COUNCIL MINUTES
April 23,1960
The Bal Harbour Village Council held its regular meeting
at the Village Hall on Saturday, April 23, 1960 at 9:30 a.m.
Those present were: Messrs. Broeman, Faulkner, Hart and
White.
Absent: Mr. Beatty.
Also present were W. H. Webb, Village Manager; and Mary
T. Wetterer, Village Clerk.
The meeting was calledto order by Mayor Hart and after
hearing the roll call, the minutes of the meeting of March 26,
1960 were approved as submitted upon motion of Mr. Faulkner,
seconded by Mr. White and unanimously voted.
The first item considered by the Council was Mr. Thomas
Enderson's letter and report of the North Beach Yellow Cab
Company litigation. Mr. Webb, the Village Manager, read the
letter from Mr. Anderson, the Village Attorney, and called to
the attention of the Council that according to Mr. Anderson's
explanation "Judge Floyd apparently held that we were not
bound by the Metropolitan ordinance regarding taxi —cabs for
the reason that it applies only to holders of certificates and
not to the number of cabs". Mr. Anderson further stated in his
letter that he felt this was contrary to the provisions of the
ordinance and that he felt the Village must find out whether
they are affected by the ordinance or not. After considerable
discussion of the letter, Mr. Broeman stated that knowing the
speed of the courts that he felt that there was no need in
pursuing the matter any further. The matter could be brought
up again in October when the Village will again issue taxi
licenses for the new license year. Mayor Hart asked the Village
Manager if the decision of the court ruled out the use of public
stands. Mr. Webb assured him that it did not. Thereupon, Mr.
Broeman moved that in view of the fact that it would be impracticable
to pursue the matter any further and that the Council had no right
to spend money for further litigation since it would not mean
a saving of tax money in the future, that the entire matter be
dropped. This motion was seconded by Mr. White and carried.
Mr. Faulkner moved that the Clerk be instructed to correct
a typographical error in the spelling of the word "preceeding"
in the March 17, 1960 minutes. Mr. White seconded this motion
and it was unanimously approved.

The six month's audit was presented to the council. Mr.
Broeman asked the Village Manager if anything should be brought
to the attention of the Council. Mr. Webb explained that every-
thing was in good condition and that he was satisfied with the
audit. Mr. Broeman then moved that the audit be accepted as
submitted. This motion was seconded by Mr. Faulkner and unanimous-
ly approved.
Mr. Broeman moved that the transfer of the Americana Hotel
liquor license from Tisch Hotels, Inc. to Americana Hotel Operat-
ing Corp. he approved. Said motion was seconded by Mr. Faulkner
and approved by the Council.
Request was made for permission to cancel delinquent personal
property tax bills which are uncollectable. Mr. Broeman made a
motion, which was seconded by Mr. White and approved by the
Council, that the uncollectable personal property tax bills as
listed below be cancelled in accordance with recommendation of
the Village Tax Collector and charged to the Tax Discount and
Abatement Account.

The items listed are small business and personal property that
are no longer in our jurisdiction.
During the discussion of suggestions for the Village 15th
Anniversary celebration Mr. Broeman stated that he felt that
there should be a fund set up in the budget for promotional ideas.
Mr. Hart explained that any items of advertising, etc. had been
paid for out of the Mayor's fund in the past. Mr. Faulkner moved
that an additional $1,000.00 be placed in the Mayor's fund in
the 1960-61 budget to take care of the 15th Anniversary expenses.
Mr. Broeman seconded this motion and it was approved unanimously.
Mr. Broeman moved that Mayor Hart declare May 1st as Law
Day and that the Proclamation be posted in the Village Hall.
Said motion was seconded by Mr. Faulkner and unanimously approved.

Mr. Webb advised the council that there had been a request
that Bal Harbour pay part of the expenses involved when Mr.
Anderson, the Village Attorney, attends the Municipal Attorney's
conventions. After a general discussion, Mr. Broeman moved that
the Village pay one—fourth of Mr. Anderson's expenses; however,
said payment is not to exceed $150.00. Mr. White seconded the
motion and it was unanimously approved.
Mr. White stated that the people residing in the apartments
just north of the church were suffering from excessive amounts
of dust caused by cars parking on the unpaved lots near the church
during services on Sundays. Mayor Hart recommended that Mr. Broeman
and Mr. Faulkner serve as a committee to discuss the matter with
Mr. Whitman and try to work out some arrangement whereby the cats
could make use of the paved parking lot on Sundays.
Mr. Broeman suggested that a hose be purchased by the Village
to be used for pumping out boats at the yacht basin. Mr. Webb
explained that the Village was getting prices on an ejector
and would contact the Bal Harbour Club, Inc. to see if they would
purchase same.
There being no further business to be brought before the
Council, the meeting was adjourned upon motion by Mr. White
and seconded by Mr. Broeman.
