SPECIAL LOCAL PLANNING AGENCY MEETING
VILLAGE OF KEY BISCAYNE, FLORIDA
THURSDAY, JUNE 24, 1993
COUNCIL CHAMBER
85 WEST MCINTYRE STREET, SECOND FLOOR
1. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to
order by Chairman Sime at 7:10 p.m. Present were members Clifford
Brody, Rafael Conte, Mortimer Fried, Michael Hill, Raymond Sullivan
(arrived at 7:25 p.m.), Vice Chairman Joe Rasco (arrived at
7:30 p.m.), and Chairman Betty Sime. Also present were Village
Manager Sam Kissinger, Village Clerk Guido Inguanzo and Village
Attorney Steve Helfman.
2. PLEDGE OF ALLEGIANCE: Chairman Sime led the Pledge.
3. APPROVAL OF MINUTES: The minutes of the special meeting of
June 3, 1993, the minutes of the workshop of June 15, 1993 and the
minutes of the workshop of June 17, 1993 were approved, as
submitted, by unanimous consent.
4. AGENDA: Member Hill made a motion to amend the agenda by
adding a fifteen minute presentation by the Banyan Development
Group. The motion was seconded by Member Brody and adopted by a
unanimous voice vote. The vote was as follows: Members Brody,
Conte, Fried, Hill, and Chairman Sime voting Yes.
Member Hill made a motion to amend the agenda by adding discussion
regarding the L' Esplanade property. The motion died due to lack of
a second.
Eric Nesse, 750 Ocean Drive, representing Banyan Development, made
a presentation regarding the Key Biscayne Hotel and Villas D.R.I.
property. Henry Iler, representing the project, and Jeffrey
Bercow, also representing the D.R.I. property, addressed the board.
5. DISCUSSION OF THE FUTURE LAND USE MAP: Member Brody discussed
the potential problems of reducing the density in the multi -family
areas as designated on the future land use map. Member Fried
concurred that the current densities in the condominium areas
should be maintained to preserve homes of persons who could be
affected by a natural disaster. Member Rasco stated his concern
regarding the issue.
Attorney Helfman stated he will draft a policy to address the
matter.

Member Sullivan discussed the variables involved in the issue.
Steve Pitkin, of Robert Swarthout, Inc., addressed the board.
Member Hill spoke in support of maintaining the current densities
in most of the multi -family areas.
Tony Pell, 161 East Enid Drive, addressed the board. Carter
McDowell, 100 Southeast 2 Street, representing the Sheraton Royal
Biscayne, also addressed the board.
Members Sullivan and Hill discussed the problem of creating non-
conforming uses. Bill Ofgant, 512 Fernwood Road, addressed the
board.
The board further discussed the multi -family designations in Area
Two of the Future Land Use map. Mr. Pitkin stated that he will
prepare a revised map for presentation at the next meeting based on
the board's comments.
The board designated the parcel at One Crandon Boulevard to be
consistent with the ten units per acre in the surrounding parcels.
Conchita Suarez, 201 Crandon Boulevard, addressed the board.
Mr. McDowell addressed the board regarding the designation of the
Sheraton Royal Biscayne D.R.I. property. Mr. Bercow and Mr. Nesse
addressed the board regarding the Key Biscayne Hotel and Villas
D.R.I. property. Martha Broucek, 170 Ocean Lane Drive, also
addressed the board. There was further discussion regarding the
designation of the Key Biscayne Hotel and Villas site. Mr. Ofgant
addressed the board. Judy Reinach, 365 Harbor Lane, also addressed
the board.
Member Brody made a motion that, as a matter of L.P.A. policy, in
deliberating on the Village's master plan, the future land use
mapping process should not take into consideration any existing,
modified or proposed Development of Regional Impact property.
Chairman Sime seconded the motion which was adopted by a 6 - 1
voice vote. The vote was as follows: Members Brody, Conte, Fried,
Sullivan, Vice Chairman Rasco, and Chairman Sime voting Yes.
Member Hill voted No.
6. ADJOURNMENT: The meeting was adjourned at 10:00 p.m.
