HomeMy Public PortalAbout1960-05-28 Regular Meeting75 Mr. Webb advised the council that there had been a request that Bal Harbour pay part of the expenses involved when Mr. Anderson, the Village Attorney, attends the Municipal Attorney's conventions. After a general discussion, Mr. Broeman moved that the Village pay one—fourth of Mr. Anderson's expenses; however, said payment is not to exceed $150.00. Mr. White seconded the motion and it was unanimously approved. Mr. White stated that the people residing in the apartments just north of the church were suffering from excessive amounts of dust caused by cars parking on the unpaved lots near the church during services on Sundays. Mayor Hart recommended that Mr. Broeman and Mr. Faulkner serve as a committee to discuss the matter with Mr. Whitman and try to work out some arrangement whereby the cats could make use of the paved parking lot on Sundays. Mr. Broeman suggested that a hose be purchased by the Village to be used for pumping out boats at the yacht basin. Mr. Webb explained that the Village was getting prices on an ejector and would contact the Bal Harbour Club, Inc. to see if they would purchase same. There being no further business to be brought before the Council, the meeting was adjourned upon motion by Mr. White and seconded by Mr. Broeman. ATTEST; Village Clerk April 23, 1960 COUNCIL MINUTES May 28, 1960 Mayor The Sal Harbour Village Council held its regular meeting at the Village Hall on :iaturday, May 28, 1960, at 9:30 a.m. White. Those present were; Messrs.'nroeman, Faulkner, Hart and Absent: Mr. Beatty. Also present were W. H. Webb, Village Manaaer; Mary T. Wetterer, Village Clerk; and Thomas H. Anderson, Village Attorney. 76 The meeting was called to order by Mayor Hart and -after hearinn the roll call, the minutes of the April 23, 1960 meeting was approved as submitted upon motion of Mr. Rrneman, seconded by Mr. Faulkner, and unanimously voted. The first item considered by the Council was a committee report reoardinq church parking. Mr. White reported that they had met with Mr. Whitman, owner of the paved parking lot east• of the church property, and that he had agreed to permit parking on that lot, without charge, to persons at.tendinn church services during church hours this summer. Mr. Webb, the Village Manager, reported to the Council that an ejector for pumping out boats had been purchased for a total price of $45.00 and was being kept on one of the fire trucks for use at any time that it should be needed at the basin. Mr. 'Webb then reported that the additional 1000 qpm sewer pump had been installed at the pumping station and that every— thing was in good condition. After a brief discussion, the Council confirmed the expenditure from surplus of $5,615.72, the total cost of the installation. A tabulation of Dade County bids for the Haulover dredninq and groin work was read and explained by the Village Manager. He reported that Calif Construction Company will construct the groin at a cost of $48,630.40 and the dredging contract was awarded to J. :'.. Fraser and Sons Inc. in the amount of $253,900. which includes the $80,000. of fill to he placed on i3a1 Harbour beaches. It is expected that the work will he started within the very near future. Mr. Anderson, the Village Attorney, had been asked to prepare an ordinance which would permit the funds received from the State of Florida for the Firemen's Relief and Pension Fund to he deposited into a special fund. Mr. Anderson explained that the ordinance which he had prepared covered the Firemen's Fund only and that it would be necessary for him to confer with the Tallahassee office further before he could prepare an ordi— nance which would cover the Policemen's fund. He further explained that the two funds had different requirements under the State Statutes, Mr. Anderson then recommended that the ordinance be accept.nd as submitted with the addition of one paraoraph which would state that all conflicting ordinances new in effect be repealed. After considerahle discussion, Mr. Rroeman moved that said ordi— nance be adopted as presented with the addition of the paragraph su,nested by Mr. Anderson and entitled ORDINANCE NO. 76 AN ORDINANCE RELATING TO THE HAL HARBOUR VILLAnE PENSION PLAN This motion was seconded by Mr. White and unanimously approved by the Council. May 28, 1960 77 Mr. Wehh then read a letter from Ra1 Harbour Club, inc. requesting an amendment to the Noise Ordinance to prohibit all construction during the winter months. He also read his reply to the Club in which he advised them that he had seen the ordinance from which n!,rs was copied attacked in the local courts and in both instances the City lost the case; and, that .to halt construction on any property is unconstitutional as long as the proposed construction meets the building code, etc. He also reminded the members of the Council that some projects such as hotels or large apartment buildings renuire a year or more to complete. When Mayor Hart asked the Village Attorney for his opinion on this matter, he stated that he felt that Mr. Aehb's letter answered the question completely and that he had nothing further to add. Mr. Faulkner then moved that inasmuch as the Village Manager's letter was read and his decision approved, that Mr. lr'ebh advise the members of the Ral Harbour Club that the Council does not see any legal way to change the Noise Ordinance. This motion was seconded by Mr. Broeman and unanimously voted. Request for permission to park approximately 75 locomotives on the Whitman property during the American Legion Forty and Eight conventior was -iranted upon motion by Mr. Broeman , seconded by Mr. Faulkner and unanimously vo to . A change in the officers of One Rat Harbour, Inc., operators of the Singapore Hotel for their liquor license was accepted upon motion by Mr. Broeman, seconder? by Mr. Faulkner and unanimous— ly approved. Mayor Hart signed a Proclamation recogni.zin❑ October 24, 1960 as United Nations Day and named Mr. John F. Beatty as leca1 Chairman. A letter from Mr. Faulkner thanking the Council for permitting the Roy Scouts to use the Council room for their meeting during the month of May was read. Mr. Faulkner stated that he had received several complaints from the people in the Village regarding the speeding. He said that he wished to call attention to the condition existing at the corner of Park and Camden "rives. Mr. 6:ebb said that a Stop sign would be painted on the street at this location and he believed that this would take care of the hazardous condition, There being no further business to he brought before the Council, the meeting was adjourned upon motion by Mr. Broeman, seconder by Mr. Faulkner.
