HomeMy Public PortalAbout2002/08/08 AUGUST 8, 2002 The Agenda Meeting of the Mayor and Council of the Borough of AGENDA MEETING Carteret preceding the Regular Meeting, August 15, 2002, was held August 8, 2002 on August 8, 2002, 7:00 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. The following were noted present: PRESENT Mayor James A. Failace Councilmember Ronald Rios " Janet Santoro " Buddy Sohayda " Brian Sosnowski Noted Absent were Councilmembers Frank Parisi and Daniel Reiman. Also noted present was William Peck, Esq. who was representing Robert Bergen, the Borough Attorney, who was noted Absent. Mailed to the Home News Tribune, The Star Ledger and posted on STATEME~rr OF MEETING NOTICE the bulletin board on August 2, 2002. TO ADDRESS GOVERNING a) Tony Neibert - Councilmember Santoro said she had invited BODY Mr. Neibert to a previous Council Meeting. There was Tony Neibert questions about the Borough issuing summons and signs to property owners and she knows Tony has been working on it. Tony Neibert said he has put together information concerning where we are with the plan. He handed out paperwork in reference to this and said they could look at the stats on it. He explained that the multi colored sheet they use to track violations, summons and warrants. He spoke shortly on this. He said with the passing of the Bulk Property Maintenance Code, it has given us an added feature to look at some of the areas we had not had an enforcement of. It has given us a tool to look at the multiple occupancies and houses that shouldn't be. The Property Maintenance Code is the basis of what the Council is trying to do to redevelop Carteret. He went on to explain that they had taken pictures of the before and after of the violations and spoke on this briefly. He said each violation they receive is about two and one half inspections. He said about $16,000.00 since January 1st has been issued. He said in September they are doing a realignment of Mr. Nagy's duties, where about 70% of his time will be devoted to property maintenance issues along with a good portion of his time. Councilmember Santoro asked if they could have some copies of the paperwork, (about twenty (20)), Mr. Neibert gave out explaining the property maintenance for the next meeting. AUGUST 8, 2002 Tony Neibert Cont: Councilmember Santoro asked Mr. Neibert if they come across a senior are they informed about the programs available to them. Mr. Neibert said they are. Mr. Neibert said he and Councilmember Rios are trying to clean up the industrial areas. Councilmember Santoro asked who has the responsibility to go out to the sites. Mr. Neibert said Cookie takes the violation sheets off the computer and distributes them to him, Mr. Nagy and Mrs. Ransdell of the Health Department and they collaborate on the violations. He commented that they usually let the Board of Health answer most of the grass questions and a water problem would be both departments, etc. Councilmember Santoro said her concern is there is two (2) active departments and a program going and she said that only one (1) should control the follow up on it. Mr. Neibert said he thinks it would be his department that should do that since they just passed the ordinance. Councilmember Santoro asked if the Board of Health had a list like this. Mr. Neibert said no. Councilmember Santoro said maybe they could request from them to do something and we could be aware of what they are doing. Mr. Neibert said when people come in with warrants the Police Department will be sent out after the individuals with the warrant. Mayor Failace asked as an example, if at this time all Borough owned property is clean. Mr. Neibert answered, No. He said obviously that is a situation that the Park's Department has a problem getting to it with their workload. Councilmember Rios said he has been in contact with Mr. Neibert's office in the past three (3) months probably about a dozen time about one individual, a commercial business. He then asked the attorney present if he could mention the name public. Attorney Peck said he would not at that time. Councilmember Rios said he did not think it was fair to the residents in that particular area to put up with that kind of bad neighbor policy that they do. He said Mr. Neibert's office has been AUGUST 8, 2002 very active in this. He said people should not have to put up with Tony Neibert Cont: such a large amount of bird droppings in their back yard. Tony Neibert commented that when they were there it was approximately two-thousand (2000). Councilmember Rios said that it is not acceptable and then went on to say he rode around in that area, and said it was Lafayette Street. Mr. Neibert said that is an area where the Board of Health had originally taken the lead because of health issues and they are still actively involved in that. He said that his office would be siting him on being a Public Nuisance. He said he understood from Mrs. Ransdell, that John Dowd, the sanitarian has gone to the state and requested them to look into the problem for us. He said their waste product winds up in open containers in their yard and they also have a problem when they receive their deliveries that it spills out onto Roosevelt Avenue and into the driveway and that is where the birds start picking up. He then said he and Mr. Rios are also dealing with another situation with a pool. He said their last court appearance was this particular Wednesday and they recommended to the judge that they remove the pool and the judge recommended to the defendant that the pool be drained and not pulled up until they get the PE's report from the retaining wall and also on the final fixing. The other resident that was involved is very happy and wished to extend her thanks to our department for the work we had done. He spoke shortly on this. Councilmember Rios said his concern it is not fair to the neighbors of either case. He questioned why they couldn't say to the judge on -- their behalf to go for the maximum. Tony Neibert said he did. His recommendation is that the pool be decommissioned. The defendant pleaded his case and the judge talked to the other neighbor and they decided to be a little more lenient. He commented that the people involved are friends. Councilmember Rios said that was a satisfactory answer and he was sure the rest of the Council would agree and then he asked Mr. Neibert if the Council could request him to shut down that business. Tony Neibert said they could. He said they corrected the outside a lot but they have an have an internal control problem. He said he would take that in consultation with Attorney Bergen before doing that. He said they probably would need proper notification. Councilmember Sohayda asked Mr. Neibert if there was a company in court, it was public knowledge and then asked him the narae. -- Mr. Neibert said I~C. He then spoke on this and other projects that are cleaning up the town. AUGUST 8~ 2002 Borough Engineer b) Borough Engineer - Don Norbut spoke on various projects. On the Road Improvement Projects, he spoke on the 2002 Road Program and wants a resolution put on for the Council Meeting for the award of the bid, and then he said the Milik Street Rehabilitation is scheduled to be completed. He then spoke on Sanitary Sewer Projects, saying the Harrison Avenue Pump Station will have the final site work completed within the next several weeks and the Roosevelt Avenue PS Communitor and HVAC Contract, Standard Industrial Services have completed all the contract work and is scheduled to complete the extra contract work for the installation of new wet well duct work within the next week and on the Roosevelt Avenue PS VFD's and Control Replacement the bids were received for the replacement of variable frequency drives and the main control panel. The low bidder was Quality Electric Construction Company which they are recommending the award of bid to and he would like a resolution put on for this at the Council Meeting and on the Sewer Inspection Camera Purchase, they will be selecting a camera system for this. Then he spoke on the Waterfront Park, on Contract Administration saying they had initiated regular progress meetings with the Reicon Group, who have submitted a tentative schedule for a six (6) month contract completion and a shop drawing submittal schedule. The NJDEP Soil Cap Approval was received by the NJDEP. On Environmental Permits, they had the Anny Core Engineer Permit and it expired and we cannot apply for an extension so what we have to do is re-file new applications and during that process the New Jersey and New York Sandy Hook Pilots Associations put in a protest about conflict between large ships and small water craft they have proposed for the project. They will respond to the Army Core within the next ten (10) days. On the Temporary Construction Access Easement, the Borough Attorney is pursuing one from the owner of Lot 1, Block 4 and anticipate it within the next week. He then spoke on Grants and Loans, saying they received $500,000 from Green Acres for the Waterfront Park, Phase II and will be asking Green Acres approval to transfer this to cover improvements at the Carteret Park and Sportsmen Field, on or before August 15th. On the Fall 2002 Green Acres Application, they will be preparing one for submission to Green Acres on August 15, 2002 for approximately one (1) million dollars for Waterfront Park, Phase II improvements, along with pond dredging and edge treatment improvements at Carteret Park. On the 2002 Middlesex County Downtown and Business District Imrovement Fund he said The Middlesex County Office of Economic Development will be accepting grant applications for a maximum grant award of $100,000 for projects aimed at Downtown and/or Central Business Districts, town and commercial centers, due September 6, 2002. Councilmember Santoro said they are filing for that grant and spoke on this shortly. She said Don Norbut was doing a good job in putting it together for them. 4 AUGUST 8, 2002 He then spoke on General Issues, on the Roosevelt Avenue Borough Engineer Bypass, West Cartert he said he was recently contacted to the Cont: Woodbridge Township Engineer concerning the Borough's Truck Diversion Plan and said the township's administration is favorable to using Milik Street as the designated truck bypass route instead of Federal Boulevard and the township is not favorable to signing Omar Avenue for "Local Traffic Only. He asked Mr. Simicsak to put something in writing and they can move forward with the county and on the Hill District Storm Sewer Project Planning Document we are proceeding with the preparation of the environmental information document as required by the USEPA for the Hill District Storm Sewer Project. His intent is to submit a draft planning document for Mayor and Council review, prior to the next Council/Agenda Meeting. On Industrial Monitoring Contract Renewal, he said quotes were received for Wastewater Monitoring of Industrial Users for 2002. The low bidder was Garden State Laboratories at $17,496. They are recommending awarding the bid and he wants a resolution put on for the Council Meeting. Don Norbut then went on to speak about the additional work at the Roosevelt Avenue pump Station they had authorized $23,000 worth of work. It was over and above the normal contract scope for him to observe that work and do the necessary paperwork and he is asking for an increase in his fee of about $2700 bringing his fee to about 7%. Councilmember Santoro asked if anyone had a problem putting that on and none of the Governing Body present objected. Don Norbut said he spoke to the County and they are ready to come in September and do all of the overlay work on several local streets. As part of the 2002 Road Program we are going to do some base repair and then mill and pave them. Councilmember Santoro asked Mr. Norbut to check on what roads they are doing. Don Norbut said the last item is associated with the Road Program, which is again $750,000. He explained they had to put a couple of deduct items in the bid just to make sure they had enough money to award a contract and that was for the extension of the Fire House Driveway and also for Liebig Lane. MINUTES FOR Mayor 23 & July 18,2002. APPROVAL Police Officers - Councilmember Santoro said they are doing the C(I'~ENDATIONS commendations for the murder investigation she spoke about and Chief Pieczyski has the list and she wants to recognize all the AUGUST 8, 2002 COMMENDATIONS people involved. She also wants to recommend Sue and Bob Talali Cont: for their work on National Night Out. ORDINANCES Public Heating - #02-16 Amending and Supplementing Ordinance #00-22, Creating Chapter 183 of the Code, Re: Open Space Trust Fund. #02-17 Amending Chapter 182 of the Code, Re: Park and -- Recreational Fees. #02-18 Amending Article 1, Licensing Regulations, Chapter 71, Re: Alcoholic Beverages. #02-19 Amending Code, Section 254-37, Schedule XiX, Re: No Passing Zones. RESOLUTIONS Directing the Issuance of Various Raffle Licenses. Refund of Tax and/or Sewer User Fees. Authorizing Various Contractors to Perform Rehabilitation of Homes Pursuant to COAH. Authorizing Extension of Time for Payment of Taxes to September 3, 2002. Authorizing Carteret Community Development Department to Request Funding for the Roosevelt Area Business District Revitalization. Mayor Failace asked the Finance Committee if they ever floated a bond for that. Councilmember Santoro said she did not think they ever completed that and said they were just talking at a Budget Meeting about adding into that. The Mayor said that he meant that Patrick was looking in order to assure, since the tax bills went out late, enough funds. Patrick was looking to go out and borrow money at a very low interest rate. Councilmember Santoro said they had to do that already. Requesting Approval of Insertion of $15,995 the 2002 Budget Revenue Available from the Gates Foundation Library Computer Grant. Appointing the School Traffic Guards for the 2002-2003 School Season. Councilmember Santoro said we have two (2) guards retiring and also they are looking for alternates to be able to start training because they are anticipating at the end of December the possibility of more. Award of Bids - Roosevelt Avenue Pump Station. Award of Bids - 2002 Road Program. AUGUST 8, 2002 Councilmember Santoro said on resolutions, we need to vote on a resolution appointing George Strangos to are UEZ as a voting member· RESOLUTION #02-302 was introduced by the Mayor and was RESOLUTION ~02-302 Appointing Member referred to the Council for action, to the Urban ~J~t rW~ Upon MMS&C by Councilmembers Santoro and Rios 7one RESOLUTION #02-302 "APPOINTING MEMBER TO THE URBAN ENTERPRISE ZONE ADVISORY COMMITTEE" was Adopted· Upon individual roll call vote, Councilmembers Adopted Rios, Santoro, Sohayda and Sosnowski voted in the Affirmative. Councilmembers Parisi and Reiman were noted Absent. Councilmember Santoro said in next weeks meeting they will look to appoint in the advisory. Clerk's Office - July 2002. REPORTS Building Dept. - July 2002· MATTERS FOR MATTERS FOR DISCUSSION: NJ Department of Personnel - Certification of Eligibles for DISCUSSION Appointment, Re: Principal Cashier Typing. Two (2) Provisionals. Principal Cashier Date of Disposition: 10/01/02. Typists The Assistant Clerk said that was for Mary Koke and Michelle Blacknall. b) Certification of Eligibles for Appointment, Re: Secretary Secretary/Board Board/Commission. One (1) Provisional· Date of Disposition: Commission 10/25/02· The Assistant Clerk said the Clerk advised her to have this brought up again in Closed Session· T&M Associates - Sewage Treatment Demolition Project, Re: Soil T&M Associates Settlement. Mr. & Mrs. Retamozo - Request to purchase property. Mr. & Mrs. Retamozo The Assistant Clerk showed them the letter from the Retamozos' and the Mayor said they had to have the Borough Attorney look at it and directed the Assistant Clerk to give him a copy of the letter. Omnibus Driver - To replace Janet Stark. Omnibus Driver Councilmember Santoro asked if that was posted. AUGUST 8, 2002 Omnibus Driver Councilmember Rios said it was and he then said he wanted to call Cont: a Parks Committee Meeting this week with Mr. Kately. He said we have someone already there and someone has to take his position. The Mayor said then the driver that is there now will move up and we are looking to put someone in his position. Councilmember Rios said he wants to make his recommendations to the Council at the next Council Meeting. -- BUSINESS TO BE BUSiNESS TO BE ADDED: ADDED Councilmember Santoro said they will be interviewing the week of the 19th for the EMT positons. She said she will not be here the EMT Positions week they are interviewing, so Councilmember Sohayda will step in to do that as the head of the Fire Committee. Councilmember At approximately 7:55 P.M., Councilmember Santoro was noted Santoro noted Absent. Absent Pond Councilmember Sosnowski said he talked to Ted Surick about the pond. He suggested to do something in-house instead of spending $450,000. Councilmember Rios said he understands exactly where he is coming from and we may be able to do it in-house, but, the total project is not going to be just dredging it. There is concrete work on the outside. He said they have to get hold of the state to get rid of the fish to hold them for us, etc. He said he spoke to the man that comes and does the Honorary PBA Fishing Derby and asked him some questions about dredging the whole pond and he told him they would have to them up and they would come and get the fish and when we get done with the project they would come back with all the fish and they would re-stock it. He then went on to World Trade speak about the World Trade Center, September llth. He suggested Center Disaster we as a Borough should have something at night, about 6:00 or 7:00 P.M., in the evening, so the people interested could be there. He said they would be planting three (3) trees in remembrance of the people that lost their lives for Carteret. We are going to have a plaque made up for them. He said he spoke to Mr. Meehan and there is a very good possibility that they could get a piece of steel from the World Trade Center. He then directed the Assistant Clerk to fax the Deputy Mayor in charge of that, who spoke to Mr. Meehan, a letter from the Governing Body requesting a piece of steel from the World Trade Center Disaster and told her to mention Mr. Meehan, who lives in town and his daughter lost her life in this tragedy and gave us his fax number and then gave the fax number to the Assistant Clerk. He also suggested we do something with the Fire Department, Police Department and the Veteran's Alliance. Mayor Failace suggested to contact Mr. Tomczuk. 8 AUGUST 87 2002 Councilmember Rios then directed the Assistant Clerk to contact World Trade Center the churches to ring their bells at approximately 6:00 P.M. on Disaster Cont: September llth. Mayor Failace said to make sure we don't conflict with someone else. Janet Stark Councilmember Rios said he wants a Council Commendation for Janet Stark, bus driver, who worked for the Borough for twenty some odd years. He said he would also like to discuss in Closed Session about the EMT negotiations. Councilmember Sohayda said on September llth at approximately Councilmember Sohayda 9:30 to 10:45 there will be a service at the Fire House. Secondly he will be out of the Borough from the 23rd to the 28th. He will be in Missouri with the Fire Department. We were nominated for a National Award, one of seven (7) towns in the United States. The Borough is paying for two (2) firemen to attend and he is paying for himself to attend. Fire Department Brian O'Connor, from the Fire Department, said we were recognized as one of the seven (7) finalists from the International Association of Fire Chiefs around the County for our (inaudible) of Life Program. Councilmember Sohayda said he has an Administration Hungarian Reformed Submission from Chief Pieczyski, referred to him by Church Councilmember Santoro, from the Hungarian Reformed Church. They are inquiring if there is a possibility of the recent fifteen (15) minute parking regulation that is now in effect on Washington -- Avenue, between, Pershing and Cooke, be changed so the parishioners of the church can park there on Sunday to attend church. He said the upside for changing the ordinance would be the church members would be allowed to park there on Sundays to attend church and the downside would be the store (Little Kliens) opens on Sunday mornings and has a constant flow of customers picking up the Sunday newspaper. He asked for this to be brought to the Council's attention and advise him if there is a change in the ordinance, thereof. He commented that they only have one (1) service on Sunday morning. He said they just did it for the church up the hill. The Mayor said he felt everyone would agree. Councilmember Rios said he had a question from a Borough Borough Office resident asking if he could sit at different intervals in a Borough office, because he was there today and he was asked to be removed, or removed himself from the office. He was removed by the police and he felt he should be able to sit there and the supervisor of that department said he shouldn't be able to sit there as long as he would like to. Mayor Failace said it is the Hot House in the Park. 9 AUGUST 8, 2002 Borough Office Councilmember Rios said it is the Office of the Senior Cont: Transportation. Mayor Failace said they should be careful, because we are treading on thing ice, because there are many residents who stop in to say hello. Attorney Peck said he would want to discuss it with Attorney Bergen and get back to them. -- Garbage Collectors Mayor Failace said he received a lot of complaints that the new garbage collectors are leaving the cans in the middle of the street. He asked for someone from the Streets and Roads Committee to talk to Ted Surick and make a note to tell them this is not acceptable. Councilmember Sohayda asked the Assistant Clerk to inform Councilmember Parisi about it. Upon individual roll call vote Councilmembers Rios, -- Sohayda and Sosnowski voted in the Affirmative. Councilmembers Parisi, Reiman and Santoro were noted Absent. MEETING CLOSED At approximately 8:08 p.m., this meeting was Closed to Discuss Litigation and Personnel Matters. Upon MMS&C by Councilmembers Rios and Sosnowski and MEETING OPENED unanimous affirmative vote of the three (3) Councilmembers present this meeting was opened at approximately 8:25 P.M. ADJOURNED Upon MMS&C by Councilmembers Sosnowski and Rios. and unanimous affirmative vote of the three (3) Councilmembers present, after no further discussion, this meeting was Adjourned at approximately 8:26 P.M.
