The Council of the City of Medina met in regular session on Tuesday, August 2, 1983
at 7:30 P.M.
Present: Mayor, Thomas Anderson; Councilmembers, Thomas Crosby, William Reiser, Anne
Heideman, Wilfred Scherer; Clerk -Treasurer, Donna Roehl; Planning and Zoning
Administrator, JoEllen Hurr; Police Chief, Michael Sankey; Public Works Sup-
ervisor, James Dillman; Attorney, Richard Schieffer; Engineer, Glen Cook
1. ADDITIONAL AGENDA ITEMS
Council agreed to discuss the following additional agenda items;

2. MINUTES OF JULY 19, 1983
Anne Heideman asked that Item 5, Page 242, be corrected to indicate that Thomas Crosby rec-
ommended acceptance of the Dundee Nursery plan for Hunter Farms Park.
Motion by Heideman, seconded by Crosby to approve the minutes of July 19, 1983, as corrected.
Motion declared carried
3. PUBLIC WORKS DEPARTMENT
Hunter Drive
Jim Dillman discussed applying oil on Hunter Dr. from Navajo Rd. north to the blacktop and
if it can be maintained it could be sealcoated later in the season. Sealcoating would help
to build up a hard surface and perhaps it could be overlaid with blacktop in a few years.
He stated that it would cost approximately $4000 to oil and $5000 to sealcoat.
Glen Cook stated that there is a great deal of traffic on the road and the surface will take
punishment. He also stated that time will tell whether or not the road fabric will resist
frost heaves.
Discussion of using surplus funds from 1982 to complete the sealcoating project, as there
is money in the road budget for the oil application.
Motion by Heideman, seconded by Scherer to authorize the application of oil and the seal -
coating of Hunter Dr., using 1982 surplus for the sealcoating.
Motion declared carried
Water Meters
Jim Dillman and Donna Roehl explained that there are continuing problems with inaccurate
meter readings in the Independence Beach and Hamel areas and that the meters or readers should
be repaired or replaced so as to secure accurate readings.
Council agreed that customers should be sent meter reading cards instructing them to read
their inside wter meters.
4. MEDINA MORNINGSIDE SEWER
Bobolink Rd., Blacktopping
Council discussed the fact that Bobolink Rd. had not been paved; that numerous residents had
called and that the August 1st. construction deadline had passed.
Thomas Anderson stated that he would like to collect the $500 per day penaly and suggested
that a Change Order be prepared.
Richard Schieffer stated that damages could be calculated when final payment request is
received.
Motion by Scherer, seconded by Heideman to instruct the engineer to put pressure on the
contractor to get the blacktopping finished and to notify the contractor that the city in-
tends to enforce the liquidated damages clause of the contract.

Willegalla Fence
Council discussed letter from John Willegalla regarding problems with incorrect replacement
of fence when storm sewer drainage ditch was constructed adjacent to his property.
Jim Dillman stated that he would inspect the problem with the city engineer.
S. PIONEER CREEK WATERSHED DISTRICT

Anne Theis, Chairperson of the Pioneer Creek Watershed Commission, reported that the
Commission was organized and will be discussing the joint powers agreement. She stated
that the city had been sent the budget amount for 1984.
6. INDEPENDENCE BEACH EASEMENT
Anne Theis reported that cable had been installed along the front of the Wm. Nelson property
and the two city road easements on either side of his property, apparently to keep cars from
parking on his property when using the city park. She asked that the city make a determin-
ation as to whether or not the easements should be retained for public purposes, perhaps for
a trail system to Lake Ardmore.
7. INDEPENDENCE BEACH DRAINAGE PROBLEM
Anne Theis asked what progresss had been made to correct drainage problems in the Walnut St. -
Lakeshore Ave. area, as water continues to be backed up onto her property.
Council discussed securing the property through an HRA, renovating and then adding the im-
provement costs to the price of the property.
8. PLANNING AND ZONING DEPARTMENT
Tom Ditter Roadway Agreement
JoEllen Hurr explained that a roadway agreement had been prepared and signed by various
abutting property owners, whereby access would be provided to a landlocked parcel owned
by Tom Ritter, on which he intends to build a house.
Motion by Crosby, seconded by Scherer to adopt Resolution 83-27, granting approval for
construction of a private road.

Albert Saari, Subdivision
JoEllen Hurr stated that the easements for roadway purposes had been signed by the Saari's.
Motion by Crosby, seconded by Scherer to adopt Resolution 83-28, approving the Albert Saari
subdivision.
Motion declared carried
George Hansen, Conditional Use Permit
Motion by Reiser, seconded by Heideman to table action on the Conditional Use Permit app-
lication of George Hansen due to the fact that he is out of town.
Motion declared carried
Woodlake Landfill
JoEllen Hurr stated that a Public Hearing will be scheduled on September 13th for the Plann-
ing Commission to consider the expansion plans for Woodlake Landfill.
She stated that water samples recently taken, are being analized by two separate firms.
Council set a Task Force meeting for September 1st. at 7:30 P.M. and JoEllen Hurr stated
that she would encourage Planning Commission members to attend that meeting.
William Nunn/Carey Radtke
Glen Cook reported that manure removal progress had been inspected Thursday, July 28th and
it was found to be complete except for the southwest corner which Mr. Nunn will slope to
the appropriate grade.
Mr. Nunn explained that he would be seeding the area, but that was not a requirement under
the bond that was posted.
Mr. Cook recommended release of the bond.
JoEllen Hurr explained that the variance application remained to be considered.
Mr. Nunn stated that he would probably begin work in the fall with completion in 1984.
Motion by Crosby, seconded by REiser to relase the bond that had been posted to guarantee
removal of accumulated manure and to consider the variance application at the August 16th
meeting.

JaTel eSewer Pond Road
e n urr8tated that the buyer of the Lutz property would like to begin construction
on the property and that she would like approval to proceed with the preparation of an
248 agreement whereby Mr. Lutz would agree to construct the sewer pond road to blacktop
specifications after work is completed on the sewer interceptor.
Motion by Crosby, seconded by Heideman to authorize preparation of an agreement, as discussed.
Motion declared carried
Planning Commission Appointment
Motion by Reiser, seconded by Crosby to appoint Patricia Headley to the Planning Comm-
ission, to fill the vacancy created by the resignation of Doug Wacek, term to end in
March of 1986.
Motion declared carried
Independence Beach Tax Forfeit Lots
Council discussed information regarding tax forfeit lots in the Independence Beach area
that could be offered for private sale to abutting property owners by Hennepin County.
They also discussed the possibility of removing assessments from those parcels that could
not be built upon.
JoEllen Hurr reported that she would have additional information for the August 16th meeting
as Hennepin County would like to offer them for sale in September.
9. CITY HALL ROOF REPAIR
Donna Roehl reported that the cities insurance carrier had requested that a roofing con-
tractor inspect and report on the condition of the city hall roof.
Council discussed the report given by Douglas Zumbusch of Dalbec Roofing; complete re-
placement at $6200. or repair of deteriorated areas for $2300.
Also discussed was the availability of funds to do the project.
Motion by Reiser, seconded by crosby to approve the repair of the roof by Dalbec Roofing at
a cost of $2300 with cost to be taken from the Council's Contingency Fund.

10. HAMEL PIZZA FACTORY LICENSE
Motion by Heideman, seconded by Scherer to approve the 1983-84 Non -Intoxicating Malt Liquor
license of Steve Stahlke for the Hamel Pizza Factory.
Motion declared carried
11. ST. ANNE'S CHURCH
Motion by Scherer, seconded by Crosby to approve the issuance of a Non -Intoxicating Malt
Liquor license for St. Anne's Church for Sunday, August 28th, at a cost of $10.00
Motion declared carried
12. HAMEL SEWER INFILTRATION
Glen Cook stated that he had not done a great deal of work on a plan for the repair of the
sewer lines in the Hamel area, but that it would cost approximately $38,000 to repair the
section from Hamel Rd. to the railroad tracks east of the Fidel Theis property.
Motion by Heideman, seconded by Scherer to table the matter until August 16th.
Motion declared carried
13. DEPARTMENT POLICIES
Anne Heideman explained that Attorney, DAyle Nolan, had advised that the city not write
individual department policies and to continue to issue memos and directives, as needed
and as has been done.
Thomas Crosby asked what State Statutes the city would be competing with.
Anne Heideman stated that she would have that information for the August 16th meeting.
14. EMPLOYMENT NEEDS
Donna Roehl stated that the city may have to hire someone to do the sewer and water billing
on the Computer and that she had asked Connie Wendland, Summer Youth Employee, whether
she would be interested in the job after she enters College.
Also discussed was the need to hire a janitor for city hall.
Council advised placing an ad in the Crow River News advertizing for the posistion to
pay $5.00 per hour for 3-4 hrs. per week.
15. CABLE TELEVISION 249
Thomas Anderson reported that three proposals had been received for Cable Television
service to the area which includes Medina and that they would be reviewed by a professional
who would then make a recommendation. He stated that unless all proposals were rejected
the city would have its advanced expenditures refunded.
16. BILLS
Motion by Heideman, seconded by Scherer to pay the bills; Order Checks # 2231-2297 in
the amount of $107,075.45; Payroll Checks # 7258-7280 in the amount of $10,408.81 and
Revenue Sharing check # 1035 in the amount of $9738.79.
