HomeMy Public PortalAbout72 Application 09-024 Exempt from California Environmental Quality Act Waltman TOWN OF TRUCKEE California RESOLUTION NO. 2009 -72 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE DETERMINING THE ACTIONS AND ACTIVITIES OF APPLICATION NO. 09 -024 EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, Boulder Diversified Enterprises LLC submitted Application No. 09 -024 for consideration by the Town of Truckee, and the actions and activities which may arise from said application include an amendment to the Town Zoning Map, a text amendment to the Development Code, a use permit to expand a snow removal business and establish a driveway sealing business, a tentative map to subdivide the property into two parcels, and future annexation of the property into the Truckee Sanitary District and provision of sewer service which will require approval by the Nevada County Local Agency Formation Commission and Truckee Sanitary District; and WHEREAS, these actions and activities constitute a project as defined in Section 15378(a) of the California Environmental Quality Act (CEQA) Guidelines; and WHEREAS, the Community Development Director conducted a preliminary review of the project to determine whether the project is exempt from further review under the CEQA Statutes and Guidelines; and WHEREAS, it is the professional opinion and recommendation of the Community Development Director that the actions and activities of Application No. 09 -024 are exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines; and WHEREAS, the Town Council has reviewed and considered the recommendation of the Community Development Director and any and all public comments submitted on Application No. 09 -024 including any comments on the sufficiency of the exemption. • ........ NOW THEREFORE BE IT RESOLVED, the Town Council of the Town of Truckee hereby makes the following determinations: 1. It can be seen with certainty that there is no possibility that the actions and activities of Application No. 09 -024 may have a significant effect on the environment; 2. The California Environmental Quality Act applies only to projects which have the potential for causing a significant effect on the environment; and 3. Therefore, the actions and activities of Application No. 09 -024 are not subject to the California Environmental Quality Act pursuant to Section 15061(b)(3) of the CEQA Guidelines. BE IT FURTHER RESOLVED, the Council hereby adopts the following findings in support of these determinations: 1. The General Plan designates the property for residential development at a maximum density of one primary dwelling unit per acre. The General Plan anticipated the subdivision of the property and the extension of sewer service to the property, including Council Resolution No. 2008-01 Page 2 approval by the Local Agency Formation Commission and the Truckee Sanitary District of annexation of the property into the District, and this was analyzed in the Environmental Impact Report certified for the General Plan in 2006; 2. The new facilities for the snow removal and driveway sealing business will be located in areas previously disturbed which will result in negligible removal of native vegetation and ground disturbance; 3. The nearest residences to the project, excluding the residences of the project itself, are located at least 500 feet away from the project site, and visibility of the project facilities from these residences will be minimal, if at all. 4. Traffic generated by the project will be less than 20 average daily trips during the summer business season and less than 100 average daily trips during the winter business season except during winter storm periods when snow removal services are most necessary. Teton Way, Skislope Way, and other Tahoe Donner Subdivision roads are sufficient in width and pavement to accommodate the increase in traffic and will not have unacceptable levels of service in the near future or upon buildout of the General Plan; and 5. The Council has not received any comments or evidence from State or local agencies, property owners or residents in the area, or the general public which question that the project may have a significant effect on the environment. The foregoing Resolution was introduced by Council Member Green, seconded by Council Member deRyk Jones, at a Regular Meeting of the Truckee Town Council, held on the 21 day of January, 2010 and adopted by the following vote: AYES: Council Members: Brown, Green, deRyk Jones and Mayor Dee.
