Members present: Mayor, Wayne Neddermeyer; Councilmembers, Thomas Crosby, William Reiser, Arthur Theis, Nancy Laurent; Clerk, Donna Roehl; Planning and Zoning Administrator, Jeanne Mabusth; Attorney, Richard Sehieffer Motion by Thomas Crosby, seconded by Arthur Theis to approve minutes of July 19, 1977 as presented. Motion carried unanimously 155 1. MEDINA MORNINGSIDE AND VO TECH SEWER Wayne Anderson explained that he and John Lobben of To Tech had met and discussed sewering of the Medina Morningside and Vo Tech area. He explained the various plans and costs re- ceived from McCombs -Knutson Engineers. Cost would be from $5000 to $7000 for a study to be shared by Vo Tech and Medina. Discussion of requesting Metro Waste Control for financial assistance plus working with Long Lake and Orono. Lyle Swanson reported that Long Lake's plans were sketchy and they are not doing anything independently and that Oren does have plans. He also reported that there are two alternat- ives for sewering the area either by using Orono and Long Lake lines or running a line ind- ependently to the sewer interceptor. Motion by Thomas Crosby, seconded by Nancy Laurent to take under advisement the proposal of McCombs -Knutson and the recommendation of Wayne Anderson and discussion the possibility of having Long Lake and Orono join in study and take up the matter again when we know we have HUD funds available for a study. Motion carried unanimously 2. JEFF HOWARD Richard Sehieffer explained that because of complaints Mr. Howard appeared in court and was told to appear before Council and request approval of his operation. This is an R-A zoning and he is in the business of building and selling animal cages, an operation which is not allowed in that type zoning. Also the signs being used are in violation of the cities sign ordinance. He stated that Council must decide if this is allowed under a home occupation type business. Jeanne Mabusth reported that the State Right of Way runs from 75 ft. on the West property line to 120 ft. on the East property line and that his signs, etc. must be kept beyond that point. Discussion of the size and type of sign that Mr. Howard could use. Wayne Neddermeyer stated that he could have a name sign near the highway but the kennels should be kept away from the highway. Motion by Thomas Crosby, seconded by William Reiser to allow Jeff Howard permission to operate his business within the confines of a building under "home occupation" as defined in the City ordinance based upon his specific request and similar situations in the city and that the Zoning Administrator be instructed to report on his compliance with the ordinance. Motion carried unanimously 3. LORETTO TOWING Discussion of plans to convert a portion of the storage garage located on Highway 19 and 55 to a repair garage. Jeanne Mabusth reported that at thetime of the origAna1 approval a parking lot variance was granted because building was to be used only as unheated storage garage; Now it would be heated and the required amount of parking spaces must be provided. Motion by Thomas Crosby, seconded by Arthur Theis to enter into a Development Agreement with Loretto Towing to change use of building to a repair garage with the amount of the bond to be $5500, an increase of $2000 from the original bond amount. Motion carried unanimously 4. BILL AND JANE OGRAM DIVISION Jeanne Mabusth presented a land division request from the Ograms to divide 23+ acres into 3 building sites ( 6.8 -- 7.1 -- 9.5 acres) along Pioneer Trail Motion by Nancy Laurent, seconded by Arthur Theis to approve the Ogram land division. Motion carried unanimously L 5 5. FRED BREITBARTH Mr. Breitbarth appeared to requett to be allowed to add an addition to his garage 32' x 60',, to be used as a storage facility. He stated that he had verbal approval from his neighbors; Libby's, Conley's and 0gland's. Council stated that a variance is not required because this is a storage building, not a garage. 6. GARY APPLEBAUM DIVISION Mr. Applebaum requested that he be allowed to divide 20 acres on Morgan Rd. into two 10 acre plots. He explained that he would need to obtain a road easement from Elizabeth Dayton, property owner to the north, so that he could reach his property. Richard Schaeffer advised that Mr. Applebaum enter into a driveway agreement with the city as he is creating a division, one lot of which, does not front on a public road. Motion by Nancy Laurent, seconded by William Reiser to grant Gary Applebaum permission to divide 20 acres into two- 10 acre lots contingent upon receipt of a road easement from Eliz- abeth Dayton, acceptable to the Zoning Administrator and entering into a driveway agreement with the city. Motion carried unanimously 7. DARR']D SCHLINZ Mr. Schlinz discussed with Council the drainage problems that will be created by the land- scaping that has been done on the lot next to Mr. Schlinz which is owned by Ken Krienke. Mr. Schlinz felt that his lot and the lot behind the house being built will receive run-off water from the lot because it is much higher than other lots. He also reported that the footings of the building had remained under water during the winter. Wayne Neddermeyer explained that if a building meets codes there is not much a City Council can do. Motion by Thomas Crosby, seconded by Arthur Theis to instruct the Zoning Administrator to write to the affected party (Mr. Krienke) asking him to take care of the hazardous condition of the ditch affecting Lot 5, B1. 1 Third Addition and Lot 5 B1. 1, Second Addition, Ind- ependence Heights. Motion carried unanimously111 Mr. Schlinz asked if the contractor that did the blacktopping of Sycamore Trail intended to do the curbing. Ron Duran explained that the road department will do the finishing work. 8. DAVID GATES Mr. Gates appeared to discuss construction of the road in the Medina Creekside Addition. Discussion of the proper road width, cul-de-sac radius and the extension of the sewer and water lines to the back lots. Motion by Nancy Laurent, seconded by Arthur Theis to approve David Gates roadway plans for Medina Creekside Addition provided that sewer and water be installed, that the street be 30 ft. wide, 7 ton blakctopped with an 80 ft. diameter cul-de-sac on the north end completed to city standards and that Mr. Gates enter into a development contract with the city and post a performance bond of $18,000. Motion carried unanimously 9. NORTHWESTERN BELL Motion by Nancy Laurent, seconded by Arthur Theis to approve Resolution 77-31 allowing cable to be buried on Tamarack Dr. north of Co. Rd. 6. Motion carried unanimously Motion by Nancy Laurent, seconded by Arthur Theis to approve Resolution 77-32.allowing cable to be buried on Hamel Rd. from Pioneer Trail to Willow Dr. Motion carried unanimously ld NORTH - SOUTH ROAD 1%nna Roehl explained that Craig Spencer of Hennepin County Public Works had informed her that Council should pass a resolution asing for cooperation between the county and Medina tb begin planning of a North -South road. The County has nothing planned for Medina foz 5 7 the next 5 years and if Medina wants action sooner than that they should ahk the County to_revise its plans. Several residents expressed the opinion that to keep Medina rural such a roadway should not be construct as it would be asking for development and serve as a thoroughfare through Medina. Others expressed the need for such a route to provide for emergency travel. Motion by Thomas Crosby, seconded by William Reiser to approve Resolution 77-33 requesting that Hennepin County begin with Medina to study and plan, if feasible for a north -south road. Motion carried unanimously 11. MANHOLE ADJUSTMENT. Ron Duran asked what the city policy was or should be regarding adjusting manholes on private property when the property owner is regrading his property. Lyle Swanson stated that this is the property owners responsibility Wayne Neddermeyer stated that the charges should include material, labor and machine rent at a reasonable rate. Motion by Thomas Crosby, seconded by Nancy Laurent to establish a policy for manhole adjustment whereby property owners pay for material and a r easonable charge for machine and labor costs. Motion carried unanimously 12. BILLS Discussion of charging applicants for city costs paid to attorney, engineer and adminstration costs in connection with developments or large commercial pro#ects. Thomas Crosby suggested that the ordinance could be changed to define such allowable costs. Motion by Thomas Crosby, seconded by William Reiser to pay the bills subject to possible investigation and charge back of Darrel Farr development costs; Order Checks # 6848-6897 in the amount of $66,093.57 and Payroll #4577-4602 in the amount of $5965.76. Motion carried unanimously 13. HENtVEPIN COUNTY RD. 24 Discussion of letter from Hennepin County Park Reserve District regarding the need to black- top the shoulders of Co. Rd. 24 because of increased use for Wycling. Motion by Thomas Crosby, seconded by William Riser to go on record supporting the Hennepin County Park suggestion for paving shoulders of Co. Rd. 24 for bikes. Motion carried unanimously 14. BUILDING INSPECTOR Discussion of the need for more complete building inspecting services. Ron Duran stated that Paul Ogland would need to attend school if he were to do building inspecting. Motion by Nancy Laurent, seconded by Thomas Crosby to direct Paul Ogland to attend school to become certified as a plumbing, sewer and water inspector and to find out what is involved in becoming a certified building inspector. Motion carried unanimously 15. PUBLIC WORKS DEPARTMENT Ron Duran called Councils attention to septic system problem of Ivan Carver at Ind. Beach. Clerk w„s instructed to write to the Carvers telling them they must connect to the city sewer system within 30 days. Ron Duran reported that Ron Kath of Ind. Beach had inquired as to dirt washing from steep bank along road side. Lyle Swanson stated that he would look at it and ask the contractor if they were responsible for making repairs. Ron Duran asked if work could be done on the old street specifications originally prepared by Carter -Krueger and Associates. Engineer had stated that it would cost about $200 to bring it up to date. Ron Duran and Jeanne Mabusth were instructed to make corrections they wished and discuss at a later meeting. Nancy Laurent reported that the Public Works Department needs a gas tank and pump as there are only small gas cans which should not be stored inside buildings. 16. VOCATIONAL TECHNICAL SCHOOL Thomas Crosby suggested that copies of letters and correspondence should be forwarded to agencies such as Metro Council, Orono, Long Lake etc. 158 17, CORRECTION OF MINUTES Motion by Thomas Crosby, second by Arthur Theis to correct minutes of July 5, 1977, page 149, Item 14: Amount of order checks shall be $28,320.40.
