An Agenda Meeting of the Mayor and Council of the Borough of AGENDA MEETING
Carteret proceeding the Regular Meeting of October 17, 2002 was held
on October 10, 2002, Municipal Court/Police Facility, 230 Roosevelt
Avenue, Carteret, New Jersey.

Councilmember Santoro interrupted the Borough Engineer and said
she is already getting calls and people are saying they are getting
policed. They need better supervision; they need someone out on that
street during the day. They better make arrangements and they know
whom they need to contact.
The Borough Engineer said they had a number of police officers on the
projects and they have contractors working in a few different areas.
Councilmember Santoro said they are also getting calls and a few at
the last minute where they are saying there is nobody there and then
(inaudible) called in and that is because it has never been requested for
that comer. We have a lot of Borough work going on and she knows
that they ~re requesting extra workers and extra police officers. They
are not requesting it for every street comer. If that is the case, it is
going to be shut down for the day. If they don't put the request in
ahead of time so we can man it, it's not going to happen.
The Borough Engineer told the Councilwoman that she was correct
and they did fail to notify. We sent a letter to the company telling them
__ that they must follow their schedule.
STATUS REPORT- STATUS REPORT

a) Harrison Avenue Pump Station - work is complete and the SANITARY SEI/ER
contractor is currently addressing punchlist items. The new pump PROJECTS (COI~I'T)
station is fully operational.
b) Roosevelt Avenue Pump Station - all contract work is complete and
the contractor is completing punchlist items. The final payment
certificate was submitted that day. He said he would like that to be on
the next Agenda, that is item 3D.
c) Roosevelt Avenue Pump Station - Control Replacement- the
contracts have been prepared and a pre-construction meeting held for
the project. They are waiting for a progress schedule from the
contractor work should be starting within the next two weeks. Project
should be completed by December.
Councilmember Santoro asked the Borough Engineer what the final
amount was.
The Borough Engineer replied that the final amount was $170,000.00.
It is a lump sum contract so there is no final change order.
Councilmember Santoro asked him if he felt comfortable that
everything has been met.
The Borough Engineer replied yes and he is going to file for inspection
(inaudible).
The Borough Attorney asked if the Borough Engineer received the
Maintenance Bond.
The Borough Engineer replied yes. Just so you are all aware, we work
very closely with the Sewer Department Superintendent, Mike
Camevale to make sure he is satisfied with any of these projects.
d) Annual Emergency Services Contracts - per the Council's
authorization, they are going to prepare contract documents for public
bid for a 12 month emergency service contract. The plans and specs
for public bid should be completed by the end of October.
e) Sewer Manhole Rehabilitation Contract - per the Council's
authorization they are proceeding to investigate and develop contract
documents for the rehabilitation of various sewer manhole throughout
the Borough. They anticipate the completion of plans and specs for
public bid some time in mid November.
Councilmember Santoro asked what happened to the Hill District,
what is the status on that?
__ The Borough Engineer replied that the Hill District is completed. The
preliminary design (inaudible). We have presented that before to you
and as soon as they let him know they are ready to discuss it he will
make the presentation at one of the meetings.
Councilmember Santoro asked if they were ready to do that. We all
know the problems with the Hill District. Do you want to do it at the
next Agenda or a Regular Meeting?

Councilmember Santoro said the First Aid is also involved in the
Police Officers getting Kitz and Hart, correct?
Councilmember Rios said he didn't know if she had mentioned at one
point...
Councilmember Reiman said just to find out and add them on.
PUBLIC HEARING 10/17/02: Green Acres Applications - PUBLIC HEARING
a) Pond Restoration at Carteret Park
b) Arthur Kill Waterfront Recreation Facility
Councilmember Parisi asked if the Green Acres application was for the
Pond Restoration. We are obviously looking to see if we can get
money from Green Acres first. COMMENTS
Councilmember Reiman said the applications have been submitted,
this is just a public hearing.
The Municipal Clerk said this is a public heating on the application.
RESOLUTIONS: RESOLUTIONS
1. Directing the Issuance of Various Raffle Licenses.
2~ Refund of Tax and/or Sewer User Fees.
3. Authorizing Various Contractors to Perform Rehabilitation of
Homes Pursuant to COAH Regulations.
Councilmember Santoro said the one that they Tabled last week on the
two family that it is alright to allow up to one thousand per unit on a
two family after $40,000.00. COMMENTS
Councilmember Par/si said he thought the Council (inaudible).
Mayor Failace said they have done that with a number of two families
in the past.
Municipa'. Clerk Kathleen Barney said that is what they gave today.
Mayor Failace said they certainly have done one and two families over
the course of the RCA money.
Councilmember Santoro asked if they were allowed, as a town, to set
a policy saying that we want a one or two family or what the practice

Councilmember Reiman said they want to move the stuff that was
stored in the Community Center, the books and documents. Those sort
of things.
Mayor Failace asked why they were not going to use it as a place
where citizens could go look at these things?
Councilmember Santoro asked what they are planning to do with that
building.
Mayor Failace replied that they were always under the impression that
it pertained to the library. If we sell it the money should go to the
library.
Councilmember Reiman said when (inaudible) Borough Hall they
could use it as some type of storage. The offices could be moved there
temporally.
The Borough Attorney said it has to be as the Mayor said. He said he DISCUSSION
has never seen the deed..
Councilmember Reiman said the Board of Trustees, The Municipal
Clerk, the Tax Assessor, none of them have the deed.
The Borough Attorney said when you get down to deciding what you
want to do we could then spend the money on a title company and go
down and pull the deed. He said he has seen a resolution and the
wording was obviously copied from a pretty old deed.
Councilmember Santoro asked what does the deed say?
Borough Attorney Robert Bergen replied that it is restricted for library
purposes.
Councilmember Santoro said for what? Would the Historical Society
go under the library?
Councilmember Reiman said it will have a bookshelf, it is a library
annex. You can call it what you want.
The Borough Attorney said the problem is that you have five or six
different entities who will want to use that facility. They might put a
partial library in there and they will all fit but you have to decide
which o~e you want. You can't give it to everybody and they all want
to use it.
Councilmember Reiman said one is an official body of the Borough
and the others are private groups.
The Borough Attorney said whatever you do it needs to be a public
building with library related services.
Mayor Failace said it sounds like a good idea...
Councilmember Santoro said if we do it and stress one room open for
public access.

Councilmember Reiman reported that the proposal for the Social
Services/Welfare, the County will take over November 1st. He then
said he would imagine that the other aspects should be discussed in BIJSINESS TO BE
Closed Session. Earlier in the year they received the additional funding ADDED
for the Community Development Block Grant. We need to put on a
resolution authorizing the bid specs on a new Senior Bus. That was
part of the funding that we used. The CDBD board approved it and so
did this Council approved it.
Mayor Failace said they are putting an air conditioner in and are
making it wider. They told the Mayor he would have to sit in it to try
it.
Councilmember Reiman said a few months ago that might have been a
good one..
Mayor Failace said no, they said the same thing last week.
Councilmember Reiman said they want to make sure that it has a
handicapped lift.
The Borough Attorney said they had to authorize receipt of bids for a
new Senior Citizen Handicapped accessible bus.
Councilmember Santoro said she had a few things to discuss. She
received a letter from the Police Department regarding Leffert Street.
She said she spoke to the Borough Engineer and he said no problem so
she would like to add that (inaudible).
Mayor Failace asked if that was in reference to the parking hours.
Councilmember Santoro said it is the parking hours, it's the turn radius
only, not the whole length of the street. It is just one hundred feet.
We'll have signs posted. She asked that someone notify someone that
they are (inaudible).
Councilmember Reiman asked if this was done by Ordinance. There
is a cost associated every time we do something. He then asked if they
are paying for the Ordinance.
Councilmember Santoro asked Councilman Reiman if he was asking
them to pay.
Councilmember Reiman said he did not think the taxpayers should pay
to change a road parking for a business. It would only be cost of
publicizing and advertising. He then asked if they can do that legally.
Sergeant McFadden said right now they lock the gates so it would help
__ (inaudible).
Councilmember Santoro said that was a private road so we'll ask about
that later.
Councilmember Reiman asked if they could require that.
The Borough Attorney said no, but they could if he would like to make
a donation on behalf of the Borough.

Mayor Failace said he thought it was a great idea.
Councilmember Santoro said she had another thing she wanted to
discuss about the phone lines. She said she received a question today
where phone lines were shut off in juvenile. (the Mayor interrupted
and said the lines in his office were also shut off) Councilwoman
Santoro then asked who was the company in Tennessee that gave us a
list of phone lines. They were ordered to shut off phone lines at a
savings of three hundred a month.
Councilmember Reiman replied that there was no order to shut phones
off. A Councilmember was authorized (inaudible), Councilwoman
Santoro.
Councilmember Santoro said this came back and was told that they did
it.
Councilmember Reiman asked if the Council ever approved any of
this.
Councilmember Santoro replied no, it was just shut off.
COMMENTS
Councilmember Reiman said to just get it back on and find out why.
There was a company that came in to do an audit of all the phone lines
to see where they went, what offices they were in.
There wa~ a loud discussion at this time and they were inaudible.
Councilmember Santoro said they need to find out who they are so
they can bring them back in.
Mayor Failace said it has been about three months. He said he has two
lines in his office that have been cut off.
Councilmember Santoro said they need to find out who to contact and
do something about this.
Mayor Failace said "3801"and "3807" He said he would use "3807" to
call out so that if anyone was calling in on "3801" he wouldn't miss
the call.
Counciltncmber Santoro said they just need to find out who to contact
and get them back in.
Councilmember Parisi said the council never approved anything.
Councilmember Santoro said that was why she was shocked because
she didn't know where this came from but they need to bring them
back in.
Mayor Failace said they gave them authorization to review the...
Councilmember Parisi said assuming it was the company that ordered
it shut off...

Councilmember Santoro said they wanted to know if they could just be
automatic or do they make the request every year.
The Borough Attorney asked if they meant they were automatically
ftmded through the budget or do they want to get their draw down.
Councilmember Rios asked if they need to officially give us a written
request.
Mayor Failace said they should request the money on a yearly basis
since we do it every year.
The Borough Attorney said it is up to them if they want them to. You
set the budget so if you want to put the money in there for the budget
they don't need to ask for it. If you put it as part of your budget
process but it makes sense, so it doesn't slip up between the cracks that
they send you a letter.
Councilmember Rios said he would rather see that. Not to break
anybody's chops but .. He then asked the Municipal Clerk to send a
letter to he First Aid, attention Mary.
The Borough Attorney asked if (inaudible) send out budget request.
COMMENTS
Councilmember Santoro said they also wanted to know the draw on it.
They were concerned that at different times but this year they received
it on time in July. There is a specific time when they receive this
money...
The Borough Attorney said that this should be worked out with Patrick
DeBlasio in terms of how much they get during the period of the
temporary budget versus when they finally were rid of the final
budget.
Councilmember Santoro said maybe they should have Patrick reach
out to them.
The Borough Attorney said he is assuming that Patrick gives them
25% sometimes and gives them the rest after the budget...
Councilmember Rios asked the Borough Attomey (inaudible).
The Borough Attorney replied yes, another resolution Thursday
awarding the contract.
Councilmember Santoro said they were also concerned and we
extended that we would advise them who our billing company was
going to be, if they so choose to reach out to them.
The Borough Attorney said he already spoke to the billing company
about whether they will be willing to do it so that as of now they will
only be billed for the calls that you submit. If you want to allow the
First Aid to become part of it that is something they would certainly
consider.
Councilmember Santoro said okay and they did extend that courtesy to
them.

have twenty six school boards and other municipalities.
Councilmember Santoro said what they are doing is basically telling
them who we use and (inaudible).
Councilmember Reiman said we have put them in contact with ...
Councilmember Santoro interrupted Councilman Reiman and asked
whom do they want to use to contact them.
Councilmember Reiman replied that Dave Baulken from O'Gorman &
Young who brought us into the County, we have his number and he
has ours.
Councilmember Santoro asked the Municipal Clerk if she would send
it so that it would be official from them to know who it is. What she
thought was that they were given the option ...
Councilmember Reiman said according to the County JIF joining
would be a significant savings for them.
The Borough Attorney said it makes sense for them to contact Brian
and work it out between themselves. Some procedure where by in case DISCUSSION
there was an emergency they would have access to the (inaudible). CONTINUED
Councilmember Sohayda asked what would happen if their rigs go
down, does that fall under the same category..
Mayor Failace said he would think that was considered an emergency.
The Borough Attorney said they need to sit down with Brian and work
out...
Councilmember Rios said if they are going to have a standard
operating procedure for our people ...(inaudible).
Councilmember Santoro asked if they needed to do that. Do we need
to adopt anything about putting the EMT'S under the Fire
Department?
The Borough Attorney said he would like to get it up and running in
case you want to change it. We should adopt this policy and
procedures that he has developed pursuant to the ordinance, but be
sure that every thing that he has written down works well for him. He
doesn't want to change anything then we should adopt by ordinance.
Councilmember Rios asked if that was putting the cart before the
horse. Having the ordinance done before the ...
Councilmember Santoro interrupted Councilman Rios and said that
seems to be a major concern on what the protocol is, who is primary
on the scene, who is the chain of command...
The Borough Attorney said nothing is changing except Rural Metro is
leaving and our people are taking over for them.

the owner and give him some suggestions to resolve it and if not, we'll
go to court.
Mayor Failace said it is sad that it has to take so long.
Councilmember Rios said yes and it is not fair to the people who live
there. He then said he had something to discuss in Closed Session in
reference to personnel.
Councilmember Parisi said he had a couple of questions raised at the
Office of the Disabled meeting. One of the concerns they had was they
thought there might be a possibility of a cross walk by Burger Express
and The Bus Stop which is across from the Turnpike entrance.
Mayor Faqace said they can have the Borough Attomey send a letter
The Borough Attorney said they won't get DOT approval for midblock
crossing but (inaudible) comer and walk down. If it is coming to the
middle of the block you won't get approval from the DOT. It has to be
comer to comer.
Councilmember Parisi then spoke about the Zoning laws. It was
brought up at the last meeting about changing the Zoning Laws. So,
how do we do it?
Councilmember Reiman replied a revision of the Master Plan. COMMENTS
Councilmember Santoro asked what the status was of the Master Plan.
She said she knew they talked about it and we were supposed to put
money aside for it. Were we going to do that?
Councilmember Reiman said potentially it can be funded over five
years. It is outside the budget ...
Councilmember Santoro interrupted Cotmcilman Reiman and said
right now towards the end of the year we might have excess money in
the ...
Councilmember Reiman spoke about the Master Plan and was
inaudible
Councilmember Santoro said that would help the schools. A lot of the
time the school has to come before the Zoning Board so if we change
it and put the schools in the right place, they would not even have to
come before the ....
Mayor Failace addressed Councilmember Parisi and told him that was
a good point and we do need to look at that soon.
Councilmember Parisi said he knew they needed to have a DPW
meeting but with conflicting schedules. He then asked if they would be
available Tuesday or possibly Wednesday in the late afternoon. He
then told the rest of the Council that when they know they should let
him know when they are available. The rest of the information he has
is for closed session, personnel.
