HomeMy Public PortalAbout1995-12 Amending sections 2-41 b and 2-41 e of the village code re clarification of the term noticeORDINANCE NO. 95-12 AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AMENDING SECTIONS 2-41(b) AND 2-41 (e) OF THE CODE OF THE VILLAGE OF KEY BISCAYNE FOR THE PURPOSE OF CLARIFICATION OF THE TERM "NOTICE" USED RESPECTIVELY THEREIN; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE. WHEREAS, this Council has determined that certain amendments to Sections 2-41(b) and 2-41(e) are necessary for clarification of the term "Notice" used respectively therein. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, DADE COUNTY, FLORIDA, AS FOLLOWS: Section 1: That Section 2-41(b) of the Code of Key Biscayne is hereby amended to read as follows:1 (b) The Village Manager shall send a Notice of hearing by first class mail to the named Violator at his last known address. The Notice of hearing shall include but not be limited to the following: . . . Section 2. That Section 2-41(e) of the Code of Key Biscayne is hereby amended to read as follows: (e) All hearings of the Special Master shall be open to the public. All testimony shall be under Oath. Assuming proper Nnotice, a hearing may proceed in the absence of the named Violator. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be a are additions to text, word struck through are deletions to text. invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code. It is the intention of the Village Council, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the Code of the Village of Key Biscayne; that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word. Section 5. Effective Date. This Ordinance shall be effective upon adoption on second reading. PASSED AND ADOPTED on first reading this 12th day of September, 1995.
