HomeMy Public PortalAboutM2007-05-15-LRALYNWOOD REDEVELOPMENT AGENCY REGULAR MEETING MAY 15, 2007 The Lynwood Redevelopment Agency of the City of Lynwood met in a regular meeting at 11330 Bullis Road on the above date at 5:46 p.m. Chairman Byrd presiding. Members Johnson, Pedroza, Vasquez, and Byrd were present. Member Santillan arrived at 5:47. Also present were Interim City Manager Arnoldussen, City Attorney Beltran, Secretary Hooper, and City Treasurer Pygatt. Secretary Hooper announced that the Agenda had been posted in accordance with the Brown Act. PUBLIC ORAL COMMUNICATIONS (Regarding Agenda Items Only) Irene Garcia spoke on item #4 & 5 -AGENCY RECOMMENDATION FOR. COMPLIANCE WITH MANDATES OF SB 53 -She feels that, we do not need redevelopment when residents' homes and schools are jeopardized. PUBLIC ORAL COMMUNICATIONS Lorene Reed spoke on item #6 -HOME FUNDS TIMELY EXPENDITURE AND OBLIGATION -The public should have received information on the item. CONSENT CALENDAR All matters listed under the Consent Calendar will be acted upon by one motion affirming the action recommended on the agenda. There will be no separate discussion on these items prior to voting unless members of the Agency or staff request specific items to be removed from the consent calendar for separate action. It was moved by Vice Chairman Pedroza, seconded by Member Johnson, to approve the consent calendar. Item #2 RESOLUTION OF THE LYNWOOD REDEVELOPMENT AGENCY OF LYNWOOD, CALIFORNIA, ALLOWING AND APPROVING THE DEMANDS AND WARRANTS. RESOLUTION NO. 2007.016 ENTITLED: RESOLUTION OF THE LYNWOOD REDEVELOPMENT AGENCY OF LYNWOOD, CALIFORNIA, ALLOWING AND APPROVING THE DEMANDS AND WARRANTS THEREFORE ROLL CALL: AYES: MEMBERS JOHNSON, BYRD NOES: NONE ABSTAIN: NONE ABSENT: NONE PEDROZA, SANTILLAN, VASQUEZ, AND Item #3 APPROVAL OF A CONCEPT FOR THE PROPOSED COMMERCIAL RETAIL EXPANSION AT THE SUPERIOR WAREHOUSE SITE LOCATED AT 3801-3831 MARTIN LUTHER KING JR. ABSENT: NONE DISCUSSION ITEM Item #4 AGENCY RECOMMENDATION FOR COMPLIANCE WITH MANDATES OF SB 53 Mr. Beltran introduced the item. The recommendation is to have the agency to seek council's direction in adopting the ordinance. It was moved by Member Santillan, seconded by Vice Chairman Pedroza, to move it to the Council Agenda. ORDINANCE FIRST READING ENTITLED: AN ORDINANCE OF SAID CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA DESCRIBING THE LYNWOOD REDEVELOPMENT AGENCY'S PROGRAM TO ACQUIRE REAL PROPERTY BY EMINENT DOMAIN PURSUANT TO THE PROVISIONS OF THE CALIFORNIA COMMUNITY REDEVELOPMENT LAW, HEALTH AND SAFETY CODE SECTION 33342.7 IN THE PROJECT AREA "A". ROLL CALL: AYES: MEMBERS JOHNSON, PEDROZA, SANTILLAN, VASQUEZ, AND BYRD NOES: NONE ABSTAIN: NONE ABSENT: NONE Secretary Hooper read ordinance into the record. Item #5 AGENCY RECOMMENDATION FOR COMPLIANCE WITH MANDATES OF SB 53 ORDINANCE FIRST READING ENTITLED: AN ORDINANCE OF SAID CITY `COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA DESCRIBING THE LYNWOOD REDEVELOPMENT AGENCY'S PROGRAM TO ACQUIRE REAL PROPERTY BY EMINENT DOMAIN PURSUANT TO THE PROVISIONS OF THE CALIFORNIA COMMUNITY REDEVELOPMENT LAW, HEALTH AND SAFETY CODE SECTION 33342.76 IN THE ALAMEDA PROJECT AREA. SUBSEQUENT NEED ITEM Item #5b HOME FUNDS TIMELY EXPENDITURE AND OBLIGATION It was moved by Vice Chairman Pedroza, seconded by Member Johnson, to add the subsequent need item to the agenda. This subsequent need item came to the attention of the agency after the agenda had been posted and there is need for immediate action. CLOSED SESSION WITH RESPECT TO EVERY ITEM OF BUSINESS TO BE DISCUSSED IN CLOSED SESSION PURSUANT TO SECTION 54956.8 Item #6 CONFERENCE WITH REAL PROPERTY NEGOTIATORS Property: 11300 Atlantic Avenue Agency Negotiator: Agency Staff and Agency including but not limited to Lorry Hempe, Tranda Drumwright, Bruno Naulls and Ronald Wilson Negotiating Parties: Agency and Conrad Group Ltd., Bill Marshall and Phoenix House, Winnie Wechsler Under Negotiation: Price and terms Item #7 CONFERENCE WITH- REAL PROPERTY NEGOTIATORS Property: 3259 Palm Avenue Agency Negotiator: Agency Staff and Agency including but not limited to Lorry Hempe, Tranda Drumwright and Ronald Wilson Negotiating Parties: American Family Housing Under Negotiation: Price and terms r r Item #8 CONFERENCE WITH LEGAL COUNSEL -ANTICIPATED LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9 (B) (3) (A) Number of Cases: One (1) Case Name of Case: Disclosure of names would jeopardize the Agency's Ability to conclude existing settlement negotiations to Agency's advantage It was moved by Member Johnson, seconded by Chairman Byrd, and carried to recess to closed session at 5:58 p.m. Agency reconvened at 12:09. City Attorney Beltran stated that the Council met on the aforementioned matters and with respect to the following: Item #6 CONFERENCE WITH REAL PROPERTY NEGOTIATORS Property: 11300 Atlantic Avenue Agency Negotiator: Agency Staff and Agency including but not limited to Lorry Hempe, Tranda Drumwright, Bruno Naulls and Ronald Wilson Negotiating Parties: Agency and Conrad Group Ltd., Bill Marshall and Phoenix House, Winnie Wechsler Under Negotiation: Price and terms Agency board members reached a 5-0 consensus regarding instructions on terms and conditions for the potential lease. Item #7 CONFERENCE WITH REAL PROPERTY NEGOTIATORS Property: 3259 Palm Avenue Agency Negotiator: Agency Staff and Agency including but not limited to Lorry Hempe, Tranda Drumwright and Ronald Wilson Negotiating Parties Under Negotiation: The item was dropped. American Family Housing Price and terms Item #8 CONFERENCE WITH LEGAL COUNSEL -ANTICIPATED LITIGATION PURSUANT TO GOVERNMENT CODE SECTION 54956.9 (B) (3) (A) Number of Cases: One (1) Case Name of Case: Disclosure of names would jeopardize the Agency's Ability to conclude existing settlement negotiations to Agency's advantage Agency Board Member reached consensus on a 5-0 basis and provided further instructions.
