HomeMy Public PortalAbout09 - 2020 - 9 - APPROVING WATER RATES AND CHARGES ORDINANCE 2020-9 AN ORDINANCE AMENDING SECTIONS 9-11,9-12,9-13,9-14, 9-15, 9-16,9- 17 AND 9-21 OF THE GREENCASTLE CITY CODE APPROVING WATER RATES AND CHARGES WHEREAS,the City of Greencastle, Indiana,owns and operates a municipal water system and collects rates and charges for the use of and the services rendered by said water system pursuant to I. C. 8-1.5-3-8; WHEREAS,due to the increased costs of providing water to the customers of the Greencastle Department of Waterworks, it is necessary for an increase in water rates; WHEREAS, the existing rates and charges do not produce sufficient revenue to pay all the necessary expenses incident to the operation of such water system, as delineated in I.C. 8-1.5-3-8, including maintenance costs,operating charges,upkeep,repairs,depreciation,taxes and payments in lieu of taxes, interest charges on bonds and other obligations, to provide a sinking fund for the liquidation of bonds and other evidences of indebtedness,to provide a debt service reserve for bonds or other obligations, to provide adequate funds to be used as working capital, adequate funds for making improvements, and a reasonable return on the utility plant, and therefore do not produce revenues sufficient to maintain such water system property in a sound physical and financial condition to render adequate and efficient service. Accordingly, said existing rates and charges are not reasonable and just for services within the meaning and provisions of I.C. 8-1.5-3-8; and WHEREAS,it will be necessary to increase the existing rates and charges in order to provide sufficient funds to meet the financial requirements of said municipal water system,and an Ordinance establishing a new schedule of rates and charges should be adopted by the City of Greencastle, Indiana Common Council. NOW THEREFORE be it ordained by the Common Council of the City of Greencastle that the enumerated water rates and charges as set forth in the Greencastle City Code, Sections 9-11 through 9-17 and 9-21, be amended and read as follows: Section 9-11. Late payments shall be subject to the following: a. The City shall allow a one business day grace period after the 10th of the month before assessing a late payment charge. All bill for water service not paid on or efore that date shall be subject to a late payment charge of ten percent (10%) of the bill. b. The City may disconnect water service on any account where payment has not been received within thirty (30) days of the due date. There shall be a Sixty and no/100 Dollars ($60.00) reconnection fee for every service that is reconnected as a result of disconnection due to late payment. Section 9-16 Bad Check Charge When a customer's check is not honored due to insufficient funds, a charge for processing will be made by the waterworks in the amount of Forty and 00/100 Dollars ($40.00). Section 9-17 Tap-In Charges a. The following fees shall be paid to the Department of Waterworks to cover the cost of installing new services: Tap-In Charges Size Charge 5/8-3/4" meter $ 1,200.00 1" meter 1,800.00 1" Tap with two 5/8" meters 2,400.00 1 '/2" meter 4,500.00 2" meter 5,800.00 3" meter 8,785.00 4" meter 15,625.00 6" meter 15,625.00 Meters larger than 6" shall be the cost of labor, materials, power equipment, transportation, and overhead costs incurred in installing the tap, but shall be no less than the charge for a 6" meter tap, above. b. If the water main water line from which a service is being connected is located in the street pavement, additional charges for special backfill and pavement repair shall be assessed. If the main water line being tapped is located in a state highway, additional charges shall be assessed made to cover state highway cut permit fees. c. In the event service is disconnected for non-payment, the reconnection charge shall be Sixty and 00/100 Dollars ($60.00). When service is turned off for non- payment of bill, or whether, for any reason beyond the control of the City, a re- establishment of service is required by any one customer, this charge shall be assessed by the City to cover the cost of discontinuance and re-establishment of service. The charge, together with any arrears due the City, shall be paid by the customer before service will be re-established. d. Customers are responsible for hiring and paying a contractor to install the connection to the City's waterworks system. The City shall be responsible for furnishing the parts necessary to connect the City's water line to the customer's water line, and shall inspect the work being done by the contractor. All contractors hired to perform the above work must be approved in advance by the City of Greencastle Water Superintendent. e. The City shall be available for service calls at no charge to customers for from 8:00 a.m. to 4:00 p.m. during regular City workdays. There shall be no charge at any time for a service call related to a suspected leak. All other after-hour service calls, not related to leaks, may be charged to the customer at the rate of Forty and 00/100 Dollars ($40.00) per call. f. There shall be no refund of tap fees if the customer reduces the size of a meter, once the meter has been put in use. In the event that a customer increases a meter size, the customer shall pay the difference between the Tap-In Charge for the initial meter and the charge for the larger-sized meter. Section 9-21 Water Service Deposit Fee a. The amount of the refundable water service deposit shall be One Hundred and 00/100 Dollars ($100.00) for service provided to the customer. Deposits may be waived by the Clerk-Treasurer, or his/her designee, for customers with satisfactory prior payment records. b. After two (2) years of on-time, current payment of bills, the deposits shall be refunded to the customer, without interest. c. If there is a disruption in service or payment another deposit may be required. d. A deposit made that has remained unclaimed by the customer for more than sisty (60) days after the termination of the customer's water service shall become the property of the municipality. If a customer comes back to the utility office at a later date, and can prove that he/she is owed the deposit, the utility office will return the deposit to the customer. All other terms and conditions contained in Greencastle Code 9-11,9-12,9-13,9-14,9-15,9-16,9- 17 and 9-21 which are not specifically amended herein shall remain in full force and effect. This Ordinance shall have full force and effect upon passage of the Greencastle Common Council and its approval by the Mayor and the above rates shall become effective January 1, 2021.
