MEETING
Carteret preceding the Regular Meeting of May 2, 2002 was held on
April 25, 2002, 7:00 P.M., 230 Roosevelt Avenue, Carteret, New
Jersey.

ROAD PROGRAM - 2002 2002 - ROAD
PROGRAM
The Borough Engineer gave his report and was mostly inaudible. He
said he was looking for authorization for the bid on this project,
miscellaneous base repairs. The cost estimate is fifty-five thousand
dollars.
At approximately 7:05 P.M. Mayor James Failace was noted absent. NOTED ABSENT
MAYOR FAILACE
The Borough Engineer said this is only the base repairs. The County
will come in and they'll spend two hundred thousand dollars. DISCUSSION -
CONTINUED
Councilmember Reiman said this is the total, two hundred thousand
dollars, which we were talking about.
The Borough Engineer said the field survey is completed on all the
roads they were constructing as part of the 2002 Road Program. T.
Grosso does not want to do punch list or agree to three thousand
dollars ...
Councilmember Reiman reported that the Borough Attorney is at a
conference and he should be here in about fifteen minutes.

ENGINEER' S THE MILD( STREET PROJECT
REPORT
(Con' t ) The Borough Engineer said they got half of Milik Street paved before
the winter. We are waiting for the contractor Tarheel Enterprises to
come back. He said he is in dispute with them. They asked for one
inch and one half of pavement on (inaudible) and they get paid by the
tonnage. They want to paid for the entire amount
Councilmember Reiman asked how much they were asking for.
The Borough Engineer replied about $30,000.00 or something like
that. He said he had a Change Order for that job and what it does is
adjust a series of quantities which (inaudible) as built quantities. We
also agreed to work with (inaudible) in exchange for some curbing
improvements and we agreed to do some additional base work. We
also decided while we are out there doing construction, due to the
heavy traffic on that road, to expand the base repairs on that road. So
this addresses all (inaudible). The Harrison Avenue Pump Station, they
will be out there doing some test pit work and they will start work on
Roosevelt Avenue some time in May 2002.

The Borough Engineer reported that the Health Department Ramp
received a bid for $21,000.00. The consensus is that it is too high.
Tony Neibert is putting together quotes.
COUNCILMEMBER At approximately 7:15 P.M. Councilmember Sohayda was noted

The Borough Engineer spoke about the Flood Maps for Bergen Street
and was told they must petition the FMBA. He then spoke about the no
parking on Leffert Street and the proposal for the Waterfront and other
priority projects.
COUNCILMEMBER At approximately 7:30 P.M. Councilmember Santoro was noted

Councilmember Rios said he saw that they have a violation from the
Freehold Soil Conservation District. He said he was doing it for less
money because they were a little apprehensive with the big difference
on the bid and obviously this is what we get. You get what you pay
for. The bottom line is if you are going to be able to live up to the dead
line it what we have in the contract.
The Borough Engineer said the work was done in the first 45 days and
is not going to be completed on time. He said he is very concerned that
they are not going make the dead line.

The Borough Attomey said besides being over time is he going to be
able to get the job done?
The Borough Engineer replied yes.
The Borough Attorney said he saw the one for Freehold Soil, that is
corrected, right?
The Borough Engineer said they believe he corrected it. We haven't
confirmed that ..
The Borough Attorney asked if he had the sense that he is not going to
be able te get the job done.
The Borough Engineer said he thought they would be able to read the
(inaudible) of the contract and we'll be watching all that work and
technically that it is done correctly. He said he thinks this is a time
thing.
Councilmember Rios asked the Borough Attorney if there is any way
we can get in touch with this guy and call him into the next Agenda
Meeting. DISCUSS ION
The Borough Attorney replied yes.
The Borough Engineer said what it does is draw out the inspection
time.
Councilmember Rios said he sees four letters of communication from
your office to him in reference to questions or violations. In a matter of
five days, how much man hours is it costing us to keep policing this
guy? He said to him that is (inaudible) and if they have to hit him hard,
hit him hard. It is our money.
The Borough Engineer said they are trying to establish a record ...
Councilmember Reiman said they have certainly been building a paper
work trail, which is good, it is still $100,000.00 cheaper than the other
bidder. You may want to extend it an extra month as long as it doesn't
cost us anything additional on whatever time we are putting into it. We
need to assess him somehow.
The Borough Attorney said that is why we don't pay him, he's not
going to get paid. We have a liquidated damages clause that we don't
issue any more payments to. You're not going to bare the cost of
whatever additional cost but you are going to bare the additional cost
of time.
Councilmember Rios said they have to follow that through the letter
because sometimes things get lost in the shuffle from one department
to another and these guys try to get away with their (inaudible).
The Borough Attorney said they usually end up hounding us and that
is why we still have a lot of contracts hanging out because they are not
going to get paid until we can resolve it and that is why you have
about four or five that are kind of hanging out there because we are not
paying them. Gloria Goodrich was told not to pay them until they

work it out to our satisfaction. He said he is more concerned with
cutting him off the contract because you don't think he'll be able to do
the job.
The Borough Engineer said if you take him off the job and by the time
you get the new contractor out there, you are talking months and
months of (inaudible) anyway.
The Borough Attorney said (inaudible) the recycling sections
(inaudible) but at lease he can get it done. He then asked if the Board
of Health does their own salary Ordinances.
The Borough Engineer then discussed the Waterfront Park. - the bids
were received last week and they received prices on that, 2.1 to 2.5 and
the engineers estimate was about two million. The low bid was from
(inaudible) group, about 2.1. You may want to give some
consideration into going with plastic recycled lumber, which has 50
years or life..
DISCUSSION Councilmember Reiman addressed the Borough Engineer and said
CONTINUED they funded an additional seven hundred thousand last week to a
second week on May 2nd. It should give us enough money in addition
to the Green Acres Grants to choose anyone of those low bidders.
The Borough Engineer said he would finish going through his
reference checks and put it together and get it to you in about a week.
Councilmember Reiman asked the Borough Engineer if they were
sitting down with Maser Consulting to review who was going to be
making the joint recommendation.
The Borough Engineer replied that he has not been talking to him on a
daily basis but we are working close enough together that they do not
have a problem with them making the recommendations. They still
need an Army Corp of Engineers and they have been giving some
assistance in tracking that down.. Actually, the working relationship
has been pretty good.

Borough Attorney Robert Bergen said he knew they had some time
extensions and did any of the bidders have any problems or have
raised any issues in regard to the biddings once they have been in and
has anyone raised any questions with him.
The Borough Engineer replied no. He said he thought they might get
one from Simpson & Brown but it has been a week now and he had
not heard anything. There was a lot of paperwork that they had to
submit with they're ...The Borough Engineer said he guessed that the
general consensus, in reference to the Handicapped ramp at the Health
Department, was that it was too high and the project has been turned
over to the Construction Department and he believed Tony Neibert
was putting together some quotes for a wooden ramp.
Councilmember Reiman said that the Borough Engineer and he spoke
with Pat Tozzi, President of the Board of Health. They expressed their

concern that $20 to 30 thousand dollars is being spent on a building
that should be knocked down. They spoke about using an existing
wood ramp that is in town that can be modified or even if they built
one for five or seven thousand dollars. That is significantly less.
The Borough Engineer said there was another matter with regard to
(inaudible) and they were looking for the Borough to petition FEMA
to re-designate the flood maps for the Beverly Street property in that
area. He said he told them that was their responsibility and they had to
petition FEMA. There is no (inaudible) for the Borough to spend any
money in that regard. Also, McGruder has asked for no parking in
front of their facility on Leffert Street. He said he went out there and
looked at it and he can understand that they need the whole width of
that street along the front to conduct their operations. He said he did
not have a problem supporting that "No Parking". There is also an odd
parking situation on Carteret Avenue in front of the funeral home. He
said he would take a look at that and make a recommendation. The
third location is on Industrial Road, near the hot dog track. The request
was made for (inaudible) parking. He said he is looking at the shoulder
width and the length width. He said he thought that was a reasonable
request for a (inaudible) area. The Borough Engineer said he would
like to make a recommendation that he supports the 15 minute parking
there.
Borough Attorney Robert Bergen asked if they were measured all out.
DISCUSSION
Borough Engineer Don Norbut said he did a small sketch outlining the
len~hs and the setbacks
Borough Attorney Robert Bergen said McGruder has a tax appeal
against the Borough ..
The Borough Engineer said the last thing to discuss is what
Councilmember Rios brought up and that was the Middlesex County
Open Space Master Plan. He received a letter from the County asking
if they had progress (inaudible). The Waterfront Property on the
Arthur Kill, along the DuPont Property and (inaudible). The second
category is Borough Acquisitions and the parking lot that is right next
to the Waterfront Park that we need to acquire to provide parking and
boat trailer parking at the site. The property adjacent to us on the
DuPont sight for an access road back to the
Waterfront Park. The last category is improvement projects. He said
he came up with a couple. The financial assistance with the new access
road, the Waterfront Park, the Pop Warner Football Field, the Carteret
Park pond dredging and John Street Park rehabilitation as the fourth. If
that sounds good then we'll pull this together and get it submitted for
the next day.
Councilmember Rios asked where they were in relation to the access
road. For example if this was not available to us how are they going to
use that access to the Waterfront. We didn't get this and it wasn't
(inaudible).
The Borough Engineer replied that they had two options. One is to get
temporary access easement across the existing property that will get
them to and from the property. The second one is that they would
continue to develop this small emergency access off Industrial Road

that runs along the South West Side of the property. That could be
turned into an access road also.
Councilmember Rios asked what he and the rest of the Council think
of putting the Park Lake in a different priority order as far as reversing
with the new access road. That is going to cost a lot of money, about
three hundred thousand dollars just to do the lake. This is something
that we have to do.
Councilmember Reiman said he thought if they showed a willingness
to find some of the project we might get a more favorable look.
Councilmember Parisi asked if that was more in the thought process of
the County.
Borough Engineer Don Norbut said if you throw a little of your own
money it kind of (inaudible) the deal.
At this time there is talking back and forth and it is inaudible.
Councilmember Parisi said his only concern about the (inaudible)
situation is the other one that wasn't mentioned (inaudible). The
football filed is in really bad shape, the Pop-Warner Field, and we are
talking about safety issues. They are all priorities without a doubt...
Councilmember Rios said he agreed about the Pop-Warner Field and it

was an idea that he was thinking of.

Councilmember Parisi said his biggest question is how important is
that access road.
Councilmember Reiman asked if they had a cost estimate to apply to
the parking lot. We know we have two hundred thousand in Open
Space right now and local funding...
The Borough Engineer said he didn't know, off the top of his head
how many acres it is but he is thinking it is a minimum.
Borough Attorney Robert Bergen said they should be discussihg this in
Closed Session.
The Borough Engineer said the one thing they need to decide on is the
(inaudible) which has to be in the next day.
Councilmember Reiman addressed Councilmember Rios and asked if
he was saying the pond, the Sportsman Field ..
Councilmember Rios said he wants to know how from the Borough
Engineer to a (inaudible) professional as far as what's a priority is the
waterfront access road and it does make sense to make the access road
to the waterfront.
Councilmember Sohayda asked how much is it for that road.
Councilmember Reiman replied that they have two hundred thousand
dollars available.

Councilmember Sohayda asked if anyone knew how much the job
came to.
Councilmember Reiman said with the Waterfront Park ...
The Borough Engineer said there is a reciprocal easement between the
two properties. The second part is the improvements to pave it and
curb it. He then said he thought is was pretty soft back there so they
will probably have to dig it out and put a new face in that road.
Councilmember Reiman said they have to acquire the parking lot too,
right where the trailers are parked.
Councilmember Sohayda said there are no more trucks there, is there?
Councilmember Reiman replied that there are only a few, at the
moment, it is not like it was last year.
Councilmember Rios said it sounds like the priority list that Don
submitted.
Borough Attorney Robert Bergen asked if they saw the arterial photos
that have been done with the layout. They look pretty nice.
Councilmember Reiman said the Baykeepers put in a Green Acres RE: GREEN ACRES
Application to fund a purchase of the portion of the DuPont property. APPLICATION
He asked if they heard anything on that.
The Borough Engineer replied no. He said he asked Green Acres when
he was speaking with them last week.
Councilmember Reiman said the contact person is Megan Calis.
The Borough Engineer said he would call Green Acres and look to
speak to the division head down there to try and get an update.
Borough Attorney Robert Bergen said he had a meeting with Andy
Wilner on Saturday. He is the actual baykeeper and he said they
submit so many applications. He said he spoke to him about a week
ago and he asked him to take a look at that application to see where it
ranks on their list. He said he might have some information for us by
the end of the week.
Councilmember Rios said he had a couple of questions. The job that
was done on Washington Avenue, the Water Company did to redo that
construct]on job that they did, they repaved it but they did a ten'ible
job.
The Borough Engineer said he sent a few letters to the Water
Company and what he does is put it in a (inaudible) file. He said he
just received it on his desk yesterday and to give him a call and find
out the status (inaudible).
Councilmember Parisi said that spot is horrendous, but they fixed it.
Councilmember Rios said before it was a hole and now it is a hump.

Borough Attorney Robert Bergen asked if they used the laser these
days.
The Borough Engineer said what they like to use is the infrared heaters
that actually meld the new asphalt with the old, it is almost a seamless
repair. They apparently did not use it.
Councilmember Rios asked if anyone received a letter from a company
in reference to (inaudible) in West Carteret at the foot of the bridge.
Councilmember Santoro asked if he meant by the drain by the comer.
They have been talking about that. Somebody knows about that and
asked if he meant in the sewer drains where the water is just sitting
there. That is fight by CVS.
Councilmember Rios said no, they are talking about the other side of
the bridge in West Carteret.
Councilmember Santoro said he is talking about the site plans for the
standing water and the company on the comer was supposed to take
care of it.
Councilmember Sosnowski said this was a complaint about standing
water and quite a few misquotes ..
Councilmember Santoro said that was when they were going back
..that was that company that went before the Zoning Board. If they
expanded they're building ...
DISCUSSION
Councilmember Rios asked if anyone else received that lett~r~
The Borough Attorney asked if they were talking about the easement,
the drainage easement for the Fugi Poly property where they gave us
$15,000.00 to do some repairs and granted us easement.
Councilmember Rios said yes and there is still water standing there
and before the summer comes ...
The Borough Engineer said if it is related to a site plan then John
DuPont, who inspects all the improvements... He then said he would
call Mr. DuPont and ask him to ...
The Borough Attorney said he had a copy. The issue was that the
easement was negotiated through the Planning Board ...one of the
issues of the easement, he sent it over to the Borough Engineer to look
at, we had some concerns if that is the same easements we a~e talking
about, the agreement then provides for who is ultimately responsible
for maintaining that easement. It has already been negotiated, we got
some things back from Fugi Poly but it is not perfect. Their letter says
if they contributed money towards the repair to the Planning Board he
doesn't know whether the Planning Board ever received the money
when the Borough received the money... Supposedly, there was an
agreement to put (inaudible) rock in there but he had not seen that in
writing or anything.
Councilmember Rios asked if that was. actually Fugi Poly (inaudible)?
He said his last question is what kind of progress are we making with

Woodbridge as far as re-routing the traffic on Roosevelt Avenue in
West Carteret.
The Borough Engineer said he spoke to Bob (inaudible) about a week
ago and they said they had received (inaudible) and that they were not
prepared at that time to respond ..
Councilmember Reiman addressed the Borough Engineer and said
they received a residential complaint where a tree was cut down a year
or two ago. The limb fell and broke a piece of sidewalk to replace that
and one was at 25 Chrome Avenue. He said Councilmember Parisi has
a name but he was not sure it was the same resident.
Mayor Failace said he was sure it was.
Councilmember Reiman asked the Borough Attorney if the name was
Sikora. There were two or three pieces of concrete that we know of.
Borough Engineer Don Norbut said one thing he forgot to mention
was that he received a letter from the DOT, which indicates that
they're accepting new applications for this year (inaudible) cycle for
road improvement projects, for pedestrian improvement projects and
bike way projects. We have a good shot at getting money for that over
the next couple of weeks.
Mayor Failace asked if we had some information for the Borough DISCUSSION
Engineer for Closed Session.
The Borough Attorney said he would handle that. He then asked if he
brought the letter that spoke about the grinders. He asked if the
Borough Engineer had to leave the meeting or could he discuss it in
Closed Session.
The Borough Engineer said he could stay.
Councilmember Sohayda reported that Brian O'Connor approached
him because he wants to know if they can ...
The Borough Engineer asked if it was in reference to the driveway. He
said he understood it was a depressed curb along Industrial Road
behind the Fire House. It may be a good idea for moving equipment in
and out to have that apron and driveway put in at that area. He said he
had not looked at it but it is graded and he is sure they can add that to
the road program for this year.
Councilmember Sohayda said safety issues number one being no
parking into the back of the firehouse. Number two, access to the
hydrant for training procedures and number three, hose testing.
Mayor Failace said he thought they should just do it, add it to the
program. He said he was sure they could find some funds somewhere.
Councilmember Sohayda said the concrete is already there. The
driveways and curbs have to be cut out.

Councilmember Rios asked if there was something wrong with the
road improvement.
Councilmember Santoro said she thought there was Oakwood and the
one they were asking about..
The Borough Engineer said they may have $5,000.00 to play with.
Mayor Failace said that would not do Oakwood Place.
Councilmember Rios said there are only patches on Poplar (inaudible).
Would that be three blocks?

Councilmember Rciman said with the COAH Regulations and the
Contractors, we never .... He then said he would ask that question in
Closed Session.
RESOLUTIONS 5. Resolution of Retirement - Carole Manetta.
6. Authorizing UEZ Administration Budget for 2002-2003.
Councilmember Santoro asked where the UEZ Budget was.
The Municipal Clerk replied that a copy was in every Councilpersons
mail bin.
COMMENTS
Councilmember Santoro asked if it was put in that day.
The Municipal Clerk said it was put in a few days ago.
Councilmember Santoro said she picked up her mail so she would like
another copy of the Budget.

1. T&M Associates -
a) "No Parking" - Lefferts Street.
b) "15-Minute Parking - Industrial Road
The Municipal Clerk said T&M already spoke about those items.
2. Councilmember Reiman - a) Temporary Clerical Position
b) LOSAP Program-Emergency Services
Councilmember Reiman reported that did a few interviews with
individuals who dropped off applications. For Court Violations Clerk,
Cheryl Valiant, temporary, full time, Joan Martin, temporary part time,
Judy O'Connor, temporary part time. He said he has a construction INTERVlEV/S
permit clerk, Mary Ann Caputo, temporary full time. Please keep in
mind that were are going to have to fill one temporary position in each
(inaudible). He said he would like to make a motion to appoint these
temporary employees tonight because we are behind, especially in the
Courts.
Councilmember Santoro said they already appointed someone for the
Courts.
Councilmember Reiman said she is only working on Saturday and
Monday night, potentially. She works three to five hours a week
versus three full time employees.
Councilmember Reiman made a motion to appoint three people for
the Court.
Upon MMS&C, by Councilmembers Reiman and Rios a motion was
made to appoint Cheryl Valiant, Joan Martin and Judy O'Connor to
the Court.
RESOLUTION #02-199 was introduced by the Mayor and referred to RESOLUTION ~02-199
the Council for action APPOINTING ~

Upon MI'AS&C, by Councilmembers Reiman and Rios CARTERET

was not adopted. Upon individual roll call vote Councilmembers NOT ADOPTED
Reiman and Rios said yes. Councilmember Santoro, Sohayda and
Sosnowski voted no and Councilmember Par/si abstained.

Councilmember Parisi asked if everyone that applied got the job.
Councilmember Reiman said no.
Councilmember Parisi said he was talking as far as the interviews.
Councilmember Reiman said it is basic clerical positions.
Councilmember Santoro asked if they abstain and hold the vote can we
make a motion to go into closed session.
The Borough Attorney said if she abstained her vote it would not count
so she would have to vote yes .... (inaudible).
Councilmember Reiman asked why they voted no. If the finance
committee members showed up at the interview as was scheduled...
Councilmember Parisi said that is a matter for discussion too because
that is not necessarily true.
Councilmember Reiman said they should pull the minutes from the
last meeting ...
DISCUSSION
Councilmember Parisi said this was mentioned all too quickly, at the
end of the meeting and initially while at that meeting we said
Tuesday..
Mayor Failace interrupted and said this doesn't mean that it is dead.
Councilmember Reiman said he understood that..
Mayor Failace said evidently Councilmember Parisi has a question
that he wants to ask and he has the right to table the (inaudible).
Councilmember Reiman said Assembly Bill A 1041, which is in the
second reading (inaudible). What he asks is the Council pass a
Resolution in support of this. What it will do is provide for LOSAP for
OEM Members. Currently the Volunteer Fire Fighters are
participating in the LOSAP Program and what it does is allow for a
pension after so much time. It is a minimal amount of money that we
would provide to this program. Since these volunteers don't receive
any compensation, after a certain amount of time they would be
eligible for this.
Councilmember Santoro asked if there were any other volunteer
groups that they were leaving out.
Councilmember Reiman said they are the only three that are provided
by state law.
Mayor Failace asked what the bill number was.
The Municipal Clerk said she had a copy if he wanted it.
Mayor Failace said yes, he would like to look at it.

Councilmember Reiman said they wouldn't be mandated to put OEM
in there but it would allow the municipality, by Ordinance, to put them
in there.
Councilmember Par/si asked how much it would cost.
Councilmember Reiman said $500.00 a year. They spend hundred of
hours a year volunteering for emergencies.
Councilmember Santoro said the other ones they did were the fire
department first then ....
Councilmember Sosnowski said he had two things for Buildings &
Grounds. He said he would like to request to go out to bid a
(inaudible) for the top of the building. It is thirty years old and it has
cost us approximately $1500.00 to keep it running for the past two
months. It is not repairable and can go at any time. He said they
received some quotes and they are all past the bid threshold.
Mayor Failace asked if there were more than two units.
Councilmember Sosnowski said there were probably two units up. The

other thing he wanted to discuss was to put on for approval, at the SERVICE
meeting, was a cleaning service to take care of Borough Hall and the
Annex. One would be one hundred thirty-three dollars a week and one
would be one hundred forty eight per week. It is a licensed maid
service. We looked into hiring additional people but right now the
money is not there.
Mayor Failace asked if that would be an additional $300.00 per week.
Councilmember Sosnowski said for a year it would be $6,916.00 for
the one building and $7,696.00 for the other. This would give our
maintenance workers some assistance in the cleaning and give them
more time for maintenance work.
Councilmember Rios asked if it would cost less to hire them part time.
Councilmember Sosnowski said if they looked at hiring part timers,
one would not cut it.
Mayor Failace asked how many people would they bring in.
Councilmember Sosnowski said they would come in Monday through
Friday everyday and that includes emptying garbage, replacing liners,
and cleaning windows and entrance doors, cleaning the bathrooms
vacuumir~g, sweep and mop and on Friday dust all areas.
Mayor Failace asked how may people will be working.
Councilmember Sosnowski said there should be two people coming in
everyday to clean that much area. They supply their own equipment.
The Borough Attorney said he needs three formal quotes to do a
resolution on that.

Councilmember Rios reported that he received a letter, he doesn't
know if the rest of the Council got it, but one Pastor spoke to him and
RE: RENTAL OF he told him he needed something in writing. This is from the Fountain
OLD LIBRARY of Salvation Missionary Church and pastor is Louis Gonzales. The
BUILDING would like to rent out the old library building for their congregation.
Councilmember Santoro asked if Catholic Charities is still looking at
that building.
Someone replied yes.
Councilmember Rios said he just wanted to present this to the Mayor
and the rest of the Council. Right now they rent the Catholic War Vets
on Jackson Avenue and their time there is limited.
The Borough Attorney said that is one of the issues that~e has for
Closed Session. He said he wanted to discuss that building.
The Borough Attorney reported (inaudible) an issue with regard to
what role he plays in property maintenance. He said he wasn't sure as
to whether he had ever been designated property maintenance officer.
There is the ordinance that he has but he never went back to take a
look at it. He said he asked him what he was enforcing here and does
he enforce the Boca property (inaudible). He said he looked over the
Boca code... He said the Borough has it's own Ordinance. Once again
he said he looked over the Boca Code, and after he went through it he
thinks its more effective than our Ordinance. He has asked if they
could put an Ordinance on to try to incorporate certain provisions of
the Boca Property Maintenance code in addition to the Borough of
Carteret. He said once they work out the languages he would like to
put it on for the next Council meeting.
DISCUSSION
Councilmember Reiman asked if there would be a legal problem
picking and choosing ....
The Borough Attorney replied no, that was why he asked, some towns
have them
Councilmember Rios said there is a strength in what he is saying. He
said he brought to Tony Neibert attention International Bakers. They
have been a nasty neighbor for many years and he has been getting
complaints of resins in the air and those conditions are disgusting. Bird
droppings over the house and cars it is horrendous.
The Borough Attorney said after you deal with that ... One of the
things about the Boca that he likes is certain provisions in regard to the
number of people you can have. You have to be careful i~ what you
want to enforce because there will always be a provisiSn in the
Ordinance that says whatever is more s~ngent has the right to enforce.
Councilmember Reiman asked if he was going to get a highlighted
version of what is changed?
The Borough Attorney replied that he and I will work on that and then
get it over to you because he is going to go over the Boca Code with
him in the next week. He said he had some questions about the
provisions he wanted to put in. He then said he had a problem with the

way our unfit dwelling ordinance complies with the State Statute.
Tony Neibert always has the power under the uniform construction
code to deal with emergency situations and dilapidated housing. Under
the statute they probably sent a letter to asked that they go out and
review the town and see what conditions they are in. There are certain
findings that he has to make before we can implement an Ordinance.
He has made those findings and they want to incorporate those
findings into a Resolution that authorizes them to an Ordinance that
must be drafted to comply with the statute. He then said he would like
it put on for Thursday night. Also, there is a professional service
resolution for (inaudible) and it appears that they get paid $150.00 an
hour and with the Ordinance they have been getting that amount fi.om
the Borough for quite a number of years. He then said he is going to
amend the prior resolution.
Councilneember Santoro asked if it was going to be more money.
The Borough Attomey said it is not going to be more money it is going
to be a different hourly rate.
The Borough Engineer said he had one additional item. He said he got
a call late that day from Tarheel Enterprises. They had finished up
(inaudible) work on Industrial Road. It is part of an old project and it is
now complete. The DOT inspected it, they inspected it and it is
acceptable. T&M has been holding the money for some period of time BOROtlGIt
and if we can add that final payment for the next meeting that would ENGINEER
be great. That would be subject to them posting a maintenance bond, if
appropriate.
The Borough Attorney said he thought they did that one already.
The Borough Engineer said he knew they approved the final payment
certificate and change order pending the work being done. The work
is now done and he thinks (inaudible).
The Borough Attorney said we have to make sure we get a
maintenance bond from them and make sure it is acceptable based
upon whatever that amount should be. We need proof of payment so
we can process the payment on that one. He then said he would call
Gloria Goodrich that week. The Borough Attorney said he thought
they did it back in December.
Mayor Failace said he had a letter from a Pastor from the Zion RE: ZION LUTHERAN
Evangelical Lutheran Church. They are looking for some parking CHURCH - PARKING
privileges. The Mayor then asked Councilmember Santoro to take a PRIVILEGES
look, unless you have already. They are not looking for handicapped
parking.
Councilmember Santoro asked if they wanted it to be permanent.
Mayor Failace said he didn't know and that was why he was passing it
along to her and this way she can take a look with the police.
Councilmember Remain said they wanted temporary approval for
Sunday Mornings.

Councilmember Santoro said they also did it once because they had an
affair so they did a temporary parking thing.
Mayor Failace said they did not do it on a permanent basis. He said he
assumes they want it for every Sunday morning for their 8:00 A.M.
service.
Councilmember Santoro asked if they had a date for the school board.
She said she was reading the letter that the Municipal Clerk sent her
with the time frame.
Mayor Failace said they have until May 20th to make any other
decisions. He said he spoke with Gary Higgins and he had not received
the (inaudible). It was due on Friday and they never got it. What he
would like to do first is meeting with a three person committee from
the board and a three person committee from the Council first, justs to
go over it. The Mayor said he called the Board of Education and he
told them he would be willing to go on May 6th, 5:30 or 6:00 P.M. and
what ever other two Councilmembers. He said he asked th~ Board of
Education if that was good for three of their members just to get some
questions answered. We have until the 20th to make any final decisions
or cuts. Because Mr. Higgins just got it today he couldn't give him a
date but he gave the Mayor the May 6th date.
Councilmember Santoro said the board meetings should be the end of

Councilmember Parisi said the 14th is their Agenda Meeting.
Mayor Failace said it will be between that date because he doesn't
know if he'll be ready because of the delay in getting his paperwork.
As you well know there is a lot of paperwork there.
Councilmember Sosnowski said he will not be at that meeting because
he is an employee of the Board of Education.
Mayor Failace said he certainly can't vote...
The Borough Attorney asked Councilmember Sohayda if he had any
current contracts with the Board of Education.
Councilmember Sohayda replied that he does.
The Borough Attorney said he just wants to make sure that Mr.
Higgins has what he needs from them because they are supposed to do
it by certain deadlines. If he doesn't have it please let the Borough
Attorney know right away.
Municipal Clerk Kathleen Barney said he gave her the information ..
The Borough Attorney said but if he doesn't have what he needs to
please let him know right away.
Councilmember Reiman said the only thing he has for Closed Session
is potential litigation.
