CALL TO ORDER — Mayor Wallace Dee called the meeting to order at 6:00 p.m. 2. ROLL CALL: Council Members; Green, Brown, deRyk Jones, Vice Mayor Anderson, and Mayor Wallace Dee. Staff Present: Town Attorney Crabb, Records Technician Kuhlemier, Town Manager Lashbrook, Community Development Director McLaughlin, Town Clerk Price, Administrative Services Director Szczurek, and Public Works Director/Town Engineer Wilkins. 3. PLEDGE OF ALLEGIANCE — led by Chief Keller. 4. PUBLIC COMMENT 6:01:49 PM Jody Sweet, Truckee resident: • Stated his father had received a letter from Truckee Donner Public Utility District (TDPUD) regarding street lights. o He summarized a letter ( letter to be provided to Town Manager Lashbrook by Monday, February 22, 2010). • Requested the Town work with the TDPUD regarding existing street lighting. • Stated he believed an agreement might exist with Nevada County regarding the street lighting. o Stated this is a public safety item. • Mr. Holley requested Mr. Sweet talk with the Town. • Stated the lights are mounted on TDPUD poles, and were paid by tax payers. Town Manger Lashbrook responded: • The Town is aware of the removal of existing street lighting by the TDPUD. • This was not an incorporation item because the neighborhood lighting has always been in the jurisdiction of the TDPUD. • The issue is between the TDPUD and their customers. • The Town's requirement on "street lighting" is directed to arterial to arterial intersections, connections, and roundabouts. o The Town installs and maintains those specific lights. • The largest subdivisions in the Town do not have streetlights. o Some older neighborhoods have neighborhood lighting. • Stated the TDPUD board is publicly elected board. • Mr. Lashbrook offered to go over the Town incorporation documents if Mr. Sweet desires. Council Member Green stated: • She had personally talked with Mr. Holley from the TDPUD. Town of Truckee Regular Town Council Meeting Page 1 o Each street light was placed on a TDPUD pole per the request of adjacent property owners. o The TDPUD has been paying for them. • If a property owner chooses, they can take over the maintenance and pay for the street lights. o If property owners do not want to do this, the lights are being taken out. 5. PRESENTATIONS — None. 6. CONSENT CALENDAR It was moved by Council Member Brown, seconded by Vice Mayor Anderson, to approve the Consent Calendar as follows: 6.1 Approve the minutes of February 4, 2010. 6.2 Adopt Resolution 2010 -05, authorizing the Town Manager to submit a grant application to the California Department of Resources Recycling and Recovery (CalRecycle) for the purpose of collecting waste tires from residents during date specific collection events and execute all necessary forms for the purpose of carrying out this grant program on behalf of the Town. 6.3 Authorize staff to amend the September 5, 2008 Downtown Snow Removal Contract to include the scope of work for hand shoveling around parking meters. The Consent Calendar passed with the following vote: 6:10:46 PM Ayes: Vice Mayor Anderson, Council Member Brown, Mayor Wallace Dee, - - - C Member Green_and C ouncil Member deRyk Jones. Noes: None. Absent: None. Abstain: None. The motion passed unanimously. 7. DISCUSSION ITEMS 7.1 STAFF REPORT — Sale of Property to Truckee Fire Protection District. Recommended Action: Authorize staff to finalize documents necessary to sell property located adjacent to the Public Service Center to the Truckee Fire Protection District. Public Works Director Wilkins presented information from the Staff report and recommended this action include the execution of the contract. Council Discussion: • Soil cost, for cleaning contaminates it is accounted for in the sale price. o Land value would be lower if we did not perform remediation. • The Town is paying fire impact fees. Fire District will pay impact fees to the Town at the development stage. • In collaboration with the Forest Service, an agreement was made regarding impact fees. The Forest Service lowered the cost of land to cover impact fees. • Stevens Lane was named for a former Town Public Works Employee, Toby Stevens, whom was killed on the job (out of state). Town of Truckee Regular Town Council Meeting Page 2 Mayor Wallace Dee opened the item for public comment. Bryce Keller, Fire Chief; • Impressed that three levels of government can make this project possible. • Stated without Jessica Thompson, Dennis Crabb, and Dan Wilkins this would not be a reality. • Complimented Joanne Roubique and her staff at the Forest Service. Mayor Wallace Dee closed public comment. The Staff recommendation was moved by Council Member Green, seconded by Council Member deRyk Jones, and carried with the following vote: 6:25:02 PM Ayes: Vice Mayor Anderson, Council Member Brown, Mayor Wallace Dee, Council Member Green and Council Member deRyk Jones. Noes: None. Absent: None. Abstain: None. The motion passed unanimously. 8. COUNCIL REPORTS Mayor Wallace Dee 111 • Atten the drawing and drew names for the First Time Homebuyers Down Payment Assistance Program at the Town of Truckee. Council Member Jones • Serving on the Audit Committee for the Town. 9. CLOSED SESSION 6:28:15 PM 9.1 CONFERENCE WITH REAL PROPERTY NEGOTIATORS — Property: leasehold interest in the parking area associated with Union Pacific Railroad right -of -way, east of McIver Crossing roundabout on the south side of Donner Pass Road, and the north side of West River Street, Dan Wilkins, Public Works Director/Town Engineer, and Kelly Beede, Parking Services District Manager, negotiators; price and terms under negotiations; Government Code Section 54956.8. No Reportable Action. 9.2 CONFERENCE WITH LABOR NEGOTIATORS — Kim Szczurek, and Alex Terrazas negotiators, General Employees Association (GEA), Mid - Managers Association, and Police Officers Association (POA), Government Code Section 54957.6 No Reportable Action. 9.3 CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION — One case, Governments Code Section 54956.9(b). No Reportable Action. 9.4 PUBLIC EMPLOYEE PERFORMANCE EVALUATION — town Attorney, Government Code Section 54957. Directed Staff to submit to Council, a two year contract with Dennis Crabb, Esq. Town of Truckee Regular Town Council Meeting Page 3 10.
