Mr. Peirce moved to appoint Ms. Shaw as Clerk. The motion was seconded by Mr. Savagnano and passed unanimously. 7:15 PM Application for Public Hearing 39 Downey Street — Vienneau Amy Vienneau — Applicant Members Sitting: Mr. Hyman, Mr. Peirce, Mr. DiMascio, Mr. Savignano, Ms. Shaw Members in Attendance: Mr. Tuite, Ms. Patel Ms. Vienneau stated they would like to build a small 6 foot deck off the house for water views. Mr. Savignano asked what the side setback requirement is. Mr. Kadlik stated it is 25 feet. Mr. Peirce asked how the new addition got approved. Mr. Kadlik stated it was his understanding that the Building Inspector at the time believed that if there was an existing structure near the lot line they could build to the same setback because they weren't increasing the non -conformity. Mr. Peirce asked if they have spoken with the neighbors. Ms. Vienneau stated they were given notice but she has gotten no response. Mr. Peirce asked how high the deck would be off the ground. Ms. Vienneau stated there would just be a few steps toward the front. Mr. Hyman asked if there were any public comments and there were none. Mr. Peirce moved to close the public hearing. The motion was seconded by Mr. DiMascio and passed unanimously. Mr. Peirce moved to find the proposed deck would not be substantially more detrimental to the neighborhood than the existing and that the lot is irregularly shaped and grant a special permit for side setback relief as requested and that it be consistent with the plans filed. The motion was seconded by Mr. DiMascio and passed unanimously. Documents Used: Uniform Applications for Special Permit/Petition for Variance with supporting documents Mr. Peirce moved to adjourn the meeting. The motion was seconded and passed unanimously.
