Absent: Bruce Evans Also Present: Sue Leven, Chris Miller, Jim Gallagher, Ben DeRuyter, Nancy Ellis Ice, Paula Miller Recording or Taping Notification The Chair read "As required by the Open Meeting Law we are informing you that the Town will be audio taping this public meeting. Discuss Technical Review Memo from SMAST and possible grant funding for additional Work Skidmore asked for comments about the technical memo. There were no comments. Leven stated the RFR 604(b) grant is due 3-15-13. There is a total of $195k. Leven read from the handout. Hughes, P suggested funding to do data integration, draft management strategy, Mills Ponds complex. Miller stated they will select the project in May. Skidmore asked if there is available money to spend. Leven, none. Skidmore asked about a matching component. Hughes, J suggested writing a proposal for a grant and asking for money at Fall Town Meeting. Miller stated there is no local matching required. _'> CWPC 2-11-13.docx Page 1 of 6 Skidmore asked what they would use it for -- $25-35k Hughes, P suggested 1) Mills Pond Complex draft management study, 2) Other ponds, 3) Identify management strategies and proposed actions. This is based on data and Ed Eichner's presentation. She feels this is a priority. Miller stated we are all saying the same thing. We have the data. 604(b) for short fall? Hughes, J asked if we should go for the $ regardless. This shows the State we are done with ground work. Hughes, P suggested going for the 604(b) and a funding request at fall Town Meeting. Miller believes it is likely to get funded based on the amount of work already completed. Hughes, P - Ask SMAST to write proposal? Miller - SMAST knows the data. Ask them if they are eligible. Leven - They should be able to do a scope. The committee discussed timeliness. Leven stated they are pretty short on money. Miller has not done a 604 (b) before. Hughes, P asked about CCC assistance to draft the proposal. Leven stated they could share a finished document. They might be going for one of their own. Hughes .] made a Motion for Leven to investigate the grant writing of the 604(b) with either SMAST or CCC for the management strategy of the Mill Ponds Complex. O'Reilly Second, All Aye, Vote 8-0. 1 3. Discuss Build out Report - HWG Leven has not received any new comments. She gave an update to the committee. Leven stated they did a good job. She addressed acreage for residential dwellings. It did not work out because of pieces of lots, etc. They still owe the committee a set of GIS maps. Leven would like to let them know the buildout is ok. Comments: Hughes, P asked about providing the committee with build out by water shed. She liked the summary spreadsheet done by CDM by water shed to be very helpful. Leven explained this request went into the scope but not the contract. It could be done during Phase III. Schell asked about the estimate of school age children. If a 40B project were age restricted to 55+ the corresponding number of children would be reduced by 25. He is concerned about school over building. Hughes, P asked if the Town could designate an age only affordable housing. Leven explained they can't say that is all you can build. If the 40B's that are developed in the future are age restricted then there will be a drop in the number of school children. A sentence can be added in. 4, Discuss Phase XII Scope ., HWG Leven gave an update. Skidmore stated the BOS are considering the expense under the BOS budget tonight. Comments: Hughes, P stated under wastewater there should be more than just Pleasant Bay. She suggested the CC Bay watershed (central part of Town, high ground water area, poor soils). It needs to be in the scope. Hughes, 3 asked if it was covered under waste water. They discussed further. Leven stated Hughes, P is looking for more than just Pleasant Bay. Leven, Hughes, 3 and Hughes, P discussed further. Paula Miller told the committee she walks the beach near the Sea Pines area at low tide there is a bright green algae. It is near oyster farming. She is concerned about along the bay beaches. Bennett asked if they want to be specific about other sensitive areas. Hughes, P suggested they ask HWG. Hughes, P had shore line concerns. Schoolhouse Pond and Considine Ditch? Did the committee ask for this location? It is $30k. Walker's Pond? What about ponds with public access? Skidmore asked if there are any other areas to be designated. CWPC 2-11-13.docx Page 2 of 6 ,rf Schell stated he was pleasantly surprised to see those areas identified. He believes Schoolhouse Pond to be significant for storm water. These areas need attention. He has storm water concerns. Miller added that Schoolhouse Pond has been studied by Silent Spring for pharmaceuticals. Bennett asked about the design for the Town Hall Rain Garden. RFP's for competitive bids from local engineering firms? Hughes, P agreed. It is under Task C2. The committee reviewed the three locations. Breakwater Beach, Town Hall, and Walker's Pond. Bennett suggested removing from Phase III. The committee discussed whether the design should be removed. Hughes, ] asked if they did a partial design. Yes. Skidmore asked for comments. Hughes, P - Good idea. HWG could assist the group with reviewing the bids. It is a way to get the local firms involved with storm water. Hughes, ] has no opinion. They discussed whether they should make a motion to make the change. Skidmore explained they will include with all the comments. DeRuyter asked if HWG could break out C2. He agrees with Bennett. This would provide a comparative analysis. Bennett added there is a manual for storm water management. It is referenced in the subdivision control law. How much of CI. is driving the $26k. Bennett asked about timing for Phase III. Are we going to get the CCC in to talk about the regional waste water plan? Do we want to defer schedules and tasks based on communication with the abutting towns and Barnstable County? Leven explained we are the only town in the Pleasant Bay water shed that has not completed a plan. Chatham is done. Orleans has approved plan. Harwich is moving forward with approval. Bennett asked what does that leave us to deal with? Sub water sheds? Schell Task Al, Do you want to discuss? Bennett - Task Al, A summary of looking at what we have List alternative development. Compare to other towns. This should be done sooner than later. Brewster does not have much land on Pleasant Bay. Where are we with the sub water sheds? Schell has strong opinions about Task Al that are related to Bennett's comments. He thinks that one of the alternatives to consider is an interceptor line that extends from Freemans' Road along the edge up gradient from Nickerson Park and all the way down gradient to the Rail Trail, then easterly to the Orleans treatment plant. He believes this should be included as a study alternate. He is strongly in favor of soft solutions. This alternate would meet nitrogen reduction requirements. Leven asked if an interceptor line is a sewer line. Yes. Schell explained they should look at groupings of dense areas of housing. Collection costs are minimized with dense groups. Local treatment plans to that group or pipe to a transmission line which takes you to a central facility. He is addressing the transmission line. Leven summarized that he is referring to transmission and treatment in Orleans. The committee discussed further. Hughes, P stated it is an alternative to consider. Taylor stated at a CCC meeting the executive director gave an update. She asked if the Towns can get money as part of the $3+ million awarded to the Commission recently and the answer was no Hughes, P explained the big question is whether we can use our own build out or do we have to use the CCC assumptions. There could be big challenges. She mentioned the Multi Variant Planner (MVP). This could be a helpful tool. Hughes, ] asked if they should communicate with the CCC regarding the second half. They discussed a point person. Leven will contact the Cape Cod Commission regarding water shed tools. Bennett summarized the Harwich/Chatham recent arrangement with sewering. He would like to see Brewster communicating early with their neighbors. CWPC 2-11-13.docx Page 3 of 6 Hughes, P - Address problematic issues. Skidmore asked what we need to communicate to HWG regarding the Phase III scope. We want this discussion with CCC to happen. Leven suggested developing the regional context. Skidmore stated Schell's comments are in an email. DeRuyter commented about the CCC efforts. Is there a point person at the CCC who could come to a meeting regarding developing a Phase III with their potential regional support tools? Leven and Skidmore explained no action has been taken yet. It was discussed at the last meeting. Miller stated they won't know until they have discussions. Miller suggested not sewering in Brewster, but do so at Pleasant Bay and pay them. Miller, Paula asked about Orleans dismantling the existing treatment plant. Bennett stated it is sewage vs. septage. He does not know what their adaptive strategy is. Invite CCC? This shows good will we have completed Phase II. Some of this is redundant with Phase I. This is an ideal time to pause and get CCC and HWG in for discussions. We should talk about Phase III alternatives. Under wastewater - Start to talk about alternatives. Taylor asked about sub watersheds with HWG. Meeting with DEP? How to approach project. Pay Orleans for some of their work? We never heard back from DEP. This is critical. Skidmore asked for an update from HWG regarding meetings with DEP. Miller, Paula participated in a long discussion with Andrew Gottlieb and Paul Niedzwiecki. They will be approving these local plans. They are going to have criteria. It would be an ideal time to review these criteria. They are not going to do a specific plan for each town. Schell commented on Harwich and Chatham. They had a volume of water to negotiate over. We don't have that with Orleans. We have to start with how much nitrogen do we have to remove to meet our Pleasant Bay TMDL. How much water is associated with that? Skidmore agreed there are a lot of issues for the Phase III Scope. DeRuyter agreed with Bennett regarding a pause. He was intrigued by Paula's comments. It might be a suitable moment to take pause. It would be a shame to develop a plan without understanding the criteria. Bennett suggested adding to Section A - Include language regarding discussions with the other towns involved in Pleasant Bay and regional government for a regional wastewater plan criteria. Section C - A breakdown of Cl. and C2 costs. Schell asked for them to resolve ambiguity about DEP conditions and MEP standards. He doubts that will be possible to completely resolve ambiguity. The main to an Orleans plant is conventional. You would not have to worry about the details of the design. Hughes, J - Second half after D3, Pond water Quality - Is this a repeat of what we are doing with SMAST? Page #5. $50k. Skidmore asked for clarification. Miller commented. They did a diagnostic study of Sheep Pond. This is a term from the State. That is quite a bit of money for one pond. Hughes, 3 asked Miller if each pond is unique. Miller stated they could bunch some together. It depends on who you talk to. Take sediment samples to reduce cost and timeframe. Then move ahead to treatment vs. long drawn out with a couple ponds a year. Hughes, 3 - Is this overlap? CWPC 2-11-13.docx Page 4 of 6 Hughes, P asked do we need to do this with every pond. She suggested exploring targeting a number of ponds with sediment sampling. Taylor stated the CCC is including pond work in their plan and they could pay SMAST to do it Taylor discussed further with Paula Miller Hughes, P made a Motion to accept the comments from HWG as discussed, Leven may pass comments along, Bennett Second, All Aye, Vote 8-0. Bennett requested to be copied on the communications. Hughes, P asked about DEP recent meetings. She asked for an update. A meeting needs to include HWG and CCC. She requested someone who is working on the "nuts and bolts" on this plan. We need to address septage and septage management. Leven will talk to Martha at the CCC. Schell asked if they have talked about $50k/Ponds. Yes, further clarification was requested. What ponds? Committee stated they would like a role in deciding which ponds plus sediment analysis. Skidmore stated that further discussion at this time is not productive. Miller, Paula asked about the pond front "Owner's Manual."There are so many manuals regarding pond front property management. She hopes this is not a large piece. Skidmore stated they are requesting clarification. I IDDE Comments Leven stated there are no comments. This is Illicit Discharge Determination Elimination Plan. It involves SEA. Leven sent the committee a copy of the draft plan for review. 6. Reviiw Minutes of 3.2-10-12 Hughes, P made a Motion to approve the minutes of 12-10-12 as written, O'Reilly Second, All Aye, Vote 8-0. 7. Topics the Chair did not reasonably anticipate Bennett asked to review action items. Leven and Moore reviewed the items. An updated list will be distributed. Moore asked Bennett for an update. Leven distributed printed and electronic versions of the HWG Phase II Final Report. Bennett made a Motion to adjourn, Ryan Second, All Aye, Vote 8-0.
