Mayor ATT:ST: --1 f:ee&A'' Village Clerk January 23, 1960 _February_27,_1960 The Bal Harbour Village Council held its regular meeting on Saturday morning, February 27, 1960 at the Village Hall. Those present were: Messrs. Hart, Beatty, Broeman, Faulkner, and White. Absent: None Also present were: W. H. Webb, Village Manager; Mary T. Wetterer, Village Clerk; and Thomas H. Anderson, Village Attorney. Mayor Hart called the meeting to order and after hearing the roll call, the minutes of the previous meeting were accept— ed as submitted upon motion by Mr. Broeman, seconded by Mr. White and unanimously approved. The first item considered was regarding taxi cab licenses in the Village. Mr. Alex Morse of Morse Taxi and Baggage Company, together with his attorney, Mr. John Wahl appeared before the Council to question the legality of the 23 additional taxi licenses which were issued in October 1959. Mr. Wahl stated that their books reflect a loss in revenue since the additional cabs have come into the Village and that if all 46 cabs are permitted to continue operation, the loss of income would eventually force one or more cab companies out of business. During the discussion, 66 the Village Manager explained that in past years it had been necessary for taxis to secure permission from the various hotels to park on hotel property and each hotel requested the number of cabs they wished. Prior to this year there had been only 23 taxis licenses issued in Bal Harbour; however, there were an additional 23 cabs coming in to operate in the Village at any time that the licensed cabs were busy. During busy times such as conventions, special events, check—out time, etc. it was not possible for the 46 cabs to take care of the business and other cabs had to be called in to relieve the condition. It was decided at the beginning of this fiscal year that since the cabs were operating here that they should be required to obtain licenses so that the Village could make use of the added revenue. Mr. Webb further stated that Mr. Reynolds of Metropolitan Dade County Department of Traffic and Trans— portation gave permission for the licenses to be issued for the additional cabs which would bring the total to 46. The 46 licenses issued were as follows: Morse — 16 licenses; Yellow — 15 licenses; and Surf — 15 licenses. Mr. Webb also explained that these cabs do not operate in Bal Harbour alone, but also in Surfside, Bay Harbor Islands and on Motel Row. Mr. Nudelman of Yellow Cab Co. and his attorney, S. R. Costanzo, appeared before the Council asking that their licenses not be revoked and that it was their feeling that the licenses are valid and that they had entered into a contract with the Americana Hotel to furnish them exclusive service — such service would require a minimum of 15 cabs. They further stated that if they are not permitted to continue operating with the 15 cabs, they would be liable for suit as they would not be ablt to fulfill their contract. After a lengthy discussion, Mayor Hart asked Mr. Anderson, the Village Attorney, for advise as to the Council's position. Mr. Anderson stated that the Village Manager should make a factual investigation; then, in light of the facts Mr. Anderson would determine the legal position. The manager should regulate the number of carriers on the assumption of what is needed to serve the public. The Village Manager then should make his recommendation to the Council for their con— sideration and study and a special meeting be held to arrive at a satisfactory disposition. The Mayor then asked the Village Manager to make the investigation and follow the advice of the Attorney and as soon as the information was available, a special meeting would be called to take care of the matter. The Mayor then asked the representatives of the three companies if they would waive the requirement of a legal notice. A11 three companies agreed to this. Mr. Webb read a report to the Council of the Baker's Haulover Dredging bids. He informed them that the bids were opened by the County on February 23rd and that the bids had been referred to the County Manager for his study and re— commendation. 67 Bal Harbour Service Station's request for permission to operate a parking lot on the filling station property was presented to the Council. It was the recommendation of the Village Manager that this request be denied because that property is zoned for a filling station only. Mr. White then moved that the recommendation of the Village Manager be accepted and the parking lot request be denied. This motion was seconded by Mr. Broeman and unanimously approved. Florida Power & Light Company made a request for per— mission to erect a transformer vault at 96th Street so that they might have a second feeder into the south section of Bal Harbour. At the present there is only one feeder for the entire south end of the Village and in case of a breakdown at any part of the section, the entire area is blacked out. It was the recommendation of the Village Manager that their request be approved. Mr. Broeman then moved that the Village Manager should go ahead and make the best arrangements possible with Florida Power and Light and permit them to build the transformer vault. Said motion was seconded by Mr. Faulkner and unanimously approved by the Council. There being no further business to come before the Council, the meeting was adjourned upon motion by Mr. Broeman. Mayor Hart called the meeting to order and announced that the special meeting had been called to consider the legality of the 23 additional taxi licenses which were issued in October, 1959.
