Failace, 7:30 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on Thursday June 21,2001. Upon individual roll call, the following were noted present: ROLL CALL Councilmember Jack Fazekas Daniel Reiman " Ronald Rios " Janet Santoro Also noted present were Borough Attorney Rob Bergen and Business Administrator Nicholas Goldsack. Noted absent were Councilmembers Remy Quinones and Buddy Sohayda. The meeting was opened with a minute of Silent Prayer and The PRAYER, PLEDGE Pledge of Allegiance led by Mayor James A. Failace. OF ALLEGIANCE The Clerk stated that on June 15, 2001, in full compliance with the STATEMENT OF Open Public Meetings Act, a notice of tonight's meeting was sent to MEETING NOTICE The Home News Tribune, The Star Ledger and posted on the Bulletin Board. Due to the malfunction of the tape recorder, this meeting was CLERK' S NOTE transcribed from hand notes. PROCLAMATION TO JANET KNEISEL Mayor Failace spoke on behalf of Janet Kneisel and issued the following Proclamation: WHEREAS, Janet Kneisel, wife of George and mother to Christopher, PROCLAMATION Terence and Matthew has been a resident of Carteret for twenty four years; and JUNE 21, 2001 PROCLAMATION WHEREAS, Janet Kneisel has been a teacher in the Carteret Public ( CONTINUED ) School system for many years in the Special Education classes; and WHEREAS, Janet Kneisel has unselfishly volunteered her time for eighteen years teaching in the Special Religion Program at Holy Family Learning Center; and WHEREAS, Janet Kneisel has touched the lives of so many children and adults with her kindness and compassion; and WHEREAS, Janet Kneisel is devoted to the Carteret Community and especially to our population with developmental disabilities; and WHEREAS, Janet Kneisel has been an asset to our community, loved by her students and their parents and respected by all who come in contact with her; and WHEREAS, she and her family will be moving to Virginia and will be sadly missed by all who had the good fortune to know her. NOW, THEREFORE, I JAMES A. FAILACE, Mayor of the Borough of Carteret, do hereby proclaim that the Governing Body of the Borough of Carteret fondly joins the many friends and admirers of Janet Kneisel in loving recalling and recognizing her many gifts to the Carteret Community. It was duly published in The Home News Tribune on June 12, 2001 with notice that it will be considered for final passage after Public hearing to be held on June 21, 2001 at approximately 7:30 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. PUBLIC HEARING OPEN Upon MMS&C, by Councilmembers Reiman and Fazekas and unanimous affirmative vote of the four (4) members present, the Mayor declared the Public hearing to be open: DISCUSSION John Sudia asked if there was any assistance from the Borough for people who are physically impaired or aged. Mayor Failace said they can work with the Code Official and he is sure they would be helped. PUBLIC HEARING There being no further comments or objections to the Ordinance, the CLOSED Mayor declared the Public Heating to be closed upon MMS&C, by Councilmembers Reiman and Rios and unanimous affirmative vote of the four (4) members present. Upon MMS&C, by Councilmembers Reiman and Rios ORDINANCE #01-31 ORDINANCE # 01-31 PROPERTY MAINTENANCE "AN ORDINANCE AMENDING AND SUPPLEMENTING ARTICLE I GENERAL PROVISION OF CHAPTER 198 PROPERTY MAINTENANCE OF THE CODE OF THE BOROUGH OF CARTERET" ADOPTED was finally adopted. Upon individual roll call vote, Councilmembers Fazekas, Reiman, Rios and Santoro voted in the affirmative for the adoption. Councilmembers Quinones and Sohayda were noted absent. PUBLIC HEARING Upon MMS&C, by Councilmembers Reiman and Fazekas and OPEN unanimous affirmative vote of the four (4) members present, the Mayor declared the Public hearing to be open: Pat Tozzi asked if there was a time limit. Mayor Failace said the County is doing Washington Avenue and Roosevelt Avenue and some streets off of those roads. Jim Stone also asked for an explanation of the Ordinance. David Crudup asked how long it would take to be able to use the roads for travel. Councilman Reiman said he had no idea. Mayor Failace said they ~vould not mill it until they are ready to do it. Larry Birgl said the last time the roads were done the utility companies wrecked them. JUNE 21, 2001 Councilman Reiman stated that the costs from the County were DISCUSSION incorrect. He asked if they can amend the Ordinance so it would be (CONTINUED) $350,000.00. Business Administrator Nick Goldsack said they would be doing some of the work in the Fall. Borough Attorney Rob Bergen explained that Patrick DeBlasio received another Bond Ordinance and that they should leave the money in the Capital Fund. Mayor Failace said they will check with the utility companies. Councilman Reiman explained that the Attorney and Engineer are preparing a road opening permit Ordinance. Larry Birgl complained about the roads. James Mancuso asked if there is a five (5) year time limit. He said a homeowner can not be stopped from putting in a gas line. Mayor Failace said they are referring to big jobs. The Business Administrator said a homeowner could be stopped from putting in a line if it is not an energy. John Sudia asked if utility companies are exempt from posting bonds. There being no further comments or objections to the Ordinance, the PUBLIC HEARING Mayor declared the Public Hearing to be closed upon MMS&C, by CLOSED Councilmembers Reiman and Rios and unanimous affirmative vote of the four (4) members present. Upon MMS&C, by Councilmembers Reiman and Rios ORDINANCE # 01-34 ORDINANCE I01-34 ROAD IMPROYEMENTS "AN ORDINANCE PROVDING FOR VARIOUS ROAD IMPROVEMENT AND SIDEWALK PROGRAM FOR THE BOROUGH OF CARTER-ET, COUNTY OF MIDDLESEX, NEW JERSEY, APPROPRIATING $250,000 FROM THE CAPITAL IMPROVEMENT FUND OF THE BOROUGH FOR THE COST" was finally adopted. Upon individual roll call vote, Councilmembers ADOPTED Fazekas, Reiman, Rios and Santoro voted in the affirmative for the __ adoption. Councilmembers Quinones and Sohayda were noted absent. Approved and Adopted: June 21,2001 Introduced: June 7, 2001 Advertised as adopted on First Reading With notice of Public Hearing June 12, 2001 Hearing Held: June 21, 2001 Approved by: Mayor James A.Failace Advertised as finally adopted June 26, 2001 JUNE 21, 2001 MEETING OPENED A copy of each Resolution was placed on the table for public review PUBLIC INPUT ON prior to the meeting in accordance with the Rules of Council and upon ALL RESOLUTIONS MMS&C, by Councilmembers Reiman and Rios and unanimous affirmative vote of the four (4) members present, the meeting was opened for public input on all Resolutions. DISCUSSION Stanley Gutowski asked if Resolutions #01-207 and #01-208 are temporary appointments to the Playground Program and the 2001 Recreational Sports Program, which run concurrently. Robert Kately advised him that the Playground Program starts next week and the Sports Program starts July 9, 2001. Councilman Fazekas announced that there would be a Parks Center Meeting next Wednesday. John Sudia asked what the legal bills are for the Csimbok case. The Borough Attorney stated that the bills were $2,000.00 to $3,000.00 for the last couple of months. He does not know what they were before. He recommended the Council discuss Resolutions #01-204 and #01-212 in Closed Session. RESOLUTION ttO1-189 RESOLUTION #01-189 was introduced by the Mayor and was AMEND THE BUDGET referred to the Council for action. Upon MMS&C, by Councilmembers Reiman and Rios RES OLUTION #01-189 "RESOLUTION TO AMEND THE BUDGET" ADOPTED was adopted. RESOLUTION #01-190 RESOLUTION #01-190 was introduced by the Mayor and was ABC LICENSES referred to the Council for action. The Municipal Clerk asked the Council to amend the Resolution to remove the Carpatho Russian American Citizen's Club - License #1201-31-048-001. She explained that the license is inactive and needs a Special Ruling from the ABC before it can be renewed. NJDOT TRUST FUND Upon MMS&C, by Councilmembers Rios and Santoro RESOLUTION #01-191 "AUTHORIZING MAYOR TO EXECUTE THE NJDOT TRUST FUND APPLICATION FOR TERMINAL AVENUE AREA ROAD IMPROVEMENTS" was adopted. Mayor Failace read the following proclamation: PROCLAMATION AMATEUR RADIO WEF. K PROCLAIMiNG AMATEUR RADIO WEEK WHEREAS, the Borough of Carteret has more than 30 licensed Amateur Radio operators who have demonstrated their value in public assistance by providing emergency radio communications; and WHEREAS, the Amateur Radio operators donate these services free of charge to the Borough, in the interest of the citizens of the Borough as well as the world; and WHEREAS, these Amateur Radio operators are on alert for any emergency, local or world-wide, and practice their communication skills during the American Radio Relay League's Field Day exercise; and WHEREAS, this year's Amateur Radio Field Day will take place on June 23-24, 2001; NOW, THEREFORE, I, JAMES A. FAILACE Mayor of the Borough of Carteret, hereby declare the week of June 19-24 as AMATEUR RADIO WEEK in recognition of this emergency preparedness exemise, and call upon all citizens to pay tribute to the American Radio operators of our Borough. 17 JUNE 21, 2001 STANDING COMMITTEES BUILDiNGS & GROUNDS: In the absence of Committee Chairman Quinones, Councilmember Santoro repeated that there has not been a committee meeting and she is not aware of what has been worked on. She said the Fire House improvements will be bid. She has no idea of anything else. FiNANCE & ADMiNISTRATION: Committee Chairman Reiman reports that we should be adopting the budget at the next meeting. He said there is a four cent ($.04) increase which equals approximately forty six dollars ($46.00). Mr. Reiman stated we were not able to get State Aid. He said he previously spoke about establishing a Historical Committee. Councilmember Reiman said an ordinance would be prepared. This would allow us to apply for grants and aid. FIRE: Committee Chairman Rios repeated that repairs were made to the West Carteret Firehouse. He said windows were fixed, it was painted and the roof was repaired. Mr. Rios said the fence was repaired by the Firefighters and he thanked them. Councilmember Rios repeated that on June 15, 2001 there was a foam class held in conjunction with Kinder Morgan. He said on June 30, 2001 the Ladies Auxiliary will hold their Blood Drive. Committee Chairman Rios said Tom Lang previously asked for information on the April 17, 2001 HAZMAT Spill. He said the bill ($1182.54) was sent to the Vendor and they are waiting for payment. PARKS & RECREATION: Committee Chairman Fazekas thanked those involved in the Chrome Park Clean-Up. Mr. Fazekas went on to give the following events and dates: a) Annual PBA Fishing Derby was held last weekend b) Boys Little League Tournament is July 14-22, 2001 c) Carteret Specials Fishing Derby is June 25, 2001 d) Sports Camp begins this month through the summer e) Town Picnic is July 7, 2001 f) Concerts in Carteret Park, Friday nights July 13 -August 31, 2001 g) Town Yard Sales is September 29, 2001 Mr. Fazekas went on to say he will hold a Parks & Recreation meeting every fourth Wednesday of the month. He said he will distribute an activity list at the meetings. Committee Chairman said he reviewed each park and graded each one for functionality. He said the report would be available Wednesday. Mr. Fazekas went on to say he will __ try to get a handle on the ADA compliance. He said he is moving right along. Councilmember Rios said the Town Meeting was held last week at the AME Zion Church. He said a question came up about the basketball court being lined. Mr. Rios confirmed that it has been lined. 18 JUNE 21, 2001 POLICE: Committee Chairman Santoro said there was a murder in STANDING COMMITTEES Carteret. She commended the Police Department. She said the PBA (CONTINUED) Fishing Derby was a huge success. Mrs. Santoro said she is working with Sprint to get them to donate cell phones to the Domestic Violence Center. Committee Chairman Santoro said there is a recommendation from Captain Hojecki to hire five (5) school guards. She said she would like to do this in July so they can start their training in August. She said the Catholic Charities need an area to operate from. Mrs. Santoro said she would talk to Nick Goldsack about this. She said the Special Charity Softball game is Saturday. Committee Chairman Santoro said she met with Taqualla Ransdell, Coordinator of Ethnic Day and everything is moving ahead. She said there is a Ground Breaking Ceremony on June 27, 2001 at Roosevelt Park for the Veteran's Memorial. Councilmember Reiman said he suggests having the Borough provide transportation. PUBLIC WORKS: In the absence of Committee Chairman Sohayda, Councilmember Rios said they desperately need a Jet Vac truck. He said it would be fully funded. He said in regards to Streets and Roads, the County would be paving Roosevelt Avenue and Washington Avenue. Mr. Rios went on to say the three (3) new employees would start on Monday. Councilmember Reiman said the Library Director is looking at a grant for one million dollars ($1,000,000). He said it is for the Library Project even though the work is completed. BOARD OF EDUCATION: Councilmember Fazekas said he is supposed to meet with the Board of Education. He said he will give his report at the next meeting. Councilmember Santoro informed everyone that the Middle School Graduation is tonight and the High School Graduation is tomorrow. Mayor Failace said he hopes that we get the Library grant. He said the bricks at the Library look good. The Mayor announced there would be mosquito spraying on June 25, 2001, at 8:30 P.M. He said they are spraying for regular mosquitoes not the West Nile mosquitoes. He said the office of Emergency Management would be participating in Amateur Radio Week. David Crudup complimented the Police for deterring undesirables. He asked about the progress of the traffic light and the Industrial Road. 19 JUNE 21, 2001 DISCUSSION Mayor Failace told him the County said they need to do a traffic study. ( CONTINUED ) Mr. Crudup asked if the Borough would pick up garbage from the vacant lots that the residents put out. Mayor Failace said yes. Arlene Swingler complimented the Police. She said the drug situation is better but it is still there. Mayor Failace said he would speak about grant money later in the meeting. Borough Attorney Rob Bergen said that the owners of several abandoned buildings were sent notices. He said there is one property for sale. Mr. Bergen said all of the attorneys with the exception of one, responded asking for more time. He said the buildings would be rehabilitated, and he would amend the Ordinance. Councilmember Reiman asked the Borough Attorney what the status was on the North Brunswick RCA. Borough Attorney Rob Bergen said the documents were sent but their Attorney is on vacation. Pat Tozzi asked what Resolution #01-193 is. Councilmember Reiman said it is a grant for pedestrian walkways. Mayor Failace said they will do the walkways and curb cuts on Carteret Avenue. Mr. Tozzi asked why they are doing Carteret Avenue. Mayor Failace said it was approved by the State. Mr. Tozzi said the school budget reduction was too low. He told Council President Fazekas the Board of Education meetings are held at Washington School and only a certain amount of people are allowed to attend. He said there are not enough seats for all the people and he suggests that all of their meetings should be held at the Middle School. Mr. Tozzi said he was disappointed that the Carteret people only got approximately six hundred dollars ($600.00) under the SAVER PROGRAM. He said it exceeds (inaudible) the money the Seniors get. Mr. Tozzi said the State said they would send another check to Seniors who own homes. He said they will boycott the elections this year. An unidentified woman asked if the truck drivers have a specific time to go through (inaudible). Mayor Failace said they do not have a specific time. The woman said truck drivers throw garbage there and should be stopped. The Mayor said we have the Police (inaudible) truck parking. 20 JUNE 21, 2001 An unidentified woman said she has a pool that she can not use. She DISCUSSION said there is an electrical outlet there but it is not connected. She said ( CONTINUED ) this should have been done before she bought the house. Business Administrator Nick Goldsack said the woman would be receiving a phone call. Ms. Crudup said Carteret Avenue is not the only street that should be fixed. She said Bergen Street also needed to be repaired. Ms. Crudup said the merry-go-round swings too fast and kids can get hurt. Mayor Failace said he will look into it. Stan Gutowski said some municipalities have gotten approval for Green Acres grants. He asked what the status is. Councilmember Janet Santoro said they have filed for grants. Mr. Gutowski said he hopes Councilmember Fazekas would attend the Board for the Disabled meetings. He said they lost a grant last year for computers because of non-attendance by members. Councilmember Santoro said they did not lose it because of lack of attendance. She said she gave Joanne Kisselman the information. Jim Stone asked why we have to spend our own money for grants. Councilmember Reiman said if we did not, we would have to scale down the project. Mr. Stone asked if we can make streets light traffic. He said Blair Road should be a light traffic street. He said this would get the trucks off Roosevelt Avenue. Diane Ronkett asked about Community Gardens. Councilmember Reiman said the ones they looked at do not meet the size. He said Borough owned property can be used for Community Gardens. An unidentified person said that traffic is being stopped at the bridge and it is being re-routed. He said this is being done every day for one (1) hour at lunch time only. John Sudia asked if they can adopt an Ordinance prohibiting truck parking. Councilmember Reiman explained that the Planning Board approved the White Rose application, which includes a Cul-de-sac. He said this will eliminate some truck parking. John Sudia said in reference to the Csimbok Resolution, he hopes this is an end for the Police Department. He said the Carteret Police Department is Carteret's Finest. Mr. Sudia said there is no reason to persecute them. He said he hopes the people heard the Mayor on WCTC because he did a fantastic job. 21 JUNE 21, 2001 DISCUSSION James Mancuso said there is not one 'No Parking" sign on Industrial (CONTINUED) Road.
