PRESENT: Chairman Dan Garren, Members - Roy Hobbs, Bette Lovinus, Melanie Shirling, Mike Taylor, and Clerk Julie Hammond. ABSENT: None. VISITORS: Jerry Hansen, Julie Sutton, Steve Sutton, Christy Coombs, Coombs Family, and Betty McKinlay. The Pledge of Allegiance was led by Member Hobbs. Chairman Garren recognized citizens from the floor. Minutes Approved: Member Lovinus motioned to approve the minutes of November 13, 2013. Member Shirling seconded the motion. All were in favor, motion carried. Application for Preliminary Plat Public Hearing for Jerry Hansen Property located at 5330 Hansen Ave - 6:30 p.m.: Chairman Garren explained the public hearing process and asked Mr. Hansen to present his proposal. Jerry Hansen of 5609 E lona Rd presented his proposal for an Application for Preliminary Plat at 5330 Hansen Ave. He stated that the 1.2 acre property currently has one home on it and was asking to subdivide the lot to place two more homes on the property. Mr. Hansen stated that the property would still meet all building codes. He indicated he would remove trees and clean up the property including the existing home. Mr. Hansen stated this would be an improvement to the property. The utilities are there, he just needed to bring them in. Mr. Hansen indicated this would be a benefit to him as well as the community. Member Lovinus asked for clarification on the lot. Mr. Hansen showed her on the map Lot 7 Block 2 of Hansen Ave. Chairman Garren asked if it still meets the 14,520 square foot lot size requirement. Mr. Hansen stated that it did. Chairman Garren's main concern was getting emergency vehicles in without street frontage. Mr. Hansen stated there was a 35' driveway from Hansen Ave and access through the alley. Currently the lot is not being taken care of. Chairman Garren asked if Mr. Hansen could meet his objective with one home. Mr. Hansen stated that he could but would like two homes. Member Shirling asked about the height access for emergency vehicles. Mr. Hansen indicated there would be access from the side road. Chairman Gauen opened the public portion of the hearing. He asked if anyone was opposed. Julie Sutton of 5354 Hansen Ave stated she was opposed. She stated that Neil Hope has been a good neighbor even though the property is an eye sore. Mrs. Sutton indicated that there had been no clean up on the property since Mr. Hansen purchased it. She thought one neighbor was more appealing than three neighbors. Chairman Garren asked if anyone was neutral; none, if anyone was in favor; none. Betty McKinlay of 5315 E Owens stated she just had some questions. She asked if the access to the property was from Hansen or the alley way. Mr. Hansen stated access would be from Hansen Ave. Mrs. McKinlay asked if the homes were single family dwellings. Mr. Hansen stated they were single family dwellings. Chairman Garren closed the public portion of the hearing at 6:50 p.m. and opened Planning & Zoning's discussion. Chairman Garren stated that all lots shall have full frontage on, and access to, a dedicated street per City Code 10-1-7 C. Chairman Garren asked for a recommendation. Member Taylor motioned for recommendation to Council, to deny the Application for Preliminary Plat for the Jerry Hansen Property because there wasn't enough room for emergency access. P&Z Member Shirling seconded the motion. Member Lovinus still needed information. Member Hobbs removed himself from the vote because of his friendship with Mr. Hansen. The majority was in favor, motion carried. Basement Residential Occupancies Public Hearing: Chairman Garren reminded everyone of the public hearing process. He then read the proposed ordinance and explained that when Planning & Zoning had gone through Title 11 they had removed basement residential occupancies from the conditional uses. He stated that this could potentially have double occupancies. He asked if anyone was opposed, neutral, or in favor of the ordinance. There were none. Chairman Garren then opened Planning & Zoning discussion. Member Shirling didn't agree with the wording of 11-4-3 A, where such uses are deemed essential or desirable to the public convenience or welfare. She thought this would be better addressed as individual instead of public. Chairman Garren asked if anyone had an objection to the way the conditional use was written. If not, he would ask for a recommendation. Member Lovinus motioned to recommend approval to Council of the Basement Residential Occupancies Ordinance. Chairman Garren seconded the motion. Chairman Garren, Member Lovinus, and Member Taylor were in favor. Member Hobbs and Member Shirling were opposed. The majority was in favor, motion carried. Chairman Garren asked everyone to come prepared next month to rewrite Section A of Conditional Uses. Bonneville County Area of Impact Agreement: Member Hobbs stated that the process for expanding our area of impact needs to start with the City of Idaho Falls. Member Hobbs indicated he would draft the Letter of Intent that would need to be approved by Iona's City Council. After the City of Idaho Falls, the letter would then go to the Iona Bonneville Sewer District, and finally to Bonneville County. Snow & Weed Removal Discussion: Member Lovinus asked about snow removal pertaining to the clearing of sidewalks. She wondered if the City could be sued for not having snow removed from the sidewalks. Member Hobbs indicated that it was the responsibility of the homeowner to remove snow from their sidewalks. Chairman Garren explained that P& Z had no jurisdiction; snow removal was not in Title 11 and would need to be addressed at Council. AN ORDINANCE OF THE CITY OF IONA, IDAHO; AMENDING CHAPTER 4 OF TITLE 11 OF THE IONA ZONING ORDINANCE; AUTHORIZING BASEMENT RESIDENTIAL OCCUPANCIES IN EXISTING RESIDENTIAL STRUCTURES IN THE R-1 ZONE; ESTABLISHING METHODOLOGY; PROVIDING FOR SEVERABILITY AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA, IDAHO THAT: Section 1. Amendment of Section 11-4-3 of the Iona City code: Section 11-4-3 of the Iona City Code Is amended as follows: 11-4-3: CONDITIONAL USES: (A) The City may, after notice and public hearing pursuant to Chapter 8 of this Title, permit the uses specified below, where such uses are deemed essential or desirable to the public convenience or welfare. On all conditional use permit applications, the City shall have the discretion to require an impact statement to assess the impact of the proposed conditional use upon surrounding properties and upon city services and infrastructure. The City may impose such conditions and safeguards, as it deems necessary to protect the best interests of the surrounding property or neighborhood and city services or infrastructure from damage, hazard, nuisance or other detriment. (B) The following conditional uses are permitted in the R-1 zone: 1. Churches. 2. Public facilities such as schools, parks and playgrounds, utility facilities and other municipal uses. 3. Temporary buildings for construction purposes for a period not to exceed one (1) year. 4. Manufactured homes as defined in Idaho Code § 39-4105(8), meeting the placement standards set forth in section 11-11-21 of this Code. r 5. Nursery school or Day Care facilities. 6. Cemeteries. 7. Greenhouses. 8 Residential occupancies located in the basement of an existing residential structure, provided the following conditions are met: a The basement occupancy has a kitchen, bathroom and bathin facilities separate from the main floor occupancy b. The basement occupancy has no more than two bedrooms. c. The residential lot has off-street vehicular •arkin• facilities for at least three (3) motor vehicles. d. The basement dwelling is fully compliant with the International Building Code for residential occupancies, as the same currently exists or a may be amended hereafter. e. No home occupation is conducted within the main floor or basement dwelling. Section 2. Methodology. For the purpose of this Ordinance, text that is underlined in the preceding sections means new text added to the former Ordinance or City Code Section, and text that is stricken through means text that is being deleted from the former Ordinance or Code Section. Text that is moved from one location in the former Ordinance to another is similarly shown as underlined text. Section 3. Severability. The sections and subsections of this Ordinance are severable. The invalidity of any section or subsection shall not affect the validity of the remaining sections or subsections. Section 4. Effective Date.
