NOTED The following were noted present: PRESENT Council President Janet Santoro Councilmember Parisi " Reiman Rios " Sosnowski Noted absent was Mayor James A. Failace, Borough Attorney Robert Bergen a.-d Councilmember Sohayda. Statement of Meeting Notice was mailed to The Home News Tribune, STATEMENT OF MEETING NOTICE The Star Ledger and posted on the bulletin board on February 8, 2002. ADDRESS GOVERNING To Address Governing Body: BODY - a) Carteret Volunteer Fireman's Ladies Auxiliary, Kimberly Pine. b) Borough Engineer Kimberly Pine, Ladies Auxiliary - reported that the President, Bevery RE: K. PINE Hedesh could not make the meeting. She said there are nine members to the organization and we've been solvent since 1997. Lately they have been attending a lot of parades and unfortunately a lot of funerals. They don't have the proper attire for these functions. We came to the meeting in hopes of getting funds from the Mayor and Council eor uniforms. She said she has a quote from John's in Somerset. Councilmember Santoro asked if they could petition the Volunteer UNIFORMS Fireman for funds. Kimberly Pine replied that they are separate from the Volunteer Firemen. Councilmember Reiman asked if they have asked the Volunteers for assistance. Councilmember Rios asked if they had ever given them any money out of their budget. Kimberly Pine said Company #II gave them two hundred dollars to start. Councilmember Santoro asked how much the uniforms were. Kimberly Pine said for nine people it is two thousand four hundred and twenty eight thousand dollars. Councilmember Santoro said the Ladies Auxiliary is basically an off shoot of the Volunteer Firemen and you are in existence because they exist. She said all she is concerned about is setting up a separate fund. We already have a separate fund that goes through them. FEBRUARY 14, 2002 Councilmember Rios said if they were going to fund it they should add it to the Fire Department (inaudible). CONTINUED Councilmember Santoro said absolutely. If they are representing us .. Kimberly Pine asked if they would be funded through the Chief's .-~ Budget. Councilmember Santoro replied that she didn't know and they should wait until the Borough Attorney arrives and a representative from Fire Department. Councilmember Santoro then told Mrs. Pine that she would get back to her. Councilmember Parisi said for nine people the amount is approximately two thousand five hundred dollars. Councilmember Rios asked if that would be for hats, shirts, and blazers. Mrs. Pine said there would be no hats. It would be for shirts, ties, jackets and pants. If it comes down to it we could pay for the belts and shoes ourselves. There is also a badge and (inaudible). Councilmember Santoro asked if she could give them time to check with other towns on how to go about doing this. We just have to see how it is funded. BOROUGH ATTORNEY Borough Attorney Robert Bergen was noted present at approximately ~ NOTED PRESENT 7:05 P.M. Councilmember parisi asked when they would need the unifcrms next. Mrs. Pine replied for the St. Patrick's Day Parade. D. NORBUT ENGINEER'S BUDGET RECOMMENDATIONS: EIIGINEER Councilmember Rios said he though it would be smart to include the electrical wiring (inaudible). Why go through the trouble of putting the pavers on top and when we do put the street lighting .. Councilmember Sosnowski asked if they could just snake it through. Councilmember Santoro asked if the Borough Engineer could possibly give them a price on what they need to do to submit to the UEZ for the upgrades. This is something that the UEZ can pay for (inaudible) so that it will be completed. Councilmember Reiman addressed the Borough Engineer and told him that should be a completed project. The light fixtures, the PVC and whatever the cost would be for the entire project. The Borough Engineer said right now they have a contractor who is more of a general contractor. He is going to go out and hire a general 2 FEBRUARY 14, 2002 sub. Any time you bring in a sub your general contractor is going to (inaudible). Councilmember Santoro asked what they were allowed to do. Councilmember Reiman said we just need an estimate to submit to the State. The Borough Engineer said they can increase the contract up to DISCUSSION (inaudible) can't exceed 20% without it being an emergency or a special reason. He said he wanted to do the cost estimate first to see where that would put us in the contract. Councilmember Santoro asked when the next UEZ meeting was going to be held. She then said she thought it was next week. Borough Attorney Robert Bergen said he would not discuss anything more than that in an Open Session. He then asked the Borough Engineer if he had any conversations with Mr. Grasso with regard to resolving the matter at this amount. The Borough Engineer replied that he the bottom line is if you want to look at the damages (inaudible). Our cost right now, to complete the job, is going to be about seven thousand five hundred dollars. He said he looked at the liquidated damages clause and you can charge him for all of those costs plus three hundred dollars a day. The contract allows for full damage. He d]dn t kno if they wanted to discuss it further but the contract gives you the ability to assess the full liquidated damages. He said his proposal is only to share the cost with him because he is a small local contractor. Councilmember Santoro asked if he was looking for three thousand dollars. At approximately 7:35 P.M., Mayor Failace was noted present. NAYOR FAILACE - NOTED PRESENT Councilmember Sohayda was noted absent at approximately 7:35 P.M. NOTED PRESENT COUNClLNAN 5[}i~fl~ The Borough Engineer replied that he was suggesting that they split the difference with him and assess him with a three thousand dollar penalty but not the full seventy five hundred. Councilmember Santoro asked if they should discuss this in Closed Session. DISCUSSION CONTINUED Borough Attomey Robert Bergen said at this point he would not discuss anything else until they went into Closed Session. He explained that the contract is overdue and we have a right to make a claim. How we go about making that claim should be discussed in Closed Session. 3 FEBRUARY 14, 2002 BOROUGH Borough Engineer said there is a change order for T. Grosso & Son ElqGINEER that he wanted to add to the next Agenda. We found that it wasn't REPORT clear if we wanted to put it on or not. It is not a change in the contract amount it is juggling some quantities around within the contract. Although it is technically a change order it doesn't increase or decrease the contract (inaudible). They are probably going to be under this contract by about twenty thousand dollars. Councilmember Santoro asked why they need a change order. Borough Engineer replied that they sometimes need a little more curbs or a little more handicapped ramps. Councilmember Santoro asked why would they do that while looking at possible damages. Would we award this? The Borough Engineer replied that it would be appropriate to do the change order but not make final payment until this issue is resolved. Municipal Clerk Kathleen Barney said they had no monies. The Borough Engineer said he had a working (inaudible) with his recommendations. He said he has had several meetings with the C of O. and (inaudible) they are broken down by Roads, Sewer or other. He said it is not his intention to go through this in any kind of detail. This also includes the Hill District Storm Sewer Project and other projects that are funded by the one point five million dollars (inaudible) grant. Councilmember Santoro asked what money they have set aside for.. The Borough Engineer replied that the first three items in his report (inaudible) and of that one million dollars we have a good portion of that money from Grants or developers contributions. Councilmember Santoro stated that the first three items we have money set aside to do. The Borough Engineer replied that they majority of the money would probably need to come up with a few hundred thousand dollars to make it work. Councilmember Reiman said the Council funds two hundred fifty thousand dollars in capital improvement projects in last years budget and projected in this years budget and there is about one hundred fifty thousand dollars from last years budget. As the budget stands now there is two hundred fifty thousand dollars in it for this year so that would give us four hundred thousand dollars for capital projects. Councilmember Santoro said then for the first three projects we have funding available. The Borough Engineer replied no because it is contingent upon two things. Number one is that we have a three hundred thousand-dollar discretionary grant that has been sitting for years doing nothing. It is for the Industrial Road Culvert Crossing. He said he is proposing, and that project is years away, that they take that money, add it to the grant FEBRUARY 14, 2002 money that he shows (inaudible) and that should give you more than enough money to complete the terminal and the surrounding streets. We then have item 2-7, a fifty thousand dollar developer contribution for Middlesex, which covers that. Councilmember Reiman asked if that was the White Rose (inaudible). The Borough Engineer replied yes and that is a conservative (inaudible) and maybe we can increase it a little bit. Councilmember Reiman asked if they had a copy of the agreement. He then asked the Borough Attorney if he reviewed it. Borough Attorney Robert Bergen replied that he had to draft it. Is this where they are giving us one hundred fifty thousand dollars? He then asked if they were going to allocate that money .He said he went through the Resolution and you can open it a little bit. Councilmember Reiman said they could use more in with the developers agreement. The agreement calls for one hundred fifteen thousand dollars off side contribution to be used for Road Improvement. This is when they expanded two warehouses. The Planning Board approved the project about two years ago. The Borough Engineer said they would have to see how much we can DISCUSSION utilize for the program. He said all the grant money will fund that portion of the (inaudible). It is the neighborhood rehabilitation program and the overlay program that we are coming up a few hundred thousand dollars short. Councilmember Santoro asked if the Borough Engineer thought that the seven hundred thousand could be covered? The Borough Engineer replied yes. Councilwember Santoro said they would be looking for funding for the four hundred. The Borough Engineer replied that Patrick will have about half of that available. We are still coming up a few hundred dollars short. Councilmember Santoro asked if they were doing anything like they did last year with (inaudible). The Borough Engineer said if they looked at section II, the County Overlay Program, this is relying on a very good rate from the County. That two hundred and fifty thousand would normally be four hundred or five hundred (inaudible). Councilmember Santoro said they could just discontinue them like we did last year. The Borough Engineer said it is a great way to go because you are getting... Councilmember Reiman said if they keep this years budget .. 5 ~EBRUARY 14~ 2002 Borough Attorney Robert Bergen said on the Industrial Road Culvert · ' e where we asked for an extension? Project, ~sn t that th one The Borough Engineer replied yes because the money has not been used in a few years and we need to continually ask for extensions and we've kept up on the extensions ... Borough Attorney Robert Bergen said they need a Resolution to apply to a different project. Is that'what you are planning? The Borough Engineer said what they will do is send a letter to the DOT formally requesting a transfer that will come back and say fine. Council has to pass a Resolution requesting that transfer. Borough Attorney Robert Bergen said if that is the Council's intent, VOICE VOTE they can do a voice vote with authorization for a different project. Councilmember Santoro said they should do that. All in favor? Upon MMS&C, by Councilmembers Reiman and Sosnowski and unanimous affirmative vote of the five (5) members present, the Council passed a Resolution requesting a transfer. (of The Borough Engineer said the bulk of that item, 41 is three and a half million dollars, partially funded through local money and half through DISCOSSION (inaudible) grant. Councilmember Santoro said that had already been set aside and we are going to be moving in that direction. The Borough Engineer said yes. Councilmember Santoro then said that was what they voted on at the last meeting. Councilmember parisi asked how much are they (inaudible) and how much is funded? The Borough Engineer replied half, three and one half million dollars. It is 55% funded through a grant and 45% is through local funding. Councilmember Reiman said they already have money set aside, the 2000 Bond Ordinance. Borough Attorney Robert Bergen said they should discuss that in Closed Session but we need to move ahead with that project. Borough Engineer Don Norbut said that item (inaudible). Councilmember Sosnowski spoke and was inaudible. The Borough Engineer said when they did a walk through the Library, they identified sight improvements and building repairs in excess of forty thousand dollars. 6 FEBRUARY 14, 2002 Councilmember Reiman said they have the five hundred sixty three thousand dollar grant that came in last year for the Library. Supposedly that is not one of the projects that was taken off the table. Councilrrember Santoro asked if they got the actual money. Councilmember Reiman said they had not received the money as yet. Borough Attorney Robert Bergen said, as he understood, that money was pretty secure because it is a separate bond issue. Councilmember Reiman said they can't spend it and even if we get it we may have to pay the bond or amend the existing bond. Borough Attorney Robert Bergen asked the Borough Engineer if he worked on any of those grant applications for the Library projects to RE: GRANT know whether they require the money to be fees or existing bonds. APPLICATIONS FOR LIBRARY PROJECTS The Borough Engineer said he had not. He said he also had in there (inaudible) and that is for the upgrade of the recycling facility. He said he wants to take an opportunity to (inaudible) the entire area. If putting a few concrete pads (inaudible). Councilmember Santoro asked if those (inaudible) bids were sold (inaudible). Are we going to be able to use their money? The Borough Engineer said the demolition money was specifically earmarked through the DCA for demolition, because this is a staging area and because we are going to disrupt the operation he is going to DISCUSSION try and take this opportunity to (inaudible) and use some of that money for that project. He may want some new partitions. He said the court was done and we were recommending a color coding of that. It is a four part painting system. Councilmember Reiman said it was done but it wasn't sealed. The Borough Engineer said it was paved and new posts and backboards are up but it has not .. Councilmember Reiman said if they don't seal it in three to five years it would start to break down anyway. The Borough Engineer said it really tums an ordinary facility to a first class facility. He then spoke about the Policeman's Park and the RE: POLICEMAN'S renderings they did on that. PARK Councilmember Santoro asked how the Policeman's Park went up to one hundred thousand dollars? She said she thought they were talking about forty thousand dollars. The Borough Engineer told Councilmember Santoro that she may be right and he may have the estimate wrong but he knew that there was one option, which had a full height bronze statue. Councilmember Reiman said that was thirty or forty thousand dollars in itself. FEBRUARY 14~ 2002 Councilmember Santoro asked to go back to the Policeman's park. She then asked the Borough Attorney what can Open Space Money could be used for. She said they might as well get this over with so they don't ever do this again. Borough Attorney Robert Bergen said the Bond Ordinance that the Council went out for and the public question that you put before the voters was very restrictive. As far as the wording, you will be restricted to acquisition and probably development of properties that you acquire. You may want to consider going back at another public question to free up some of that money and use it for a number of these projects. Councilmember Santoro asked if they could use it to create a new park. Borough Attorney Robert Bergen said they could under the State Statute. The questions that was offered to the voters and he has to get the exact question that the Municipal Clerk sent out, and see if it is any different then the Ordinance that was passed and the actual language that was used. He said he can see how the Ordinance was passed and it seems more restrictive than the .Statute allows you to go. You have to give the voters another opportumty.. Councilmember Santoro said if they change it out to the voters would they be allowed to gain access to money that was already put aside? Borough Attorney Robert Bergen said he thinks they would because they would draft a question to say can they use the money for that purpose so that would be the intent of it. Councilmember Reiman told them to keep in mind that they are going DISCUSSIOII to need a significant amount of money for the Waterfront because you can't use the money for any other purpose. Councilmember Rios said if they can't do it now in the interim and we do place questions on the voters (inaudible). Borough Attorney Robert Bergen said they may have misunderstood him. His initial opinion is that you can't use it for maintenance. Councilmember Rios said he understood that but you are saying that (inaudible). Borough Attorney Robert Bergen said no, not until the voters actually approve alternate uses for that money. Councilmember Rios asked if that was done two or three years ago. That was more or less written with the State Statute guidelines. Borough Attorney Robert Bergen said the state provides about five alternatives for which you can use the money. It appears when you drafted the Ordinance and put the public question out, you only included two of those options. FEBRUARY 14, 2002 Councilmember Rios said State Statute would not supersede that being that (inaudible). Borough.Attorney Robert Bergen replied no because the Statute gives you the choice of asking (inaudible) five different reasons but you only asked the voters for two of the permissible five so that is all they approved. Councilmember Santoro asked what they had to do to adjust this because they need to have more access to be able to improve our parks PARK IMPROVEMENTS and (inaudible). Does it have to be a November Election or could it be a June election? Municipal Clerk Kathleen Barney replied that it had to be a November Election, a General Election. Borough Attorney Robert Bergen said if that is what you really want to do you need to really take a closer look at the Statute. He said he thinks he can give them the interpretation under the Statute that you could use the money more than you can use it now but there may be some cases out there that may be restrictive only to maintenance of the new facility. The Statute basically allows you to use the money for acquisitions and improvements. You can have an interpretation that says improvements are to the properties that you acquire with that DISCUSSION money or you can make an interpretation that you can use those improvements for previously acquired properties. He said he will give them the opinion both ways but he has not searched the caseload to see if there is a case that has already been decided. Councilmember Rios asked if two weeks would be sufficient for him to (inaudible). Borough Attorney Robert Bergen said yes, unless you have another use for the money. Councilmember Santoro said they should put these three items on hold until they find out what they are doing with this money. The Borough Engineer said the John Street Park in the Borough has RE: GREEN ACRES some Green Acres property down there that is really underutilized. PROPERTY They can bring some topsoil in and re-grade the area and seed the whole thing and possibly use it as a soccer field. Councilmember Santoro asked if the Borough Attorney said that was Green Acres. Would the County be responsible for kicking in any money to help us? The Borough Engineer said no. He said he believes it is the responsibility of the Borough since it is Borough's property and on the (inaudible). Councilmember Reiman said at one point John Spognetz said they swapped Green Acres property. Councilmember Santoro asked why Green Acres was the Borough's total responsibility and not go to them for money for improvements. FEBRUARY 14, 2002 Borough Attorney Robert Bergen said Green Acres is just the funding mechanism, the property still belongs to the Borough and you will DISCUSSION (CON' T) generally have an obligation to maintain Green Acres property. They GREEN ACRES probably come in and do an annual inspection and sometimes they give you a list of things they want you to do because you are not maintaining that property adequately. If they fund the money and it becomes part of the Green Acres inventory, is it their responsibility to maintain.. Councilmember Santoro asked if they could go back to them for any kind of funding. Borough Attorney Robert Bergen said they could always go back for GRANT APPLICATION another grant application. That might be something you want to look at with all the park programs, if you put them all together and make one Green Acres Grant Application to fund a number of Park Improvements. The Borough Engineer said although we are proceeding with the Storm Sewer Improvements and a possible pump station in the Hill RE: STORM SEWER District to alleviate local flooding problems the DEP is still on our IMPROVEMENTS case as far as what they believe are some sanitary sewer problems. There are some other related problems as well. They are pushing for that sanitary sewer system to be addressed. Killam had done a study to identify I/I in the system and really did not come up with a lot. However there are still some problems that need to be looked at. Now that we are finishing the suspect area project it is going to be top on the DED list. They really need to do work in that area. Councilmember Par/si said he had no idea what I/I means. Borough Engineer said I/I is Infiltration and Influx and ICI are illegal connections. Borough Attorney Robert Bergen said they should not use the term questionable connections anymore. He said he wasn't sure they were illegal connections and they should discuss this in Closed Session. We have a case against us from the DEP with regard to these so he doesn't like to say these things with regard to (inaudible). The Borough Engineer said at this point the suspect sewer area is done and we are really speaking about (inaudible). Councilmember Santoro once again asked to go back to funding. The Borough Engineer said her question was with regard to .. RE: IMPROVEMENT Councilmember Santoro said three million dollars is what they have in FUND FOR HILL the improvement fund for the Hill District. The (inaudible) had some DISTRICT money put aside .. ~ The Borough Engineer said the current suspect area project is about a five hundred thousand dollar project. Half of that is funded through the EPA Grant and half is being funded through local monies that were appropriated in the 2000 Sewer Bond Ordinance. That project is 10 FEBRUARY 14, 2002 considered fully funded and monies encumbered (inaudible) but that is not fully funded through the 2002 Capital Program. Councilmember Santoro asked what projects are being put against those funds. The Borough Engineer replied the Suspect Area, which is five hundred thousand dollars and the (inaudible) that was just pointed out. The projects that make up the EPA Grant Project are item, 4.1 and item 7.4, which is the Hermann Street Sanitary Sewer. Councilmember Santoro said on the other project (inaudible) fund.. The Borough Engineer said all of these projects would be locally funded though monies that are available through (inaudible). Councilmember Reiman asked if that was a capital loan or (inaudible). The Borough Engineer said for the most part anything he has listed under item seven can be funded locally through (inaudible). Councilmember Reiman said they have monies available. Keep in DISCUSSION mind the two hundred forty seven thousand dollars that came in last year was part of the settlement from UNOCAL. We also have, by increasing the commercial industrial sewer fee, which we already did, RE-' SETTLEMENT is going to generate a potential three hundred thousand dollars so we FRON UNOCAL have five to six hundred thousand dollars available from municipal projects. Councilmember Santoro said the three hundred thousand dollars that was (inaudible) was supposed to make us (inaudible). She said she remembers in that report when they did the assessment, was just to keep us even instead of going in the red. So where are we generating... Councilmember Reiman said last year they were projected to have a one hunched fifty thousand dollar deficit and there was no deficit. We were ahead in addition to the two hundred forty seven thousand dollars. As it stands, the MCUA thought we were going to be in a hole. Councilmember Rios said that he was talking about the money that was generated from (inaudible). Councilmember Reiman said it will be retroactive until January 1st and a portion of the money will be (inaudible) until the first of the year. The Borough Engineer reported that the Roosevelt Avenue Pump ROOSEVELT AVE. Station is the main pump station. It sends all the sewage to PUMP STATION Woodbridge. They talked about an annual emergency service contract MAIN PUMP STATIOI~ that will be allocated fifty thousand dollars (inaudible). The Hermann Sanitary Sewer Replacement is in an existing (inaudible). In severe wet weather it does not have the capacity to handle the flow. He said number five is a wish list item and that is a TV camera put in so that the Sewer Department can investigate their own problems. With the new Jet-Vac Truck and the TV camera we'll be in good shape to do a lot of investigating and cleaning. 11 FEBRUARY 14~ 2002 Councilmember Reiman said he thought they signed that with the County and we can borrow those. The Borough Engineer said the feedback was tested out and it was a very small lateral camera on a main line camera (inaudible). ENGINEERS STATUS REPORT: EIqGIIqEERS REPORT 1. Road Improvement Projects a) Milik Street Rehabilitation - Project work is approximately 75% complete. The project has been winterized and has been shut down until April 15, 2002. b) Washington Avenue Streetscape - Contract work is complete. Diamond Construction has agreed to install concrete pavers between the curb and sidewalk. It will be in a similar type and pattern as around Borough Hall. c) Carteret Avenue Pedestrian Improvements - the concrete work is substantially complete. A deficiency list has been prepared and sent to T. Grosso & Sons. The deficiency work is weather dependent and will be completed in April 2002. d) 2002 Road Improvement Program - He said he has pre'oared the 2002 Capital Improvement Program recommendations. The recommended road program is approximately one million dollars. II. SANITARY SEWER PROJECTS SAfllTARY SEhlER PROJECTS a) Suspect Area Sewer Separation - the work is approxirn~tely 85% complete. To date approximately fifty illegal connections have been disconnected from the storm sewer and properly reconnected to the sanitary sewers. Final work is scheduled for Spring 2002. b) Harrison Avenue Pump Station - a preconstruction meeting was held for the replacement of the Harrison Avenue pump station. The contractor is A&J Construction and the value is two hundred fifty thousand dollars. It is a 180 day contract and the completion date is July 2002. c) Roosevelt Avenue Pump Station a preconstruction meeting was held for the pump station rehabilitation project at the main pump station. The contractor is Standard Industrial Services in the amount of one hundred fifty- four thousand four hundred dollars. d) Sewer Treatment Plant Demolition - preconstruction meeting was held for the demolition of the old sewage treatment plant. The Contractor is Double Edge Contracting and the amount is one hundred ninety thousand dollars. It is a 120 day contract. Councilmember Rios said they should have that done in no time because they are using Union Laborers, correct? 12 FEBRUARY 14, 2002 The Borough Engineer said they have not done the insurance certificate quite right so we are holding off a little bit. Borough Attorney Robert Bergen asked if Double Edge is the contractor. ENGINEER' S The Borough Engineer replied yes and they have worked with REPORT (inaudible) to a good extent in allowing the Recycling Facility to be CONTINUED (inaudible). They are not planning to make any additional costs based on (inaudible). WATERFRONT III. WATERFRONT PARK PARK a) Phase I, Fishing Pier - We have been coordinating the activities of Maser Consulting as requested by the Council. Maser has completed preparation of design plans and specifications for Phase I of the fishing pier project. A series of deduct alternates have been added to the contract so the Council will have the ability to remove various items for the contract prior to award. The engineer's estimate is approximately 2 million dollars. Borough Attorney Robert Bergen asked if the contract provides for delay as to providing access for each day that we may need an easement or access agreement that the contract is going to provide for the contractor to hold his price and (inaudible). Borough Engineer replied yes. b) Temporary Construction Easements - they are working with the Borough Attorney to obtain a temporary construction easement across Block 4, Lot 1 so that large construction equipment can access the fishing pier for demolition and construction of the new pier. c) Parking Lot Acquisition - there is an existing parking lot at the fishing pier site at Lot 1, Block 4. The Borough had planned to acquire this lot from the property owner to provide vehicle parking and boat trailer parking for the Waterfront Park. d) Permanent Access Easement - the Borough Engineer said he has begun to research the status of the permanent site access easement. It is thought to exist across adjacent Block 5.02, Lots 1.01 and 103. He said he understood the Council has authorized New Jersey/New York Baykeeper to submit an application to the Green Acres Program. e) Phase II, Passive Recreation Area - by authorization of the Council, they have prepared a Green Acres Development Application for a low interest loan and grant up to five hundred thousand dollars for the Phase II of the Passive Recreation Area. Application is due February 15, 2002 and the notice of the grant award is scheduled for June 2002. There is a policy that once the permits have expired you must reapply. Councilmember Reiman asked if they would fast tract that because we have existing permits. 13 FEBROARY 14, 2002 The Borough Engineer replied yes because typically, it is a ninety day process along with sixty days to secure those properties. Councilmember Reiman asked if they are taking in the bids on March 4th SO we call award them. Do we have thirty or sixty days to award them? The Borough Engineer said sixty days. Councilmember Reiman said they should be able to secure those permits. Councilmember Santoro asked if he filed for the permits or will you file for them? The Borough Engineer replied yes. He just want to let them know that he will go ahead and prepare them. 1V GENERAL ITEMS GENERAL ITEMS a) Roosevelt Avenue Bypass, West Carteret - as requested by Council they have outlined a concept plan for re-routing track traffic around Roosevelt Avenue in West Carteret. We had a meeting scheduled with the County but we are going to push that back for a week or so until the Woodbridge people can come up to date on the concept. b) Recycling Facility Upgrades - the Borough's Recycling Facility will need to be relocated on-site for demolition of existing structures. c) Turnpike Authority, Interchange 12 Improvements - he said he also wanted to report that the Turnpike Authority, as far as Interchange 12 improvements, they have been soliciting proposals for an environmental assessment phase which is the next step in the improvement project. The Borough Engineer said he wanted to keep a close eye on that. Councilmember Santoro said at their last meeting (inaudible) they said they did do the meeting at the (inaudible). Borough Attorney Robert Bergen said it is only the first days and if they don't find any problems you go to the next phase. d) Industrial Road Extension -the borough was awarded a "high priority" TEA-21 Grant in the amount of two million dollars approximately seven years ago to design the Industrial Road Extension just south of Middlesex Avenue to the Carteret/Woodbridge boundary in the vicinity of the Staflex Products site. The Borough Engineer said that was only a partial grant and there was also money needed to complete the extension from Woodbridge to Port Reading Road. There are a lot of environmental constraints back in that property. There are property acquisitions to take place. They 14 FEBRUARY 14~ 2002 have received inquiry from the North Jersey Transportation Planning Authority. They track funding and they are looking for an update. He said he can give them some of the information. He said he really put this on to remind all of them that we have it there and he is sure they ENGINEERS REPORT are going to be looking for us to show some progress (inaudible). CONTINUED Councilmember Santoro said when they meet with Woodbridge in West Carteret, we can also ask them to (inaudible). They just need time to (inaudible). Mayor Failace asked if anyone had questions for the Borough Engineer. (Councilmember Parisi asked a question that was cut off the tape). You just have to make some minor adjustments to the funding but the dollar amount will be the same. Councilmember Parisi asked what that was about. 15 FEBRUARY 14, 2002 Municipal Clerk Kathleen Barney said Community Development. Mayor Failace said eighty-eight thousand dollars in the Block Grant. That is how the Community Development Board chooses how to split up the funds. Then we got another thirty thousand dollars in and there was a letter sent to everyone on the Board and the Council also got a copy. Councilmember Rios asked what they were doing with the additional thirty thousand dollars. Mayor Failace replied that they were putting more money into the bus, we are cutting handicapped curbs and the Fire Department requested some breathing apparatus. Councilmember Reiman said they also put some in the Children's Community Garden that was approved last year. 8. Professional Services - Hodulik & Morrison, not to exceed two RESOLUTION thousand dollars, Re: Extraordinary Aid and REAP Application. Councilmember Reiman said that was the same thing as last year. Mayor Failace said they have to fill out all the paper work for the extraordinary.. Councilmember Parisi asked what REAP was. DISCUSSION Councilmember Reiman said Regional Efficiency .... Municipal Clerk Kathleen Barney replied that it was the Regional Efficiency Aid Program. Mayor Failace said beside the aid that we get from the State there is also the extraordinary aid that we apply for which is six hundred thousand dollars this year. Councilmember Reiman said the Regional Efficiency Aid Program is where we did the share services with the County and we saved several hundred thousand dollars. So the State rewards us for saving the tax payers money. Mayor Failace said they get money back for that, any shared services with other communities. COMMUNICATIONS COMMUNICATIONS: ll. Borough Attorney Robert Bergen said he had the Ordinance. We already advertised it and certain notices have to go out so we can put the final adoption on. REPORTS: REPORTS 1. Inspection of Buildings - January 2002. 2. Office for the Disabled - 2001 Annual Report. MATTERS FOR DISCUSSION: MATTERS FOR DISCUSSION 1.NJ BOP - a) Appeal, Re: Truck Driver. Mayor Failace said they should discuss this in Closed Session. Councilmember Santoro asked why they just re-post for now? Municipal Clerk Kathleen Bamey said she just wanted to check what their time is to see if they have a year. b) Certification of Eligibles for Appointment - Police Sergeant. Date of Disposition: 5/7/02. Councilmember Santoro said they hired off last year's list and this is for certification of the list once the top person was removed. Mayor Failace said they have a new list. COMMENTS Councilmember Santoro said this is really the same list, it just moved everybody up. We interviewed and we are going to be making a recommendation of number one. The Police Committee is going to make the appointment of Sergeant. Mayor Failace asked if they had an opening for Sergeant or are we adding. Councilmember Santoro said they should discuss that Close Session. 2. Kathy Dean - Request for resolution requiring proof of citizenship for voting. Borough Attorney Robert Bergen said he could draft a resolution supporting this but he is still trying to get more information on what the County does. Councilmember Reiman said he was opposed to the Resolution. He thinks they are now infringing upon freedom and rights. You already have to show I.D. to pick up mail with security but to suggest that a person needs I.D. to vote or to register.. Councilmember Rios said he thought she had a valid point. 17 FEBROARY 14, 2002 Councilmember Santoro said she is just asking for verification that you are a citizen. Mayor Failace said not that she doesn't has a valid point but he called the County to find out and they are supposed to do whatever needs to be done. COMMENTS Councilmember Santoro said all they were really asking is that the proper thing be taken to ensure .. Mayor Failace said he just did not want to open a lawsuit for somebody and he worries about that. Councilmember Santoro said she d~dn think they were ready to pass a resolution or to do anything until we get more facts from the County and possibly what we can do. She said she didn't think it was a bad idea. Mayor Failace said he did not disagree he just didn't think we should jump into it. Councilmember Santoro agreed and said she thought they needed more time to be researched. Once we find out more we can take another look at it. Borough Attorney Robert Bergen said he thinks the notion is that it is a self regulated system and there are probably not too many illegal aliens that are running to register to vote. Councilmember Rios asked how much was it monitored and how much is it enforced as far as people registering to vote? He said he could lie and say he was bom in this country. Mayor Failace said when the time comes we can certainly support something to that effect. They need to be more stringent in they're (inaudible) and that we support something to that effect. Borough Attorney Robert Bergen said he is sure that everyone heard the stories about people registering from the grave yard. MATTERS FOR 3. Division of Alcoholic Beverage Control - ABC Violation, Re: B&B DISCUSSION Lounge. CONTINUED Borough Attorney Robert Bergen said they have three others, do we need a Special Meeting? We'll have to do it in March. He was told there were more coming so we'll do them in one shot. He said this one he has not even seen. He said there are no statute of limitations on these and he knew he was doing a new round of investigation. 4. Gloria Goodrich - Request from Tariff Billing Specialists, Corp. to do telephone audit. Councilmember Reiman said the Finance Committee met last year with Tariff Billing and what they do is come in and go through the last three years of your phone bills and if they could find a savings they will literally go through all the phone bills all the phone numbers and 18 FEBRUARY 14, 2002 the lines that you pay for. There is no cost to the Borough and if they find that the phone company over billed you they receive 50% of whatever the phone company reimburses you. If they find ten thousand dollars worth of billing errors we have to pay them five thousand dollars after we get the money back from the Phone Company. Borough Attorney Robert Bergen asked if they received a proposal from them. 5. Stanley Relford Adjustment of Employment Dates. MATTERS FOR DISCUSSION - Borough Attorney Robert Bergen said they should look at some older CONTINUED contracts to see if anything was different then what you provided. 6. Councilmember Reiman said this was the basketball insurance that RE: BASKETB4LL he talked briefly with Run about. He said he had Patrick do some PROGRAN quotes. There is a new basketball program in the Borough but not run through the Borough. It is run through a group of kids involved here. They are eighteen years old and older. They run a boys basketball league for kids under fourteen. We looked to see what it would cost the Borough to insure them through the Borough's Recreation Program. The insurance would cost three hundred dollars for the year. That would insure them whether they play in the park or (inaudible). Mayor Failace asked if they would be insured under our policy.. Councilmember Reiman said they are not insured through the Borough. Councilmember Santoro said one of the questions that came up, and this goes back a couple of weeks, is can we just have a policy set aside for the Borough when groups come forward and what criteria we're going to use to have them fall under us. She said this is something we need to decide as a Borough. She then asked if there certain certifications they require? Borough Attorney Robert Bergen said your insurance is going to cover those facilities and programs that are run by the Borough. If there is a question about that it is always better to get additional endorsements. Councilmember Reiman said that is why the additional rider or endorsement would be three hundred dollars. Borough Attorney Robert Bergen said if you let them (inaudible) on a Borough piece of property and they got hurt there the property would cover it. If the issue became that the coach might have done something wrong (inaudible). Councilmember Reiman said that his understanding is that the School Board ha~ agreed to allow them to use one of the school facilities, the gym, to practice. Councilmember Santoro said the School Board allows anybody to use their facilities if they are insured. Not that they are saying this is okay if we insure them. You have to basically say what criteria we are going to use and how do we do this. 19 FEBRUARY 14~ 2002 Borough Attorney Robert Bergen said he can give them a simple resolution that sets a policy in place and to those private organizations that you intent to come onto Borough property and conduct events that they have to give you proof of insurance. Councilmember Santoro said that is not it because we're not asking them for insurance. What happened is the School Board rents out their facility and requires insurance. This group has come to us to get insurance and we don't have facilities to allow them.. Councilmember Reiman said they insure Sportsman and Little League and he did not see the difference between them. It is a minor cost. Councilmember Santoro said the Sportsman has certain regulations that they fall under, Little League, Girls Softball.. Unidentified person asked who paid for the insurance. Councilmember Reiman said that was a good question. He then said that the Borough pays the insurance. · ~' Unidentified person spoke again but was inaudible. DISCUSSION Borough Attorney Robert Bergen said they need to set up a committee CONTINIJED and figure out what criteria that you want to make to determine what groups are going to become part of the Borough's insurance program. We have to draft a policy to put that in place. Mayor Failace said there are a couple of things and what Councilmember Santoro is saying is that we need to set a policy saying that if your covering (inaudible). We are saying that we need them to (inaudible) and this is completely different. What Councilmember Reiman is talking about is they are not insured and we are covering them under our insurance. He said he was not sure how they set this up but when we say, and he has no problem with three hundred dollars because it is not that exactly, but if we do this we have to be careful what we are setting up. What if another group wants to come in and say okay now are we going to pay for them or are we going to okay this ... Councilmember Reiman said the criteria should be pretty basic. Mayor Failace said that was what he was saying. Councilmember Reiman said 501C3 organizations are registered with this National Traveling Basketball Association Program. This is a Statewide and a National Program.. Councilmember Santoro spoke and was inaudible. Councilmember Reiman said he thought they should.. Mayor Failace said then it becomes a Borough function. 20 FEBRUARY 14~ 2002 Councilmember Santoro said it is going to be a Borough function once we insure them. Borough Attorney Robert Bergen said if you are going to provide some insurance for them you are going to have to provide some type of sponsorship with the notion that they are Borough approved. Mayor Failace said that was fine and we should do just that. Councilmember Santoro said it should funnel through Parks and Recreation. Mayor Failace replied then it would be part of the Borough's Recreation Program. Borough Attorney Robert Bergen said there are a number of ways you can do it. You can require them to go before (inaudible) and ask them to approve it before it comes here. You can have the request come before the Council so they are policy decisions that you need to make here as a Council. How do you want to approve them? We can sit down and talk about what criteria you want approved. Mayor Failace said that might be how we set that up, that it comes before the Council. Someone is planning on doing this, setting up a league.. Borough Attorney Robert Bergen said this way you can contact your DISCBSSION insurance carrier and find out if they have any restrictions as to what actually is a Borough Organization. Do they require 70% of the kids that play be from town or 25% of the kids to be from town. What is the criteria you want before you incorporate them into your group. Councilmember Parisi asked what percentage of these kids are from out of town? Councilmember Reiman said it is his understanding that the entire team lives in town. Councilmember Santoro said again, if this goes through our Parks and Recreation these are the things that would be answered. Borough Attorney Robert Bergen said the recreation ones are going to be the easiest for you to do because the majority of kids from town and the more difficult problems you may have is a Sportsman Club. Councilmember Rios said it is for the kids. Borough Attorney Robert Bergen said he thought they can you just have to check with the insurance company wants an extra three hundred dollars and it is much cheaper to pay that amount than to have him fighting six months from now if it is covered or nor. This way it is covered~ Councilmember Reiman said the rider they put together includes a traveling basketball team. 21 FEBRUARY i4, 2002 Councilmember Parisi said not that it matters, but it is a girl's basketball team. Is that the same thing or is that a whole different thing? He just want to be sure it was the same team. Councilmember Relman said it is a boy basketball team, 14 years old and under. Councilmember Santoro asked if they should have Bob Kately go over it or not? Mayor Failace said for this we should certainly have Bob look at it. Councilmember Parisi asked if they could do some kind of resolution that is okay with this. We give them this three hundred dollars but at the same time they have to fall under the restrictions of the t'olicy that we will be setting in the near future. They are not separate. He said he didn't know if that could be done. Councilmember Santoro said why couldn't he review this in the mean time? Councilmember Rmman said they dldn want to hold up the program. Councilmember Parisi said they have to understand that when we get DISCUSSION the policy done they are covered under that. CONTINUED Borough Attorney Robert Bergen asked who they are. Councilmember Reiman said Central Jersey Basketball Association. CENTRAL JERSEY That is the name of the group that is registered. He said all he knew BASKETBALL was that it was a bunch of kids, primarily from the Chrome area who ASSOCIATION last year (inaudible). He said he was able to put together shirts and shorts that were donated and the Bus Company. Borough Attorney Robert Bergen said that Central Jersey group is pretty standard. They have rules and regulations and by-laws for the members who participated. Does the Borough have a Chairman or someone here who can take a look at those rules and regulations and see that they comply? Councilmember Santoro said that would be Bob Kately. Borough Attorney Robert Bergen said they should contact him and see if they could quickly get the rules and regulations of their organization so there is nothing discriminatory in them or nothing abusive in them. Then we'll adopt them and say that we will provide insurance provided they live up to the rules and regulations established by their league. In the future we can do something else for everybody else. That may be something to work on, how to regulate those groups. He said he could draft something but he needs some guidance on who you want to make it based upon. The percentage of people that live in town other than what rules and regulations would largely be based upon policy decisions and when do you want to support an organization that is not fully run by your town but contributes to your town, gets the kids from town involved and does some things to benefit them. You have to go on what feels right and what seems reasonable. 22 FEBRUARY 14, 2002 Mayor Failace said he thought they could do that and he thought they should approve the three hundred dollars and get the insurance and let them do it. He said he didn't think they were setting any prescient. Councilmember Parisi said he hoped they were right .. Councilmember Santoro said she thinks if Bob Kately looks at (inaudible).. Mayor Failace said he didn't think doing this obligated them. Borough Attorney Robert Bergen said this is an individual request that comes through the Council. You reject the ones you don't want and accept the ones that you do want. If you want to set a policy it is largely going to be based upon that. You can sense what you do and don't want. Mayor Failace asked Councilmember Reiman if there was anything else to add. Borough Attorney Robert Bergen asked if they wanted him to put together a policy for those private organizations. Mayor Failace said he didn't think they needed to rush. Borough Attorney Robert Bergen said with Borough property, you want to make sure those private organizations that come to you and DISCUSSION ask to be put on there is a policy that says (inaudible). Do you have people come to you and ask to have a picnic in the Borough Park? This is why I see in the summer time the do it quite a bit. Mayor Failace said he has had family picnics in the park with 100 PARK PICNIC people. He said he thought those types of things were covered under INSURANCE our insurance. Borough Attorney Robert Bergen said if just a family goes there and has a picnic generally they are .. Mayor Failace said he meant an extended family. Borough Attorney Robert Bergen said your insurance company may dispute it if they are completely private organizations. If somebody slips and falls on the property on the property you are covered for that but if somebody from that organization start to fight among themselves.. Mayor Failace said the citizens call up all the time and say they want to use the park for June 23rd, for a family picnic. He said he always assumed they were covered. We do it all the time. Borough Attorney Robert Bergen said you probably are with regard to the use oi the property just so long as it is an informal gathering. If you start to allow your properties to be used all the time by private organizations the insurance company may say no we're not going to provide coverage because that is not a Borough sponsored event. 23 FEBRgARY I4, 2002 Mayor Failace said if a business in town wanted to use the park .. Borough Attorney Robert Bergen said for example the VFW wanted to have an affair for which they wanted to bring people from all over New Jersey and they want to come and use your park and come and ask permission. Do you want to dispute with your insurance carrier as to whether or not they are covered or not? Do you want tO guarantee that they bring their certificate of insurance? Councilmember Reiman said he a few other thing to speak about. Last year they talked about auctioning off some of the Borough owned property and we looked at a potential sale. He said there were RE: PARK approximately 16 vacant lots and maybe a few buildings that we need INSURANCE to .. Councilmember Santoro said they should set up a Finance Committee Meeting. She said the need to review the lots and then come back with a recommendation to the Council. She then asked how many.. Councilmember Reiman said they delineated lots last year. We'll sit down as a committee and go through it. Councilmember Santoro said maybe they can sit down and go through it and see what we want in (inaudible) and how many we want released. Councilmember Reiman said the only other thing he has is for Close Session. Councilmember Santoro said she had something for open in reference to Blue Collar Workers and the adjustment of salaries. Paul Mercatanti is still going to come down. He thinks he approves it but he wants to make sure everybody is okay and on board with it. We are going to meet with them and the White Collar Union. She said there was a question about what they had adopted last year. Borough Attorney Robert Bergen said he would like her to discuss this in Closed Session. Councilmember Rios asked if they had a job posted for Parks Laborer. Councilmember Parisi said he didn't know if he should go Open or Close Session because he wants to speak about Umpires and Little League. We have a situation that we are trying to rectify. We have a new person to put on, he is the head of the umpires and one of the issues that came up in conversation was that the Borough pays for the umpire. They get money taken out and everything like that. We found that other towns do it differently. We are trying to figure out if we can do the same thing. He said he wanted to talk about that if there was a way we could. Councilmember Rios said he spoke to Patrick DeBlasio on that and he assumes that certain communities are paying their umpires a flat fee without a tax deduction. For instance, they are giving it to the Community and say Carteret would then give it to the Little League is 24 FEBRUARY 14, 2002 giving $10.00 per umpire donation the Little League (inaudible). without a tax deduction. Mayor Failace said if they were going to do that do we still control the hiring etc. Councilmember Parisi said he would like to think they would control it but that i:, .a very (inaudible). Councilmember Rios said he would assume that Bob Kately would have to answer that one. Borough Attorney Robert Bergen said if you hire them then you are going to have to pay them because they could come back later and say they were not paid. If you hired them they will come back to you with the question if they got paid what they should have gotten paid. He said he can't see why they can't be paid with a voucher. He doesn't know why they have to be paid through payroll. Any deductions they have they record it themselves. Many times you hire people by separate voucher rather than a payroll check. Mayor Failace asked if they get a 1099. Borough Attorney Robert Bergen said he had to speak with Patrick DeBlasio. He said he wasn't sure if he has to or if the money is so minimum it is their obligation to report it. DISCUSSION Councilmember Padsi said the only thing he has is some thoughts on the Office of the Disabled about some curb cuts specifically between Hermann and Washington Avenues. In researching it he was told that in some cases we could go out to single contractors to look at certain parts if we want to. They were also discussing more visible side crosswalks specifically by the High School. He said he knew they were trying to address that anyway.. Mayor Failace said he should speak to John Riggio about that because there is always some funding available. Councilmember Santoro said that the Mayor put in a request about the letter for the tree person. Mayor Failace said they need a representative for a County Committee. He said he sent it to the Council President to choose somebody. Councilmember Santoro said she would talk to Councilmember Rios about it and then we'll have it for next weeks meeting. She said the other thing was that they did meet with the Senior Citizens Buildings & Grounds Committee. We met with one group and we'll meet with the second group and take care of a lot of the questions that they have. Councilmember Rios said he had something for Close Session and he would like to leave right after that. 25 FEBRUARY 14, 2002 RESOLUTIOIt ~02-81 RESOLUTION #02-81 was introduced by the Mayor and referred to CLOSED SESSION the Council for action Upon MMS&C, by Councilmembers Reiman and Santoro RESOLUTION #02-81 "RESOLUTION TO GO INTO CLOSED SESSION" ADOPTED was adopted. Councilmember Reiman said he had a letter that came in from Jack Fazekas. He is offering to help us through some of our technology with computer problems, to help oversee the web page. He is going to CO[il'lENTS more or less volunteer his time but we need to give him permission from the Council to be the contact person for Comcast. Councilmember Santoro said at the same time they don't want him incurring any expenses. Councilmember Reiman said he agreed with that. He is also requesting a budget, not for him but to .. We have the money set aside. Mayor Failace asked how much they were talking about. Councilmember Reiman said about $2,000.00. Municipal Clerk Kathleen Bamey said about $1,000.00 to get the software. Councilmember Reiman said it is not like we are paying him it is the computer expenses Councilmember Sohayda said he was tiding around town and he found some men pouting concrete and working on a house without ~* building permit. He denied that he was a contractor but had some very intricate equipment and tools. Councilmember Sohayda said the man became very belligerent so he called the Police. What he wanted to know was if that was the proper procedure. Mayor Failace said absolutely. Borough Attorney Robert Bergen said the police could enforce any Ordinance. 26 FEBRUARY 14, 2002 Mayor Failace said he was on the Council when Charlie Nagy got him. He said he thought if you build something less than a 10xl0 you don't need a foundation so in turn he didn't think he needed a permit. Councilmember Parisi asked if they were doing anything with Channel 36. Municipal Clerk Kathleen Barney said that is part of what Jack Fazekas is (inaudible). Borough Attorney Robert Bergen said this property is going to be used RE-' HEAD START for the Head Start program. They are going to be sending over the PROGRAN deed and it requires them to use it exclusively as a Head Start Facility and if not, it reverts back to the Borough with any improvements. It is subject to all development regulations and any governmental approvals and federal, state, and local rules and regulations. Councilmember Parisi said on these requisitions, isn't the first person supposed to be the chairperson of that committee? Mayor Failace said he didn't know if that was a rule but it has to be done. Although any three Councilmembers can sign .. Councilmember Parisi said in his department he would prefer that he at least sign one of them. Borough Attorney Robert Bergen said they should take a look at that Ordinance because he doesn't know why they have four people signing those things. You could make it the Department Chairperson, it seems to make the most sense.
