A RE SOLUTION OF THE VILLAGE COUN CIL OF THE
VILLAGE OF KE Y BISCAYNE, FLORIDA, URGING THE
MIAMI-DADE COUNTY BOARD OF COUNTY
COMMISSIONERS TO ADOPT AN ORD INANCE
ALLOWING THE USE OF PARK IMP ACT FEES FOR
GRE ENW AYS; PROVIDING FOR TRA NSMITTAL; AND
PROVIDING FOR AN EFFECTIVE DATE.
W HERE AS, currently, under Section 33H-3 of the Code of Miami-Dade County
("County"), park impact fees provide a source of funding for park land acquisition and capital
improvements to address the impacts of new development, but park impact fees cannot be used for
the development of greenways; and
WHERE AS, on February 1, 2022, the County Board of County Commissioners ("BCC")
will hear an Ordinance on first reading to allow the use of park impact fees for the development of
greenways; and
WHEREAS, in order to encourage the development of green ways throughout the County,
the Village Council supports the Ordinance and urges the County BCC to adopt it; and
WHERE AS, the Village Council finds that this Resolution is in the best interest and
welfare of the residents of the Village.
NOW , THERE FORE , BE IT RE SOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals. That each of the above-stated recitals are hereby adopted,
confirmed, and incorporated herein.
Section 2. Urging Miami-Dade County BCC. That the Village Council hereby urges
the BCC to adopt the Ordinance.
Section 3. Transmittal. The Village Clerk is directed to transmit a copy of this
Resolution to the members of the County BCC.

Sect ion 4. E ffective D ate. That this Resolution shall be effective immediately upon
adoption.
