RESOLUTION NO. 99.66
RESOLUTION OF THE LYNWOOD REDEVELOPMENT AGENCY
APPROVING THE SECOND FIVE YEAR AB 1290
IMPLEMENTATION PLAN IN ACCORDANCE WITH SECTION
33490 OF THE COMMUNITY REDEVELOPMENT LAW, AND
MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH
WHEREAS, the Lynwood Redevelopment Agency (the "Agency") is
a community redevelopment agency organized and existing under the California
Community Redevelopment Law, Health and Safety Code Sections 33000, et
seq. (the "CRL") and has been authorized to transact business and exercise the
powers of a redevelopment agency pursuant to action of the City Council of the
City of Lynwood (the "City Council"); and
WHEREAS, the Agency is engaged in activities necessary and
appropriate to carry out the Redevelopment Plan for each of the Redevelopment
Project Areas in the City, including the following: (i) the Alameda Redevelopment
Project Area, and (ii) the Project Area "A" Redevelopment Project Area
(collectively, the foregoing Redevelopment Plans and Redevelopment Project
Areas are herein referred to as the "Redevelopment Plans" and the "Project
Areas"); and
WHEREAS, the California Legislature by Assembly Bill 1290,
Statutes 199, chapter 942 ("AB 1290"), amended the CRL, and particularly in
relation fio this Resolution, Section 33490 was added to the CRL, and the
Legislature by Senate Bill 732, Statutes 1994, Chapter 936, as supplemental
legislation to AB 1290, made minor modifications to Section 33490 provides in
part that prior to the end of 1994 every agency was required to prepare,
consider, and adopt an implementation plan for each project area (and such
legislation permitted one implementation plan for two or more project areas); and
WHEREAS, in 1994 by resolution of the Agency and in conformity
with the requirements of CRL Section 33490 (a), the Agency approved the "AB
1290 Implementation Plan' containing specific goals and objectives of the
Agency for the Project Areas in implementation of the Redevelopment Plans,
including potential projects and estimated expenditures then proposed to be
made during the next five (5) years of said plans ("Implementation Plan");and
WHEREAS, CRL Section 33490 (a) requires that the
Implementation Plan be prepared each five years thereafter from December 31,
1994 and that the Agency notice and hold a public hearing to receive testimony
of all interested parties on the Implementation Plan for the project Areas and
evaluate the progress of the Project Areas and implementation of the
Redevelopment Plans; and
WHEREAS, after review and evaluation of the Second Five Year
AB 1290 Implementation Plan by the Agency staff and after making the Second
Five Year AB 1290 Implementation Plan for All Project Areas available to the
public and providing to the public the opportunity to review and comment on
such plan and, on December 21, 1999 the Agency held a public hearing and
provided to .all interested parties the opportunity to be heard concerning the
Second Five Year AB 1290 Implementation Plan; and

WHEREAS, in conformity with CRL Section 33490 (d) notice of the
public hearing was published pursuant to Government code Section 6063 and
posted in at least four (4) permanent places within each of the Project Areas,
with such publication .and posting having been completed not less than ten (10)
days prior to the public hearing; and
WHEREAS, by this Resolution the Agency desires to complete the
evaluation and review of the progress of the Second Five year AB 1290
Implementation Plan for the Project Areas, to approve certain modifications to
the Implementation Plan as set forth in the Implementation Plan for the Project
Areas, which is attached hereto as Exhibit "A" and fully incorporated by this
reference.
NOW, THEREFORE, THE LYNWOOD REDEVELOPMENT
AGENCY DOES HERESY RESOLVE AND DETERMINE AS FOLLOWS:
Section 1. The Agency finds the above Recitals are true
and correct and are made a substantive part of this Resolution.
Section 2. The Agency has duly undertaken the review
and evaluation of the progress of the Second Five Year AB 1290 Implementation
Plan to the Redevelopment Plans for the Project Areas in conformity with the
CRL, in particular, Section 33490, subsections (c) and (d).
Section 3. The Second Five year AB 1290
Implementation Plan, Exhibit "A" hereto, is approved and made a part of the
Implementation Plan. The Agency confirms and approves the Second Five-Year
AB 1290 Implementation Plan.
Section 4. The City Clerk shall certify as to the approval
of this Resolution, and a copy of the Second Five Year AB 1290 Implementation
Plan, shall be placed in the City Cierk's records and in the offices of the Agency.
