HomeMy Public PortalAbout05-20-93 Special Local Planning Agency Meeting.tifMINUTES SPECIAL LOCAL PLANNING AGENCY MEETING VILLAGE OF KEY BISCAYNE, FLORIDA THURSDAY, MAY 20, 1993 COUNCIL CHAMBER 85 WEST MCINTYRE STREET, SECOND FLOOR Chairman Sime announced that this was a continuation of the regular meeting of Tuesday, May 18, 1993. The meeting was called to order by Chairman Sime at 7:15 p.m. Present were Members Clifford Brody, Mortimer Fried, Raymond Sullivan, and Chairman Betty Sime. Absent were members Rafael Conte, Michael Hill and Vice Chairman Joe Rasco. Also present were Village Clerk Guido Inguanzo, Village Attorney Steve Helfman, Finance Director Jack Neustadt, and Community Development Director Robin Sobrino. Chairman Sime called for a special meeting of the Local Planning Agency on Tuesday, June 1, 1993, and Thursday, June 3, 1993. There was no objection from the board. Chairman Sime stated that the Village Attorney and Community Development Director will review the Future Land Use Map, as well as the Goals and Objectives, and make recommendations to the board. Chairman Sime recognized Mr. Steve Pitkin, of Robert Swarthout, Incorporated, who made a brief statement regarding the traffic circulation presentation of May 18th. Mr. Pitkin proceeded to make a presentation regarding the recreation and open space aspect of the plan. He recommended one acre per thousand as the standard with a goal of three acres per thousand. Member Sullivan and Chairman Sime stated that the board should adopt three acres per thousand. John Festa, 695 Harbor Lane, addressed the board regarding the recreation level of service. There was further discussion by the board. Member Sullivan made a motion to adopt 2.5 acres per thousand as the standard. The motion was seconded by Member Fried and adopted by a unanimous voice vote. The vote was as follows: Members Brody, Fried, Sullivan, and Chairman Sime voting Yes. Mr. Pitkin made a presentation regarding the Urban Design Plan. Maria Valls, 662 Glenridge Road, spoke in support of the Village acquiring the Beach Club to provide beach access to all residents. Mr. Festa also made brief comments. Conchita Suarez, 201 Crandon Boulevard, inquired about an easement at the Sheraton property. Howard Nelson, 100 Southeast 2 Street, Miami, representing the Page 1 of 3 May 20, 1993 Sheraton, addressed the board. Chairman Sime stated that an Urban Design Plan should not be a part of the Master Plan submitted to the Department of Community Affairs. Eduardo Chamorro, 784 Woodcrest Road, spoke in support of bay access. There was extensive discussion by the board regarding the different aspects of the plan. There was a consensus by the board not to adopt an Urban Design Plan as part of the Master Plan. Bill Ofgant, 512 Fernwood Road, addressed the board regarding the plan. Michael Kahn, 881 Ocean Drive, discussed the disadvantages of including non -required elements in the Master Plan. Frank Kaplan, 101 Crandon Boulevard, also addressed the board regarding the plan. Chairman Sime recognized Community Development Director Sobrino who made a presentation regarding the following ordinance: AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE AMENDING SECTIONS 33-1(17) , 33-11, 33-41, 33-50, 33-136, 33-310(a) and 33-310(c) OF THE CODE OF ORDINANCES, VILLAGE OF KEY BISCAYNE, FLORIDA, PERTAINING TO THE DEFINITION OF BUILDING HEIGHT; IMPOSING FINISH REQUIREMENTS FOR FENCES AND WALLS; ESTABLISHING SETBACKS FOR STEPS, ROOF OVERHANGS, BOAT DOCKS, AND MECHANICAL EQUIPMENT; CLARIFYING THE PROHIBITION OF ENCROACHMENTS INTO SWALE AREAS; AND MODIFYING NOTIFICATION REQUIREMENTS FOR PUBLIC HEARING APPLICATIONS; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE. Member Brody discussed various aspects of the ordinance. Member Fried discussed the fence and wall section. Member Sullivan stated his concerns with sections of the ordinance. Carlos Penin, Village Engineer, addressed the board regarding similar ordinance requirements in other municipalities. Mr. Festa, Mr. Chamorro, Debra DeLeon, 250 Galen Drive, Ms. Suarez, and Garver Wilson, 725 Woodcrest Road, addressed the board regarding the ordinance. Member Sullivan stated that architects should have been hired to review the zoning code and make recommendations to the board. Attorney Heilman stated that an R.F.P. to hire architects has been prepared and will be released in a week. Member Sullivan recommended the creation of an advisory committee of local architects to evaluate this situation. Debra Neve, 180 Harbor Drive, addressed the board regarding the committee idea. Attorney Heilman stated that he will prepare a resolution, for the board's review at their next meeting, creating a committee with goals and qualifications.
