HomeMy Public PortalAboutM2004-11-16-LRALYNWOOD REDEVELOPMENT AGENCY REGULAR MEETING NOVEMBER 16, 2004 The Redevelopment Agency of the City of Lynwood met in a Regular Meeting in the Council Chambers, 11330 Bullis Road on the above date at 5:35 p.m. Chairman Byrd presiding. Members Pedroza, Rodriguez , Santillan, Vasquez, and Byrd answered roll call. Also present were Interim Executive Director Wang, City Attorney Beltran, Secretary Hooper and Treasurer Pygatt. Secretary Hooper announced that the agenda had been posted in accordance with the Brown Act. PUBLIC ORAL COMMUNICATIONS (Regarding Agenda Items Only) NONE PiJBLIC ORAL COMMUNICATIONS NONE ITEMS FOR CONSIDERATION Item #1: MINUTES OF PREVIOUS MEETINGS: It was moved by Member Pedroza, second by Member Rodriguez to approve the following minutes. . Regular Meeting of September 21, 2004 • Regular Meeting of October 5, 2004 • Special Meeting of October 13, 2004 • Regular Meeting of October 19, 2004 • Regular Meeting of October 26, 2004 Item #2: WARRANT REGISTER It was moved by Member Pedroza, seconded by Member Rodriguez to adopt the following Resolution. RESOLUTION NO. 2004.038 ENTITI,ED: A RESOLUTION OF THE LYNWOOD REDEVELOPMENT AG~NCY OF LYNWOOD, CALIFORNIA, AL~OWING AND APPROVING THE DEMANDS AND WARRANTS THEREFORE. ROLL CALL: AYES: MEMBER PEDROZA, RODRIGUEZ, SANTILLAN, VASQUEZ, BYRD NOES: NONE ABSTAIN: NONE ABSENT: NONE CONSENT CALENDAR All matters listed under the Consent Calendar will be acted upon by one motion affirming the action recommended on the agenda. There will be no separate discussion on these items prior to voting unless members of the Agency or staff request specific items are removed from the Consent Calendar for separate action. It was moved by Member Santillan, seconded by Member Pedroza and carried to receive and file and adopt the following resolution and ordinances. Item #3: TREASURER'S QUARTERLY INVESTMENT REPORT Item #4: 41h AMENDMENT TO THE COMMERCIAL REHABILITATION LOAN AGREEMENT. ROLL CALL: AYES: MEMBEI2 PEDROZA, RODRIGUEZ, SANTILLAN, VASQUEZ BYRD NOES: NONE ABSTAIN: NONE ABSENT: NONE DISCUSSION ITEMS Item #5: UPDATE ON THE ENVIRONMENTAL INVESTIGATIONS AT THE K AND K SITE. Interim Executive Director Wang stated the Deputy Director of Redevelopment John Perfit will give a detailed report of the statues of the investigations. Deputy Director of Redevelopment John Perfit stated K& K has completed a comprehensive Phase One investigation and some of the initial Phase Two investigations at the site. Unfortunately, the combination of these two investigations has uncovered some issues related to ground water at the site as well as the soil. At this point the development knows that both in the ground water and in the soil, Tricoraletholien which is a common solvent used for degreasing and cleaning exists. It has higher level in the ground water which are more of a concern. The good news is that often times ground water at a site can be remeditated while the Redevelopment activity is on going. The property has been and continues to be in escrow contingent on these environmental issue being resolved. Agency staff inembers are going to the feds for $160,000.00 dollars for Brownfields money because the new program requires a 20% local match. The Agency sent out the application and expect to reply in February or March if the City can apply any clean up funds to the K& K site. The Agency is still cooperating with the Regional Board to assure that priority processing and oversight is provided to the K& K site. So the environmental issue can be address and remeditated hopefully as soon as possible. Mayor Pro-Tem Vasquez asked what would be the total cost for the entire site for clean up. Deputy Director of Redevelopment John Perfit responded the total cost is estimated by the consultant. Unfortunately, the consultant was hired by the seller and at this point it is confidential information, which will be available in a couple of weeks at which time the Agency will know the total cost. For the purpose of the Brownfield application the Agency estimated a rough amount a million but do not hold him to that. He will know more in a couple of weeks. Mayor Pro-Tem Vasquez stated the City is in the process of entering into a ENA with the developer for the Plaza Mexico expansion project. How would the approval of this impact the ENA. ~ Director of Redevelopment Louis Morales responded that matter is scheduled to be heard in closed session, and it will center around the property negotiations with the ~l contamination and ENA. As of right now the Agency is considering doing a ENA with ~ the expansion of the Plaza Mexico the Agency has two willing buyers and sellers that are - looking to buy the property and those are the two parties that are paying for the studies in connection with the source of contamination and what will be the cost to have it cleaned up. If the Agency would enter an ENA right now it would impact some of the discussion and some of the negotiations that the Agency has in place with the two parties that are willing to undertake the clean up. More detail will be provided in closed session. Deputy Director of Redevelopment John Perfit stated this is a receive and file update that is provided tonight.
