Failace Councilmember Frank Parisi Daniel Reiman Ronald Rios Janet Santoro Brian Sosnowski Also noted present was Borough Attorney Robert Bergen. Noted absent was Councilmember Alexander Sohayda. NOTED ABSENT Statement of Meeting Notice was mailed to the Home News Tribune, STATEMENT OF The Star Ledger and posted on the bulletin board on January 25, 2002. MEETING NOTICE To Address Governing Body: BOROUGH ENGINEER DONALD NORBUT a) Borough Engineer Donald Norbut b) Glen Sandor and Tim D. Allen - Kinder Morgan. Borough Engineer Donald Norbut said he would be speaking about his January l0th status report. He said several construction projects are going on. The Milik Street Rehabilitation, Carteret Avenue Project and the Washington Avenue Streetscape. He has a Special Service proposal for the Washington Avenue Streetscape in the amount of $1,650.00. They are requesting additional money for more inspections for pavers. Councilmember Reiman asked if they thought it would be more prudent for them to do the wiring while they are doing the pavers. He said he wasn't sure they have the funding but they can get the wiring from Capital. Councilmember Santoro asked if they could do that through the UEZ. Councilmember Reiman said they could but they won't have any funding for three to six months. Councilmember Rios said they were not able to get the lamppost now but at least they could have the wiring done. Councilmember Reiman said he asked John Riggio and we can do the wiring ifUEZ approves and then reimburse the Borough. Councilmember Sosnowski said he couldn't see putting the pavers in and then removing them. Councilmember Reiman said he didn't have the cost off the top of his head. jANUARY 31, 2002 BOROUGH ENGINEER Borough Engineer Don Norbut said they have a few preconstruction CONTINUED meetings for some projects and the demolition of the sewer treatment plant. He then asked if there was a plan for relocating the Recycling Facility. Councilmember Parisi said he spoke to the men from Streets & Roads and they do not want to be moved. They said the contractor for the demolition work said they do not have to be moved either. They will be secure and far enough away to be safe. Borough Engineer Don Norbut said they did not want the public coming into the construction site. They were allowing the (inaudible) to use that area of the stage because after the demolition there is going to be a sorting process and we are going to take the opportunity to clean up the operation. Councilmember Parisi said he thought they had to meet with those men because (inaudible). They are saying there are possibly two different ways to get where the demolition (inaudible). He said they should sit down together before the demolition starts. Councilmember Sosnowski said the Streets & Roads Department were not at the reconstruction meeting. He said he saw the guys today and they told them (inaudible). Councilmember Santoro said they are worded about our employees. We have the public coming in and out of there. Councilmember Sosnowski said they secured the area but safety is the first concern. Councilmember Parisi said if the demolition company is agreeable and they don't think it is going to be an issue, then we should sit down ad hammer out the details. It is our decision on whether or not we'll move on it. For some reason the safety factor has not been issued to our satisfaction and that is a concern for us. Borough Engineer Don Norbut said if the contractor doesn't feel he needs the area (inaudible) we could section it off. Councilmember Parisi said maybe next week we can meet among ourselves and the demolition company with Ted Surick and John Riley and hammer this out ourselves. Borough Attorney Robert Bergen told Don Norbut that they reached an agreement. He asked if Mr. Norbut would have them send a letter indicating what that agreement is. He is not going to ask for any additional time because we forced him to work around this and then he will not ask for any additional time. He said he would like to do a formal agreement but they could give them a letter in writing. Unidentified person asked the Borough Attorney for a copy of the letter for their files. Borough Engineer Don Norbut said the suspect area sewer separation project is down to about one half dozen illegal connections that they 2 JANUARY 31~ 2002 have (inaudible) so they are making good progress. He then asked if there was a second entrance. Councilmember Pafisi said they were meeting next week. Mayor Failace asked if this was more than the abatement of fines. Councilmember Reiman said it should be discussed in Closed Session. At approximately 7:15 P.M. Councilmember Santoro was noted NOTED ABSENT - COUNC I LWONAN absent. SANTORO Borough Engineer Don Norbut said he spoke to Mr. Gannon from (inandiblc) Consulting. Hc said they are doing thc bid specs for (inaudible) demolition and they are looking for some alternate materials and that should be done in the next few weeks. The Green Acres application is asking for Vz million dollars for Phase II of Waterfront Park. They will bc filing in the middle of February. At the next meeting they are asking for a Resolution to support the application as well as the required public hearing which will be present to the public. Councilmember Reiman asked the Borough Engineer how much he was requesting. DISCUSSION Borough Engineer Don Norbut replied that they are looking for the (CONTINUED> maximum amount and that is ½ million dollars. Councilmember Reiman asked if they were calling it Phase II but being used for Phase I. Borough Engineer Don Norbut said no, the original project was funded through Green Acres. Because of the funding issue we broke it down and called it (inaudible). Borough Attorney Robert Bergen said there were some issues in regards to some additional properties he may want down there and it may be a good idea if the Council (inaudible). Councilmember Reiman asked if they started negotiations. Borough Attorney Robert Bergen said no, that is why they need to have a meeting to decide what they want before they even do Phase I (inaudible) to go onto the property and take a look at it. Councilmember Reiman asked if it was the parking lot area. Borough Attorney Robert Bergen said yes and some of the areas -- adjacent to it. He said it might be wise to either set up a committee or refer to a (inaudible) committee. Councilmember Reiman said they spoke about doing that to the Finance Committee. Borough Engineer Don Norbut said he thought the most important issue is the temporary construction access, which (inaudible) ground work for. JANUARY 31, 2002 Councilmember Reiman asked if the Borough Engineer took the 55 foot wide easement from John Spoganetz and do we have a copy of that? Borough Engineer Don Norbut said yes, he has a map showing the easement and some other documents. He said he will bring them to his office. Councilmember Reiman said to keep in mind that they have the Open Space Fund and that can be used (inaudible) and the purchase of property. If they have the intention of doing something permanent we'll try to get it done all at one time. We'll likely have to go through Court to get it done and he doesn't want to go there twice. Borough Engineer Don Norbut said he has a proposal that is work related to the Carteret Landfill Redevelopment. (Inaudible) is the developer and he was asked to come in and provide mapping (inaudible). He said he sent this information over to the Municipal }ISCUSSION Clerk for a resolution not to exceed $4,400.00 for case mapping and · CONTINOED) overlay mapping. Borough Attorney Robert Bergen said he would like a copy because they were going to discuss this in closed session. Councilmember Reiman asked the Borough Attorney if he reviewed the Escrow Account. Borough Engineer Don Norbut said last year they did an emergency sewer repair on Layfette Street. He said they found that several homes had their laterals blocked and sewage was backing out of the (inaudible). They need to install a manhole on top of an existing line and the best way to do that is included in the suspect area sewer separation. They have a contractor that does good work and there is some contingency money in the contract we can have. That will give us the ability to clean and TV the line that goes down to Roosevelt Avenue. Borough Attorney Robert Bergen said with the Finance Department's help maybe we can get an idea of how much this emergency work D&D Construction did last year. Borough Engineer Don Norbut said Patrick DeBlasio was concerned that it was emergency work. We already have the framework for the contract, it is just a mater of polishing it up and putting it out on the street. Borough Attorney Robert Bergen said he did not keep tract of the (inaudible) but there are quite a few Resolutions for them so he (inaudible). Mayor Failace asked how they would anticipate emergency work. Unidentified person replied you have so much each year. Mayor Failace said he understood what they were saying. 4 JANUARY 31, 2002 Borough Engineer Don Norbut said it is something that you come to expect. Borough Attorney Robert Bergen said there could be less concern if they called a different contractor but if you called D&D... -- At approximately 7:22 P.m. Councilmember Santoro was noted NOTED PRESENT - COUNCILWONAN present. SANTORO At approximately 7:23 P.M. Councilmember Sohayda was noted NOTED PRESENT - present. COUNCILHAN SOHAYDA Borough Engineer Don Norbut said there are 25 sinkholes per year and... Borough Attorney Robert Bergen said he was surprised about the same DISCUSS ION thing because it was done last year and he has never seen (inaudible) out for emergency work before. He asked how they did that and they responded that they have quite a bit of emergency work around here. Borough Engineer Donald Norbut said the last item he handed to them was a proposal to improve the Hill District. He said the next step is with the three million dollar project. For those of you who are not familiar with this, the Hill District Area has flooding problems several times a year when heavy rain falls. Beverly Street becomes almost under water. We believe the sanitary sewer system is seeing some significant influence from this flooding and it is causing the Borough -- some problems. The DEP sited the Borough for (inaudible). The next step is called a (inaudible) document. Because we are using DEP Funds for this project, this is a requirement under the National Policy Environmental Act. The project consists of a new storm water pump station and a force main right along Beverly Street. It also has a new culvert crossing under Industrial Road. Preliminary estimates are 3 million dollars. This analysis does a number of things. It does a survey of the architectural and historical (inaudible) and it does some soil borings and testing of the soil. He said on page two he outlined the requirements and they are quite lengthy. Some hydraulic calculations related to (inaudible). Looking at the intensity of various rain falls we see the level of protection that we need to provide for that area. He then said this is only the next step, the final design will follow in the summer once we have approval from the EPA. Councilmember Santoro asked how long it would take to do your end once this approval goes through and you are ready. Borough Engineer Don Norbut replied they need ninety days and at least thirty to sixty days to hear back from the EPA. -- Borough Attorney Robert Bergen asked if they needed a Bond Ordinance. Councilmember Santoro said it was done already. This is the one that was done and (inaudible). Borough Engineer Don Norbut said (inaudible) Cultural Resource Survey and (inaudible). 5 JANUARY 31, 2002 Councilmember Santoro said they need it for 56 (inaudible). Borough Engineer Don Norbut said those would come back for consideration. Councilmember Santoro said they should put the first one on for next week. Councilmember Rios asked if there was any progress with the traffic coming and going to West Carteret. Borough Engineer Don Norbut replied yes. They actually submitted an outline of the issues to the County and they responded on a number of issues. He said it looked like they were going to meet with the County and a representative of the County for next Thursday. Councilmember Santoro asked where the Borough Engineer would meet. DISCUSSION (CONTINUED> Borough Engineer Don Norbut replied they would meet in the County. Councilmember Santoro asked him to let them know when they would meet and what time. She then asked if the Borough Engineer knew about the Board of Health Building (inaudible). Borough Engineer Don Norbut said yes he knew the good weather was coming and he would get some quotes and in a few weeks they will have (inaudible). Borough Engineer Robert Bergen asked the Borough Engineer if he knew anything about the proposal for Washington Avenue because they were putting it on for the meeting and he would like a copy. Councilmember Santoro then spoke about the estimates for the wiring. Councilmember Reiman said the natural lights will be expensive and the wiring will cost the Borough a couple of thousand dollars. UEZ can pick up the cost of the lights and while you have it ripped up, it might as well get done. Unidentified person asked if they anticipated the possibility that the lights (inaudible) this year. Councilmember Reiman said yes, that is one of the first things on the UEZ Agenda. Councilmember Santoro said they are having monthly meetings. Mayor Failace asked if there were any more questions for (inaudible). Borough Engineer Don Norbut asked if there was anything on the Agenda for him to stick around for. Borough Attorney Robert Bergen said he would like him to stay for the presentation by Kinder Morgan. 6 JANUARY 3I, 2002 GLENN SANDOR Kinder Morgan. GLENN SANDOR KINDER MORGAN Last March Kinder Morgan took over GATX. He said his reason for coming to meet them was to discuss the petroleum pipeline from their facility over to Linden, NJ. It is a basic underground pipeline and they would have their product pumping (inaudible). He said they need some -- right of ways ad easements from the Borough of Carteret to cross the Rahway River and go under the Turnpike and come back up on the Linden side. He said his discussion here today is to inform the Borough of the project. As noted, Kinder Morgan is a large facility along the Rahway River. We went to the Planning Board a few months ago and spoke about building four tanks. They will be built on a portion of their facility. They are interested in building three additional tanks in another part of the terminal. In the back are some storage tanks and what they need is to use this pipeline to have the product come from their facility to Linden and from there all the petroleum products are distributed up in the North East. What they want to do is build some additional tanks, a pipeline and operate their facility. They believe that the underground pipeline is the safest mode of DISCUSSION transportation. There are no additional trucks to go through the Borough of Carteret. Councilmember Parisi asked if that was common for that area. Councilmember Santoro asked if there was a pipeline there already. Glenn Sandor replied that they already have an existing eight inch -- pipeline in the same area. This would be a sixteen inch pipeline that they plan on constructing. He then asked if they were going to follow a different route in this area but for the most part it runs along the railroad tracks. Councilmember Santoro asked if the new pipeline would run along side the old one. Glenn Sandor replied yes. Councilmember Santoro asked if he would be installing (inaudible). Glenn Sandor replied that she was correct. Councilmember Santoro asked the proximity of the Industrial Road. Glenn Sandor replied they were staying away from the railroad, all the tanks will be in back of their facility. Some are already behind existing tanks. We have approval for four tanks and we are accountable for the additional three tanks. He said that was what they were looking for as far as their expansion projects. Councilmember Santoro asked if they had any other plans (inaudible). Glenn Sandor said they have no mom plans. Typically, Kinder Morgan is the smaller portion of the terminal and right now we don't have any plans. Councilmember Reiman stated that they are not operating any other chemicals anyway. JANUARY 31, 2002 Glenn Sandor said gasoline is the only product that they are (inaudible). We have to supply other customers like Amoco, Gulf, Exxon and Mobil. This is a safe way to get the product over to those facilities. You can't use trucks to get large volume (inaudible). Councilmember Reiman asked what improvements have been made since the four tanks were approved? There were some minor improvements for carbonated beverages... Kinder Morgan has approximately thirty million dollars worth of projects. Glen Sandor said Kinder Morgan has purchased GATX and we have seen a big difference in the way we are operating. Kinder Morgan has been very good to us and we are looking at an expansion in Carteret of three million dollars. Councilmember Reiman asked if that was the total. RE: KINDER Glenn Sandor replied yes. All the projects they heard about ~'iORGAN (inaudible). Kinder Morgan is good company; they are allowing us to grow. They are also making jobs in their facilities. Borough Attorney Robert Bergen said (inaudible) is going to require some easement through the Borough. He advised them that in addition to whatever sight plans they require; they may have to meet the Council as to some plans for the redevelopment of that area. They would also require some easements to be granted on behalf of Borough property. His recommendation to the Borough would be that they have to post some escrow for the Council so that the Engineer and he could take a look at that project and be able to give the Borough some information with regard to the technical aspect of it. His understanding is that there would be no problem. Unidentifiable person said that would be fine. Councilmember Santoro said tonight is the presentation asking for the Borough Engineer and Borough Attorney to work with them and come back with a recommendation. Borough Attorney Robert Bergen said that would be his recommendation to the Council. Unidentifiable person asked Karen McMillin if he missed anything. Karen McMillin said to pass the information over to the Mayor and Council. Councilmember Santoro said you would need permits and they are in the process (inaudible) will take a lot longer than that because of the environmental issues. She asked if they would need a resolution. Borough Attorney Robert Bergen said they should because it is closer to the railroad tracks. He said Councilwoman Santoro should accept the $5,000.00 check for escrow. Councilmember Rios asked about the pipeline that is already there. OANUARY 31, 2002 AT THIS TIME THE TAPE MALFUNCTIONED - TRANSCRIBER' S NOTE Borough Attorney Robert Bergen said he agreed about posting the five thousand dollars to get it started. It is going to cost more than that (inaudible) on behalf of the Council and give us some advice (inaudible) their terms of what the cost of the ultimate use of that -- property may be (inaudible) tax assessor. We need to get that information from the Borough Engineer. Karen McMillin said they estimated with the temporary work (inaudible). What they are offering for the permanent (inaudible) is $10,000.00 for the temporary workspace. She told the Mayor and Council that it was all broken down in the packages she gave them. Councilmember Rios asked Glenn Sandor what kind of numbers he had. Glenn Sandor said they already started working on it. Councilmember Parisi asked if he had any idea how many more (inaudible) they would need when it was all completed. Glenn Sandor said most of the volume they have already and the pipeline (inaudible) because it is not a labor intensive thing. Councilmember Rios asked they suggested that your fire protection that you have right now (inaudible). Glenn Sandor said they have a fire brigade and they are now looking at RE: KINDER purchasing a fire truck. MORGAN Councilmember Santoro said when they moved before the board there were certain conditions they had to meet. Glenn Sandor said they have already started the security upgrade of the facility. The only area left is by the waterfront. The employees are out there al the time. He said they do have a lot of (inaudible). What they are trying to do is slightly increase... Councilmember Santoro asked if they had to do anything in the form of a Resolution to accept the money to be used for (inaudible). Borough Attorney Robert Bergen said his recommendation is a resolution authorizing them to turn towards an Escrow Agreement with Kinder Morgan. Karen McMillin said she had already given them a sample draft of (inaudible). Borough Attorney Robert Bergen said they should just authorize the Council so Patrick DeBlasio can deposit the money and establish an escrow account. Councilmember Santoro said they would come back with the recommendations. JANUARY 31, 2002 Councilmember Reiman asked how that worked. He stated that they don't actually sell them the property. Borough Attorney Robert Bergen said it gives them the fight to use that particular (inaudible). He then asked what the dollar value was on the leased property. They were only now finding out the extent of the use. Even though there is a 30 foot easement there are a number of issues. Karen McMillin said they are not building any permanent structures on top of it. )ISC~SS ION 30NTINUED Borough Attorney Robert Bergen said there is a number factor that you have to consider when you figure the value of the easement. You can have an easement that is very small but if it runs fight down the middle of the property, you can't build in the middle of the property. Councilmember Santoro said after the recommendations that come from our Attorney (inaudible) before the board. At this time they are talking all at once and it is inaudible. Borough Attorney Robert Bergen said after we grant them access to our property, (inaudible). Mayor Failace said this is not a public hearing. He said he did not feel comfortable with this. Borough Attorney Robert Bergen said this is only a preliminary (inaudible) on whether or not the Borough wants to grant them an easement. Ultimately if the project goes forward he was sure if would go before the Planning Board. Mrs. Gaydos wanted to ask a question and the Mayor told her ask it. Mrs. Gaydos wanted to know where they will cross the fiver. She the asked if they were going to pass the school. Councilmember Rios asked if the whole section is three hundred years. At this time everyone is talking at once and it is inaudible. Borough Attorney Robert Bergen asked if someone would like to make a motion authorizing the Borough to accept the five thousand dollars in escrow so it can be deposited in the account so that the Borough Engineer can draw on the account. Upon MMS&C, by Councilmembers Sohayda and Santoro and unanimous affirmative vote of the full membership present, a motion was made to accept five thousand dollars in the escrow account. Refund of Tax and/or Sewer User Fees. 4.Authorizing the Borough to Enter into a Cooperative Pricing Agreement. Borough Attorney Robert Bergen asked who put the Resolution on. Municipal Clerk Kathleen Barney said it was Patrick DeBlasio. COMMENTS Borough Attorney Robert Bergen then asked if he drew it up. Councilmember Santoro said she asked him about that. That is the Middlesex County Utilities where we have the option to buy at their prices when they give (inaudible) different situations. Mayor Failace asked if they already discussed this. Councilmember Santoro said this was a different one. We did this once before. Mayor Failace asked if they had a copy of it. Did Patrick DeBlasio give us a copy? Councilmember Santoro replied that she asked him and he said there was still the option, we're not locked into anything but we should be able to get it at a better rate. 5. Appointing David Balken, O'Gorman and Young - Broker of RESOLIJTION Record. Councilmember Reiman said he is the individual that handled our insurance entering the Middlesex County (inaudible). He said he thought it was for the life insurance. It was something that they could COMMENTS not negotiate unless they were our broker of record. It doesn't come with any salary but they would receive a pementage of the fee. 6. Approving Change Order #1 - Diamond Construction, Re: RESOLtJTIONS Washington Avenue Business District Improvement. 7. Authorizing Execution of 2002 Playground Safety Grant Agreement. 8. Creating Handicapped Parking Space 90 Louis St. 9. Creating Handicapped Parking Space 116 Linden St. Mayor Failace said a handicapped parking space goes to the Police Department and then the Borough Engineer inspects it. 11 JANUARY 31, 2002 Borough Attorney Robert Bergen said the Borough Engineer is COi~MENTS sending him copies of the application. He said he was going to advise the Borough Engineer that he really does not need to see the letters approving them. Mayor Failace said if that saves us some money he'll be happy Councilmember Santoro asked the Borough Attorney if he charged a fee for looking over the applications for handicapped parking. Borough Attorney Robert Bergen said he doesn't but if it is there he has to look at it. Municipal Clerk Kathleen Barney asked if it would be a Special Meeting. Councilmember Reiman said they were still going to have their heatings, afterwards. Borough Attorney Robert Bergen said they had to have the regular Public Heating. RESOLUTIONS 16. Authorizing Various Contractors to Perform Rehabilitation 10. Authorizing the Issuance of Various Amusement Device Licenses. 11. Amendment to the 2002 Budget. 12. Councilmember Reiman asked the Mayor if they wanted a heating prior to the budget. Mayor Failace asked if he was referring to the Council. Councilmember Reiman asked if they should start it a ½ hour earlier so we can get it over with. Mayor Failace replied that it was fine with him as long as everyone agrees. RESOLUTION 16. Authorizing Various Contractors to Perform Rehabilitation of Homes Pursuant to COAH Regulations. Councilmember Reiman asked the Borough Attorney a question. He said they had some quotes from last year, specifically for diesel fuel COl'il'lENTS and gas. They have a State contractor and he was wondering if they have to go out to bid. We had a quote that is $.20 cents cheaper per gallon with a local vendor. We are looking at a significant amount of savings under the State contract. What he wanted to know is if they are still allowed to go out to bid. He then said they were paying over one dollar and we had a quote from a local man at (inaudible). 12 JANUARY 31, 2002 Borough Attorney Robert Bergen said he had never seen this bid for gasoline nor did he miss it. Councilmember Reiman said it is a State Contract. It is cheaper to get a local guy. What he is saying is that they can go out to bid. -- REPORTS: RF.PORTS 1. Board of Health - December 2001. 2. Clerk's Office - January 2002. MATTERS FOR DISCUSSION: MATTERS FOR DISCUSS ION 1. Job Posting - Laborer Parks Department. Councilmember Reiman asked if this was a new position or just a moving over. Councilmember Santoro asked if they were choosing someone. Mayor Failace asked if they were going to pick someone. 2. Fire Department - Donation of Fire Hose - to South Carolina. CONTINIJED Municipal Clerk Kathleen Barney said she thought they would need a Resolution to declare it junk. COMMENTS Mayor Failace said they are helping out a fire department and that is fine. He then asked Brian O'Connor if they were coming to pick it up. Brian O'Connor replied that Over Night is doing it for free. Borough Attorney Robert Bergen asked if there was a letter indicating that there was no value to the hose. Councilmember Reiman said the had to write a Resolution saying it was junk. 3. C-3 Operator - Annual Contract for 2002. CONTINtlF. D Municipal Clerk Kathleen Barney said there is three of them now. Councilmember Parisi said they have letters from (inaudible) saying that he no longer wants to do it. COMMENTS Councilmember Reiman said he asked Patrick DeBlasio and he contacted (inaudible) other Municipalities. One would be the C-3 __ Operator from Woodbridge Township and the other one would be at the same amount of $1,000.00 a month. The position of contractor we want to be a Borough Employee at additional money. Woodbridge Township's C-3 operator would do it at the current amount. There is a potential former contractor who use to do it and he is a C-3 Operator with South Plainfield. Michael Carnevale suggested this man for the position. He said they could potentially have the Resolution ready for Thursday. 13 JANUARY 31, 2002 Borough Attorney Robert Bergen asked if he denied the appointment. DISCUSS ION CONTINUED Councilmcmbcr Reiman asked if he was speaking about the contractor. Municipal Clerk Kathleen Barney said they didn't put him on for this year. Councilmember Reiman said his letter said he was resigning but he would take a lot more money. Borough Attorney Robert Bergen said they should appoint someone as soon as possible because if they come in and do a inspection they need the C-3 License. Councilmember Reiman asked Councilman Parisi to set up the interview with Michael Carnevale and Patrick DeBlasio. Councilmember Santoro asked if it would be ready by next Thursday. Mayor Failace said they should be on board by next Thursday. Councilmember Santoro said they did not negotiate the salary. She said they not yet accepted his resignation so he is still on record and they can still use him. Borough Attorney Robert Bergen said they should make a permanent appointment as quickly as possible. MATTERS FOR 4. NJ DOP a) Notice of Promotional Exam Fire Captain. DISCUSSION - CONTINUED Councilmember Parisi asked if they had a open position. We still have to decide if we want a test or not. Mayor Failace replied that was what they were asking. He said they should have a test. Municipal Clerk Kathleen Barney said they usually have a test for Fire Captain. b) Certification of Eligible for Appointment - Assistant Violations Clerk. One eligible, date of disposition: 4-14-02. It is a current employee so we are just certifying them. Mayor Failace said it is someone doing the job and we are just certifying the position. Continued 5.Bergen County Partnership Requesting resolution/requesting legislature provide tax relief. 6. Sam Perry - Requesting adjustment of employment dates. Councilmember Santoro asked if they had to do that in Closed Session. Borough Attorney Robert Bergen said they need to check the contract COMMENTS and see what it provides. Councilmember Reiman said it is a long time employee and he thinks there was a discrepancy. 14 JANUARY 31, 2002 Councilmember Santoro said they were employed from 1983 to 1989. 7. Office of the Disabled - Requesting Salary increase for secretary. MATTERS FOR DISCUSSION Mayor Failace asked what they were asking for. -- Councilmember Reiman said they want a 20% increase. 8) VFW Second Request to store trailer on municipal lot. Councilmember Santoro said this is the first time they made such a request. She said she spoke to Tony Neibert and to refresh what was going on with that. Presently, there is an Ordinance. Councilmember Sosnowski said it was one that Tony Neibert said would open up a really big can of worms. He is talking about putting trailers on properties and he is recommending against it. Councilmember Reiman said he though they should speak with the VFW. Mayor Failace said they are going to store wheel chairs, crutches and so on. DISCUSSION CONTINUED Councilmembcr Rciman wanted to know if they should put it there or they arc responsible for it. It is going to bca permanent trailer and are they going to have a concrete foundation? Councilmember Santoro said there was a meeting at the Recreation Building with the Little League and Softball. They also want to put a trailer at the Recreation Building. This is how this whole issue came about. There was a meeting and that is how Tony Neibert got involved, now there are two requests in for trailers. If you are going to grant it for one you are not going to be able to grant it for the other. Again, it is depending on which direction you want to take and the code concerning trailers. They have the request in for the Recreation Building. When they built that building they did not plan for all the equipment and they need more storage space. Mayor Failace asked where they have stored things in the past. Councilmember Sosnowski said baseball rents a storage facility. Councilmember Reiman said he did not think both issues are one and the same. In one you have a large municipal parking lot where they showed them where they want to put it and that could potentially work. The other one has an existing building and there us a different (inaudible) to look at. He said they should give them permission. Councilmember Santoro asked if they should have Tony Neibert speak to them about it because this came from him and he could explain it in more detail. Councilmember Sosnowski said (inaudible) is against the Zoning Ordinance. 15 JANUARY 31, 2002 Councilmember Reiman asked if it was going to be a mobile trailer with a foundation. Councilmember Santoro said the same thing is putting baseball equipment (inaudible). This is coming from him so we should bring him in and let him answer all the questions. Mayor Failace said they can look at other alternatives but he did not think the two (inaudible). Councilmember Rios asked if they could use the old library for storage. It could probably be used for the Little League and the Veterans. Mayor Failace said he thought they were selling the old library. Councilmember Rios said they didn't sell it yet but they should take it into consideration. HATTERS FOR 9) T&M Associates - Requesting Professional Services Resolution - DISCUSSION - $1650.00 RE: Washington Avenue Streetscape, Concrete Paver CONTINUED Installation. 10) General Assistance - Consolidation. Councilmember Reiman said they spoke about this in December, the Consolidation of Social Services with Middlesex County with hardly any cost to the Borough. We could still have a full time Director and potentially combine that position with the Director of Office on Aging. We also have one or two individuals retiring. We have one full timer and one green thumber. One can go to John Riggio's Office and the green thumber can go to the Recycling Department. He said he thought this should work out fine. It could save the Borough approximately $30,000.00 and by next year it will be $100,000.00 in savings. We need a resolution to authorize .... Mayor Failace said (inaudible) practically at no cost. Councilmember Reiman said he didn't know if there would be any minimal administrative fees. They are certainly going to be considerably less then we are paying. Councilmember Santoro said maybe when they go into Closed Session they can talk about the different moves... Councilmember Reiman said (inaudible) before Hadiyah Muhammad can go any further or Patrick or the County. They would need a resolution, a sample that they sent over. There is a time frame and we would like to get it in, so we can realize the savings in this budget year. Mayor Failace asked if there was anything else for open. Councilmember Santoro said there is going to be a benefit basketball game and she thinks it will be February 22nd. She said she had to check the date with the Fire Department. It is for the Scholarship Fund for the World Trade Center. They are going to be selling tickets for $20.00 16 JANOAR¥ 3i, 2002 each. She then asked Councilman Sosnowski if he knew when the benefit basketball game was ... DISCUSSION CONTINUED Councilmember Sosnowski said she was correct it is going to be held on February 22nd. -- Councilmember Santoro said they will be bringing it to the next Council Meeting and telling everyone about it. Also, there was a new UEZ Meeting Tuesday night with new people. They seemed excited about it and they wanted to know everything about what they could do. That would be extended to all businesses through out the town and not just one area. Mayor Failace asked how she could do that. Councilmember Santoro said it is not designating just one area. Mayor Failace then asked if it was just for the UEZ. Councilmember Santoro replied yes. Councilmember Reiman asked if they were going to have a different fagade. He then asked that Roosevelt Avenue isn't going to look like Washington Avenue. Councilmember Santoro said basically there is going to be an approval process and a different application when they fill it out because it isn't -- matching, it's 50-50. He is going to bring it back to us and those (inaudible) to discuss. Mayor Failace said he was worried about the whole thing. Councilmember Santoro said it has to be within the UEZ. We spoke about the streetscapes and the lighting on Washington Avenue and trying to get a uniform streetscape. She then said she had something for Closed Session. Councilmember Sosnowski said he wanted to get together with the Building and Grounds Committee and set up a meeting. He said he would like to have a discussion with the committee about... Councilmember Rios said when the summer comes we have different RE: AMUSEMENT organizations that have carnivals and amusements. He said they should RIDES look a little closer at the owner of these rides to make sure they are certified to operate the equipment. Just because the operator has a certificate that says they run a safe piece of apparatus the operator should also know the operation of the machine. They should also be inspected before they operate at the different carnivals and Ethnic Day __ or for any event that is held in the Borough. Municipal Clerk Kathleen Barney said they just received another letter concerning that last week. She said she turned it over to the Borough Attorney. Councilmember Rios said some of the rides are horrendous and you hear of accidents quite often. Let's not wait until that happens. We should make sure we have someone in the Borough, maybe the 17 JANUARY 31, 2002 Building Inspector. When they are ready to start having a three day carnival or Ethnic Day he should go out there and inspect the equipment and make sure it is safe. Mayor Failace asked if they are capable of doing that. Borough Attorney Robert Bergen said the Municipal Clerk sent the letter over to him. He said the equipment is regulated by the State and there are certain regulations they have to comply with. The State is just (inaudible) to make sure when they come in, if we have a licensing procedure, and that they understand what the requirements are. They require that anybody that they have a contract that meets the State requirements. He said he didn't know if the Borough does anything other then Ethnic Day and he wanted to know if we hire any vendors to do the rides. DISCUSS ION Mayor Failace replied that they do. CONTINUED Councilmember Rios said they only hire for Ethnic Day. Municipal Clerk Kathleen Barney said the Churches have carnivals too. Borough Attorney Robert Bergen said the Borough does not license them so we should probably send some letters to them advising them to do that. He said it is regulated by the state and he has a problem with that. He then said he did not think that Tony Neibert was qualified to do the inspections. He said they should work with the Municipal Clerk to put a policy together to implement what the State wants. Councilmember Rios said they have to enforce some kind of safety measures because there are young children going on these rides. Borough Attorney Robert Bergen said they have to see if they are complying with the State rates unless you have some standard by which to set them. He said he could speak to Tony Neibert, but if he is not qualified, he doesn't know what standards we could set for him to inspect the equipment. Councilmember Rios asked how they could enforce it, if we don't have to do anything whether it be an Ordinance or Resolution. Borough Attorney Robert Bergen said one way to do it is to establish a license for those people and require them to pay a fee. This way when a private organization runs an affair then we can require an Ordinance that all the people they hire produce the proper State certification. Councilmember Rios said they should make the organization that is running the affair pay for a license for the rides and such. We don't want to (inaudible) the local organizations because they are the ones that are having the fundraisers to help pay for the (inaudible). Borough Attorney Robert Bergen said you want them to come and get a vending license. He said he would call the State to see if they have any ideas. 18 JANUARY 31, 2002 Councilmember Rios said they had a request from a lady in town. She WORLD TRADE asked what can the Borough do. We have organized a Carteret World CENTER DANCE Trade Center Scholarship Fund and we have been meeting on a regular basis. He said on April 27th we are having a dance and he would get back with that ad give them all the specifics. It will be a scholarship for Carteret Residents; children that go to school in the Borough of Carteret. Councilwoman Santoro mentioned that one of the police officers and some firemen are organizing a basketball game. Councilman Rios said they approached him and they want to be part of our group. The donations that are raised through the basketball game will go through the same fund. Hopefully they will sustain this every year and allow it to go to some kind of scholarship (inaudible). DISCUSSION Mayor Failace asked if they set up a bank. Councilmember Rios said they are in the process of getting a Post Office Box and a Bank. Vincent Manetta is our treasurer and we are looking for members to come and help, especially with the dance so we can cut costs. Municipal Clerk Kathleen Barney asked where they were having the dance. Councilmember Rios said they were having the dance at St. Demetrius Hall. It's the biggest hall in Carteret and the price is right. He said he wanted everyone to know this because if you hear about this on the street (inaudible) the Council Meeting next Thursday and give you more information. Borough Attorney Robert Bergen asked if they established themselves as a non profit corporation. Councilmember Rios said they are established with the State and are filling out forms for tax exemption.. We are filing for the proper forms so it is non profit (inaudible). Councilmember Reiman said he only wanted to add a few things. The CBGC Meeting (inaudible). We had a Community Development Meeting ... On Tuesday they spoke about the disbursement with the block grants. It looks like we are going to get another $88,000.00 this year from the county. It is actually from the Federal Government but administered by the County. The Community Development Board has a budget of $3,500.00 for the Volunteer Fire Department, $32,500.00 for Housing Rehabilitation Programs, be it for hot water heaters or furnaces and $2,500.00 for the Kiddie Keepwell Program. Councilmember Rios said they should keep in mind that we had a person at a Council Meeting (inaudible) so we can have handicapped accessible (inaudible). Councilmember Reiman then spoke about the three commuter lots. RE: FEE FOR Currently we only charge for parking at one. He thought they should PARKING LOTS take a look at that. To park at the lots on Roosevelt and Terminal Avenues is currently free of charge. He said he doesn't know why because it is for the residents from out of town. They also use the one at the comer of Industrial and Roosevelt Avenues. It is $140.00 for a six month pass. 19 JANUARY 31, 2002 Borough Attorney Robert Bergen said they might be able to find out faster if they check the orders. Councilmember Sohayda stated that everyone got their year end review from the Fire Department. There was a gasoline spill at Kinder Morgan and we are being reimbursed for the expenses of that incident. DISCUSSION Councilmember Reiman asked Councilman Sohayda if he knew what the expenses were. Councilmember Sohayda replied that approximately $2,784.64. Brian O'Connor has been expedient in this matter. There was an incident at a fire last week involving the Volunteer Fire Department and the Police RE: RURAL Department. He asked if they all received a copy of the report. He said METRO he now has a complaint between the person being transported, her "COMPLAINT" daughter and somebody named Maria from Rural Metro. The Lady wanted to go to JFK or Rahway but one of the hospitals was on bypass. The person from Rural Metro got a little mouthy with the daughter of the person being transported. He said he is making a complaint about the Borough's relationship with Rural Metro. Summarizing the conclusion we are a town under contract with Rural Metro to investigate how the people would be treated and that would be with compassion and respect. He said they should investigate this Mafia and fire her. He said he hoped this matter would be taken care of. Councilman Sohayda said he is turning this over to the Municipal Clerk so she can carbon copy it, read it and make a decision. Mayor Failace said at the very least we need to .... Councilmember Santoro said they need to send a copy to Rural Metro. Councilmember Sohayda said the letter is very hard to read. It is handwritten and ... Mayor Failace said they need to speak to a (inaudible). Coun¢ilmember Sohayda replied however they all thought it should be handled. Borough Attorney Robert Bergen spoke, he was inaudible. Councilmember Sohayda said the letter is three pages long and not well written. Mayor Failace said in the past they never had a complaint or a problem. Councilmember Rios said they never had a complaint with Rural Metro as professionals. Borough Attorney Robert Bergen said they should address it and (inaudible) responsive to Carteret. Councilmember Rios said as far as professionalism and courtesy... Councilmember Pafisi said he had one thing and it is for Public Works. He said he spoke to Ted Surick about the notifications from 20 JANUARY 31, 2002 companies coming into the Borough, be construction or PSE&G. They are digging up the road and they are not paving properly. Councilmember Reiman said they proposed an Ordinance last year (inaudible). -- Borough Attorney Robert Bergen said he asked Don Norbut, Borough RE: PERI~IITS FOR Engineer, to take a look at (inaudible). It is very detailed as to how ROAD OPENINGS they have to restore the road. He had people go over the specs and make some changes. He said he is going to have Tony Neibert take a look and they will meet with the Water Company. They want to meet with us because it is going to be very restrictive and they are happy with that. Councilmember Parisi said if they are going to come in and rip up our roads and not put them back the way they found them... Borough Attorney Robert Bergen said they have an Ordinance now that requires a permit. You have people coming in and opening up the road and not taking out the permits that they are required to do now. An Ordinance is not going to help that. The Police Department needs to report it and they should be stopped right away. He said he spent the morning on the phone with the Municipal Clerk and someone came in for a permit. He said he called the engineer and the Water Company and we told them this was how we want the road restored. If you want a permit you'll do it the way we ask you to. -- Councilmember Santoro asked who would have the authority to stop someone until they got a permit. Borough Attorney Robert Bergen replied Ted Surick, Tony Neibert and the Police Department or just about anybody can go down there and stop it. Councilmember Santoro asked if any one of them would do that. She then asked if they could send a letter to each department to notify them as to what we are doing. Borough Attorney Robert Bergen said they have an Ordinance right now and we are going to make it more restrictive. If they are ignoring the one you have now you need to have it stopped. Councilmember Santoro said that is why if we start reporting it among ourselves and they know who the proper person is we need to shut them down until they get a permit. Borough Attorney Robert Bergen said the new Ordinance is going to prevent them from doing that but you are going to have to start to give -- them more notice before you can do it. The problem is that you have to give them advanced notice and they are going to have to say they are going to pave this road next year. If you have any sewer (inaudible) do it now, this way they can't say they never received notice that we can pull out a letter saying they received it four months ago advising them that they were doing this. You can't pave the road and then come back afterward. 21 JANUARY 31, 2002 Councilmember Santoro asked if they could designate somebody as the proper authority. Mayor Failace asked if she meant to stop them. Councilmember Santoro asked if that would be easier. Mayor Failace said he wasn't sure they wanted to do that. We have the full Police Department and the Fire Department. We have anybody that is out there. Councilmember Reiman asked who is going to be the new contact person with the new Ordinance. Borough Attorney Robert Bergen said it is going to be a combination. The initial permit procedure, we're going to take it from the Clerks Office and have it initiated out of Tony Neibert's office and have him do the inspections on the road. There are going to be some areas where you want a combination of the Engineer and the Road Supervisor to also be involved in looking what takes place. It is going to be a combination of the three but the head person should be Tony Neibert. RE: NJ Councilmember Reiman said he knew the Tumpike Authority and all ONE-CALL the chemical companies have the program, "NJ One-Call" before they can dig or do anything. Tony Neibert can be the coordinator... Mayor Failace said he did not think they wanted someone from the County Department driving to work, get out of the car and tell them to stop digging. We should notify the Police Department because that would have more of an effect... Councilmember Santoro said if they send a letter out then they need to contact the Police Department and inform them that they need a permit and they have to stop the work until they do. CONNENTS Borough Attorney Robert Bergen said if they are not doing it then it might be a good idea to start stopping and check. People have a habit of not getting a permit. Mayor Failace said if they see them opening the road you assume... Councilmember Reiman said he stopped Ted Surick and the Water Company when they were on Washington Avenue and they did indeed have a permit. Councilmember Parisi said there is a minimal fee but .... Councilmember Reiman said he thought there was part of the Ordinance that they have to post a bond so that (inaudible). Councilmember Parisi said the Board of Education names the liaison to the Office of the Disabled and they have to appoint a person. Councilmember Reiman said he saw the letter but he didn't think they had to actually do the appointing. He then asked who their appointee was. 22 JANUARY 31, 2002 Borough Attorney Robert Bergen asked if the Board of Education has RE: BOARD OF a member on the (inaudible). EDUCATION Mayor Failace said this is something that the Board of Education has requested. We did this a few years ago when he was there and they discussed doing that but he wasn't sure if they did it by Ordinance or -- not. Borough Attorney Robert Bergen said Tony Neibert called him in PROPERTY HAINTENANCE regard to some property issues. He said it came to light when he asked OFFICER him if he enforced the bulk of the property maintenance code. Presently the Borough doesn't have anyone appointed as the property maintenance officer in Town so that needs to be addressed. He is going to take a look at the bulk code and may make some recommendations. Councilmember Reiman said they just hired Tony Neibert as the full time inspector and that was to free up the other inspector who is going to do all the property maintenance. Borough Attorney Robert Bergen said they have to appoint somebody and that is perfectly fine. You may want to refer to a committee and take a look at what they want. It is what they call bulk property maintenance or a combination of both. If he is going to do any Ordinance changes he recommends to the Council that somebody else gets involved in that process so you have an Ordinance (inaudible). Councilmember Sohayda asked if this was about cleaning up the properties. Borough Attorney Robert Bergen said somebody has to be designated RE: PROFESSIONAL because it is his understanding that he just goes to Court on those SERVICES CONTRAC' issues but he really has no authority to present a property maintenance 1 ) Handwriting Exper code violation. He then said he has to do a few professional services 2) John Wanskus contracts. One is for the hand writing expert and the other is for John Wanskus. The deal is for about $10,000.00. Councilmember Reiman asked if there was any chance they could get the money back from the insurance company. Borough Attorney Robert Bergen replied no, because it is a contractual claim and you can't get insurance for contractual violations because what you'll do all the time is violate the contract and then make the insurance company pay. Councilmember Reiman asked if they were going to file a counterclaim after they win. Borough Attorney Robert Bergen said it is too late to do that. There is RE-INVEST CO. PROFESSIONAL SERVICE. also going to be a professional service resolution with a company called Re-Invest. His fees will be reimbursed out of the bond. The reason why we need somebody ...again he would like to discuss more in Closed Session what actual work is going to be involved. He said he would let them know ahead of time that there is going to be a resolution on for that. He said he expects to have one for the appointment of a hearing officer for the Election Day incident. He also 23 JANUARY 31, 2002 RIJRAL wants to put on a resolution approving Rural Metro to provide services NETRO seven days a week. We have been negotiating with them and trying to solve a few more insurance issues, six months with the option to renew in another six months. He then said he wasn't sure if the Mayor and Council saw this letter he received from John Spognetz with regard to a deed that was issued back in 1959 for Lot 5, Block 116. It required the person who bought the property to make some improvements on curbs, sidewalks and gutters. They asked for a t~uick Claim Bed waiving those restrictions because he assumes they are done. He said he wants to put on another Resolution authorizing the Mayor to execute that deed. He then asked if anyone had any questions or if they wanted to take a look at 55-57 Beverly Street. He said he assumed that everything was done. It is kind of late to go back and say it has not. Borough Attorney Robert Bergen said he is assuming that they already put the curbs in and basically they have to accommodate the property that was sold. Councilmember Santoro said that they really want to insure that it is all there. She then asked if they should ask Tony to ride by. Mayor Failace said they must have done the sidewalk and the curb work. RE: RESOLIJTION & Borough Attorney Robert Bergen said he was going to dral2 a DEED FOR resolution and draft a deed for curbs gutters and sidewalks, two feet CURBS, GUTTERS & SIDEWALKS wide. He wanted to speak about the Library Project. He said he spoke about this before, about a negotiation with a company called CCM that are specialist in recovering money on bond. They may be good experts to use in the Library Project. They were successful in a motion to have the case transferred from Morris County down to Middlesex County. He said he thought he might be able to get it moved quicker and have a much better result with a Middlesex County Judge than a Morris County Judge. He said he now put the order in for this week SENIOR LIAISON Councilmember Santoro said they spoke at the last meeting and the Seniors asked about liaisons and who to contact. She said she thinks they were in agreement that in Buildings and G'~unds, which is Councilman Sosnowski, she and Councilman Reiman are going to be the contact. We are going to be setting up a meeting with each group. Borough Attorney Robert Bergen asked the Municipal Clerk about a man that wanted them to do something with the Bus Company.
