AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA, ADOPTING AMENDMENTS TO THE VILLAGE OF
KEY BISCAYNE MASTER PLAN PURSUANT TO THE
PROVISIONS OF A STIPULATED SETTLEMENT
AGREEMENT BETWEEN THE VILLAGE OF KEY BISCAYNE
AND THE STATE OF FLORIDA, DEPARTMENT OF
COMMUNITY AFFAIRS, AUTHORIZING TRANSMITTAL AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, on August 16, 1994, the Village of Key Biscayne
adopted the Village of Key Biscayne Master Plan (the "Master Plan")
pursuant to the provisions of Chapter 380, Florida Statutes, and
WHEREAS, on October 6, 1994, the State of Florida, Department
of Community Affairs ("DCA") issued a Notice of Intent To Find The
Master Plan Not In Compliance based upon specific objections and
findings, and
WHEREAS, the Village and DCA have entered into a Stipulated
Settlement Agreement in order to resolve DCA's objections to the
Master Plan and pursuant to that Stipulated Settlement Agreement,
the Village wishes to adopt amendments to its Master Plan as shown
on Exhibit "A" to this Ordinance
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE
OF KEY BISCAYNE, FLORIDA, AS FOLLOWS
Section 1 The amendments as shown on Exhibit "A" are hereby
adopted
Section 2 The Village Clerk is hereby directed to make
appropriate transmittals as required by law
Section 3 Effective Date This Ordinance shall be effective
in accordance with applicable provisions of State law

NOTICE OF CHANGE OF LAND USE/
AMENDMENTS TO MASTER PLAN
The Village of Key Biscayne proposes to amend the Village's Master Plan for all the land
within the area shown m the map in this advertisement
Specifically, the Village Council shall consider (1) the adoption of amendments to the
Village's Master Plan pursuant to the terms of a Stipulated Settlement Agreement
between the Village ofKey Biscayne and the State of Florida Department of Community
Affairs, authonzed under Florida Statutes, Chapter 163 3184(16) and (2) amendments
affecting the densities permitted within the "Medium Density Multifamily and Ocean
Resort Hotel' land -use category of the Master Plan.
A public hearing on the amendments will be held on Tuesday, September 12, 1995 700
p m at Village Hall Council Chamber 85 West McIntyre Street, Second Floor Key
Biscayne, Florida This is a continuation of the July 25, 1995 meeting of the Village
Council
