Absent: Joanne Hughes Also Pre$ent: Sue Leven, Ed Lewis, Jim Gallagher, Chris Miller, Peter Johnson, Nancy Ellis Ice, Bob Bersin Recording or Taping Notification The Vice Chair read "As required by the Open Meeting Law we are informing you that the Town will be audio taping this public meeting. Dsc i$s Technical Review Memo from SMAST Leven provided a copy of the Technical Memo on the Mill Ponds from SMAST. Ed Eichner has offered to meet with the committee. Committee Comments: Skidmore stated they did what was asked of them. He was disappointed the major recommendation was to do more studies. He added Phase III includes more study. He asked if there are there things we can do now to Mitigate phosphorus. Miller agreed with Skidmore. We can manage storm water issues. He is also tired of studies and would like to fix something. He referenced the last page of the memo. This section talks about more data analysis. He explained this is a reasonable recommendation. Miller also noted there are no surprises in this report and we already know about the issues. CWPC 1-28-13.docx Page 1 of 5 Skidmore asked what is the difference between the Mill Ponds complex and the rest of the Town. Should this be addressed in the report? Miller noted there are no drugs or chemicals but lots of phosphorus in the ponds. The up gradient ponds are bringing phosphorus to the down gradient ponds. Taylor stated there is no bird data. She asked if they could test the ponds for phosphorus. Would this help determine a bird issue? What would we do about it? Miller referenced a pie chart from another report. (Natural vs. other sources). Taylor and Miller discussed further. Schell commented on the flow from the cranberry bog, south of Cranview Road, through a conduit into Walkers Pond. He noted it was finally recognized and quantified. He thinks the estimate is low. He shared an example. Miller stated he does not agree. He explained further. Schell referenced the flow volumes mentioned in the report and commented on an intermittent event with heavy rain flow. • Skidmore stated there might be issues that are not addressed in the report. He asked the group to comment, Discuss with Ed Eichner or HWG? Leven stated HWG wants to look at the Mill Ponds in Phase III. Hughes, P wants Eichner to talk to the committee about it. She added there is more phosphorus coming from the sediments. Is this a pond issue that needs to be addressed? Schell explained there is a lot of phosphorus in the sediments. He noted it would be helpful to know the diurnal cycle. SMAST has data from the Sondes. They need to evaluate the data. • Skidmore asked if SMAST should do more work. He questioned the issue of data? Miller explained that HWG probably does not want to go into that level of detail. If there is enough data • then go into management and treatment. They could take the data and come up with a plan. Phase III? Not sure. He suggested speaking to Eichner. He mentioned a 604(b) grant for management of ponds. • Could HWG pursue? Hughes, P stated they can't get MEP data from SMAST. Leven will contact Eichner about setting up a meeting. She will email the committee possible dates. Leven requested comments be sent by Friday 2-1-13. Hughes, P asked for more clarification on what kind of analysis -- to Schell's point. Is additional field work needed? 3. Disc iss Phase II Report and Build out Report Phase II Report: Leven addressed the committee. They have received an updated Phase II Report with fourteen pages of changes. She is communicating with HWG and has signed off on the final version of the report. HWG will print copies for the Committee soon and post a copy on the website. Build out: Leven stated it has been reworked and resent. Committee members have electronic copies. HWG made a lot of changes. The committee should review and send comments to Leven. If no comments they will provide iiihard copies and an electronic version. Skidmore asked the committee to review next week. This will be included in the 2-11-13 agenda. Leven asked for comments and questions by the middle of next week. 2-7-13 CWPC 1-28-13.docx Page 2 of 5 Schell asked a question for Mark Nelson. When would he have a recommendation on how to minimize the impact of the build out growth, especially in the Pleasant Bay water shed area? The Build out numbers are higher in that area. He asked about a soft solution, town by-laws or revisions to zoning to minimize the impact. Leven explained this is a big part of Phase III. Skidmore stated the Build out is based on the current zoning regulations. Lewis asked if the Planning Board and the CWPC would meet to discuss this topic as it relates to Phase III. 4.Preliminary discussion about Phase III Scope Leven made reference to the Memo 1-25-13. Leven has a few questions about the budget numbers for HWG - are the tasks for the first 6 months or for the entire project period? Skidmore asked to put this topic on the 2-11-13 agenda. fi Nelson will be sending an outline for the second half with budget information. Project cost (2nd half) is higher than anticipated by approximately 8,000 dollars. Miller stated they might be able to tighten up the scope a bit. Skidmore asked the committee to consider eliminations or move work into second half. Schell commented on two public meetings for the first half. He suggested presenting alternatives and cost at the community meeting. (Cost for hard pipe, available, IA systems, ref Town of Barnstable, other solutions, operating and maintenance) Hughes, P asked about Phase III for the whole town. She questioned by the end of 2013, only wastewater management in Pleasant Bay? Not as quite as comprehensive as thought. Miller acknowledged they need to focus on Pleasant Bay, but again the pond portion is "light." It covers only Mill Pond. It does not talk about work on the other ponds. Can we work with them through a grant to expand the work? Lewis asked if there are plans to share this information with surrounding towns or the county. He wants to see mediation, planning, coordination with Harwich, Dennis, and Orleans. He spoke in favor or a regional standpoint. Leven explained that a lot goes through the Pleasant Bay Alliance. Once the final Phase II report is on line, messages go out to contacts in the surrounding towns. Hughes, P asked about the Cape Cod Commission (CCC) draft Regional Wastewater Plan and demonstration of their new software. She would like to learn more and suggested entering asking if they would consider using Brewster's data. They are getting close to being able to share information with neighboring towns. Lewis wants to see more of a regional approach. The deadline for comments regarding the memo is 2-7-13 to Leven. Bennett agrees with Lewis about early communication. He wonders about how this is all being coordinated. He suggested having someone from the CCC explain how they will integrate Brewster's plan or other options. He added there are a lot of groups discussing these solutions with good intentions. Lewis stated this is a good opportunity for Taylor. Hughes, P stated the committee needs a technician, from the CCC who can demonstrate the Multi Variant Planner (MVP) Program. A technician could put the Brewster Build-out information into this formula. The committee discussed further. Miller stated some of the things being asked for are regional in nature. He wants to see suggestions to fix the ponds. CWPC 1-28-13.docx Page 3 of 5 Skidmore asked the committee who they should talk to and who to invite to a meeting. Involve other towns? Other groups? Schell asked about DPW compliance with Illicit Discharge Detection and Elimination (IDDE), mapping of storm water conveyance routes. Bersin stated they have all the outfalls mapped. How do you mean conveyance? Schell explained from Schoolhouse Pond to Freeman's Pond. Bersin stated they are not included, They discussed further. Bersin, not sure if required. (EPA to determine) DPW is not doing mapping. Skidmore asked Schell to send comment re: Phase II to Leven. Leven announced she has received an email from the CCC regarding a focus group invite. Hughes, P received invite. 1-4pm, 2-13-13. Phase III comments will be discussed 2-11-13. I 5. Rauh v minutes of 11-26-12 Hughes, P made a Motion to approve the minutes of 11-26-12 as written, O'Reilly Second, All Aye, Mote - 8-0. 6. D©a ilpiark siting Skidmore asked the Committee to clarify their previous recommendation. Last year the committee recommended to not site a dog park in a Zone II. Skidmore shared an example of a dog park consideration in Nantucket. Skidmore suggested keeping dog parks away from environmentally sensitive areas. Miller commented on the Freeman's Way field's location. They are doing nitrogen management in this area. It Is located in a water shed area. Lewis added it is not a viable location since controlled by the water commissioners. He asked where a good location is. Gallagher stated if in Drummer Boy Park then it has to be one hundred feet from the marsh. Lewis agreed. Schell asked Lewis for the Board of Selectmen (BOS) view on supporting the Board of Health/Town's appeal. Skidmore announced that subject was not germane to agenda. Lewis explained the BOS voted for an appeal because it would force the BOS to seriously come up with a plan for Town Meeting. Lewis stated the Town should have a say in it. The BOS is not in favor of challenging another Board's decision. Lewis believes any solution should have Board of Health (BOH) input. 17. Topita the Chair did not reasonably anticipates Leven just received the Illicit Discharge Detection and Elimination (IDDE) plan draft. The following committee members requested a copy. Taylor, Schell, Skidmore, Hughes, P, Miller & Gallagher. Schell asked why the Town is buying steel. Miller explained it is for the Paine's Creek culvert project. Leven added she will ask Nelson for all of Phase III in a Gant chart. Hughes, P made a Motion to adjourn, O'Reilly Second, All Aye, Vote 8-0.
