Mayor Pro Tem Briggs called the regular meeting of the City Council to order at 7:30 P. M. He also welcomed the 8th grade class of the "Citizen and the Law" who were present with their instructor, Sgt. Stevens, 2. Invocation was given.by Rev. Wm. W. Gresham of the Church of Christ, 5272 N. Sereno, Temple City, following which Mayor Pro 3, Tem Briggs led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen- Harker, Merritt, Briggs ABSENT.: Councilmen - Beckley, Tyrell ALSO PRESENT: City Maneger'Koski, City Attorney Martin, Planning Director Dragicevlch, Traffic Engineer Envall, Public Works Director P i zzorno The.Mayor Pro Tem advised the. Council that both Councilmen Tyrell and Beckley were ill and unable to attend the Council meeting. Councilman Harker moved to excuse both absences because of illness, Councilman Merritt seconded, and the motion carried unanimously. APPROVAL OF MINUTES: A. Regular meeting of Febr. 6, 1968. Councilman Merritt moved to approve the minutes of the regular meeting of Febr. 6, 1968, as mailed, Councilman Harker seconded, and the motion was carried unanimously. B. Adjourned meeting of Febr. 8, 1968. Councilman Harker moved to approve the minutes of the adjourned meeting of Febr. 8, 1968, as mailed, Councilman Merritt seconded, and the motion was carried unanimously. PUBLIC HEARING: 7:30 P. M. APPEAL FROM PLANNING COMMISSION DECISION ZONE VARIANCE CASE NO. 67 -238 - Re,..: Thomas F. & Kathryn Minahan, 5430 N. Halifax Rd. Mayor Pro Tem Briggs felt it would be to everyone's advantage to continue this public hearing until March 5 to have a.ful.l Council with a five man decision and asked if those present would agree to this. Atty. John Shaw spoke on behalf of the applicant and agreed to the continuance. Frank V. Biava, 10523 Daines, stated . he did not feel there should be a continuance as the Planning Commission ruled unanimously against the case and he felt the Council: would do the same. On questioning Mr. Biava stated he was not the applicant and opposed the request and continuance of the public hearing. City Attorney Martin advised it is difficult to hold a public hearing with a three man Council and in such cases the public hearings are generally continued because of this rather than on the merits of the case. Councilman Harker moved to continue Zone Variance Case 67 -238 public hearing to the next regular meeting on March 5, 1968, Councilman Merritt seconded, and the motion carried unanimously. The City Attorney stated that this public hearing is continued to the next regular meeting of the City Council on March 5, 1968, and no further notice will be given. Council Minutes, February 20, 1968, page 2 PUBLIC HEARING: 7:30 P. M. APPEAL FROM PLANNING COMMISSION DECISION CONDITIONAL USE PERMIT NO. 67 -241 - :RE : for batting cage at west side of Temple City Blvd., 160 ft, south of Lower Azusa Rd. to William Carroll. Appeal to granting, Mary J. Laby, 9575 E. Bixby St. Mayor Pro Tem stated that for the same reasons if satisfactory to those concerned that this hearing on the granted conditional use permit be held over until the March 5, 1968, regular meeting of the City Council. William Carroll, applicant, stated he had two objections to delaying this hearing, first their lease option runs out on Febr. 23 and they had already been delayed two months and holding the hearing over another two weeks would delay them another month. At the request of the applicant the Council decided to hold the public hearing as scheduled. Mayor Pro Tem Briggs declared the Public Hearing opened. Planning Director Dragicevich presented the request for the Conditional Use Permit No. 67 -241 for the batting cage. The proposal is for 6 batting cages and 6 pitching machines, the surrounding property is mixed residential use and commercial use, the lot contains 10,600 sq. ft. approximately, with 15 ft. front setback. No parking facilities are proposed on the property. The Planning Director advised that a public hearing was held before the Planning Commission on January 9, 1968, at which time they granted the Conditional Use Permit subject to 12 conditions which the applicants have accepted. An appeal was filed by Mrs. Mary J. Laby, 9575 Bixby St., within the legally required period of time and a public hearing was set before the City Council on the appeal. The Mayor Pro Tem asked if anyone wished to speak in favor of the granted Conditional Use Permit. William Carroll, applicant, stated this batting cage was basically for 10 to 12 yrs. old age group. Mostly the boys are brought there by team managers or coaches and they leave together and are only there to hit the baseball, As far as the argument against the proposal that it would be unattractive that at present it is just a vacant lot. He presented pictures of a similar operation which the Council accepted as an exhibit in the case. Also the parking problem has been solved as the people in the market will lease them ten stalls, and that the proposed plans have bathroom facili- ties up to standard code. J. Miller, partner of Mr. Carroll, stated they felt the need of this type of operation for the young boys, that they expect to operate on a professional and businesslike basis and are in a position to comply to the recommendations of the Planning Commis- sion. No one else came forward to speak in favor of the installation. Mayor Pro Tem asked if anyone wished to speak in opposition to the granting of the conditional use permit. Mary J. Laby, 9575 Bisby St., stated her main objection was the type of juvenile crowd it could possibly attract.:-She did not believe it would be an attractive asset to Temple City. Also she felt the parking on the street would be the main objection. She did not feel the possible revenue to the City was worth tying up this piece of property with this type of business which might preclude a suitable type of business in the neighborhood. Mr. Jack Skorski, 9562 Lower Azusa Rd., spoke against the opera- tion as he felt the noise would be as great as light manufacturing, Also he felt this would lower property values tremendously in the neighborhood. He also was very concerned about the parking problem. Council Minutes, February 20, 1968, page 3 Jeff Lyman, 5725 Oak Ave., referred to the noise bothering the people in the area and he felt that the railroad tracks and trains made a lot more noise than the batting cage would. Also that he had been a member of the Little League and this operation . means a lot to them. Mr. Smith, partner of Mr. Carroll, reconfirmed that they are going to comply in every way with the recommendations made by the Planning Commission and it is their intent to check with them and be guided accordingly re parking. He stated they wanted to make arrangements with the Leagues in the San Gabriel Valley so they can have an hour or two a week there with their teams. No one else came forward to speak. Councilman Harker moved to close the public hearing, Councilman Merritt seconded, and the motion carried unanimously. Councilman Harker was not concerned about the use of the parking lot to meet the ten spaces required by the Planning Commission as if the kids are old enough to drive they are old enough to cross Lower Azusa from the parking lot at the market, and if not driving they would be in the company of an adult that drove them there. If just dropped off to be picked up later they would not require a parking space. He felt the only thing they should consider would be the distance from the market spaces for parking and the operation which might encourage parking on the street. Councilman Merritt felt that control of the youngsters was a matter of management and he felt that parking should be provided closer than the market parking lot. Mayor Pro Tem Briggs felt the parking should be closer also. He felt the location on the main thoroughfare was the right place for it to be and he would be favor of granting. Councilman Merritt moved that the appeal from the Planning Commission decision be denied and to confirm the Resolution of the Planning Commission changing only that the parking recommendations of the staff is incorporated into the motion, Councilman Harker seconded the motion, which was carried by the following roll call vote: AYES: Councilmen- Harker, Merritt, Briggs NOES: Councilmen -None ABSENT: Councilmen- Beckley, Tyrell City Attorney Martin presented Resolution No. 68 -805 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY CONFIRMING RESOLUTION NO. 68 -280PC WITH MODIFICATIONS. He advised all conditions of the Planning Commission which were imposed are confirmed by the City Council except Condition No. 1 which is modified to read "It is understood however, that the ten parking spaces provided in condition No. 1 shall be new stalls developed to code requirements and located either on the subject lot or on the C =)2 property immediately northerly thereof, but not across any streets.- Councilman Merritt moved to adopt Reso- lution No. 68 -805, Councilman Harker seconded, and the motion was carried unanimously. PUBLIC HEARING: 7:30 P. M. RE AMENDMENT TO ZONING REGULATIONS APPLIC- ABLE TO R -3 AND R -4 ZONES HAVING PARCELS WITH LESS THAN THE REQUIRED WIDTH Mayor Pro Tem Briggs recommended this also be held over to the March 5, 1968 meeting. Councilman Merritt moved to defer this public hearing to March 5, 1968, at 7:30 P. M., Councilman Harker seconded, and the motion was carried unanimously. ASSESSMENTS - CURB & GUTTER: South side of Live Oak Ave. between Rosemead Blvd. & Eaton Wash The Mayor Pro Tem recommended this also be held over until the next meeting when all Councilmen would be present. Councilman Merritt moved to defer this public hearing until March 5, 1968, Councilman Harker seconded, and the motion was . unanimously carried. RESOLUTION NO. 68 -805: Disapproving Zone Change Recommendation from Planning Commission from R -1 to C -2 for 5409 through 5429 Baldwin Ave., west side; and 9933 through 9945 Olive St., north side. City Attorney Martin recommended this be held over to await the report from the Planning Commission. Councilman Merritt moved to defer this item until March 5, 1968, Councilman Harker seconded, and the motion was unanimously carried. NEW BUSINESS: 7. TRAFFIC COMMISSION RECOMMENDATIONS: Meeting of Febr. 7, 1968. A. Item 5. Las Tunas Dr. - Traffic Signal Timing. Recommended that the signal timing on Las Tunas Dr. between hours of 6 P. M. and 8 A. M. be set with signals at Sultana, Encinita, Alessandro, Cloverly, Primrose, Camellia and Kauffman flashing yellow on Las Tunas Dr., and flashing red on the cross streets, with remaining signals on Las Tunas Dr. to remain at their normal cycle. Traffic Engineer Envall presented the above recommendation. Councilman Merritt moved to approve item A, Councilman Harker seconded, and the motion was unanimously carried. B. Matters from City Officials: Recommended that green parking zone formerly used for the Post Office on the south side of Las Tunas Dr. from 155 ft. to 174 ft. east of Rosemead Blvd. be removed. Traffic Engineer Envall presented the above recommendation. Councilman Harker moved to approve the recommendation, Council- man Merritt seconded, and the motion carried unanimously. 8. PARKING COMMISSION RECOMMENDATIONS: Meeting of Febr. 15, 1968 A. Recommend that green and white trapezoidal signs measuring 36 inches at the top and 30 inches high reading "Enter" or "Exit" as appropriate, and the words, "Back -in Parking Prohibited, T. C. Ord. 68 -261" be installed at the entrances to Lots 1, 2, 5 and 6. B. That proposed Ordinance 68 -261, as amended, exempting all trucks in excess of three ton gross weight from the pro- visions of this Ordinance be approved by the City Council. Mayor Pro Tem Briggs stated he felt these recommendations should be held over until the whole Council was present to consider them. The other Councilmen concurred and these recommendations will be considered at the regular meeting of March 5, 1968. 9. RESOLUTION NO. 68 -802: employing temporary personnel, Recrea- tion Dept. City Manager Koski presented the above Resolution. Councilman Harker moved to adopt Resolution No. 68 -802, Councilman Merritt seconded, and the motion was unanimously carried. Council Minutes, Febr. 20, 196 &, page 5 10. .RESOLUTION NO. 68 -804: appointing permanent personnel, Account -Clerk City Manager Koski presented Resolution No. 68 -804, Council- man Merritt moved to adopt Resolution No. 68 -804, Councilman Harker seconded, and the motion was unanimously carried. RESOLUTION NO. 68 -803: Warrants & Demands in the sum of $37,447.58 No. 10598 through No. 10641 City Manager Koski presented Resolution No, 68 -803. Council- man Merritt moved to adopt Resolution No. 68 -803, Councilman Harker seconded, and the motion was unanimously carried. 12. COMMUNICATIONS: City Manager Koski presented a request from the Los Angeles County Fire Fighters t� proclaim the week of Febr. 28, 1968, as "Fire Fighters Week ". Councilman Harker moved to so pro- claim, Councilman Merritt seconded, and the motion was unani- mously carried. City Manager Koski presented a letter from Mr. Leiland Shaw requesting an additional period of time to complete the con- struction of his home at 6329 Sultana Ave. for an additional 60 days to April 30, 1968. Mr. Shaw spoke giving details of problems that delayed his completion of the work by Febr. 29, 1968, which was the deadline previously given by the Council for completion of the house. Following considerable discussion Councilman Merritt moved to grant a continuance of 60 days for completion on condition that Mr. Shaw take off the siding on the windows and put in glass within 10 days from this date and that he give priority to completion of the exterior portion of the house, Councilman Harker se- conded, and the motion was unanimously carried. 13. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mr. =Ray Truss, 8856 E. Live Oak, asked if deferring the assess- ment hearing to March 5 would automatically defer: payment due Febr. 26, and he was advised it would. 14. MATTERS FROM CITY OFFICIALS: The City Manager presented each Councilman with a program of the events for the Camellia Festival. City Manager Koski presented a memo from the City Treasurer recommending removal of Eunice Schiller as Deputy City Treasurer and appointment of her replacement, Edna Jean Meek. Councilman Harker so moved, Councilman Merritt seconded, and the motion carried unanimously. The City Manager presented a request from the Director of Re- creation requesting permission to enroll in and attend the Municipal Department Heads' Executive Development Seminar at U.S.C. Febr. 23 through May 10, 1968. Provisions were made in the 1967 -68 budget for this Seminar. Councilman Harker moved to approve, Councilman Merritt seconded, and the motion carried unanimously. The City Manager presented a request from Dr. Hart, 6034 N. Hart, for removal of a tree at that address. Mr. Ristow, Parks Supt., has inspected the tree and recommends a permit be issued to Dr. Hart for its removal. Councilman Merritt moved to approve, Councilman Harker seconded, and the motion carried unanimously. 1 1 Council Minutes, Febr. 20, 1968, page 6 The City Manager presented a request from Mr. Everett Greenberg, Chairman of the Parks & Recreation Commission, to attend the California Park and Recreation Society Conference to be held in San Diego, March 3, 4, 5, and 6. Following discussion Councilman Harker moved that in lieu of his non - attendance at the Contract Cities Seminar that this request be approved, Councilman Merritt seconded, and the motion carried unanimously. 15. ADJOURNMENT: City Manager Koski recommended the City Council adjourn to a study session on Tuesday night, Febr. 27, 1968, at 7:30 P. M. for a presentation on underground utilities to be pre- sented jointly to the City Council and Planning Commission. Councilman Harker recommended the work session set for March 8 and 9 be held for consideration at a later date to which the Council agreed. Councilman Merritt moved to adjourn to a study session on Febr. 27, 1968, at 7:30 P. M., Councilman Harker seconded, and the motion was unanimously carried, Council ad- journed at 8:55 P. M.
