An Agenda Meeting of the Mayor and Council of the Borough of AGENDA MEETING
Carteret preceding the Regular Meeting of March 7, 2002 was held on
February 28, 2002, 7:00 P.M., Municipal Court/Police Facility, 230
Roosevelt Avenue, Carteret, New Jersey.

To Address Governing Body- Borough Engineer BOROUGH ENGINEER -
Don Norbut
Donald Norbut said he would (inaudible) on a few things. He said
once a month he issues a Status Report. He said he received a call
from a gentleman from Edwards and Kelsey Engineering. They are the
Engineers from the company that (inaudible) Turnpike Authority for
Interchange 12. We are authorized for final assessment and alternative
assessment. It requires a public representation element and they are
reaching out to us to schedule a meeting. All interested parties are to
kick off that next phase.
Mayor Failace said he wanted to know when they had this meeting.
Councilmember Sosnowski said it should be limited to those who are
present.
Mayor Failace said it can't all go to that (inaudible) the sunshine law.
Borough Engineer Don Norbut - Suspect Area Sewer Project - four to SUSPECT AREA
five homeowners on Tyler Avenue were connected to the Storm Sewer Sewer Proj ecl:
and need to be connected to the Sanitary lines. The Sanitary elevation
lines are higher than the storm lines and because of the plumbing
facilities that they have in their houses it (inaudible). We have laid out
two options and we have sent them a letter. He said he wanted to
advise the Mayor and Council just in case any residents contact them
so they would understand the issues. The options we are giving them
are to get a plumber to come in and raise the plumbing about a foot or
two so that you can connect by gravity. The other option is if you have
basement facilities, they would have to put in a small pump. If they
can work with us over the next thirty days while the contract is still
open, we will accommodate them and run piping onto their property to
help them out as best as we can. Just so that you are aware, there are
five property owners that are affected. We are very lucky that there are
so few on the whole project. Also, Change Order g4, for the same
project, the suspect area project. Throughout the project he has
reported to them that due to some of the field work that have been

going on, they have been popping manhole covers and looking to
ENGINEERS disconnect things, we have found additional connections that have to

CONTINUED be removed. The additional piping that is needed to reconnect those
with additional (inaudible) repairs are an additional cost to the project.
We also hit an underground fuel storage tank that was abandoned in a
Krauszer's parking lot. This delayed the contractor for one day. For
those additional costs the contractor is entitled to compensation for
that. We are recommending a Change Order for a total of $17,000.00,
which makes the contract (inaudible). We did agree, because of the
additional work, to give the contractor a thirty day extension. We are
giving him an extension until the end of March to complete that work.
There is a second deadline for paving that takes place some time in
April. There is one new on the Milik Street Project - when we
originally put this project out to bid we knew we needed to put in a
new storm water out fall at one of the basis to a small stream or a
ditch. Because we needed a Wetlands Permit we did not include that
out fall in the original road (inaudible) but as it worked out, because
the project was delayed over the winter, we were not able to complete
it. We are now going to have the permit in time and we'll have the
ability to add that back in. He said it makes sense to add it in. He said
he would probably be coming to them with a change order in a month
or SO.
The Carteret Avenue Pedestrian Improvement - He said he thinks that
CARTERET AVE.
PEDESTRIAN he laid out his last report. He said there are going to be additional
IMPROVEMENT engineering inspection costs related to the 120 days the contract
completion date. He said he is recommending the assessed liquidated
damages in the amount of $3500.00. He said he spoke to the attorney
about that and he is going to have to dig into that a little bit more.
Right now because of that delay the additional cost is $8000.00.
Because we added some additional work to it we didn't think it was
fair to assess him the entire additional fee so he is recommending only
$3500.00 to liquidate the damages. In a separate letter, he said he has
copies for everyone, he is requesting that the Council consider
(inaudible).
Mayor Failace asked why don't they consider have more curbs done
throughout the town. Raise it up a little more and (inaudible).
Councilmember Parisi said that wasn't a bad idea. He asked the Mayor
if he meant unstead of taking money.
Mayor Failace replied yes. If we got more done it would mean more
money. We can use it in West Carteret, Washington Avenue
(inaudible). We did some over there years ago but not enough.
Councilmember Parisi said he passed West Carteret and he noticed
that there definitely there needs to be some cuts. If you want to focus
on the area that we are talking about like West Carteret and
Washington Avenue...

Borough Engineer Don Norbut said the Harrison Avenue and the
Roosevelt Avenue pump station - they have been started and they
have ordered the materials and equipment and it is going to take a
month or so before it starts.

Sewer Plant Demolition - they are in the asbestos removal right now SEWER PLANT
and the experts PMK are supervising that that operation and we have DEMOLITION
very limited. They have very (inaudible).
The Waterfront Park, Phase I - They are scheduled to receive bids this WATERFRONT PARK -
Tuesday, March 5th. There has been request from a few contractors to Phase I
give them more time. We want to give them about 4 to 41/2 weeks but
because by the time you received the plans it might be 3 weeks. We
also have a series of questions asking for clarification on the technical
specifications, which is normal on a big job like this. In this particular
case he is asking for more time so he sent out addendum #1 for an
extension telling them that the bid will be extended to March 26th.
They had contractors picking up specs as late as today.
At approximately 7:15 P.M. Councilmembers Reiman and Santoro NOTED PRESENT
were noted present.
At approximately 7:16 P.M. Councilmember Rios was noted present. NOTED PRESENT
Councilmember Reiman said he understood that there were fourteen
picked up and five (inaudible).
Borough Engineer Don Norbut said the more they have the better the
competition.
Mayor Failace asked if one of the other contractors complained
(inaudible). DISCUSSION
Borough Engineer Don Norbut said there was no justification to that,
not that he has see. What they do is if one contractor asks a question
on specs we have to answer in writing and we have to make the reply
available to all the contractors. As far as the Roosevelt Avenue by-pass
for West Carteret, the last Council Meeting (inaudible) at the request

of Woodbridge. That is tentatively scheduled for Wednesday the 6 , a
3:00 P.M., Woodbridge Township Engineer's Office. The County has
kind of begged-off on that meeting. What they said was whatever you
and Woodbridge decide it is fine with us and they will support our
position. He said he asked them to be there ...
Councilmember Santoro said Roosevelt Avenue is part of their road
and they need to support this and to work with us on this. She said she
thought that was one of the reasons they set up the meeting with the
County and Woodbridge and Carteret.
Borough Engineer Don Norbut said he spent some time with Rich
(inaudible), he is one of the assistants and he tried every gimmick to
get him to come to the meeting.
Councilmember Santoro said they should send a representative.
Councilmember Rios asked if they even said they will support
whatever Woodbridge and we decide·
Borough Engineer Don Norbut said when Carteret raised the issue they
sent a series of comments and questions and they have answered them
in writing and accorded them satisfactory. What he is saying is this is
what the two municipalities get together and (inaudible).

Councilmember Santoro said that was fine, but why delay.
Borough Engineer Don Norbut said that was what he told them. He
asked them why have two meetings when you can have one,
streamlined.
Councilmember Rios said he would not suggest canceling the meeting.
If they don't show up, they don't show up.
Mayor Failace said to let the Municipal Clerk know who will be
attending.
Councilmember Sohayda said to the Municipal Clerk that he would

Borough Engineer Don Norbut said to reiterate Edwards and Kelsey,
the engineers for the Turnpike Authority, Exit 12, they are moving
ahead with the environmental assessment phase and they want to have
a kick-off meeting and they want to offer (inaudible). They haven't set
a date but he just wanted the Mayor and Council to know about it. It
sounds like there is a lot of interest so whoever is going please let him
know. What he agreed to be to let everybody know when the time and
date is.
Councilmember Santoro asked if they could invite them to an Agenda
Meeting.
Borough Engineer said he has a more defined list of the sanitary
improvements. He said Patrick DeBlasio and himself had (inaudible) it
looks like if you want to proceed to amore aggressive program
(inaudible). He then said he would go over the road program briefly. It
is about a 1.1 million dollar program and the biggest chunk of it is two
roads, Hagaman and Terminal. Remember supplementing these grants
so we can virtually 100% funded.
Councilmember Santoro asked if the Borough engineer would go over
the numbers again. She then asked if the costs are $6,000.00.
Borough Engineer Don Norbut replied that the total construction costs
are six hundred thousand dollars and the engineering contingency is
estimated for about one hundred thousand and the total project cost is
seven hundred thousand. If you look at the grant money available
you'll see (inaudible). Then we have three hundred thousand from
Industrial Road. (Inaudible) that is what he thinks we'll be able to use
based on the eligible cost (inaudible). We are anticipating that it will
not be done t this time. If you add another two fifty to it a substantial
of the seven hundred thousand will come out of the OT money. The
only thing the (inaudible) will fund is all the engineering, inspection
costs and contract administration they just don't fund (inaudible).
Councilmember Santoro asked if the design he is going to be handing
us is for this improvement.
Borough Engineer replied yes. One is represent the neighborhood
rehabilitation, not simply overlaying the roads but reconstructing them

for (inaudible) pavement, drainage problems that have not been
corrected. Item number two, is where the County will come in and do
the milling and some minor base repairs.
Councilmember Rios asked if the Borough Engineer could explain the
fifty thousand dollars as the developer contribution.
Borough Engineer Don Norbut replied when we acted as special
consultant for the Zoning Board a few years ago, Port Carteret came to
him with a new warehouse facility. The Board assessed them as an off
site contribution.
Councilmember Reiman replied that only a percentage of it can be
allocated for certain roads.
Borough Engineer Don Norbut said they were also successful in
getting the twenty thousand dollars from Transco and (inaudible) in
the West Carteret Area and (inaudible). DISCUSSION
At this time everyone is speaking at once and it is inaudible.
Councilmember Parisi asked if they were obligated to the twenty
thousand dollars.
Borough Engineer Don Norbut said they sent us a check for
(inaudible). He said Patrick and himself went through some of the ones
he has available and there seems to be a local contribution for the
Capital Budget, which we have on hand (inaudible) mixed with the
developer contribution. With the Town Overhead Program and we still
have the ability to take a street out or put a street in if you want to look
at these a little closer and give your input.
Mayor Failace said he saw Oakwood Avenue on there and he thought
the Borough Engineer had to look at Oakrwood Place. It is really bad.
Since we are doing Oakwood Avenue it is something that you want to
look at.
Patrick DeBlasio said they have the money for the Sewer Improvement
Project.
Councilmember Parisi said one thing they have to be careful of is
when we take an overlay road out, category 2, which is just milling
and resurfacing and it is relatively inexpensive. When we are doing the
reconstruction and the road is in bad shape the construction cost ten
grand.
Councilmember Reiman said the number of the streets (inaudible). He
said this was just a suggestion...
Councilmember parisi said this started with the Road Program, which
evaluated all the streets that were done several years ago and they are
on the list as one of the worst. An overlay is when you put an inch and
a half of paving down. You may have to go down to the sub-grade and
you have to have some new curbs. You may have to go down to sub-
grade and do some curb some grading and drainage.

Mayor Failace said he would still like him to look it over because it is
pretty bad. He said he thinks it is pretty dangerous.
Councilmember Parisi said he's missing something. He said he though
Terminal Avenue was considerably smaller than Hagaman Street.
Councilmember Rios said Hagaman Street is much longer than
Terminal Avenue.
Councilmember Reiman said Terminal Avenue is considered industrial
use.
Borough Engineer Don Norbnt said what this does include is a portion
of McKinley. He said he wanted to stretch the deal as far as he could
(inaudible).
Councilmember Parisi said the Borough Attorney had mentioned that
we pave roads. The Council had roads approved last year and his
suggestion, and he agrees, is that we should contact PSE&G before we
do this incase they have any work they want to do on the roads first
DISCUSSION before we pave.

Councilmember Reiman said the Borough Engineer did send letters
out last year...
Councilmember Parisi said as soon as we get this set in stone we will
immediately send out (inaudible) letters to all the utility companies
advising them that we are working on these roads. They will let us
know if they need services or (inaudible).
He said "Murphy's Law", as soon as you finish paving there will be an
emergency, a water main break or a gas problem. One thing he is
concerned about is that they want to try to get this done this year,
before cold weather sets in.
Councilmember Santoro said (inaudible) what roads we are doing.
Councilmember Rios said within the next two weeks we should try to
focus on that.
Councilmember Sosnowski said the only thing he had a question about
was Industrial Road and Middlesex Avenue is (inaudible).
Borough Engineer Don Norbut replied that is what this includes.
Councilmember Santoro said there was Oakwood Place, Garland and
there was another one. She then asked what it was....She then asked
the Borough Engineer to take a look in the next few weeks. Everybody
should take a look and then pick which ones we are going with.
Borough Attorney Robert Bergen said (inaudible).

Councilmember Rios said he though it was the parking lot.
Councilmember Parisi said somebody had a good idea.

Mayor Failace said it is bad because they are all sunken in.
Councilmember Parisi said maybe you would want to do (inaudible)
services.
Borough Attorney Robert Bergen said the 24 thousand includes the
paving we were talking about and the (inaudible) parking.
Councilmember Reiman said yes, make the Council aware of what we
discussed as far as the possibility of angle parking. It would create
about thirty five parking spaces.
Councilmember Santoro said that has to be done. This is our
(inaudible) and what about lights, it gets dark on either side.
Councilmember Parisi said if it is dark, we should contact the Power
Company.
Councilmember Sosnowski spoke and was inaudible.
Borough Attorney Robert Bergen said the second sheets talks about
the sewer improvements and the big item there is item 6 and that is the
Hill District Storm Sewer ',Ir~rovement. He said he would let the DISCUSSION
finance committee sit down with that. Patrick DeBlasio seems pretty
confident that you can attack this program if you choose.
Councilmember Santoro said she spoke to (inaudible) this week. The
county had contacted us about what the status was with the light on the
comer of Washington Avenue and Roosevelt Avenue. She said she
spoke to Councilman Reiman and (inaudible).
Councilmember Sosnowski said maybe they put in a proposal
(inaudible).
Councilmember Santoro asked if they remember the history of the
(inaudible).
Councilmember Padsi said the County had entered into an agreement
to upgrade the intersection and do some widening and handle the
traffic that goes through there. That was prior to the Industrial Road
and it was the same time as it went in. One of the issues was property
acquisition. It required property acquisition and a number of the
property owners were not in favor of that. The project sat for a few
years and the County and their engineer's designed it. There must have
been a hundred sheets of plans. With the Industrial Road coming in,
the traffic volumes were lessened. At this time the significant
improvement the County proposed isn't really necessary. The County
is pushing the Borough to move ahead with the project. If you don't
__ want to proceed with the project they want you to pay seven-five to
one hundred thousand dollars for engineering costs when completed.
The front end signal should be upgraded and we have come up with a
concept plan that shows very minor lighting with no property
acquisition, we can get two lanes of traffic in there to get a (inaudible)
and a left turn on Roosevelt Avenue. The County said okay rather
than us taking your concept and hiring an engineer and charging the
Borough for a re-design why doesn't Carteret hire an engineer and do
the design yourself and (inaudible). The Town has excepted the

responsibility of hiring an engineer to do that intersection design. The
County wants us to work quickly.
Councilmember Santoro asked if they had the plans that the County
approved. She wanted to know if the plans were changed.
Councilmember Parisi replied that they are about ten to fifteen years
old and they have to be updated.
Councilmember Santoro asked if the County would accept the concept.
She then asked what the next the next stage would be.
Councilmember Parisi said it would be a final design of the signal.
Councilmember Santoro asked if this is what (inaudible) was for. Is it

Councilmember Padsi said it is the proposal to for a final design
inspection.
Councilmember Santoro then asked what the estimated cost would be
for the ftnal design.
Councilmember Reiman said they would have to get the authorization
permits. The County can review for this proposal.
Councilmember Santoro said they have been discussing this and she
agrees with the proposal.
Councilmember Reiman said if they could do it cheaper ... lie said he
just briefly went through this and he thinks they are suggesting that it
may cost about $300,000.00. The Borough Engineer said it may cost
$200,000.00 and if that is the case these numbers will come down. So,
if the Borough Engineer can touch base with them that would be fine.
It has to be done and he agreed with them.
Councilmember Santoro asked the Borough Engineer if he could do it
instead of them.
Borough Engineer Don Norbut said yes, we do have a staff that can do
but it is very (inaudible) when other professionals ask you to do a
proposal.
Councilmember Santoro stated at this point we need to move on with
this one. The county has asked us for an update on it.
Councilmember Rios asked how far are we committed. He said he
understood their concern and asked where is the overall cost factor and
is it smart on our part to either go with you or be concerned about
(inaudible) with somebody.
Borough Engineer said there are a few issues here. We want to
aggressively thank the men on the Road Program. If the County is
(inaudible). He said he doesn't have a problem if they go with another
consultant. If you want me to give you a proposal he'll be more than
happy to.

Councilmember Reiman said thank you. He said he asked him and...
Borough Attorney Robert Bergen said they want to move ahead with
this and again these numbers will be scaled down based upon a
number, so if it comes in lower, the construction costs are lower.
Councilmember Reiman asked if these are the same as the construction
fees that they are going to set. Even if we accept this as it is we'll go
out and get additional proposals. Where are we going to get
$300,000.00 to do that project? We'll be paying all the additional
design fee..
Unidentified person said he thought 25% of the construction and you
have to pay for the full cost ..
Councilmember Santoro said they have to pay for the re-design
regardless. If we don't do the re-design they are going to ask for
reimbursement. Either way we are paying, design the light and get it
down.
Councilmember Reiman said we can get the proposal over to the
County and have Dominic, from T&M Associates, and ask if it is DISCUSSION
acceptable we'll approve it.
Councilmember Santoro said at least we are moving in the right
direction. We asked the County for a lot of money and we need to
move in the direction to clear some of the old things. She then asked if
(inaudible) wanted to review (inaudible) with some recommendations
and next Thursday we'll inform everybody before ...
Borough Engineer Don Norbut said they were asking him if it was a
fair proposal.
Mayor Failace asked if they got all the proposals.
Councilmember Reiman said he spoke to John DuPont because we
want to talk to a few (inaudible) and see what type of proposals we can
get. John DuPont said he doesn't do that type of work. He put a call
into Schoor DePalma and sent some information over to CME and one
of them said they could do it and to get the information over to them as
soon as possible.
Mayor Failace said we want a few of the proposals. He said he knew it
had been a long time and he knows they should do this but he doesn't
see why we wouldn't want two or three more proposals before we
accept one.
Councilmember Santoro said if they could get things (inaudible).
Borough Engineer Don Norbut said they are going need a week or so
to get the background..
Councilmember Santoro said they should have this for the next
Agenda to be voted on.
Mayor Failace said he had no problem with that but we should get a
few more proposals.

WHEREAS, the citizens of Carteret stand firmly committed to
promoting reading as the catalyst for our students' future academic
success, their preparation for America's jobs of the future, and their
ability to compete in a global economy; and
WItEREAS, Carteret has provided significant leadership in the area
of community involvement in the education of our youth, grounded in
the principal that educational investment is key to the community's
well being and long-term quality of life; and
WHEREAS, NEA'S READ ACROSS AMERICA, a national
celebration of reading birthday on March 1, promotes reading and
adult involvement in the education of our community's students; and
WHEREAS, Read Across America-NJ is being conducted statewide
by the New Jersey Education Association, in partnership with the New
Jersey State League of Municipalities, the New Jersey Library
Association, the Saturn-UAW, Staples, and their local affiliates across
the state;
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and
Council calls on the citizens of Carteret to assure that every child is in
a safe place reading together with a caring adult on March 1, 2002;
AND BE IT FURTHER RESOLVED that this body enthusiastically
endorses NEA'S Read Across America and Read Across America-
NJ, and recommits our community to engage in programs and
activities to make America's children the best readers in the world.

Local Councilmember Reiman said they want to start to bring in (inaudible)

Councilmember Rios said he recommends that instead of printing out
an Agenda Meeting they just have a budget workshop with just the
Council.
Mayor Failace said that was done in the past and he would think the
easier way. DISCUSSION
Councilmember Reiman asked if they would have a Budget Workshop
Meeting and have the Department Heads or is it just for the Council?
Councilmember Rios said they could all come in one night.
Mayor Failace said that it could take a while.
Councilmember Rios replied that he understood that it was done
before.
Councilmember Santoro asked when they would be able to do this.
Councilmember Reiman said they wouldn't have final adoption until
May or June sometime.
Mayor Failace said they have time to do it but we should review the
individual budgets. You might even want to speak to the Department
Heads prior to the meeting and see if there is anything we can find out
if there is a way to help make it most (inaudible) on the night we do
discuss it as a Mayor and Council.

Councilmember Reiman replied no.
Councilmember Santoro asked if they can meet with them.
Councilmember Reiman said he would have Patrick set up an
appointment with them. They didn't want him to talk about the
refunding issue. They want to talk about potentially (inaudible). There
were about five million in bonds that were issued from 1999-2000 ...
Councilmember Santoro said they need to come in.

3. John Riggio - Employee Title Request.
Councilmember Reiman said this is the request that he spoke about for
.. He then said he would like to discuss this in Closed Session.
DISCUSSION
Councilmember Santoro said she thought there were a couple of
different positions including Tony Neibert, John Riggio's request and
she recommends that they do the same.
Councilmember Reiman said he didn't have a problem with that, this
has nothing to do with him because he thought they had decided to
change the title for the Clerk in that office.
Mayor Failace said he thought they did agree with that but they should
discuss it in Closed Session.
4. UEZ Advisory Board - Appointment.

Councilmember Reiman said he spoke to Patrick and we talked about
Mobil I and Mobil II site as far as funding for the proposal in front of DISCUSSION
them. (Inaudible). Potential litigation and (inaudible). CONTINUED
Councilmember Sosnowski said the Ladies Auxiliary wants to meet
with the Chief just to go over it.
Councilmember Rios said he had one thing for Closed Session and we
are now getting involved with the tree cutting. They had a Parks
Committee meeting on Monday and Frank, himself Brian and Bob
Kately have gotten rid of the big tree by (inaudible). We have someone
that is interested in taking either by flatbed, which will take a lot
longer or we can take it with the roll off and when it gets full we can
deliver them to (inaudible). Before we made that decision we thought
that we should bring it before the Mayor and Council in case there are
any questions. He said he didn't think there with it. We are going to
save on cost as far as paying somebody else. It is going to be sent to
somewhere around North Belleville.
Borough Attorney Robert Bergen said it is going to be taken to
somewhere around North Belleville
Councilmember Reiman said these are wood and trees that were cut
down and we have to get rid of them. We could just give it to this
company; we don't have to go out to bid.
Councilmember Rios said they were paying, years ago, to get rid of it.
We could let the guy come and pick it up with a small trailer or we can
load it up in our roll off and have our track deliver it once a month.
Mayor Failace said that was fine with him.
Councilmember Rios asked Attorney Caliendo if that was okay with
him.
Attorney Caliendo replied that he would check on that.
Councilmember Sohayda said the Fire Department is such a well oiled
machine that he has nothing for open or closed.
Councilmember Reiman said he received a phone call from Ocean
County and they had recently done some privatization down there.
Councilmember Parisi and himself talked about the potentially they
have four or five garbage trucks that are about five years old and they
got them really cheap. This is something that we really have to look
into. He then said he had something for Closed Session, potential
litigation.
