AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING UTILITY EASEMENTS IN THE PREVIOUSLY VACATED PARTS OF
THE 400 AND 500 BLOCKS OF WEST MILLER STREET, THE 500 AND 600 BLOCK
OF HARRISON STREET, THE 600 BLOCK OF WEST ELM STREET AND AN
UNNAMED ALLEY SOUTH OF INLOT NOS. 768, 769, and 770.
WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that the
owners of land adjacent to and abutting upon the previously vacated parts of the 400
and 500 blocks of West Miller Street, the 500 and 600 block of Harrison Street, the 600
block of West Elm Street and an unnamed alley south of Inlot nos. 768, 769, and 770 in
the City, have petitioned the City Council to vacate the retained utility easements on a
portion of vacated right-of-way; and
WHEREAS, it has further been shown that it would not inconvenience the public or the
citizens of the City to discontinue the utility easements in the previously vacated parts of
the 400 and 500 Blocks of West Miller Street, the 500 and 600 Block of Harrison Street,
the 600 Block of West Elm Street and an unnamed alley south of Inlot nos. 768, 769
and 770 for public use as described in Section 1 of this Ordinance.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri, hereby declares it
necessary, reasonable and proper to discontinue the utility easements in the previously
vacated parts of the 400 and 500 Blocks of West Miller Street, the 500 and 600 Block of
Harrison Street, the 600 Block of West Elm Street and an unnamed alley south of Inlot
nos. 768, 769 and 770 and forever vacate the following described easements in said
City:

Section 2. The statutory right of reversion in the owners of the abutting property
is hereby confirmed, as is provided by the laws of the State of Missouri, and the Mayor
and the City Clerk are hereby authorized to execute all necessary instruments required
to confirm the reversionary rights of the owners of property abutting on the area
vacated, as described in Section 1 of this ordinance, in the right-of-way vacated.
Section 3. This Ordinance shall take effect and be in full force from and after its
passage.

Harrison and Miller Streets
A tract of land being a part of Miller Street and Harrison Street right of way and also
being adjacent to the northerly line of Inlot No. 664, in the City of Jefferson, County of
Cole, Missouri, being more particularly described as follows:
Beginning at a point on the southwesterly right -of-way line of Routes 50 & 63, said point
also being the northeast corner of Inlot No. 659; thence in an easterly direction along
said right-of-way line to a point opposite Routes 50 & 63 centerline Station 14+70; said
point being 56.00 feet South of and at right angles to Routes 50 & 63 centerline; thence
in a southeasterly direction parallel to the centerline of Routes 50 & 63, a distance of
31.87 feet, said point being 56.00 feet South of and at right angles to Routes 50 & 63
centerline Station 15+01.87; thence in a southeasterly direction along a curve to the
right, said curve having a radius of 55.00 feet, to a point intersecting the southerly right -
of-way line of Miler Street; thence in a northwesterly direction along the southerly right -
of-way line of Miller Street and the extension of that line to the point of beginning.

West Elm Street
A parcel of land being a part of Elm Street in the City of Jefferson, County of Cole,
Missouri, More particularly described as follows:
Beginning at the northeasterly corner of Inlot 770; thence N 47° 34’ 29” W, along the
northerly line of Inlot Nos. 770, 769, and 768, 365.75 feet to the northwesterly corner of
Inlot 768, said point being on the Range Line; thence N 02° 45’ 51” E, along the Range
Line, 25.00 feet; thence N 57° 14’ 09” W, along the southerly line of Elm Street, 22.68
feet; thence northerly on a curve to the right, having a radius of 351.97 feet, a distance
of 43.20 feet to a point on the southerly extension of the easterly line of Bolivar Street;
thence N 42° 09’ 35” E, along said southerly extension, 23.62 feet to the southwesterly
corner of Inlot 660; thence S 47° 34’ 29” E, along the southerly line of Inlot Nos. 660,
661, 662, and 663, 417.50 feet to the westerly line of Harrison Street; thence S 42° 09’
35” W, along the westerly line of Harrison Street, 80.00 feet to the point of beginning.

All that part of a twenty (20) foot wide alley l ying South of Inlots No. 768, 769 and 770,
and North of Inlot No. 771, in the City of Jefferson, County of Cole, Missouri.

North, Range 12 West, in the City of Jefferson, County of Cole, Missouri, more
particularly descried as follows:
Beginning at the northwesterly corner of Inlot 771 in the City of Jefferson, Missouri, said
point being on the Range Line; thence N 02° 45’ 51” E, along the Range Line, 25.98
feet; thence N 47° 34’ 29” W, along the westerly extension of the northerly line of a
vacated 20 foot alley, 30.05 feet; thence S 02° 06’ 01” E, 42.08 feet; thence N 02° 45’
51” E, along the Range Line, 12.99 feet to the point of beginning for this description.
