SPECIAL LOCAL PLANNING AGENCY MEETING
VILLAGE OF KEY BISCAYNE, FLORIDA
WEDNESDAY, JUNE 30, 1993
COUNCIL CHAMBER

1. CALL TO ORDER/ROLL CALL OF MEMBERS: The meeting was called to
order at 7:10 p.m. by Chairman Sime. Present were members Clifford
Brody, Rafael Conte, Mortimer Fried, Michael Hill, Raymond
Sullivan, Vice Chairman Joe Rasco (arrived at 7:20 p.m.), and
Chairman Betty Sime. Also present were Village Manager Sam
Kissinger, Village Clerk Guido Inguanzo, Village Attorney Steve
Helfman, and Community Development Director Robin Sobrino.
2. PLEDGE OF ALLEGIANCE: Chairman Sime led the Pledge.
3. AGENDA: There were no changes to the agenda.
Chairman stated that the L.P.A. will have a special meeting on
July 8, 1993 and a regular meeting on July 20, 1993.
Camille Guething, 260 Seaview Drive, addressed the Council
regarding the L'Esplanade property. Chairman Sime stated that the
issue will be discussed at the meeting of July 20th.
4. DISCUSSION OF THE FUTURE LAND USE MAP: Attorney Helfman
briefly discussed a revised version of the proposed land use
categories.
Steve Pitkin, of Robert Swarthout, Inc., addressed the board
regarding the planner's recommendations for the land use density in
Area Two of the June 22, 1993 Future Land Use Map. Member Brody
spoke in support of the planner's suggested densities. Robert
Swarthout, the Village's Master Plan consultant, discussed his
proposal. Member Sullivan expressed his concerns regarding the
proposed Swarthout densities. Vice Chairman Rasco discussed the
Swarthout and Sullivan recommendations. Member Hill spoke in
opposition to a reduction in the existing densities.
Member Fried made a motion to adopt the Swarthout recommended
densities for Area Two of the June 22, 1993 Future Land Use Map.
The motion was seconded by Member Brody and adopted by a 5 - 2 roll
call vote. The vote was as follows: Members Brody, Conte, Fried,
Vice Chairman Rasco, and Chairman Sime voting Yes. Members Hill
and Sullivan voted No.

The board discussed the issue of resort hotel categories. Jeffrey
Bercow, 200 South Biscayne Boulevard, Miami, representing Key
Biscayne Hotel and Villas, addressed the board. It was the consent
of the board to adopt thirty units per acre -- with each hotel
room representing one unit. Bill Ofgant, 512 Fernwood Road,
addressed the board. Stanley Price, One International Place,
Miami, representing the Sheraton Royal Biscayne property, made an
inquiry regarding the planner's recommendation for the total number
of units per acre. Mr. Swarthout discussed his proposal of
seventeen units per acre. Member Brody discussed the implications
of high room number hotels. Vice Chairman Rasco requested that
staff further study the matter and prepare recommendations for the
L.P.A. Conchita Suarez, 201 Crandon Boulevard, addressed the
board.
Mr. Swarthout discussed the designation of the D.R.I. properties.
Member Fried stated his support for the Swarthout designations of
the D.R.I. properties -- acknowledging the vested rights of the
property owners. Mr. Price further addressed the board. Vice
Chairman Rasco stated that the board should adopt a policy
reflecting the board's wishes for the future on the land use map
while acknowledging and preserving the present rights of the
property owners. Woody Weiser, 3250 Mary Street, Miami, addressed
the board regarding discussion of the Sheraton Royal Biscayne
D.R.I. property. Member Sullivan stated that the D.R.I. properties
should be regarded as vacant parcels.
After extensive discussion by the board, Member Sullivan made a
motion to adopt the planner's recommendation, regarding the
Sheraton Royal Biscayne property, as indicated on the Future Land
Use Map dated June 22, 1993. The motion was seconded by Vice
Chairman Rasco and adopted by a 5 -2 roll call vote. The vote was
as follows: Members Conte, Fried, Sullivan, Vice Chairman Rasco,
and Chairman Sime voting Yes. Members Brody and Hill voted No.
Mr. Bercow addressed the board regarding the Key Biscayne Hotel and
Villas D.R.I. property. He offered a covenant limiting the density
to 300 hotel rooms and 505 residential dwelling units within the
project to reflect the policy desires of the L.P.A. and requested
the establishment of a new line separating the residential and
hotel developments within the property. Ms. Suarez further
addressed the board. Member Sullivan stated his concern over the
height of the buildings to be built on the property.
Member Brody made a motion to adopt the Bercow proposal. The
motion was seconded by Member Hill. After further discussion, the
motion was adopted by a 6 - 1 roll call vote. The vote was as
follows: Members Brody, Conte, Fried, Hill, Sullivan, and Vice
Chairman Rasco voting Yes. Chairman Sime voted No.

Member Fried made a motion to adopt the planner's recommendation
regarding the designations along the Crandon Commercial Corridor,
Area Four, of the June 22, 1993 Future Land Use Map. The motion
was seconded by Vice Chairman Rasco. Chairman Sime expressed her
concerns regarding the agricultural designation of the Rebozo
property.
Member Brody offered an amendment to the motion to replace the
Village Center, Office Commercial and Restricted Retail
designations with a single retail commercial designation. It was
the consensus of the board to permit office uses in the commercial
area. Member Fried concurred with the Brody amendment. Mr. Ofgant
addressed the board.
Member Sullivan suggested the re -designation of the single family
homes on the "Wooley's" parcel as Townhouse Residential.
The following residents addressed the board: Nancy Malloy, 605
Ocean Drive; Michael Kahn, 881 Ocean Drive; and Shirley Brill, 550
Ocean Drive.
Member Hill suggested using the land for boat parking.
After further discussion, the amended Fried motion was adopted by
a unanimous voice vote. The vote was as follows: Members Brody,
Conte, Fried, Hill, Sullivan, Vice Chairman Rasco, and Chairman
Sime voting Yes.
5. ADJOURNMENT: The meeting was adjourned at 10:55 p.m.
