Alan Wheat seconded the motion. Motion passed unanimously. Communication Received Jayme Abbott stated no communications have been received. New Business Demolition Review Application for 310 E Miller St. Sheri Johnston began the staff report by stating that the purpose of this request is to demolish 310 E Miller St. It was constructed in 1920 therefore making it less than 100 years old. It is not individually listed on the National Historic Register, part of a Local Historic District, or designated as a local landmark. A 2008 architectural survey identified the property as being eligible for the National Register of Historic Places under Criterion C. The Second Baptist Church, owner of the property, wishes to demolish the structure for parking and future expansion. The staff recommended form of motion is that there will be no historic properties affected and that the demolition application be approved. Nathan Percy moved to approve the demolition review application for 310 E Miller St. Bill Case seconded. Motion passed with Steve Hoffman voting nay. Section 106 Review a. 605 Houchin St Homeowner has been approved to participate in the CDBG Grant Homeowner Support program. The proposed project is removal of failing back addition of structure, return of the back wall to an exterior wall after addition is removed with application of acceptable siding, building an acceptable replacement landing, stairs, and railing, and replacement of missing railing on front porch and steps. The residential structure was constructed in 1907 and is not listed individually on the register or within a historic district. Staff recommended approval of Section 106 Review as no historic properties are affected Steve Hoffman moved to approve the 106 Review. Donna Deetz seconded. Motion passed unanimously. b. 217 Ridgeway Dr Homeowner has been approved to participate in the CDBG Grant Homeowner Support program. The proposed project is to replace HVAC system. The residential structure was constructed in 1960 and is not listed individually on the register or within a historic district. Staff recommended approval of Section 106 Review as no historic properties are affected. Steve Hoffman moved to approve the 106 Review. Jane Moore seconded. Motion passed unanimously. Other Business a. Facade Improvement Committee Appointment During June's meeting it was discussed a new HPC member needs to be appointed to the facade committee. Jayme Abbott explained that the city has several programs such as the Commercial Fa9ade Program, Rental Fagade Program, and Adaptive Reuse program. As part of these programs the Facade Committee approves the applications. Two members from the Historic Preservation Commission are to serve on this commission. Donna Deetz moved to have Doug Record fill the vacancy. Jane Moore seconded. Motion passed unanimously. b. Staff Updates on Prior Actions School Street Local Historic District Public Hearing, City Council Meeting, Monday, July 16, 2018 at 6 pm. Dates to Remember a. Cedar Way. According to MidMOGIS the property was constructed in approximately 1900, therefore the age of the structure is over 100 years old. In accordance with Section 8-47(A)(1)(a) the property was posted with a public hearing sign on July 31, 2018. Exterior and interior photos, MIDMOGIS Map, and other documentation are attached. Condition That Historic Preservation Commission or City Council May Impose In accordance to Section 8-43(I), The Commission or Council may impose conditions on the approval of a Historic Preservation Demolition Clearance in order to ensure that the demolition complies with any applicable requirements of this section that include, but are not limited to, the following: 1. To ensure that notable historic or architectural features or historic fixtures that contributed to the finding of a notable structure are being salvaged or preserved. 2. To ensure that a structure found to be a notable structure and approved for demolition clearance is properly documented for posterity. 3. To ensure that partial demolition of a structure found to be a notable structure does not result in establishment of an exterior finish that is out of character with the structure. 4. Other conditions that the Commission or City Council may deem appropriate to reduce the impact of the demolition with respect to the applicable review criteria. Conditions imposed by the Historic Preservation Commission may be appealed to the City Council in the manner provided for in Section 8-43(H) Staff Recommendation In reviewing Section 8-43(F), Review Criteria (as outlined above), 211 W Cedar Way does not appear to hold significant historic value as it is not individually listed on the National Register of Historic Places or Local Landmark. The recently adopted Historic Southside Old Munichburg District & Neighborhood Plan (page 133) identifies the land use for the area for commercial use. The property owner has not identified future plans with the site. At the time of completing this staff report, no comments have been received in response to the public hearing sign. Based on this information, staff recommends that property owner's application for demolition be approved. Recommended Form of Motion Move that the demolition clearance application for 211 W Cedar Way is approved by this Commission. McCarty Street Jefferson City, MO 65101 MEMORANDUM TO: Historic Preservation Commission FROM: Larry Burkhardt, AIA, P.E., Building Official RE: 721 Walsh St. Demolition Permit Application DATE: July 19, 2018 Carrie Tergin, Mayor Sonny Sanders, Director Phone: 573-634-6410 Fax: 573-634-6457 The structure at 721 Walsh Street was damaged by a fire on January 3, 2018. The Jefferson City Fire Department responded and reported that there were flames showing from the roof. Upon my site visit, the damage was extensive. In accordance with Section 8-95 of City Code, 25% of the insurance proceeds ($12,500) were sent to the City of Jefferson to hold until the nuisance is abated since the loss exceeded more than 50% of the value of the policy. Improvements to the property are listed at $42,300 on MidMOGIS. As stated in the Dangerous Building Regulations, Section 8-81, the structure's condition is unsafe due to the fire damage and cannot be occupied. Given the repair cost exceeds 50% of the value (Section 8-82, paragraph D), the City of Jefferson has the right to order it to be repaired or demolished. The owner has opted to voluntarily pursue demolition. Please note that if the owner did not pursue to abate the situation, the City of Jefferson would have eventually abated the nuisance by demolition. Given the above facts, the building's condition is categorized under the dangerous building City Code and is declared a nuisance. The structure's condition must be abated. High St. - Demolition DATE: July 31, 2018 Carrie Terqin, Mayor Sonny Sanders, Director Phone: 573-634-6410 Fax: 573-634-6457 The structure at 200 E. High Street experienced a partial collapse of its western wall on June 7, 2018. The City of Jefferson's: Fire; Public Works; Police; and Building Regulations staff responded to the emergency to control the area. Upon my site visit, the damage was extensive to the structure. The enclosed photo was taken a couple of hours after the collapse. As stated in City Code under the "Dangerous Building Regulations," Section 8-81, the structure's condition is unsafe due to the instability of the main structural supports. This will classify it as a "dangerous" building. The structure has been reviewed by numerous engineers and the consensus cause of failure appears to be water infiltration to the exterior unreinforced masonry walls — the main structural component. This water action weakened the wall at the area of failure by washing out the mortar that held the bricks together. The wall then somehow received an off -balanced load to prompt the collapse. In reviewing the structure (built circa 1885), the remaining walls have also been affected by water infiltration and will need extensive repairs. Additionally, the building 202 E. High is structurally tied into the 200 E. High building by their adjacent wall. This wall is also compromised and will need extensive repair. The current value of the property improvements is $276,500 per MidMOGIS. The repair cost would greatly exceed 50% of this value (Section 8-82, paragraph D). Therefore, the City of Jefferson would have the right to order it to be repaired or demolished. The owner, however, has opted to voluntarily pursue demolition. Please note that if the owner did not pursue to abate the situation, the City of Jefferson would have eventually abated the nuisance by demolition. A more recent photo of the structure is enclosed. Nature of the Request The bill would create the National Register Historic Overlay (NR) District and establish the overlay district in the seven areas that are coterminous with the areas in the City that are historic districts listed on the National Register of Historic Places. Effect of Overlay District The effect of the overlay district would be to take the City's current existing National Register Historic District through the City's zoning processes and establish those areas as being "zoned" as historic. This would allow these areas to take advantage of rights, privileges, or benefits offered under state or federal law to areas that are zoned as historic under local procedures. One such statute that affords protection to areas "zoned as historic" is contained in newly passed Missouri House Bill 1991 (2018), which regulates deployment of small wireless antennas and facilities in the public rights-of-way. Under HB 1991 wireless telecommunications companies can place their facilities in the public rights-of-way as of right, including installing new poles in the rights-of-way. However, HB 1991 carves out an exception for areas have been "zoned as historic" as of August 28, 2018, which will allow applications for new poles and larger modifications of existing wireless facilities to be processes through discretionary, public hearing procedures. This will allow public input on the impact of these facilities in historic areas and will the give the City ability to work with wireless telecommunications companies to figure out a deployment strategy that works for both the company and a neighborhood. Relationship to other Districts Existing underlying zoning, including existing overlapping overlay districts, will remain in place and the NR District will have no impact on the function of existing zoning districts. Staff Analysis City staff believes the NR District has the potential the confer substantial benefits on the areas in which the District is put in place by allowing those areas to take advantage of rights, benefits, or privileges conferred by state or federal which require an affirmative act or formalization by the City to claim such rights, benefits, or privileges. The NR District does not create any new restrictions or requirements on Case P18020, National Register Historic Overlay District 2 private real property owners in the District. Staff recommends approval of the text amendments creating the National Register Historic Overlay District and the proposed map amendments implementing the NR District in the seven areas identified above. Staff Recommendation Staff recommend approval of the proposed text amendment. The section of the city code dealing with establishment of local historic districts currently has no procedure for how the boundaries of a district could be amended. Chapter 8 (Buildings and Building Regulations) Sec. 8-44 (Nomination of Historic Districts) is amended with the addition of a new sub -section E as follows: E. Expansion of Established Historic District. Once a historic district is established by ordinance under this section, such historic district may be expanded by application of the owners of record of parcels seeking to be added to an established district. Such parcels shall be directly abutting the established historic district. When an area containing ten or more parcels seeks to be added to an established historic district, the application shall contain at least seventy-five percent (75%) of all owners of record of the parcels seeking to be added to the established district. Applications to expand a historic district shall be reviewed under the same criteria set forth in Subsection C above and under the same procedures applicable to original establishment of a historic district. A Historic district shall not be expanded until approved by ordinance and any design criteria applicable to the originally approved historic district shall apply equally to any expanded area, provided that design criteria may be amended by ordinance following review by the CJHPC and notice and hearing applicable to original enactment of design criteria. Section 2. This ordinance shall be in full force and effect from and after its passage and approval.
