The following were noted present: NOTED PRESENT Mayor James A. Failace Councilr~;ember Parisi " Reiman " Rios " Santoro Noted absent was Councilmembers Sosnowski and Sohayda. Also noted present was Borough Attorney Robert Bergen, Engineer J. McKelvy from T&M Associates representing the Borough Engineer. At approximately 7:02 P.M. Councilmember Sohayda was noted COUNCILMAN SOHAYDA - NOTED present. PRES ENT Statement of Meeting Notice was mailed to the Home News Tribune, STATEMENT OF The Star Ledger and posted on the bulletin board on August 23, 2002. MEETING NOTICE TO ADDESS GOVERNING BODY: J. McKelvy representing the TO ADDRESS Borough Engineer Don Norbut. GOVERNING BODY - O. McKely, Engineer 2002 ROAD PROGRAM - 2002 ROAD PROGRAM The contract has been awarded and the pre-construction meeting has been scheduled for September 9th at 10:00 A.M. at the offices of T&M Associates. Discussion between Councihnembers Santoro and Reiman is inaudible. Engineer John McKelvy said there are still punch list items that still remain, ' they expect to close that out within the next week or two. SANITARY & SEWER SPdqlTARY SEWER PROJECTS - PROJECTS Engineer John McKelvy said these are the projects that he is working on. The Harrison Avenue Pump Station and the existing pump station is being demolished and that day they were doing the final demolition. __ There is one more major part of the construction that has to be done and that is the valve chamber and that should be put in early next week. Councilmember Santoro asked if that was by Walgreen's. She then wanted to know how much it would cost. John McKelvy rephed that he d~dn t kno . AUGUST 29, 2002 Mayor Failace said evidently they were not sure of the exact number. COMMENTS It is somewhere between $200.00 and $900.00· Mr. McKelvy reported that the contractor has completed the extra work that he was authorized to do. There are a few punch list items on that job also· He said he expects that job to be closed out within the next two weeks. The Roosevelt Avenue Pump Station job was just awarded to Quality Electric. They are going to have a pre-construction meeting that has not been set up yet but will be scheduled for the week of September lOth' Councilmember Sohayda asked if Mr. McKelvey could inquire if this camera might be used in fire scenarios. He said the camera could also be used in bad smoke buildings on the scene. They are saying the sewer cameras can be used as twofers! Maybe it will be a minimal amount of dollars to buy one that does both. Mayor Failace said he thought they already had the infrared camera that sees through the walls. Councilmember Rios said maybe they are talking about more intense fires. · · , ' oitbut~hethought Councilmember Sohayda smd he really &dnt get ~nt he might check on it. RE: WATERFRONT Mr. McKelvy continued his report concerning the Waterfront Park. PARK There is no real status change. They are doing some shop drawings and the Borough Engineer mentioned to him that he is expecting DEP permit to be received in mid September and the Army Corp of Engineers report by the end of September. Councilmember Reiman asked why the Army Corp. is holding up the boat ramp project. Councilmember Santoro asked for them to explain to her what their objective is. Mayor Failace said the channel right there by the Arthur Kill is very narrow. Councilmember Reiman said they have boat launches in Sewaren, South Amboy and Perth Amboy. Masur Consulting and T&M Associates had a camera out there to count the number of ships going up and down and it was a very minimal amount. If you got one very big tanker every few hours it was something. The DEP permits have to be renewed· Councilmember Sohayda said someone put something in our mailboxes about that. 2 AOGOST 29, 2002 GRANTS & LOANS - GRANTS & LOANS John McKelvy continued his report. The Spring 2002 Grant and Loan - the August 15th deadline has been extended according to the Borough Engineer. He is working on final scope and cost. Councilmember Santoro asked why the Borough Engineer extended the deadline. John McKelvy's reply was inaudible. 2002 Mfl)DLESEX COUNTY DOWNTOWN & BUSINESS 2002 Middlesex DISTRICT IMPROVEMENT FUND - An application was prepared County Downtown & Business District by John Riggio and was submitted, lie said they will bc waiting to Improvement Fund hear on that one. He then said he just had a couple of gcnerai items to discuss. The Rooscv¢lt Avenue Bypass in ~Vest Cartcrct - according to the Borough Engineer they are not in favor to (inaudible) Milik Street as a designated truck bypass instead of Federal Blvd. They are waiting for a letter from (inaudible) to verify that. Councilroember Rios asked Mr. McKclvy to have the Borough Engineer to follow up on that, It has been a month since we got thc no objection from Woodbridge and hc thinks they should get the letter so COMMENTS wc can go about what we want to do. Mr. McK¢lvy resumed his report. Thc Hill District Storm Sewer Project - He said he is working on thc final draft and he will have an intemal draft of that by next week. Industrial Monitors Contract has been renewed with Garden State Laboratories. He said they test about once a month. Councilmcmber Padsi said there seems to be a major concem with the storm sewer linc. That is right by thc office where the ladies are. They has to be addressed very seriously because those woman are very upset and they will move forward with action against us if they don t get thi resolved quickly. John McKelvy said that hc knew that thc Borough Engineer attempted to TV that line. They got in one hundred feet and thc linc was full of debris so there was no way they could complete that in one day. Hc said he his also trying to get a quote from B&W to do a test unilateraily (inaudible). -- Councilmember Parisi asked if that has to be opened or can it be capped? Everyday there is a bad odor and it is almost unbearable for them to work there. Councilmember Rios said (inaudible) to repair that sewer line or it may be wise for us to look at a septic system or what ever is going to be the least expensive. Like Councilman Parisi said it is a serious concern and we have to .. AUGUST 29, 2002 Councilmember Sohayda asked if they were familiar with that property at all. He then asked another question but was inaudible. Unidentified person said he did not think it would be faraway (inaudible). He asked if there were houses over there. John McKelvy said the one park building is connected to the storm sewer and there is a sanitary that runs between the storm and the building. We are going to try to disconnect the storm (inaudible). Mayor Failace said he would not doubt that it is bad, they have every fight to complain. God Forbid we don't do something soon we're going to have a real problem. Councilmember Par/si said he didn't know if the should temporarily move them. Mayor Failace said that might not be a bad idea because they can't work down there. Councilmember Rios said they could move Jessie Bagala over to the Community Center. Nancy Mulowski is there cleaning the bathrooms. DISCUSSION Councilmember Santoro asked if they could be moved to the Recreation Center. Councilmember Parisi said moving Jessie to the Recreational Center is not going to fly either. Councihnember Santoro said there is a health issue. Mayor Failace said this is something that has to be done because the other side of the coin is we'll have a lawsuit against us. The Borough Attorney said, as he understands this is the line adjacent to the line that is connected to the other sewer. He said it seemed to him that they are going to resolve these both as part of the same project. You do have a little while to address that and the other problem that needs to be addressed (inaudible). You have one building where it is connected where it cannot be connected any longer. Councilmember Pafisi asked if they wanted to do a Directive. Will they move Jessie upstairs? Councilmember Santoro replied that Jessie can't go up the stairs. Where could we put her? Councilmember Sohayda said somewhere near the park. Councilmember Rios said this why she is somewhere near. the park because that was what she was hired to do. Councilmember Parisi said there is plenty of room upstairs. Councilmember Rios said they are concerned about the health hazard for the employee .. 4 AUGUST 29, 2002 Councilmember Santoro said we should ask them what they would like to do. Would you rather sit on a heath issue or where would you like to go? Mayor Failace addressed Councilmember Rios and said he thinks that you should stop, maybe give him a call and make a decision with them because it is going to take awhile to get this resolved. Regardless of what anybody says they are going to have to do something. It is a Health Hazard to the Borough so you have to talk to them and see what can be worked out. Councilmember Santoro said we have to talk to them before it happens.. Councilmember Parisi said by the same token, they seem to be under the impression that they are complaining to us and we are not doing anything for them. Mayor Failace said exactly. Councilmember Rios said that is not true.. DlSCUSSlOtq Councilmember Parisi said he knew but they don't know that. So by the same token.. Councilmember Rios said if he can't get there tomorrow he'll get there early next week and talk to them. The Borough Attorney said it is more than just cleaning out the line, there is another line that has to be done together. So when they say just clean out the line he thinks it is more than cleaning out that one line. Councilmember Rios said the Borough Attorney should go there and explain ii to them. Mayor Failace said to Councilman Rios that he could probably take Nancy but not Jessie. At this time there is much laughter between the Mayor and Council. Councilmember Sohayda asked if he spoke to them over the phone. Mayor Failace said no, he went there and it is bad. The Mayor then asked if anyone had any more questions for John McKelvy. Councilmember Reiman asked what the outcome was with the DEP. He then asked who was walking down by the park in West Carteret along the Rahway River? Mayor Failace addressed Councilman Reiman and said he believed it had something to do with misquotes, they are going to spray next week. Councilmember Rios asked if the County was doing that. Mayor Failace said the County is coming down very early in the morning because they received a ton of phone calls. Someone told 5 AUGUST 29, 2002 them that only the Mayor can approve misquito spraying. He said he didn't know that, he just found that out. Councilmember Santoro asked if they could post it on that board. Mayor Failace said Ellen Ransdell was supposed to let us know but they had some terrible misquito problems over the last few months, w MINUTES FOR MINUTES FOR APPROVAL: August 15, 2002. APPROVAL PROCLAMATION PROCLAMATION: "A Day to Remember" - September 11,2001. "A DAY TO REMEMBER" ORDiNANCES: ORDINANCE 1. #02-18 Amending Article 1, Licensing Regulations, Chapter 71 - Entitled Alcoholic Beverages. (Carried from August 15, 2002). Mayor Failace asked what they were doing with that. The Borough Attomey said you can increase 20% or $500.00, whichever is less. He asked if they wanted to amend it or (inaudible) to the number that you want to be at or do you want or do you want to increase the 20% and do another ordinance? Mayor Failace asked if the increase was more than $500.00. DISCOSSION Councilmember Reiman said the maximum you can go up is either 20% or $500.00 or whichever is less. Why don't we right up the ordinance with the 20% this year and another 20% next year. Mayor Failace said they will do it as a progressive over the next couple of years. The Borough Attorney asked if they wanted to get to that point or do you want a 20% five year ordinance? Councilmember Santoro asked what the objection was so they don't get jammed again. Mayor Failace said they want to get to the numbers that were originally generated, the problem is that you can't do it all at once, so if the Council agrees, we are going to have to do it over a five year period. Councilmember Reiman said when they raise the sewer user fee on the Industrial users we set it up for a two or three year ordinance and it goes up 5%,5%and 5%. Mayor Failace said it should be more power (inaudible). Councilmember Parisi said that was one of their concerns, they said it was all in one shot. Mayor Failace asked if they were in agreement that they are going to do it over a five year period. Whatever the numbers come out to be .. 6 AUGUST 29~ 2002 Councilmember Reiman said even that wouldn't bring it up anywhere near where (inaudible). The Borough Attorney said he can do a five year ordinance or a ten year ordinance. Do you want to do a five year ordinance and just let it sit? He then said he could do a chart to get them all the way to where they were, it will probably take us twenty years. What would be the recommendation? Mayor Failace said five years sounds like a good number. The Borough Attorney then asked about the club licenses. Do you want to go right to $150.00 or do you want to split it in the middle? The Municipal Clerk said that every other town is $150.00. The Borough Attorney said the statute does not have an interpretation it just has a maximum. The other maximum is $2000.00 and a club maximum.. Mayor Failace said they should do that over .. The Borough Attorney spoke and was inaudible. RESOLUTIONS: RESOLUTIONS 1. Directing the Issuance of Various Raffle Licenses. 2. Refund of Tax and/or Sewer User Fees. 3. Approving Fireworks - Ethnic Day 2002. 4. Creating Handicapped Parking Space - 47 Delaware Avenue. The Municipal Clerk said that Taqualla asked that they approve this RE: FIREWORKS resolution for the fireworks that night so she can get the insurance in ETHNIC DAY place. Councilmember Parisi asked if they already did the handicapped parking space. Councihnember Reiman asked who was it for. Mayor Failace said 47 Delaware Avenue. The Municipal Clerk said she would check on it. Councilmember Santoro said Taqualla just told her today that they went over so they are having a bigger Fireworks display. Councilmember Reiman said they sent letters out to Comcast about three weeks ago and they are donating about $1,000.00. He said he spoke with one of their Vice Presidents. Frank Raia and )mthony Sirignano are donating $5,000.00. Councilmember Santoro said she would check with Taqualla because she said there was no more money because of the fireworks. If they are donated... 7 AUGUST 29, 2002 Councilmember Rios said she knows the fireworks are being donated .. Councilmember Reiman said she received confirmation from Comcast Mayor Failace asked Councilwoman Santoro what her point was because he did not understand. Councilmember Santoro said Taqualla called her today to tell her the can't pay for a band because there is no more money left in the budget. She said she might pay for it out of the police budget. Councilmember Rios said he thought they spent sixteen or seventeen Councilmember Reiman said sixteen plus the five that was paid from the fireworks. Mayor Failace said so now we appropriated the same amount of money, the sixteen, seventeen plus the fireworks. Councilmember Santoro said if they are donated she is just confusing the message. She said she had no problem doing it for the fireworks. RESOLOTION #t~-iO~ RESOLUTION #02-320 was introduced by the Mayor and referred to APPROVING FIRE- the Council for action WORKS FOR ETHNIC DAY Upon MMS&C, by Councilmembers Parisi and Santoro RESOLUTION #02-320 "RESOLUTION APPROViNG FIREWORKS FOR ETHNIC DAY" ADOPTED was adopted. Upon individual roll call vote, Councilmembers Parisi, Reiman, Rios, Santoro and Sohayda voted in the affirmative. Councilmember Sosnowski was noted absent. APPLICATIONS: APPLICATIONS 1. Carteret Volunteer Fire Co. #2 - Application for membership, Joel Rosado. COMMONICATIONS COMMUNICATIONS: 1. Borough of Milltown & Sayreville - Resolutions Supporting A-273, Return of Polling Hours to Times that Existed prior to 2002. 2. Township of South Brunswick - Resolution urging changes to the Migratory Bird Treaty Act. The Municipal Clerk said that communication is about the Canadian Geese. Councilmember Sohayda asked if they fly South in the Winter. 8 AUGUST 29, 2002 The Borough Attorney said you can't stop them from stopping.. REPORTS: REPORTS 1. Clerk's Office - August 2002. 2. Inspection of Buildings - July 2002. 3. CFO - 2002 Tax Anticipation Note. 4. Carteret Library - Audit Report 2000 & 2001. Mayor Failace asked if they had a copy of the CFO report? The Municipal Clerk replied that she just received it. Councilmember Santoro said she had a question on the Library Audit report and there were findings on the back was (inaudible) that are still not resolved. She then asked if they could have the Council or extend them anything about the concerns ... DISCUSSION Mayor Eailac¢ asked if that was fi.om 2001. Councilmcmbcr Santoro replied that they are still saying from two years ago (inaudible) and she thinks that needs to be addressed. Them arc still outstanding dues from previous years that they have not taken care of. The Borough Attorney said they could send them a letter that the auditor found repeats from prior years and to kindly advise them as to what collective action they will be taking. Councilmember Santoro said that needs to be addressed. Mayor Failace asked if Councilwoman Santoro wants to meet with the Library Board. Why wouldn't you just meet with Veronica Chan? The Mayor said what they should do is put a call in or write a letter and have someone come over and explain it. Councilmember Santoro asked the Municipal Clerk if they could send something for the next Agenda Meeting? She said she remembered the first time they were told to correct that and they still have not done so. The Borough Attorney said they have to have a corrective action plan MATTERS FOR DISCUSSION: MATTERS FOR DISCUSSION 1. NJ Depattment of Personnel - a) Temporary Commuter Parking Lot Attendant. The Municipal Clerk said the gentleman we have we have to either terminate him or make him permanent. We can't keep him as a temporary employee any longer. Councilmember Reiman said that it should be discussed in Closed Session. 9 AUGUST 29, 2002 b) Certification of Eligible for Appointment - Secretary, Board/ NATTERS FOR Commission - that should be discussed in Closed Session. DISCUSSION CONTINUED 2. Paul Mercantanti, Afcme Local 3850 Administrative Secretary. Mayor Failace said that should be discussed in Closed Session. 3. Cherry Picker - One (1) bid received. Councilmember Rios said hopefully they will have Vic Kazio from the garage to go look at the Cherry Picker and if we can award :.hat bid at the Council Meeting. Councilmember Reiman said the one bid came in under budget. The Borough Attorney asked if Bobby had any idea why they received only one bid. He then asked if there were other companies out there that he called, to find out why they did not bid? Councilmember Rios said he feels very comfortable. He said to tell the truth he does not want to delay the tree process any longer. DISCOSSION Councilmember Reiman said they buy a ton of stuff from (inaudible). He then asked if that was who the bidder was. Mayor Failace said it always bothers him when we get only one response to a bid. John McKelvy, Engineer asked if it was spec'ed out that way where maybe they wanted that specific truck ... Mayor Failace said that is the Council's pleasure. Councilmember Reiman asked if they still have Cherry Pickers in the state contract because if it is you can just go out and buy it. Mayor Failace said you don't want to delay it and he understood that because we have a lot of tree work to do. The Borough Attorney said it has to be in accordance with whatever specifications you put out. The Mayor asked if they drew the specifications up. Councilmember Sohayda said he was sure they called in four companies and got the paperwork in. BUSINESS TO BE BUS1NESS TO BE ADDED: ADDED Councilmember Reiman asked if they would be scheduling a meeting for the ABC violations? That should be coming up soon. The Borough Attorney said he didn't want to speak specifically about the detailed ones. Carteret Tavern is closed, that is one of the ones that had the summons against them. The problem is they were going to do them in July as they planned but Detective Rivers is out on disability. 10 AUGUST 29~ 2002 Councilmember Sohayda asked if Such's served a minor. The Borough Attorney replied yes but he did not want to go into the details. We can discuss what we can in Closed Session but not until Detective Rivers comes back or works something out with the PBA where he can appear while out on disability. He will be going back to the doctor on September 13th. Councilmember Reiman said he also has something from the Carteret Historical Committee. It was a requisition requesting funds for Calendars. They are doing four hundred Historical Calendars this year. They will have pictures on them dating back to the 1900's. We have a sponsor who is going to be picking up the tab on this. It is one of the local charitable organizations in town. They are the Italian American Club. The board o£tmstees has to approve it so what he would like to do is set this up for Ethnic Day and use it as a fund raiser for the Historical Society. Councilmember Santoro asked how they are going to be spending to do that? DISCUSSION CONTINUED The Borough Attorney said the money would be reimbursed in a number of different ways. Councilmember Reiman said he just wanted to make sure everyone knew ab<at that. Secondly, last year we had okayed the Historical Committee to look at displaying some of the plates that have been in the attic of Borough Hall. We didn't do that at Ethnic Day last year so they wanted to know what and how many they could put on. There is a significant amount up there and we wanted to keep some for other areas, there are more then one hundred up there. Mayor Failace asked how many they have given out over the years, not too many. Councilmember Santoro said the letter that everybody (inaudible) so we have openings on the UEZ and she wanted to know if they should discuss that in Closed Session. Mayor Failace said he didn't know if that was a Closed Session unless you plan on going into some deep discussions on the individual. Councilmember Santoro said she knew there was one more voting that needs to be replaced. Councilmember Parisi said he was going to suggest somebody. Mayor Failace addressed Councilmember Parisi and told him to give them a name while they are all there. Councilmember Parisi said his name is Bill Pimenow, he is Greg Setar's brother-in-law. Mayor Failace said there was an opening for voting (inaudible). 11 AUGgST 29, 2002 Councilmember Santoro said she would like to move somebody up from the advisory to the voting if we could. She would like to do that so she would like to talk to John .... And this way they would be familiar (inaudible), she then asked if she could do that in public. The Borough Attorney said they can do it in Closed Session as contract negotiations ... Councilmember Santoro said they have done it this way, they are just extending it. This is the PBA Building, they want to extend their lease for one dollar. She then asked if that was alright for everybody. Mayor Failace said there is a lease in existence. The Borough Attorney asked if they minded them making additions and modifications. Do you want any say of what they are doing? Councilmember Rios said they spent a lot of money when they first got it twenty years ago. Councilmember Santoro said they just want to improve the building. They have been taking care of that building and they do use it all the time. She then said she had four items to discuss in Closed Session. RE: 0/11 - Councilmember Rios reported that they are on board for September MONUMENT IN 11th. They are working on it and he requested that everyone be there. CARTERET PARK He said he has a meeting for the following week with (inaudible) who is the Veterans Alliance Chairperson. Hopefully we will have the families or extended families of the three people who lost their lives. Mayor Failace said it looks nice. He said he had one concern and that was the placement of the monument and baseballs. STEEL FROM WORLD Cquncilmember Rios said where they placed the monument was the TRASE CENTER only logical place to put it. The major concern was electric. He said they are getting help from different people. We received th,: piece of steel from the World Trade Center and we got it sand blasted. Councilmember Padsi asked if there was a reason why they faced the monument the way they did because more people are going to walk facing to see it. Councilmember Rios said he understood what he was saying but they felt that the big tree was a safety issue and a lot of the roots are above the ground. If anyone went there to pay their respects, he is afraid they might fall down. The Borough Attorney said it was amazing to be there and not see those buildings at that site. Mayor Failace said he was there awhile ago. It looks nice, they are doing a good job. AWARD Councilmember Sohayda said that they have to talk about the building CEREMONY company and he reported the Borough Attorney will be handling that. CARTERET POST OFFICE September 18th between 10:00 AM and 2:00 PM they are having an awards ceremony at the Carteret Post Office. They are undertaking and 12 AUGUST 29, 2002 making it Hero's Day. They are giving awards to the Fire Department POST OFFICE and the Police Department and possibly EMT's. The Post Office is (Continued) looking for help for a big turn out. Some really high ranking officials from the Postal Department are coming down. Mayor Failace asked who they were inviting. Councilmember Sohayda said the Mayor, Governor... They are going to have refreshments, awards and give-aways. The Council will receive a flyer but you are all invited. Councilmember Santoro asked what time it starts. Councilmember Sohayda said at 1:00 P.M. they will be giving out the awards. They will also give out refreshments and give aways. Councilmember Santoro asked what day it was. Councilmember Sohayda replied Wednesday, September 18th. The Council and anyone affiliated with the Borough is invited. We had a great showing in Kansas City. We did not receive the big award but we had a great showing. Mayor Failace asked what was the award that we won? Councilmember Sohayda replied that somebody created for the minority children, in California, .... Brian O'Connor said this summer they had an eight week program (inaudible). Councilmember Sohayda said it had to be a minority child. He then said he would like a Council accommodation for the Chief and Joe Godomski at a Council Meeting. He reported that they had a good time and what it was, was a yard sale for the Fire Department. Councilmember Parisi said his issues have been resolved and he had two things to discuss in Closed Session. Borough Attorney Robert Bergen said he had nothing for Open Session but he had to get back to his office to open his mail to make sure he adds onto the Agenda. Mayor Failace reported that he was speaking with Jack Engel and he RE: ,~,ItBtlL,M~ICE mentioned to the Mayor that they had a problem. One of the young ON FIELD people got hurt while they were practicing and the ambulance could not get onto the field. They use to come in the back way by where the Skate Park is so they need to see about doing a cutout by the back of the Library. They should keep a couple of spaces open so God Forbid they need it, they can get the ambulance in there. The Mayor things they should have somebody take a look at it, from Streets and Roads, and see if they can make some kind of cutout. Secondly, he had something he would like the council to approve. He asked if they remembered that he told them about this company "Six Trees". They are a house wares distributors and they are looking to come into the Borough of Carteret. He said he met with them and they are not a giant distributor but they are looking at the property on Grant Avenue. They 13 AUGUS~ 29~ 2002 are looking for abatements, they said Staten Island gave them 20 years but he told them they don't do that in Carteret. If it is okay with the Council, the Mayor said he would like the Borough Attorney to speak to them and maybe offer them maybe five years .. Councilmember Santoro asked what they were looking to do for the new development. The Mayor replied that it is a rather large house ware distributor, not chemicals or appliances but more like picture frames and that type of things. They don't manufacture... Councilmember Reiman asked if they were looking for new construction or do they have a building in mind. Mayor Failace said he is sure they already have a building in mind. The Borough Attorney asked if they plan to make improvements to the building. Mayor Failace replied that he was not sure they were ready at the moment but it fits perfectly if that is what they want.
