I E- / a A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO, RESETTING THE DELINQUENCY DATE FOR PAYMENT OF LOCAL IMPROVEMENT DISTRICT NO. 3 ASSESSMENTS, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of McCall, Valley County, Idaho, created Local Improvement District No. 3 ("L.I.D. No. 3") on April 1, 1993, for the following purposes: a) To acquire the necessary land and improvements for a nine (9) hold addition (the "Addition") to the existing City of McCall Municipal Golf Course and for other related recreational facilities; b) To acquire the necessary land and improvements for waterways, amenities and other items appurtenant to the Addition; c) To acquire the necessary land, easements and improvements all as needed to complete the "Eastside Bypass Road," a public road, connecting Lick Creek Road to Deinhard Lane; d) To acquire the necessary land, easements and improvements for the public roads within the boundaries of the Property; e) To acquire public sidewalks, pedestrian pathways, bikeways within and/or adjacent to the Property; f) To acquire public sanitary sewer, potable water and drainage improvements and facilities, as well as necessary easements and appurtenances; g) To acquire necessary easements for snow removal storage necessitate by public streets; and h) To acquire such other lands, interests in land, and improvements as are necessary or appropriate to accomplish the foregoing. WHEREAS, the City originally declared August 14, 1998, as the delinquent date for installments due on LID No. 3. WHEREAS, the City Council of the City of McCall wishes to clarify the delinquency process for LID No. 3 by resetting the delinquency date and providing notice thereof in a form provided by example in Exhibit A, attached hereto and incorporated herein by reference; Page 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF McCALL, IDAHO, as follows: Section 1: The payment date for all 1998 assessments for L.I.D. No. 3 not heretofore paid, is hereby established as December 3, 1998. Any payments of assessments not paid by said date shall be and are hereby declared delinquent. Section 2: The City Council orders the City Treasurer to send the Notice of Delinquent McCall LID No. 3 assessments to property owners of record prior to December 3, 1998, in the form shown described in Exhibit A, attached hereto and incorporated by reference herein. Section 3: This resolution shall take effect and be in force from and after its passage and approval. DATED: November 19, 1998. ATTEST: Cherry Wo berry, City Clerk CITY OF McCALL VALLEY COUNTY, IDAHO Kirk Eimers, Mayor Page 2 City d McCall Office of the City Treasurer [Name & Address of Property Owner] NOTICE OF DELINQUENT McCALL LID ]#3 ASSESSMENTS On November 19, 1998, the McCall City Council declared, by Resolution, a new delinquency date for payment of assessments on LID #3 to provide notice before the date of delinquency. The new delinquency date for McCall LID #3 is December 3, 1998. If the installment due as stated on the LID invoice previously mailed on July 28, 1998* is not paid by December 3, 1998, an automatic 296 penalty will be added to the amount due. If the installment and 2% penalty are not paid by December 14, 1998, the City will issue a Delinquency Certificate to the property, which certificate will have the force and effect of a sale of said property for the amount of such delinquent installment. The Delinquency Certificate will bear the date of the delinquent installment plus the penalty charged thereon which includes charging ten percent (1096) interest on the full amount owing. To bring the payments current by redeeming the Delinquency Certificate, a property owner must pay to the City the full amount of principal, interest and accrued penalties identified in the Delinquency Certificate. The Delinquency Certificate may be redeemed at any time written two (2) years following the issuance of the Delinquency Certificate. If the Delinquency Certificate is not redeemed within this time, the City will issue a deed to your property to the City and sell the property for the amount of the Delinquency Certificate. A copy of this invoice is included with this notice for your convenience only and does not provide you additional time to pay your LID installment except as provided specifically in this Notice. f t-3I T A,
