MICHAEL PEIRCE, Vice Chairman Minutes of the Board of Appeals Minutes: August 12, 2015 Town Hall, 2"d Floor W W W.HOPK]NTON.ORG ZBA@Hopkintonma.gov 8:47 Called to Order: 7:10 PM Adjourned: 7:40 PM Members Present: Rory Warren, Chairman; Mark Hyman, Clerk; Michael DiMascio; June Clark; John Savignano Members Absent: Michael Peirce, Vice Chairman; Peggy Shaw Others Present: Charles Kadlik, Zoning Enforcement Officer; Michael Shepard, Assistant Building Inspector 7:10 PM Administrative Session of the Board of Appeals Mr. Warren read a letter from the Zoning Advisory Committee requesting a Board of Appeals member be appointed to ZAC. Ms. Clark moved to nominate Mr. Peirce as a representative for ZAC. The motion was seconded by Mr. Hyman and passed unanimously. Documents Used: July 28, 2015 letter from Elaine Lazarus 7:15 PM Appeal of Administrative Decision 59 Wood Street — The Learning Center of Hopkinton Mr. Warren stated the appellant has requested a continuation of the public hearing. Mr. Hyman moved to continue the public hearing until September 23, 2015 at 7pm. The motion was seconded by Ms. Clark and passed unanimously. Documents Used: Request for Continuation of Public Hearing Form 7:20 PM Application for Public Hearing 9 Kruger Road - Towner Kathleen Towner — Applicant Roderick Towner — Applicant Members Sitting: Mr. Warren, Mr. DiMascio, Mr. Hyman, Ms. Clark, Mr. Savignano Ms. Towner stated they are seeking a special permit for an accessory family dwelling. Mr. Warren asked if it was within the existing structure and Ms. Towner stated yes. Mr. Shepard let them know they will have to update their smoke detectors. Ms. Towner stated they already have updated them. Mr. Kadlik asked who would be living in the accessory family dwelling and Ms. Towner stated her parents would be living there. Mr. Warren asked if there were any public comments. Mr. Hyman moved to close the public hearing. The motion was seconded by Mr. DiMascio and passed unanimously. Mr. DiMascio moved to grant a special permit under 210-126 for an accessory family dwelling unit with all the usual conditions. The motion was seconded by Mr. Hyman and passed unanimously. Documents Used: Uniform Applications for Special Permit/Petition for Variance 7:30 PM Application for Public Hearing 47 Winter Street — Trukanavicius & Jasiunaite Arunas Trukanavicius — Applicant Victorijia Jasiunaite — Applicant ith supporting documents Members Sitting: Mr. Warren, Mr. DiMascio, Mr. Hyman, Ms. Clark, Mr. Savignano Mr. Shepard stated the applicants have been doing a lot of work in their home. He stated they are increasing the height of the structure in the front. He stated the existing house does not meet front setback and he is not proposing to get any closer. Mr. Trukanavicius stated they purchased the property in the spring and it had been very much neglected. He stated they have been working on the part of the house that is conforming. He stated they would to build up in the front of the house. He stated they are not increasing the footprint. Ms. Clark asked what the increase in height would be and Mr. Trukanavicius stated it would be an additional 14 feet more. Mr. Warren asked if there were any houses behind it and Mr. Trukanavicius stated no. The Board reviewed the plans. Mr. Warren asked if there were any public comments. Peter Hubbe, 49 Winter Street stated he was here in support of the project. Mr. Hyman moved to close the public hearing. The motion was seconded by Ms. Clark and passed unanimously. Ms. Clark moved to find the proposed changes would not be substantially more detrimental to the neighborhood than the existing. The motion was seconded by Mr. Hyman and passed unanimously. Board of Appeals August 12, 2015 Page 2 of 3 Mr. Hyman moved to grant a special permit under 210-128A for a change to a pre-existing non- conforming structure in accordance with the plans attached. The motion was seconded by Ms. Clark and passed unanimously.
