PRESENT: Acting Chairman Roy Hobbs, Member Dee Johnson, Member John Lott, Member Jake Lindsay and Clerk Shara Roberts. ABSENT: Chairman Melanie Shirling and Member Bette Lovinus. VISITORS: Kevin Murray. Acting Chairman Hobbs welcomed everyone and Member Lindsay led with the Pledge of Allegiance. Minutes Approved: Member Lott moved to approve the Planning & Zoning (P&Z) Minutes of July 8,2015 as written (August's meeting was cancelled). Member Johnson seconded the motion. All were in favor, motion carried. Bob & Melanie Hart — Amended Plat — Located at 5287 East Owens Avenue: Kevin Murray with Keller Williams Realty introduced himself to the commission, and explained he is representing Bob & Melanie Hart in the matter of the re -plat of their property located at 5287 East Owens Avenue. Currently the property has an old single wide manufactured home that was grandfathered in. Bob & Melanie Hart approached Mr. Murray with the proposal to split the lot into two 1 /3 acre lots. The City Engineer has reviewed the Hart Re -plat and his findings and conclusions are on four issues: 1) The proposal outlines Lot 3-B would only have 80.25 feet, which 11-4-6-(A) of the Iona Code states that the minimum frontage allowed in this zone is 85 feet. For acceptance of this requirement, Mr. Hart would have to apply for a variance under Chapter 14, Title 11 of the City Code. 2) Lot 3-A can be permitted as a flag lot given a permit is obtained under 11-11-26 of the Iona Code. This code section states that lots in a residential zone may be accessed through a private drive which includes asphalt pavement 20 feet wide and an address sign. A review of the site by the Public Works Director revealed that the 20 foot wide flag lot access would be sufficient in this case. 3) As an alternative to the solution, the developer could eliminate the flag lot access to Iona Road for Lot 3-A and make the flag lot portion of Lot 3-A part of Lot 3-B and then give Lot 3-A a 20 foot wide utility easement through the same area for water and sewer services for Lot 3-A. This would allow Lot 3-B to have more than 85 feet of frontage, thus eliminating the need for a variance and require Lot 3-A to take its access in the alley. 3) The location of nearest fire hydrants to alley accessible homes or homes in flag lot should be considered as part of the approval process. If a variance is secured and the City accepts the preliminary plat as prepared with the flag lot, then a fire hydrant would be useful mid -block along Iona Road between Dayton St. and Main St. It stands to reason that alley accessible lots should also be allowed while ensuring the distance to the nearest hydrant is compatible with current fire and public safety codes. The City needs to determine as a matter of public policy whether it will assume the cost of installing mid -block hydrants or require the applicant to bear such cost as a condition for permit issuance. Mr. Murray informed the commission that they intend to apply for a variance, and turned the application in with The City Clerk this afternoon, Exhibit C. Member Lindsay expressed that the variance request is feet shy from meeting city code requirements. Acting Chairman Roy Hobbs asked Mr. Murray if the developer is required to put in the sewer and water lines. Mr. Murray explained that they haven't gotten that far yet, but it his understanding that the 20 feet easement is where the utilities would need to go. Acting Chairman Hobbs indicated that typically the developer would need to provide the water and sewer lines and then there would need to be a quitclaim deed and The City would take management control over it. Planning and Zoning Members agreed that this was an acceptable plat as long as certain stipulations were met. Member Johnson seconded the motion. All were in favor, motion carried. Clerk Roberts clarified with the commission that this recommendation will need to go in front of City Council on September 22, 2015 and as a result of the application for variance a Public Hearing will need to be held at both Planning and Zoning and City Council meetings in October. Members confirmed this understanding was correct. Reports Area of Impact Agreement Update: To date, the commission has not received an update on the Iona Impact Area Agreement with Bonneville County Planning & Zoning. Chairman Melanie Shirling was to attend that meeting scheduled July 22, 2015 and provide an update. This item should be included again in next month's reports. Our findings and conclusions are centered on four issues: size of Lot 3-B, Lot 3-A as a flag lot and water and sewer service lines from Iona Road, distance to the nearest hydrant, and City related plat clauses. Each issue is addressed respectively. This property is located in the R-1 zone. It is apparent that under § I 1-4-6-(A) of the Iona Code, that the minimum frontage allowed in this zone is 85 feet. Lot 3-B would only have 80.25 feet if the City accepted the preliminary plat. For acceptance of this requirement, Mr. Hart would have to apply for a variance under Chapter 14, Title 11 of the City Code. As determined in our June 24, 2015 letter regarding the Hansen re -plat on the other side of the alley and a little east of the subject property, flag lots are permitted provided a permit is obtained under § 11-11 26 of the Iona Code. This code section states that lots in a residential zone may be accessed through a private drive which includes asphalt pavement 20 feet wide and an address sign. A review of the site by the Public Works Director revealed that the 20 foot wide flag lot access would be sufficient in this case. As an alternative solution to the above two paragraphs, the developer could eliminate the flag lot access to Iona Road for Lot 3-A and make the flag lot portion of Lot 3-A part of Lot 3-B and then give Lot 3-A a 20 foot wide utility easement through the same area for water and sewer services for Lot 3-A. This would allow Lot 3-B to have more than 85 feet of frontage, thus eliminating the need for a variance and require Lot 3-A to take its access in the alley, which is okay. As indicated in our June 24, 2015 letter regarding the proposed Hansen Replat nearby, the location of nearest fire hydrants to alley accessible homes or homes in flag lots should be considered as part of the approval process. If a variance is secured and the City accepts the preliminary plat as prepared with the flag lot, then a fire hydrant would be useful mid -block along Iona Road between Dayton St. and Main St. If the alternative plan we suggested in the Share Roberts August 26, 2015 Page 2 paragraph above is proposed, then a fire hydrant mid -block at the alley on Main St. or Dayton St would be the better alternative. As stated in the June 24, 2015 letter regarding the Hansen replat, Section 11-11-26(B)(5) specifically requires flag lots to comply with all fire codes and public safety codes, as a condition for issuance of the permit. It stands to reason that alley accessible lots should also be allowed while ensuring the distance to the nearest hydrant is compatible with current fire and public safety codes. The City needs to determine as a matter of public policy whether it will assume the cost of installing mid -block hydrants or require the applicant to bear such cost as a condition for permit issuance. We have reviewed the plat clauses applicable to the City given on the preliminary plat. Please have the developer use the attached clauses on the final plat. These include City's Acceptance, Irrigation Disclosure and Owners Dedication. This concludes our findings and recommendations. Please contact me if the City has any further questions.
