PRESENT: Chairman Dan Garren, Members - Roy Hobbs, Bette Lovinus, Mike Taylor and Clerk Julie Hammond. ABSENT: Robyn Keyes. VISITORS: Greg Hansen, Lin Longhurst, Jolyn Louk, Scott Hunting and Kurt Roland. The Pledge of Allegiance was led by Member Taylor. Minutes Approved: Member Lovinus motioned to approve the minutes. Chairman Garren seconded the motion. All were in favor, motion carried. Agenda: Chairman Garren made a change to the Agenda. He requested Mayor Andersen be heard prior to the Public Hearing. Mayor Andersen: Mayor Andersen recognized Planning & Zoning for their efforts in Formatting Changes to Title 11, this process took almost two years from start to finish. The Mayor also stated he and the City Council wanted to thank the members for their time and dedication to the City of Iona and presented them with a small token of appreciation. Mayor Andersen stated that the Park Committee would meet next month after Planning & Zoning. He reported that the City's Application for the Idaho Parks & Recreation Grant made the short list and if awarded would include money for the parking area and shelters as well as the splash pad. Mayor Andersen was excused at 6:35. Annexation of Black Property — Public Hearing: Chairman Garren explained and opened the Public Hearing portion of the meeting. Greg Hansen of Rockwell Homes requested that the RT Zoning be discussed prior to the annexation. He stated that the RT Zone has been a great success in Mountain Ridge Estates and Patio Homes have been very successful. Chairman Garren explained that the RT Zone is for high density housing with 1/4 acre lots which include Patio Homes and Town Homes. Chairman Garren asked the visitors to speak in favor, neutral or opposed. Lin Longhurst stated she was opposed to the annexation because the City of Iona represents country living and this portion of Iona would turn into the equivalent of Bellaire. Jolyn Louk concurred about the high density housing. Scott Hunting stated that his property is across from the proposed annexation and was concerned about what would happen to his property. Mr. Hansen rebutted by stating that Rockwell wants to be a good neighbor and provide entry level homes for everyone. He explained that Town Homes are less popular and the biggest buyer of Patio Homes is families. Rockwell's plan is to do more Patio Homes and from experience families are staying in the homes or selling to other families. Mr. Hansen's stated Brookstone Subdivision in Chubbuck has been in place for five years and is family oriented and maintained well. Kurt Roland of Eagle Rock Engineering stated that everyone needs a place to live and these are nice family neighborhoods. He explained that Patio Homes are just as big as regular homes and create a good tax base for the City. Jolyn Louk rebutted by saying not all income is positive. P&Z Member Hobbs inquired about having high density housing in front and larger density in back of the subdivision. He also asked about the projections to high density with regards to the road system. Mr. Hansen replied that they had not made any projections; he was here tonight to find out what Rockwell would be able to do. If the zoning was approved then they would work within the confines of that zoning and are thinking of a little bigger lot size but does not want to lead anyone astray. Chairman Garren referenced the Comprehensive Master Plan stating that it provides for diversity of housing but only 5% of the Citizens surveyed wanted growth/development. 94% of Citizens stated Iona was growing too fast and didn't want to pattern itself after Ammon. Chairman Garren suggested annexing as Rl. Member Hobbs agreed stating that high density was a problem. Member Lovinus had mixed emotions she likes the bigger lots but sees the need for smaller lots. Ms. Lovinus stated that Mountain Ridge does not look bad with mixed housing. Member Taylor leaned towards R1 and agreed there needs to be diverse housing. Member Hobbs wondered what the impact on the City's water system, fire and police protection would be. Chairman Garren stated they needed a recommendation for Council. Member Taylor motioned to approve the annexation zoned as R1. Member Hobbs seconded the motion. All were in favor. Mr. Hansen withdrew the request for the annexation and stated that Rockwell would hold off for now. Ordinance #84: Mr. Hansen stated that Ordinance #84 — Area of Impact Agreement with Bonneville County is very old (2001) and asked if Planning & Zoning would look at updating the agreement. Member Hobbs agreed it was outdated. Mr. Hansen suggested some changes such as 6,000 sq ft lot size and 50' frontage. He presented a draft of a new zone, the RTA Zone, and asked if Planning & Zoning would review it and put it on next month's Agenda. Green Valley Subdivision: Clerk Hammond explained that Mayor Andersen would like someone from Planning & Zoning to attend Bonneville County's Public Hearing on the Zoning & Preliminary Plat of Green Valley Subdivision scheduled for February 27, 2013 at 6:30 pm. Chairman Garren stated he would attend. This proposed subdivision is located South of Iona Rd and West of 45th East with roughly 200 units Impact Area Updates: Member Keyes will take two letters to the Sewer District, Idaho Falls Water and Bonneville County Planning & Zoning, one that follows the Sewer District Boundaries and one that follows the highway and have them sign the one they prefer. Often the P & Z will recommend items that should be included in the Agreement. I will need the complete name of the person/entity who will sign the DA, and if an entity, the name of the person who will sign on behalf of the entity. At some point in time, the Mayor, Council and I should discuss the pros and cons of annexing unplatted property into the City, as opposed to waiting until the Developer is ready to move forward on the development and has prepared a subdivision plat. BONNEVILLE COUNTY ORDINANCE NO. ,206 4/ AN ORDINANCE IDENTIFYING AN AREA OF IMPACT FOR CITY OF IONA; PROVIDING FOR THE APPLICATION OF PLANS AND DEVELOPMENT ORDINANCES WITHIN THE IDENTIFIED AREA OF IMPACT; PROVIDING FOR THE ADMINISTRATION 1 AND ENFORCEMENT OF SUCH ORDINANCES; PROVIDING FOR SEVERABILITY; SETTING FORTH A PROCESS FOR RENEGOTIATION; AND ESTABLISHING ANEltECTIVE DATE. WHEREAS, Idaho Code Section 67-6526 requires, among other things, that cities and counties shall: (a) adopt by ordinance a map identifying an area of city impact with the unincorporated area of the county; (b) by separate ordinance, provide for the application of plans and ordinances for the area of city impact; and WHEREAS, the City Council (the "City") for the City of Iona, Idaho, and the Board of County Commissioners (the "County") for the County of Bonneville, Idaho, have pursuant to the mandate of Idaho Code Section 67-6526, entered into and conducted negotiations regarding the area of impact; and WHEREAS, the aforementioned negotiations considered the following factors, among others: (1) trade area; (2) geographic factors; acid (3) areas that can reasonably be expected to be annexed into the City of Iona, Idaho in the future; and WHEREAS, the Bonneville County Planning and Zoning Commission has considered and made recommendations to the Board regarding an appropriate Area of City Impact, and (2) the Comprehensive Plan and Zoning Ordinance requirements that should apply thereto; and WHEREAS, the governing boards for the County and City have by separate ordinance adopted and created an Area of City Impact; and NOW THEREFORE,: BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF IONA, IDAHO AND THE BOARD OF COUNTY COMMISSIONERS OF BONNEVILLE COUNTY: Section 1. Legislative purpose: The purpose for establishing an area of impact is to comply with Section 67- 6526 of the Idaho Code. Section 2. Geographic, Area of Impact, The area of impact for the City of Iona is defined by Exhibit A. If a boundary line of the impact area divides an existing parcel, the parcel shall be included in the jurisdiction in which the larger area of the parcel is located. Section 3. Comprehensive Plan: The Comprehensive Plan as adopted by Bonneville County along with amendments shall apply to this area of impact. Modifications to the County Map will be made where possible to mirror the City plan. Section4. Subdivision ,Ordinance: The Bonneville County Subdivision Ordinance as amended shall apply to this area of impact. All improvements within the area of impact will be built to city infrastructure standards if they are more restrictive. Section 5. Zoning Ordinance: The Zoning Ordinance, map and subsequent amendments thereto as officially adopted by Bonneville County, shall apply to this area. It is understood that in areas where central water and sewer services are not available that densities will be limited to one dwelling per ten acres with the allowance for lot averaging and agricultural density transferring with a minimum lot size of one acre. Modifications to the County Ordinance will be made where;possible to mirror City plan. Section 6. Development Agreements: The County will enter into a development agreement with owners, tenants and developers of property located in the area of impact. The purpose of these agreements will be to address the implementation of standards for development in the area of impact as agreed to by the City and the County. er% Section 10. Idaho Code. Section 7. , Annexations: Annexation to the City of Iona shall be in accordance with Section 50-222 as amended of the Idaho Code. Section 8. Administration and Enforcement: Bonneville County shall be responsible for administration and enforcement of all Sections 3, 4, 5 and 6 above. The Board of County Commissioners of Bonneville County and its employees and agents shall enforce compliance with the provisions of this ordinance and the regulations adopted herein. The Bonneville County Planning and Zoning Board shall act as the planning commission for the area of City Impact. Impact area representatives shall be assigned as follows: Bonneville County outside of any impact area 5, and from within each city proper or it's impact area, Idaho Falls City (2), Ammon (1), alternating board member between Ucon and Iona (1) and between Swan Valley and Irwin (1). At least 3 of which shall reside within the boundaries of an incorporated, city. A city can wave its board member privilege to the other city. The County Commissioners will consider recommendations by the City Council prior to making any such appointment. The City shall have the right ;to review plans and make recommendations for change and inspect all infrastructures under it's purview that are being installed within the impact area. At least fourteen (14) days prior to any proposed action the County will submit to the City for compliance check and comment all applications for rezoning, conditional use permits, comprehensive plan changes, subdivision plats, and improvement drawings. Section 9. Overlay requirements within the Iona Impact Area. The following shall be adopted by the County for use within the impact area. 1. Also characteristic of this Zone are residential amenities adequate to maintain desirable residential neighborhoods. The principle permitted uses in the R-TA Residence Zone shall be one family dwellings and certain other public facilities which are necessary to promote and maintain stable residential neighborhoods. In order to accomplish the objectives and purposes of this Ordinance and to promote the essential characteristics of this Zone, the following regulations shall apply in the R-TA Zone: 1-2 Use Requirements. The following uses shall be permitted in the R-TA Zone: A. Any use permitted in the RT Zone. B. Home occupations. C. Single- Family dwellings C. Single-family attached dwellings 3-3 Area Requirements. An area of not less than six thousand (6,000) square feet shall be provided and maintained for each dwelling. No minimum area shall be required for other main buildings, except as may be required for conditional uses permitted in the zone. 1-4 Width Requirements. The minimum of any building site for a dwelling shall be fifty (50) feet measured at the building setback line. 1-5 Location of Buildings and Structures. A. Setback. All buildings shall be set back a minimum distance of thirty (30) feet from any public street. B. Side Yards. For main buildings there shall be a side yard of not less than eight (8) inches for each foot of building height, except that no side yard shall be less than seven (7) feet, six (6) inches. Side yard requirements for accessory buildings shall be the same as for main buildings, except that no side yard shall be required for accessory buildings which are located more than twelve (12) feet in the rear of the main building. lZ Single-family attached dwellings shall have no side yard setback requirement at the property line separating the attached or party wall or walls; however, all accessory buildings shall comply with the setback requirements set forth above. C. Rear Yards. For main buildings there shall be a rear yard of not less than twenty-five (25) feet on both interior and corner lots. For accessory buildings, no rear yard shall be required, except where an alley is located at the rear of a lot, in which case a three (3) foot rear yard is required. 1-6 Height Requirements. No building shall be erected to a height of greater than two (2) stories. Roofs above the square of the building, chimneys, flagpoles, television antennas, church towers, and similar structures not used for human occupancy, are excluded in determining height. 1-7 Size of Building. The minimum building size, excluding basements and open patio areas, attached garages and carports, shall be not less than one thousand one hundred (1100) square feet, and may have a basement or crawl space. 1-8 Lot Coverage. The total area of structures on a lot shall not exceed forty (40) percent of lot area. 1-9 Special Provisions Regarding Single -Family Attached Dwellings: A. All lots upon which a single-family home attached dwelling is located shall have frontage upon and vehicular access to a dedicated street. B. No single-family attached dwelling shall be located above another dwelling unit, either in whole or part. C. Each single-family attached dwelling shall have at least one direct pedestrian access from the interior of the dwelling to the exterior boundaries of the lot and no pedestrian access may be held in common with another single-family dwelling unit. D. No more than two (2) single-family dwellings may be attached together. E. Except as noted below, a single-family attached dwelling shall have no facilities or property in common with another single-family attached dwelling and all dwellings shall be structurally and functionally independent from each other. All single-family attached dwellings shall have separate electrical service, water service lines and sanitary sewer service lines. Common facilities or property are allowed for the following: 1. Common party walls constructed in accordance with the Uniform Building Code. 2. Foundations supporting attached or party walls. 3. Flashing at the termination of the roof covering any attached walls. 4. Roofs. 5. Vehicular access to a dedicated street from off-street parking facilities or garages. F. All single-family attached dwellings shall meet the dwelling unit separation requirements of the officially adopted and applicable building codes of Idaho Falls. G. The net density of single-family attached projects shall not exceed seven (7) units per acre. The area within public rights -of -way shall not be included in the calculations for net density. H. When applications for single-family attached dwellings are submitted for conditional use review, a plat, site plan showing the location of proposed buildings, driveways, sidewalks, and other improvements, and preliminary elevations of the proposed buildings shall be submitted.
