Resolution 2008-106IN THE CITY COUNCIL OF THE CITY OF LIVERMORE STATE OF CALIFORNIA A RESOLUTION AUTHORIZING THE EXECUTION OF A PURCHASE AND SALE AGREEMENT BETWEEN LIVERMORE VILLAGE I LLC AND THE CITY OF LIVERMORE FOR THE PURCHASE OF LIVERMORE VILLAGE AND THE APPROPRIATION OF 2200000 IN HOUSING INLIEU FUNDS F611 FOR ALL COSTS ASSOCIATED WITH THE PURCHASE AND MAINTENANCE OF THE LIVERMORE VILLAGE PROJECT AT 20092111 RAILROAD AVENUE LIVERMORE CA BE IT RESOLVED by the Livermore City Council that the City Manager is authorized to execute on behalf of the City of Livermore a Purchase and Sale Agreement between the City of Livermore and Livermore Village I LLC in substantially the form on file with the City Clerk and attached to the staff report on this matter together with such additions or changes as are approved by the City Manager upon consultation with the City Attorney Those additions or changes may include provisions necessary or advisable to permit the payment of property taxes escrow fees and other transaction costs associated with the purchase of the property The amount of the Purchase and Sale Agreement exclusive of the above additions or changes shall be 2100000 and the Council authorizes the appropriation of 2200000 in Housing InLieu Funds F611 in Fiscal Year 20072008 for all costs associated with acquiring transferring and maintaining the Livermore Village property and project A copy of the Agreement is on file in the office of the City Clerk On the motion of Councilmember Leider seconded br Councilmember Horner the foregoing resolution was passed and adopted on the 12 h day of May 2008 by the following vote AYES Councilmembers Horner Leider Vice Mayor Marchand NOES None ABSENT Councilmember Williams Mayor Kamena ABSTAIN None ATTEST DATE mil CITY CLERK ALICE CALVERT APPROVED AS TO FORM CITY ATTORNEY JOHN J POMIDOR DATE May 13 2008 RESOLUTION NO 2008106
