Congratulations on both the success of the Regional Park
Election and on your own election as a Director!
Proper land use has always been a prime interest of mine and
of the District. . . .the best use for much of our land on the
west side - is no use.
At our last hoard of Directors meeting it was suggested that
the Black_Nountain District offer to the nei%rly created
Regional Parks whatev-er assistance it could. give. This night
just be Naps , resource information as to carability of
various xaa.rcels of land within the District, soil, crop and
vegetative information. Yuch information can be provided- through
our agreement with the Federal Derartment of Agriculture and
the U. S. Soil Conservation Service. We have access to various
types of technical. assistance that is free to cooperators
within nur district and we very much would like to have the
Regional Parks as one of our cooperators .
I know that you will be flooded with requests by various
private planning groups to do work for you even before you have
funds to pay for that work. . . .maybe the Resource Conservation
people can help you develop some of the background information
at a no cost. .or printing cost basis .
While the Black Mountain Resource District has some funds they are
strictly limited by law, however if at your beginning we can
help in some manner such as initial planning I know our board would
be pleased to do so.

The following Js a summary of a conversation with Yr. Vince Garrod,
Director of the UTTCD. I undertook this discussion as a follow-up to
the attqched letter.
BACKGROUND CF THIE F,'�TZCD
1. Formerly called the Blac! Nowntain- Scil Conservation Districtq
the District was formed in 1941 in or: to orovide a

2. Three such districts in Santa Clara County cover essentially all
hillside areas plus all county Flood Control lands. District

Through the "70morandum of understandinF" the Conser7aticn Mszrlat
can provide technical assistance to cooperating agencies such as the
Park District. !or example :
1 . Technical raports concerning lAn! evaluation such as a7ria"l-
tural uso-vatential , watershe , fire hazzard, scils and slope,
erodability, wildlife , veEetation, etc.
2* Provide 7anvFamcnt program for yroper conservation and care
of part lands and- open space. 3unh a "Farm Plan" could include
a schedule for planting, ErazinE or cutoing, fire control ,
. wildlife manaCement, etc,
3- EnEinevrinE expertize in planning, laying cut and actual
marking of desirable trails. (Not ccnatruction)
4. Aerial photos of all the area are available for 7aFD use.
5- Cannot provide surveys or services outside of District such
as on the Baylands.
According to Yr. Garrod the Conservation District ' s Directors ,
who ''kno'' this hillside area very well, are very willing and anxious
to lend their expertize and assist aace , to the 7,7-,7D.

An act to amend Section 23010 of the Covernment Code, and
'to amend Section 5544.1 of,and to add Section 5544.3 to, the
Public Resources Code, relating to regional park districts,
" and declaring the urgency thereof, to take effect
immediately.
LEGISLATIVE COUNSEL'S DIGEST
AB 2392, as introduced, Hayden (L.Gov.). Regional park
districts. `
Includes regional park districts among those entities to
which counties may loan moneys.
Authorizes regional park districts to borrow not to exceed
$100,000 to cover operating expenses between the time of
formation of the district and the first receipt of tax revenue.
To take effect immediately, urgency statute.

The people of the State of California do enact as follows.-
1 SECUON 1. Section 23010 of the Government Code is
2 amended to read:

1 district, fire protection district, flood control and water
2 conservation district, park, recreation and parkway
3 district of, recreation, park .and parkway district, or
4 regional park district located wholly within the county, if
5 its funds are or when available will be in the custody of
6 the county or any officer of the county, in order to enable
7 the district to perform its functions and meet its
8 obligations. The loan shall not exceed 85 percent of the
9 district's anticipated revenue for thelfiseal year in which
10 it is made or for the next ensuing fiscal year, and shall be
11 repaid out of such revenue prior to the payment of any
12 other obligation of the district.
13 , SEC. 2. Section 5544.1 of the Public Resources Code is
14 amended to read:
15 5544.1. Notwithstanding any other provisions of this
16 article, the board may borrow money by issuance of
17 promissory notes or other evidences of indebtedness in
18 an amount or of a value not exceeding in the aggregate
19 at any one time the sum of two hundred thousand dollars
20 ($200,000) or 5 percent of the assessed valuation of the ,
21 real and personal property situated in the district,
22 whichever is the lesser amount, to be used for any
23 revenue-producing purpose for which the district is
24 authorized to expend funds.
25 Indebtedness incurred pursuant to this section shall be
26 repaid in approximately equal annual installments during
27 a period not to exceed five years from June 30th of the
28 fiscal year in which it is incurred and shall bear interest
29 at a rate not exceeding six percent (6%) per annum
30 payable annually or semiannually or in part annually and
31 in part semiannually.
32 Each such indebtedness shall be authorized by a
33 resolution of the board unanimously adopted,and shall be
34 evidenced by a promissory note or contract signed by the
35 president of the board and attested by the secretary.
36 The indebtedness authorized to be incurred by this
37 section shall be in addition to, and the provisions of this
38 section shall not apply to, any bonded indebtedness
39 authorized by vote of the electors.
40 Nothing herein shall be construed so as to limit or

1 restrict the authority of the district to issue promissory
2 notes or deeds of trust in the acquisition of real property
3 or the exercise of its right of eminent domain subject to
4 the limitations set forth in Section 5568 of this code. -
5 Nothing herein shall limit the authority of the district
6 to borrow pursuant to Section 5544.3.
7 SEC. 3. Section 5544.3 is added to the Public
8 Resources Code, to read:
9 , 5544.3. The district may, pursuant to Section 5544,
10 borrow not to exceed one hundred thousand`dollars
11 ($100,000) to cover operating expenses between the time
12 of formation of the district and the first receipt of
13 revenue under Section 5545.
14 SEC. 4. This act is an urgency statute necessary for
15 the immediate preservation of the public peace,health or
16 safety within the meaning of Article IV of the
17 Constitution and shall go into immediate effect. The facts
18 constituting such necessity are: V
19 New regional park districts were formed at the
20 November 7, 1972,general election in Santa Clara, Marin,
21 and Monterey Counties. Tax revenues will. not begin to
22 flow to these districts until the fiscal year 1973-74. It is in
23 the public interest that these districts begin operations
24 immediately upon their formation and, since they must
25 be able to borrow money for operating expenses until _
26 they receive tax dollars, it is necessary that this act take
27 effect immediately.
