Reiman, 7:30 December 18, 2003 P.M., Municipal Court, Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey, on December 18, 2003. ROLL CALL Upon individual roll call, the following were noted present: Councilmembers Randy Krum " Susan R. Naples " Frank Parisi " Ronald Rios Joseph Sitarz Councilmember Sosnowski was noted Absent. Also noted present was Borough Attorney Robert Bergen. The meeting was opened with a minute of Silent Prayer and the P~A'~a"Ii, Pl.I~GE Pledge of Allegiance led by Mayor Daniel J. Reiman. OF ALLI~GI/~ICE The Assistant Clerk stated that on December 10, 2003, in full STATEM~ OF compliance with the Open Public Meetings Act, a notice of MI'~I'ING NOTICE tonight's meeting was sent to The Home News Tribune, the Star Ledger and posted on the Bulletin Board. a)Students A~jnst Destructive Decisions (SAAD) - Mayor O3~IENDATIOIqS Reiman then asked the SAAD Members to come forward as he Stt~ents ~2ainst: called their names. The following were given awards; Redmond Destructive Decisions Godfrey, Caitlin Keating, Satinderjit Singh, Balwinder Takhar, (Stt~O) Jessica August, Anthony Castillo, Marcial Garcia, Joanne Spoganetz, Christine Pogorzelski and Robert Pogorzelski. He then asked Joan Vitale, a teacher in Carteret High School with the SAAD Program, to explain about the program. She gave a short synopsis. Mayor Reiman commented that Ms. Vitale does a tremendous job with SAAD and the members of the organization and on November 1st of this year they had the opportunity to put together a program, "This Private Child I.D. Kit." The child would be fingerprinted, photographed and asked specific information to be included. He showed the audience a copy of the card and explained -- that the volunteers present made the program work. The Mayor DI~E~B~ 18, 2003 then read the commendation, that would be presented to each member, into the record: ShAD Comn~ndation "WHEREAS, Carteret Mayor Daniel J. Reiman is pleased to honor (Name of Member) for actively participating to help benefit this Borough as a member of Carteret High School's Students Against Destructive Decisions "S.A.D.D." and who has gone far and beyond his/her civic duty; and WHEREAS, donating one's time to assist others is praiseworthy and benefits the entire Borough of Carteret and all of its citizens; and WHEREAS, he assisted members of the Carteret Police Department during their recent "Child Identification Program" where children were digitally photographed and fingerprinted within the Borough; and WHEREAS, by willingly and selflessly participating as an active leader in our community (Name of Member) has brought honor and pride to the community and has earned the respect of the residents of the Borough of Carteret and Middlesex County. NOW, THEREFORE,BE IT KNOWN TO ALL THAT THE UNDERSIGNED HEREBY HONORS: (Name of Member) and extends sincere gratitude for his/her many years of service to his/her community. On behalf of all of the citizens I congratulate him/her on receiving such a prestigious award." Mayor Reiman then read off the names of each member and they came forward to receive a Mayor's Commendation. Mayor Reiman then commented that they also had some representatives of the Police Department helping that day. Deputy Chief Hojecki read off the names. He mentioned Captains Talalai, D. Tarrant, McFadden and Detectives, D.Kopin, T. Curran, and F. Ciarkowski. Captain Tarrant also brought his children. He commented without SAAD and the other volunteers they would have never gotten through the day. He thanked them all from the Police Department. Fire Prevention b) Fire Prevention Poster Contest - Mayor Reiman asked Chief Poster ~outest Brian O'Connor to come forward for these commendations. Chief O'Connor explained that they had a poster contest in the Grammar Schools and Gateway School. A $300.00 Savings Bond was given to each First Place winner and a ride to the school on a fire truck. As each winner was called he displayed their posters. 18, 200.3 Mayor Reiman then read the names of the winners; Stephanie Fire Prevention Poster Hemsel from Nathan Hale School, Catherine Amarillo from Minue Contest Cont: School, Daniel Jansen from Columbus School, Tyhesha Walden from Gateway School, Charlotte Caporrino from St. Joseph School and Alina Ali from Carteret Middle School. c) Jorge Perez - Mayor Reiman then called upon Jorge Perez, Jorge Perez explaining that he is an Army Veteran of the Iraq War, resident of and from Carteret and was injured in serving his country in Iraq. -- He is getting a commendation for serving in the United States Army, for fighting the war on terrorism. He read his commendation into the record: "WHEREAS, on September 11, 2001, this nation suffered one of C(~m~ndation the most tragic losses in our history. Thousands of people from all over the world were impacted by this horrific attack on life; and WHEREAS, in efforts to keep the world from ever suffering this great loss again America went to war against their number one enemy, terrorism; and WHEREAS, by taking part in this war against terrorism, Jorge made his Country, Community and Family very proud; NOW, THEREFORE, BE IT KNOWN TO ALL, on behalf of the Mayor and Council we hereby honor JORGE PEREZ and on behalf of all the citizens of the Borough of Carteret, extends -- sincere gratitude for your service in the United States Army" Mayor Reiman then said they are also giving Jorge the "Key to the City of Carteret." He then gave the commendation and key to Mr. Perez, for which he received a standing ovation. Police Officers - Mayor Reiman then explained that the Borough b-'VtEhRI~ of Carteret just hired seven (7) new Police Officers. He said they Polic~e Offi~rs will take their "Oath of Office" tonight. He spoke in the highest regard about the Borough's Police Department and then asked each officer to come forward when their name is called. He called Michael J. Damman, John Witkowski, Robert Worgocki, John Moody, Paul Stentella, Jonnathan De Felice and Thomas O'Connor. He then called to the front and introduced the Chief of Police John Pieczyski and Captain of the Patrol Division, Captain Talalai and Deputy Chief Hojecki and Council President and Police Commissioner Ronald Rios. Mayor Reiman then swore in the seven new Police Officers. After being sworn in they were presented with their badges. -- Mayor Reiman then said they would be taking a five (5) minute Recess recess so they can take pictures and leave, if they would like. DI~C~IBI~ 18, 200.3 Meeting Recessed At approximately 7:55 p.m., a five (5) minute recess was held. At approximately 7:60 the meeting was reconvened by Mayor Daniel J. ORDINANCE ~33-48 The Assistant Clerk stated that Ordinance #03-48 was introduced Establishing a and passed upon First Reading at a Regular Meeting of the Prevailing Wage Borough Council of the Borough of Carteret, held on November 17, Requir~-nent 2003. It was duly published in The Home News Tribune on November 20, 2003 with notice that it will be considered for final passage after Public Heating to be held on December 27, 2003, at approximately 7:00 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Public Hearing Upon MMS&C by Councilmembers Sitarz and Rios and unanimous affirmative vote of the five (5) Councilmembers present, the Mayor declared the Public Hearing to be open. Jim Failace asked what exactly the ordinance required. Mayor Reiman explained that the ordinance requires the prevailing wage clause, that any contractor we do business with, with a contracting excess of $2000.00, have to provide for proper documentation to certify they are paying their employees the proper prevailing wages set forth by the state. Patrick Haley then asked if there was any conversation between his attorney and the Borough since he last spoke to them. Mayor Reiman said he had no conversation with his attorney, but he is under the impression that he has had a conversation with the attorney to the developer. He said they cannot just move ahead and condemn, but he will set it up if we have to. Hearing Closed There being no further comments or objections to the Ordinance the Mayor declared the Public Heating to be closed upon MMS&C by Councilmembers Sitarz and Rios and unanimous affirmative vote of the five (5) Councilmembers present. It was duly Department Heads/ published in The Home News Tribune on November 20, 2003 with Miscellaneous notice that it will be considered for final passage after Public Heating to be held on December 18, 2003 at approximately 7:00 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Public Hearing Upon by MMS&C by Councilmembers Sitarz and Krum and unanimous affirmative vote of the five (5) Councilmembers present, the Mayor declared the Public Hearing to be open. Jim Failace, 13 Ghinda Avenue asked if this was the ordinance which would add to the years salary ordinance. Mayor Reiman said it is the Salary Ordinance that would increase the Department Heads as well as the Mayor's salary. Jim Failace said he is in opposition to it. He thinks something like this would be an unnecessary burden to the taxpayers of Carteret. He then asked Councilwoman Naples, because of her article in the newspaper, if the idea came basically from her, why, and if the duties of the Mayor would change. Councilmember Naples said the duties of the Mayor are he would be CEO. She commented she read his article and in reference to DI~'~I~ 18~ 2003 what he had said she commented, she said she did not say Carteret Ordi_nanc~ ~[03-53 C~ont: requires a Business Administrator, but said in lieu of, we have a Chief Financial Officer. Jim Failace then asked her what her thought process was regarding the reasoning behind this. Councilmember Naples said to run the daily operations of the Borough, in these times, with a lot going on and Carteret on the -- move, she thinks a full time mayor is necessary. Jim Failace questioned why not a Business Administrator with credentials. Councilmember Naples said the credentials the Mayor would have is the confidence of public, knowledge he has, because he had a good pulse on the Borough. She also said is should make more people interested in the election and raises the standards. Jim Failace said he also saw a statement saying that it would be a cost savings by not hiring a Business Administrator. He said he did not see a cost savings. He mentioned the Executive Secretary with benefits. Councilmember Naples said she is an Executive Secretary and commented that there were people in the Clerk's Office that were not replaced, so they are still saving money. Mayor Reiman told Mr. Failace that his Business Administrator was making $90,000.00 and his Police Director was making -- $103,000.00. Mr. Failace said he did not agree with his totals and commented that he had the credentials needed and he would do the job for $70,000.00. Councilmember Naples said this is where they differed and then explained they have someone elected by the public that has the knowledge, the know how and the confidence of the community, which she thinks is very important. Mr. Failace commented that the Mayor could not be a Business Administrator in any other town. Councilmember Naples gave examples of part time Mayors that already make what our Mayor will be making working full time. Hardyal Singh spoke, saying that the way Carteret is moving, a full time Mayor is needed. He spoke favorably of the Mayor. Frank James then spoke, saying that contrary to what the article in __ the paper said, he is not a paid aide. He then commented how the town is working and how we now have a dynamic young man leading this town and that he is well worth the money. 9 18, 20{23 Ordinance i~03-53 Cont: Father Chubenko, Roosevelt Avenue, spoke favorably about Mayor Reiman saying that he is total support of him being a full time Mayor. Frank Walsh, 19 Wedgewood Drive. He thanked the Streets and Roads for the great cleaning of the streets and then congratulated the Mayor for becoming full time and that he was in favor of it. Pastor Torres. He thanked the whole Council and the Mayor for the good job they are doing and that he is in favor of a full time Mayor as well as his congregation. Mr. Theordore Majoris then spoke. He questioned the Mayor about how he came about with $52,000.00 for his salary. Mayor Reiman said it was done through a comparison of other municipalities in the area and gave some examples. He explained to him how the Salary Ordinance would become law. Mr. Majoris asked about a tax increase and Mayor Reiman said there would be no incremental tax increase. Mr. Majoris went on to say that he lives in 215 Roosevelt Avenue and questioned a project going on across the street at the ballfield. He commented he was told there would probably be no increase in the taxes, but yet he saw his taxes go up for a quarter, so he had his doubts as to the reality of that. He questioned with that new project, whether the value of the properties would go up and then asked the Mayor if he was familiar with the Zoning Codes for his area. Mayor Reiman said it is commemial and residential and it is overlaid in the Zoning Map as a Redevelopment Area, which would throw out zoning and will be based upon the Redevelopment Plan. He then explained to Mr. Majoris that it is now a public portion to speak only on the ordinance #03-53, but, he can speak about other things in the public portion of the meeting. Mike Kepich spoke in favor of the full time Mayor. Hearing Closed There being no further comments or objections to the Ordinance the Mayor declared the Public Hearing to be closed upon MMS&C by Councilmembers Rios and Sitarz and unanimous affirmative votes of the five (5) Councilmembers present. Upon MMS&C by Councilmembers Sitarz and Rios ORDINANCE #03-53 "AN ORDINANCE TO AMEND ORDINANCE #71-9 ESTABLISHING SALARY SCHEDULES AND FIXING THE MANNER OF PAYMENTS OF SALARIES FOR VARIOUS 10 DISCOVER 18, 2003 OFFICIALS AND EMPLOYEES OF THE BOROUGH OF O~itmnc~ ~03-53 CARTERET" was Adopted. Upon individual roll call vote Councilmembers Adopted Krum, Naples, Parisi, Rios and Sitarz voted in the Affirmative. Councilmembers Sosnowski was noted Absent. Prior to the individual roll call vote, Councilmember Rios spoke. Couneilmember Rios He said this ordinance was new for the Borough of Carteret, but many things are new for the Borough. He spoke of the former Business Administrator, under Mayor Failace, who had a salary of $90,000.00. He explained that most Business Administrators are not from the town they work in, but we have a Mayor who is elected by the people and now that we are undergoing so many changes that we need a full time Mayor/CEO. He spoke about many of the changes and then spoke of the Police Director, under the former Mayor, who had a salary of over $100,000.00, and was from out of town. He said even the News Tribune Editorial Board endorsed this ordinance and then commented that one of our critics said that our Mayor does not have the qualifications for on the job training. He mentioned that the requirements of the President of the United States, the leader of the free world, is to be thirty-five (35) years of age and a Natural Bom Citizen and questioned if we should ask more of our mayor than that. He said this was a practical decision done by the Council and went on to say he fired the former Business Administrator and he did not say or move to abolish the position at that time He thinks the people that are opposed to this are very short sighted and by adopting this ordinance they won't be shortchanged. Councilmember Krum said he wanted to let everyone know he is Cotm~:ilmember Krum proud to work with the Council this year, especially under Mayor Dan Reiman who he thinks is the best thing that ever happened in the town of Carteret. Councilmember Sitarz said we have discussed this many times Cotmeilmember Sitarz when he was a former Councilmember. He said when Mr. Sica was here he was readily handy because his business was in Carteret. He said he thinks we are getting a bargain getting Mr. Reiman, he puts a lot of time in. Se~er Investigation An unidentified man spoke asking about the resolution for the investigating of the sewers in West Carteret and the Hill Section. Mayor Reiman explained that it was part of the administrative consent order that was agreed to by the Department of Environmental Protection. When the prior administration did the investigation in the Hill District, they only did half and now we are going to complete it and fix the problem. Public Portion Upon MMS&C by Councilmembers Rios and Sitarz and Closed unanimous affirmative vote of the five (5) Councilmembers present, the public portion on resolutions was closed. Consent hgenda Mayor Reiman then asked for a motion on the Consent Agenda. Councilmember Parisi Abstained on Resolution #03-371 and yes on all the others. Councilmember Sosnowski was noted Absent. RESOLUTIONS #03-357, 358, 359, 360, 361,362, 363, 364, 365, 366, 367, 358, 369, 370, 371,372, 373, 374, 375, 376, 377, 378, 379, 380, 381, 382, 383, 384 and 385 were introduced by the Mayor and referred to the Council for action. She then reported that the Library/Community Center has experienced another vandalism. They are looking for a security system complete with cameras. She said there will be a rental on the Fire House Hall through the Buildings and Grounds Department, that was formerly the Community Center. They are now charging a $100.00 deposit and they will be monitoring it. She then mentioned an Angel Tree in the Atrium of the Community Center, sponsored by the Mayor's Childrens Charity Fund. FINANCE & ADMINISTRATION: Committee Chairperson Parisi reported that Mr. De Blasio and all the Department Heads have been asked to come up with a budget for the coming year. They have been directed to stay within their budget from the last year. He said they would like to approve no tax increase for the following year. He then wished the Mayor and Council a happy, healthy holiday season. FIRE In the absence of Committee Chairperson Sosnowski, Councilmember Naples would report on Fire. She reported on November 24th a high end rescue drill was conducted with Kinder Morgan Emergency Response Team. They rescued an injured worker on the top ofa fifiy (50) foot storage tank. She said the Fire Department has announced they will be receiving $100,000.00 for an (inaudible) Preparedness Grant and the money will be used to replace the air filling station at Fire Headquarters. They have also been awarded a $74,000.00 Fire Action Grant. She said the Chief asked her to congratulate Susan Bodnar, EMT, for completing her Firefighter I Training, at the Middlesex County Fire Academy and to congratulate Kevin Pine who was recently accepted into the Navy and is training to be a Navy Firefighter. PARKS & RECREATION: Committee Chairperson Krum reported that our Christmas Festival will be held on Friday, Saturday and Sunday. Some of the work in the Parks, such as Grant Avenue, are finished and the Sportsman Field is half way finished and the Skate Park Bid went out. He wished everyone a happy and safe holiday. Progress. 20 DI/I2EI~ER 18, 2003 POLICE: Committee Chairperson Rios reported we are working in C~dttees Cont: conjunction with the Prosecutors Office, handing out the CD Rom from the Police Department, so parents monitor their children and see if they are going into any illicit sites. He went on to report that our civilian Police Academy is working fantastic with the High School Kids and there was a "Weapons of Mass Destruction Seminar" held and attended by our Chief and Deputy Chief. The FBI came last week and handed out certificates/commendations to the Police Officers that were involved in the apprehension of the -- two (2) suspects that kidnapped the Senator's wife and last night they had the Board of Education okay the donation of the old library van to the Police Department for a Command Center in case we have to use it in a case of emergency. He asked everyone, prior to the meeting, if they would sign the certificate for the proper burial for the World Trade Center Victims in the fresh kill landfill. He said Mr. Meehan, one of the victims fathers, mentioned to him here afterwards that the state legislature passed a resolution and now they are just waiting for the Governor to sign it. He then wished everyone a happy and healthy holiday. PUBLIC WORKS: Committee Chairperson Sitarz thanked all the Borough employees for doing a great job with the clean up of our last snow storm, that it was done with minimum equipment and they had no major breakdowns. He said next week we would be getting two (2) new Dump Trucks and we just pumhased a new Street Sweeper and with money left over they may be purchasing a small super vac. He reported that they took care of the problem from the last storm with flooding on Beverly Street and he wished everyone a Merry Christmas and a Happy New Year. -- BOARD OF EDUCATION: Committee Chairperson Naples thanked students for helping register the little ones for the I.D Kit Program. She said Carteret High School will be having a play, West Side Story and she spoke shortly on this. Mayor Reiman commended the Streets and Roads Department and I4AyOR Councilman Sitarz, for doing a great job. He said most people were not aware that Councilman Sitarz works on the jobs with the guys. He said this was the first time that Carteret hosted a "Weapons of Mass Destruction Seminar" and he spoke shortly on this. He went on to say that we would be having our first Holiday Festival and commented that he has a great staff and recognized Judy Leshko who headed up the project. He said it is sponsored by the Charity Trust Fund for Children as well as the Borough of Carteret. Mayor Reiman told him it was purchased by the Borough in 1995 for about one quarter of a million dollars. It has been used as a public works yard and we are in contract to selling that property. Mr. Majoris said he was told the Borough didn't own it and asked if he sees machinery working on the property, do they have the right to do this. The Mayor told him currently what he sees going on is stockpiling from the streetscape and if he spoke to someone on the streetscape project they may not know we are selling the property to the redeveloper. He said we sold the site for roughly 4.6 million dollars and we are under contract to sell it to Meridian Square Terrace. They are awaiting final approval from the DEP. They are reviewing the property to see if wetlands existed there and if they determine there were wetlands there, legally filled, the DEP would levy a dollar value or dollar fine against the Borough for the Borough. Overall if they do fine us X amount of dollars we still have a net profit of over four and one half million dollars. If they do make the developer put in wetlands that can be accommodated and a number of units would be reduced to work around the wetlands, so the wetlands are not an issue. Mr. Majoris asked if there should be any activity with machinery by the P&E Station up to the Municipal Garage. Mayor Reiman told him it is one parcel and is used for a Public Works Facility and used as storage for the Streetscape Project. There is only environmental testing going on. He told him if he has questions or sees something he can always call the Police Department. Father Chubenko Father Chubenko spoke saying there is an inherit problem in Carteret, explaining that it probably has to do with the fact that a lot of the complexion in Carteret has changed, moving to and from. He said there is a basic problem with pretty much every parish in Carteret with parking. He said he had checked with Captain Talalai and was told there is no ordinances in reference to parking in front of churches, which they were told they were and commented that signs are going up by churches and funeral directors for no parking because of weddings or funerals and certain people will disregard them. He asked Councilmember Rios, who is the Police Commissioner, to look into this because it is creating a hazard. 22 D~Eli 18, 2003 Councilmember Sitarz said back when he was previously on the Council, there was an ordinance and then when they re-codified the ordinances, they took some of that out. An unidentified woman said she remembered when Fitch Street was a one way by Sacred Heart and now it is a two way. Mayor Reiman said that is something to look at and will be taken into consideration. An unidentified man told the Mayor that last year when he took Smeer User Fee over this administration he asked him a few questions that bothered him. One was in regards for how we were charged for the Sewer User Fee. He said he did some investigating on his own and called fourteen (14) of the twenty one (21) towns in Middlesex County and they charged the sewer user fees based on consumption. The other half had flat rates and other means. He asked if something would be done in 2004. Mayor Reiman said he expected there would be a proposal drafted early in the year which will effect the rates that seniors pay. The unidentified man complained about loosing days for garbage garbage/reeyctables or recyclables because of holidays. Mayor Reiman said they are considering putting out the recycling the day after the holiday for these people but they will have to see about the people contracted for the garbage. -- Mayor Reiman then said they would be going into Closed Session to discuss some Litigation items.
