ave. and Garibaldi. Proposals were from Howard S. Martin & Associates and John J. Gastlin and both were approximately the same. Following discussion Councilman Merritt moved to approve the retention of Howard S. Martin & Associates for these appraisals, the total cost of the work not to exceed $11,000; additional services rendered not to exceed $125. per day; also to utilize Gerard Morriss;and work to be completed not later than May 1, 1968, Councilman Tyrell seconded, and the motion was carried unanimously. 1 1 Council Minutes, February 6, 1968, page 4 City Manager Koski advised the Council that a meeting of the Transportation Assn. of So. Calif. will be held on Febr. 14, 1968, and the City at present does not have a representative appointed, he recommended an appointment be made so Temple City can be re- presented. He stated this TASC was an affiliate of SCAG and is tied in with L. A. Regional Transportation Study (LARTS). Following discussion it was agreed that Councilman Briggs should represent the City on this committee, as official City delegate. The City Manager presented a letter from the Board of Supervisors concerning the stand of the Board relative to the use of nar- cotics, LSD and dangerous drugs. Following discussion it was agreed to continu@ this for a study session and possibly have someone from the District Attorney's office in attendance. The City Manager requested permission to attend the spring meeting of the City Manager's Dept. of the League of Calif. Cities which i5 being held in Palm Springs Febr. 28 - Mar. 1, and also to authorize the necessary expensesl.r .Councilman Harker moved to approve and authorize expenses and allowance of time for. the City Manager to attend, Councilman Tyrell seconded, and the motion carried unanimously. The City Manager requested permission for the Director of-Re- creation to attend the California Parks & Recreation Conference to be held in San Diego March 2, 3 and 4. Also for Parks & Recreation Commissioner Leonard Adams, requestswos (made :for hin to attend in lieu of his non - attendance at the League of Calif. Cities Conference. Councilman Tyrell moved to approve and authorize payment of expenses for the Director of Recreation to attend this Conference, Councilman Merritt seconded, and the motion carried unanimously. Councilman Tyrell moved to authorize the attendance of Commissioner Adams with expenses not to exceed that allowed for the League Conference, Council- man Harker seconded, and the motion carried unanimously. Councilman Tyrell apprised the Council re the Sky Night Pro- gram of the Sheriff's Dept. and the Sheriff's request for additional helicopters for night surveillance. This service has been in operation in Lakewood for about 15 months and has been very satisfactory. He felt the Council should consider whether this is appropriate for Temple City and this area, and possibly the adjacent cities might be interested in some kind of cooperative ,rrangement. Re the tennis courts Councilman Tyrel4 Stated& in some of the contracts the City has come out second best, for instance Baldwin Ave. which is rough, and he felt the City sets up specifications but does not get what they bargain for. Re the tennis courts he felt there was no lack of good faith but he felt the job should be done right. He felt we should possibly review our bidding and specifications system so the City is adequately protected. 19. ADJOURNMENT: Councilman Tyrell moved to adjourn to 7:30 P.M. on February 8, 1968, in the Council Chambers, Councilman Merritt seconded, and the motion carried unanimously.
