PRESENT: Chairman Dan Garren, Members - Roy Hobbs, Bette Lovinus, and Clerk Julie Hammond. ABSENT: Mike Taylor. VISITORS: Nolan Getsinger, Jolyn Louk, Eric Bodily, and Alice Olsen. The Pledge of Allegiance was led by Member Hobbs. Chairman Garren recognized citizens from the floor. Minutes Approved: Member Lovinus motioned to approve the minutes. Member Hobbs seconded the motion. All were in favor, motion carried. Recreational Vehicles for Human Habitation on City Lots Public Hearing: Chairman Garren explained the public hearing process. He stated that the proposed ordinance limits human habitation on residential lots within the City of Iona for a period of ten days in any calendar year. He further explained that the remainder of the ordinance defined recreational vehicle. Chairman Garren opened the hearing for public comment. Nolan Getsinger of 5434 Steele Ave was concerned about relatives that may come for a funeral or family event. Chairman Garren indicated that was still fine but there would be a ten day limit. Jolyn Louk of 5428 Rockwood was concerned about snowbirds that might bring a motorhome for two to three months. Chairman Garren indicated that they could apply for a conditional use permit. Chairman Garren closed the public portion of the hearing at 6:40 p.m. and opened discussion for Planning & Zoning Members. Member Lovinus recommended the period of time be extended to fourteen days and anything over that would require a permit. She proposed buying a thirty day permit. Member Hobbs wasn't sure why we needed so much paper work. He stated that it was just more taxation. Chairman Garren wondered where it would stop if thirty day permits were available. He stated short term stays were fine, long term stays would require a conditional use permit. Chairman Garren didn't forsee a problem and thought it could be addressed if and when there was a problem. Member Lovinus motioned to recommend to Council approval of the Recreation Vehicles for Human Habitation on City Lots Ordinance. Member Hobbs seconded the motion with the period of time extended to fourteen days. All in favor, motion carried. Impact Area Agreement: Member Hobbs asked where we sat on the Impact Area Agreement. Chairman Garren stated that it had been tabled for lack of progress and until we see a need. Member Hobbs asked if we were taking into consideration what the gas company was doing. Chairman Garren replied that the County stated we didn't have services out there. Member Hobbs stated he would research. Public Questions: Eric Bodily and Alice Olsen of 3180 Olsen asked about putting an apartment in the basement for her grandson. Chairman Garren stated that they would need to see Clerk Hammond during office hours and apply for a variance. Meeting Adjourned 7:15 p.m. foN ORDINANCE NO. AN ORDINANCE OF THE CITY OF IONA, IDAHO, PROHIBITING THE PERMANENT OCCUPANCY OR USE OF RECREATIONAL VEHICLES FOR HUMAN HABITATION UPON RESIDENTIAL LOTS LOCATED WITHIN THE CITY; PROVIDING FOR SEVERABILITY AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA, IDAHO, THAT: Section 1. Adoption of New Section 11-11-24, lona City Code. A new section 11-11-24 of the Iona City Code is hereby adopted as follows: 11-11-24: EXTENDED USE OF RECREATIONAL VEHICLES FOR HUMAN HABITATION PROHIBITED IN RESIDENTIAL ZONES. (A) It shall be unlawful for any person to use, occupy or permit the use of any Recreational Vehicle for the purposes of human habitation upon any lot located within a residential zone within the City for a period of more than ten (10) days in any calendar year. (B) For the purposes of this section, a "Recreational Vehicle" shall mean a vehicle primarily designed for use as temporary living quarters for recreational, camping, or travel use, which either has its own motive power or is mounted on or drawn by another vehicle. Such vehicles include, but are not limited to travel trailers, camping trailers, truck campers, fifth -wheel trailers and motor homes. (1) "Camping trailer" means a vehicular portable unit mounted on wheels and constructed with collapsible partial side walls which fold for towing by another vehicle and unfold at the campsite to provide temporary living quarters for recreational, camping or travel use. (2) "Fifth wheel trailer" means a vehicular unit, mounted on wheels, designed to provide temporary living quarters for recreational, camping or travel use, of such size or weight as not to require special highway movement permit(s), of gross trailer area not to exceed four hundred (400) square feet in the set- up mode, and designed to be towed by a motorized vehicle that contains a towing mechanism that is mounted above or forward of the tow vehicle's rear axle. (3) "Motor home" means a vehicular unit designed to provide temporary living quarters for recreational, camping or travel use built on or permanently attached to a self-propelled motor vehicle chassis or on a chassis cab or van which is an integral part of the completed vehicle. (4) "Travel trailer" means a vehicular unit, mounted on wheels, designed to provide temporary living quarters for recreational, camping or travel use, of such size or weight as not to require special highway movement permits when towed by a motorized vehicle, and of gross trailer area less than three hundred twenty (320) square feet. (5) "Truck camper" means a portable unit constructed to provide temporary living quarters for recreational, camping or travel use, consisting of a roof, floor and sides, designed to be loaded onto and unloaded from the bed of a pickup truck. Section 2. Severability. The sections and subsections of this Ordinance are severable. The invalidity of any section or subsection shall not affect the validity of the remaining sections or subsections. Section 3. Effective Date. This Ordinance shall become effective on its passage, execution and publication in the manner provided by law. PASSED BY THE COUNCIL AND APPROVED BY THE MAYOR this day of , 2013.
