1 CALL TO ORDER/ROLL CALL OF MEMBERS The meeting was called to order by
the Chairman at 7 10 p m Present were Councilmembers Martha F Broucek, Carol Diaz -Castro,
James L Peters, Robert L Vernon, Vice Mayor Jorge Mendia and Mayor Robert Oldakowski
Councilmember Mortimer Fned was absent Also present were Village Manager Jacqueline R
Menendez, Village Clerk Conchita H Alvarez and Village Attorneys David Wolpin and Stephen P
Helfman
2 INVOCATION Reverend Gabnel Sinisi, St Chnstopher's by the Sea gave an invocation
Reverend Bud Schroeder addressed the Council regarding the loss of former Councilmember Scott
Bass
Youth Council Mayor Joseph Peltz also addressed the Council regarding the loss of former
Councilmember Bass
3 PLEDGE OF ALLEGIANCE Mrs Louisa Peltz led the Pledge of Allegiance
4 APPROVAL OF MINUTES Councilmember Broucek made a motion to approve the
minutes of the February 11, 2003 Local Planning Agency Meeting The motion was seconded by
Councilmember Diaz -Castro and approved by a 6-0 voice vote The vote was as follows
Councilmembers Broucek, Diaz -Castro, Peters, Vernon, Vice Mayor Mendia and Mayor Oldakowski
voting Yes

ADJOURNMENT The meeting was adjourned at 8 16 p m

5 ORDINANCES A public heanng and recommendation of the Village Council sitting as
the Local Planning Agency on the following proposed ordinance
AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, PROVIDING FOR
A MORATORIUM ON DEVELOPMENT PERMITS FOR ALL LANDS ZONED FOR
COMMERCIAL OR OFFICE USES ALONG THE CRANDON BOULEVARD CORRIDOR
AS DEPICTED ON ATTACHED EXHIBIT A, PROVIDING FOR A VESTED RIGHTS
PROCEDURE RELATED TO THE MORATORIUM, PROVIDING FOR EXCEPTIONS,
PROVIDING FOR EXCLUSION FROM THE CODE OF KEY BISCAYNE, PROVIDING
FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE
Councilmember Broucek made a motion recommending the adoption of the ordinance to the Village
Council The motion was seconded by Vice Mayor Mendia
The Attorney addressed the Council regarding this ordinance
The Mayor opened the public heanng Carter McDowell, representing the owner of 200
Crandon Boulevard, Robert Fabncio, 200 Ocean Lane Dnve and Jim Taintor, 355 Crandon
Boulevard addressed the Council The Mayor closed the public heanng
Jud Kurlancheek, Director of Building, Zoning and Planning addressed the Council regarding this
ordinance
Councilmember Broucek made an amending motion to include the following properties in the
ordinance hotels on the east side, The Oasis, Harbor Plaza Shopping Center and the West Mashta
Office Buildings The motion was seconded by Councilmember Peters and approved by a 6-0 voice
vote The vote was as follows Councilmembers Broucek, Diaz -Castro, Peters, Vernon, Vice Mayor
Mendia and Mayor Oldakowski voting Yes
The motion recommending the ordinance as amended was approved by a 6-0 voice vote The vote
was as follows Councilmembers Broucek, Diaz -Castro, Peters, Vernon, Vice Mayor Mendia and
Mayor Oldakowski voting Yes

MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS
MADE, WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH
THE APPEAL IS TO BE BASED
