W H E RE A S , on March 3, 2021, Miami-Dade County received an unsolicited proposal for the design, build, finance, operation and maintenance of the Rickenbacker Causeway and the Venetian Causeway, including the development of parkland and beachfront along the Rickenbacker Causeway; and WHEREAS, on July 8, 2021, the Board of County Commissioners (the "County Commission") adopted Resolution No. R-648-21 to accept the unsolicited proposal and to approve the issuance of a competitive solicitation for the same project purpose as set forth in the unsolicited proposal; and WHEREAS, on August 15, 2021, the County's administration issued a competitive solicitation (RFP No. 01982) for the design, build, finance, operation and maintenance of the Rickenbacker Causeway and the Venetian Causeway, including the development of parkland and beachfront along the Rickenbacker Causeway (the "RFP"); and WHEREAS, the Village of Key Biscayne (the "Village") is uniquely affected by the RFP given that the Rickenbacker Causeway is its sole means of access to and from the mainland; and W H E RE A S , on September 30, 2021, the Village Council adopted Resolution 2021-44 respectfully requesting that the County Mayor and/or County Commission immediately rescind the RFP and begin a new collaborative public process with all stakeholders; and WHEREAS, on October 5, 2021, the County Commission adopted Resolution R-942-21 removing the Venetian Causeway in its entirety from the RFP and extending the time for submittal of proposals to allow for adjustments to the RFP and sufficient time to complete and review the Value for Money (VfM) Financial Assessment; and WHEREAS, the County engaged IMG Rebel Advisory, Inc. to perform the VfM Assessment analyzing both the project delivery and financing options for the Rickenbacker Causeway project and evaluating the delivery model offering the best "value for money" (the "IMG Report"); and WHEREAS, on November 19, 2021, the County Mayor issued a memorandum entitled "Report Providing the Value for Money Assessment and Executive Report for the Rickenbacker Causeway," which summarized the strategic procurement options to further ensure "value for money" for the public and offered an option to cancel the procurement and restart a new iterative procurement; and WHEREAS, the IMG Report concluded that cancelation of the RFP allows for greater optimization of the project's "value for money" because the procurement process has already been started, which would make significant changes to the RFP more difficult to achieve; and WHEREAS, on November 23, 2021, County Commissioner Regalado issued a memorandum regarding the "Response to the VfM report on the Rickenbacker Causeway RFP," which provided that after "reviewing the facts and feedback that have brought us to this point in time, my request is to cancel this procurement and start over;" and W H ERE A S, C omm issioner Regalado in her m em ora ndum fu rther pro vided that she w ould advocate that the C ounty M ayor create a w orking gro up of key stakeholders to flesh out the priorities and develop a detailed survey of all the elem ents to be considered fo r the project w ith the m ost critical public safety elem ent being the Bear Cut Bridge; and W H ERE A S, on D ecem ber 6, 2021, the County M ayor held a public m eeting regarding the IM G Report to allow fu rther fe edback from the com m unity and stakeholders; and W H ERE A S, on Decem ber 7, 2021, based on the input and feedback from hundreds of m em bers of the com m unity and key stakeholders, along w ith the recomm endation from C omm issioner Regalado, the County M ayor issued a m em ora ndum recom mending that the RF P be canceled and restart a new pro cur em ent; and W H ERE A S, the V illage Council w ould like to confirm that it supports the County M ayor and Com m issioner Regalado' s requests that: (1 ) the County Com mission cancel the RF P and refresh the pro cess by starting over to align the project w ith critical priorities and enable com petition and creative solutions; and (2) a w orking gro up of key stakeholders be established to define and develop priorities fo r the redevelopm ent of the Rickenbacker Causew ay w ith the m ost critical public safety elem ent being the Bear Cut Bridge; and W H ERE A S, the V illage Council finds that this Resolution is in the best interest and w elfa re of the residents of the Vill age and of M iam i-D ade County. N O W , T H ERE FO RE , BE IT RE SO LV ED BY TH E CO U N C IL OF THE V ILLA GE O F KE Y BISC A Y N E, FLO RI D A , A S FO LLOW S: Section 1. R ecitals. The above recitals are tru e and correct and are incorporated herein by this refe rence. Sect ion 2. Support . The Village Council supports the County Mayor and Commissioner Regalado' s requests that: ( 1) the County Commi ssion cancel the RFP and refresh the process by starting over to align the project with critical priorities and enable competition and creative solutions; and (2) a working group of key stakeholders be established to define and develop priorities for the redevelopment of the Rickenbacker Causeway with the most critical public safety element being the Bear Cut Bridge. Secti on 3. Transm itt al. The Village Council hereby directs the Village Clerk to transmit this Resolution to the Clerk of the County Comm ission and the County Mayor. Sect ion 4. adoption.
