7:40 P.M.
Members present:
the City of Medina met in regular session on Tuesday, August 3, 1976 at
Mayor, Wayne Neddermeyer; Councilmen, William Reiser, Robert Franklin,
Donald DesLauriers, Arthur Theis; Clerk, Donna Roehl, Attorney, Richard
Schieffer; Planning and Zoning Administrator, Anne Dorweiler.
Motion by Donald DesLauriers, seconded by Arthur Theis to accept minutes of July 20, 1976,
as presented. Motion carried unanimously
ANNE DORWEILER
1. RICHARD TOOMEY, LOT COMBINATION
Anne Dorweiler presented request from Mr. Toomey to allow combination of Lots 18 and 19, Block
9, Independence Beach, and added that no variance would be necessary unless Council felt that
Beechnut is a street that will someday be constructed.
Motion by Robert Franklin, seconded by William Reiser to adopt Resolution 76-29 to allow comb-
ination of Lots 18 and 19, Block 9, Independence Beach with a variance from front yard require-
ment to permit house to be no less than 20 feet from Right of Way of Beechnut St. and to waive
the fees.
Motion carried unanimously
The Toomey's are attempting to acquire Lot 17, same block, which is now a tax forfeit lot.
Robert Franklin suggested that either we ask for a private land sale or release and sell through
Hennepin County.
Clerk was instructed to request that the county appraise the lot.
Douglas Wall
Anne Dorweiler presented request from Mr. Wall to allow construction of a 24' x 36' house on
his 30' lot at Independence Beach, previous house having been destroyed by fire. She stated
that the ideal situation would be one owner purchasing a lot from other party and eliminating
one assessment. Mr. Hoff, owner of the other 30' lot and Mr. Wall have not been able to make
an agreement and thus Mr. Wall requests variances be granted allowing him to build. Mr. Hoff
has asked to be notified when council discusses the matter so that he may oppose the re-
building.
Motion by Robert Franklin, seconded by Arthur Theis to refer the Wall application for var-
iances to the Planning Commission and place on the Council agenda August 17th, also to
notify Sheldon Hoff, Dean Bailey and Marie Hopfenmiller.
Motion carried unanimously
William Fenholt
Richard Schieffer explained resolution regarding sale of tax forfeit land. Discussion as to
city securing a Torrens Title and passing it on to new owner, if a 6 month limit should be
placed on removal of hazardous building, and if payment of legal fees should be included in
the resolution.
Motion by Robert Franklin, seconded by Arthur Theis to adopt Resolution 76-30, acquiring land
for public purposes and amend portion of resolution to include fees incurred by city attorney.
Motion carried unanimously
2. STREET EVIPMENT
Donald DesLauriers explained structure of heavy-duty wing assembly that is needed for snow plow,
this would be the same type as is installed on Ford Tandem, but slightly shorter. An offer of
$250 has been made for the old sweep plow.
Motion by Donald DesLauriers, seconded by Arthur Theis that we award Itasca Equipment Co, the
quote on the heavy duty wing assembly at a cost of $4935•
Motion carried unanimously
Motion by Donald DesLauriers, seconded by William Reiser that the old snow -sweep be sold to
Ttasca Equipment Co. for $250.
Motion carried unanimously
Discussion of street sweeper and the fact that the bidder has not gotten the machine nor
paid for it. Attorney advised that a certified letter be written asking him to get the
machine within 10 days or we will assume he does notwant it and we will retain the $70.00
which was 5% of the bid price.
3. CONTINENTAL TELEPHONE CO. 55
Anne Theis of Independence Beach explained the landscaping that needed to be restored by
Continental Telephone Co. as a result of their burying cable on various streets in the area.
Clerk was asked to write to them and request that they restore to the condition in which it
was found.

4. FEE SCHEDULE COMMITTEE
Robert Franklin asked that William Fenholt be made a member of the committee to study various
fees charged by the city. As remaining councilmen did not have people to serve the matter
was tabled until August 17th.
5. METROPOLITAN COUNCIL RULES AND REGULATIONS
Robert Franklin presented a resolution regarding amendments he would suggest for the proposed
Rules and Regulations. 1. After a municipalities Comprehensive Plan has been approved by
Metro Council it should not be necessary for Metro to measure each variance request against
the Metro Plan. 2. A11 information must be public and may not be retained as confidential
for any period .
Motion by Robert Franklin, seconded by Arthur Theis to adopt Resolution 76-31, regarding
Metro Council Rules and Regulations and send copies to Metro Council, Mr. Weaver and Mr. Murphy.
Motion carried unanimously
6. ORONO-LONG T,A INTERCEPTOR
Discussion of resolution regarding request that Metro Council and the Physical Development
Committee begin, at once, to take steps toward construction of the Orono -Long Lake Interceptor
and a Medina Interceptor, because of the critical sewage problem at Medina-Morningside.
Motion by Donald DesLauriers, seconded by Arthur Theis to adopt Resolution 76-32 regarding
the Orono -Long Lake Interceptor.
Motion carried unanimously
7. METRO SYSTEMS STATEMENT
Motion by Robert Franklin, seconded by William Reiser to adopt Resolution 76-33 regarding
request to Metro Council that they supply Medina with a systems statement and a request for
planning assistance funds to aid in the adoption and implementation of the Medina Comp. Plan.
Motion carried unanimously
8. WCCO
Letter, dated July 28, 1976, from WCCO, was read, regarding current status of their request
before the FCC.for construction of a radio antenna near Hamel. The Broadcast Bureau of FCC
has until August 4th to file findings, after which parties may reply. There is no estimation
as to when'a dedision will be made.
9. REVENUE SHARING REPORT
Motion by Arthur Theis, seconded by Donald DesLauriers to accept the Revenue Sharing AotUal
Use Report No. 7, as prepared by the Clerk.
Motion carried unanimously
10. INDEPENDENCE BENCH SEWER RATES
Discussion of sewer rates for Independence Beach customers to allow for sprinkling. Council
agreed that a credit should be given after a winter quarter reading is taken.
11. SCHERER BROTHERS LUMBER CO.
Letter from Greg Scherer was read requesting permission to display fireworks on September 12th,
at Holy Name Lake. Donna Roehl stated that Mr. Scherer had been supplied with the agreement
to be signed and with information that the fire department must be notified and approve.
Motion by Arthur Theis, seconded by Donald DesLauriers to allow Greg Scherer to display fire-
works on September 12th from 8:00 to 9:00 P.M. if necessary steps, as outlined are complied with

5 6 12. INDEPENDENCE BEACH CONSTRUCTION, FINAL PAYMENTS
Council agreed that before final checks are issued tb G L Contracting and ABJ Enterprises
they would ask the Engineer to tour the construction with them and would ask Leo Leuer if
there are any problems in the well house.
13. BILLS
Discussion ofthe assessors salary, allowable by law. Richard Schieffer stated that he
would secure information before the August 17th meeting.
Motion by Arthur Theis, seconded by William Reiser to pay all bills except G L Contracting,
ABJ Enterprises and Willis Kohnen. Order checks # 6156-6223, in the amount of $161,274.60
and payroll #4131-4159 in the amount of $8810.45.
Motion carried unanimously
14. RON DURAN
Motion by Robert Franklin, seconded by Donald DesLauriers to have attorney write a letter to
Jim Lane requesting that rocks be removed from road right-of-way on Willow. Rocks had been
removed from Mr. Lane's fields.
Motion carried unanimously
Discussion of painting center line on Willow Drive. Donald DesLauriers will call Hennepin
County Public Works and request that they do it when they are in this area.
Regarding any claim that may be submitted arising out of someone triping on sidewalks,
attorney advised that they be forwarded to the cities insurance carrier fora determination.
Motion by Donald DesLauriers,seconded by Arthur Theis to adjourn.
