Failace, 7:30 P.M., Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey on Thursday July 19, 2001. Upon individual roll call, the following were noted present: ROLL CALL Councilmember Jack Fazekas " Daniel Reiman " Ronald Rios " Remy Quinones Also noted present was Borough Attorney Rob Bergen. Noted absent were Councilmembers Santoro and Sohayda. The meeting was opened with a minute of Silent Prayer and The PRAYER, PLEDGE OF Pledge of Allegiance led by Mayor James A. Failace. ALLEGIANCE The Clerk stated that on July 13, 2001, in full compliance with the STATEMENT OF Open Public Meetings Act, a notice of tonight's meeting was sent to MEETING NOTICE The Home News Tribune, The Star Ledger and posted on the Bulletin Board. Upon MMS&C, by Councilmembers Reiman and Fazekas and MINUTES FOR APPROVAL unanimous affirmative vote of the four (4) Councilmembers present, the minutes of April 5, 2001, April 19, 2001 and May 3, 2001 were approved as transcribed and engrossed by the Clerk. Mayor Failace administered a commendation to Mark Bergery and COMMENDATIONS Joseph Fontana the two gentlemen who displayed a heroic act on November 22, 2000 which saved the life of a Carteret citizen. ORDINANCE #01-40 was introduced and adopted on First Reading ORDINANCE ~tO1-40 and the Clerk authorized and directed to advertise same for Public SALARY SCHEDULES Hearing to be held on August 16, 2001, upon MMS&C, by Councilmembers Rios and Reiman. Upon individual roll call vote, Councilmembers Fazekas, Quinones, Reiman and Rios voted in the affirmative. Councilmembers Santoro and Sohayda were noted absent. ORDINANCE # 01-40 "AN ORDINANCE TO AMEND ORDINANCE #71-9 ESTABLISHING SALARY SCHEDULES AND FIXING THE MANNER OF PAYMENTS OF SALARIES FOR VARIOUS OFFICIALS AND EMPLOYEES OF THE BOROUGH OF CARTERET" ULY 19, 2001 ORDINANCE ~O1-41 ORDiNANCE #01-41 was introduced and adopted on First Reading OFF STREET PARKING and the Clerk authorized and directed to advertise same for Public AND LOADING Hearing to be held on August 16, 2001, upon MMS&C, by Councilmembers Rios and Fazekas. ORDiNANCE # 01-42 "AN ORDINANCE AMENDiNG AND SUPPLEMENTiNG SECTION 160-119.1 ("CERTIFICATE OF CONTINUED USE OR OCCUPANCY") OF CHAPTER 160 "LAND DEVELOPMENT" OF THE CODE OF THE BOROUGH OF cARTERET" ORDINANCE t01-43 ORDiNANCE #01-43 was introduced and adopted on First Reading HISTORICAL COMMITTEE and the Clerk authorized and directed to advertise same for Public Hearing to be held on August 16, 2001, upon MMS&C, by Councilmembers Reiman and Rios. ORDiNANCE # 01-43 "AN ORDiNANCE CREATiNG A CARTERET HISTORICAL COMMITTEE" Mayor Failace said when this gets under way, this will actually be something very good. He said it will probably (inaudible) some 2 JULY 19, 2001 history into Carteret. The Mayor said there is a lot of information out there that we have not brought in yet. ORDINANCE #01-44 was introduced and tabled on First Reading and ORDINANCE [O1-44 the Clerk authorized and directed to advertise same for Public Hearing SALARY SC}~EDULE FOR to be held on August 16, 2001, upon MMS&C, by Councilmembers BOROUGH OFFICIALS Quinones and Reiman. Upon individual roll call vote, Councilmembers Fazekas, Quinones, Reiman voted in the affirmative. Councilmember Rios voted to abstain. Councilmembers Santoro and Sohayda were noted absent. ORDINANCE # 01-44 "AN ORDINANCE TO AMEND ORDINANCE #71-9 ESTABLISHING SALARY SCHEDULES AND FIXING THE MATTER OF PAYMENTS OF SALARIES FOR VARIOUS OFFICIALS AND EMPLOYEES OF THE BOROUGH OF CARTERET" Councilmember Quinones said she wanted to make the motion to table MOTION TO TABLE this. She said when this was first brought up at the Agenda meeting, the Mayor asked that we go back and look at the salary adjustments and discuss them. Ms. Quinones said she does not see how this can now be back on the Agenda without all Councilmembers having discussed it. Councilmember Reiman said actually we had quite an extensive conversation. Councilmember Quinones asked who discussed this. Councilmember Reiman said this was discussed with the Business Administrator who also serves as the Mayor's Chief of Staff. He said he does not have a problem tabling it, but this was discussed with the Mayor. Mr. Reiman said if we approve it tonight, we can still make changes to it prior to the final document. Councilmember Quinones said why did you even put it on for consideration if we have not talked about it. Mayor Failace said if we do have to make changes, depending on what the changes are, this could have to be re-advertised. He said he does not agree with the "extensive conversation" comment. The Mayor said he remembers saying at the last Agenda Meeting that they should take it, look at it and come back the next Agenda Meeting. He said he is not against it, but he does think there are some things that need to be looked at a little closer. Councilmember Reiman said his understanding was it would be placed on the Agenda today, however he made the second motion to table. JLY 19, 2001 IDINANCE {01-35 The Clerk stated Ordinance #01-35 was introduced and passed upon First Reading at a Regular Meeting of the Borough Council held on June 21, 2001. It was duly published in the Home News Tribune on June 26, 2001 with notice that it will be considered for final passage after Public Hearing to be held on July 19, 200l at approximately 7:30 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the -- Ordinance by title. ISCUSSION John Sudia a resident of Carteret asked what the Police Director is going to cost us. Mayor Failace said at this point it is not a signed contract. He said the Borough Attorney will be looking into this. ANTORO NOTED At approximately 7:45 P.M. Councilmember Janet Santoro was noted RESENT present. ISCUSSION Stan Gutowski said in reference to Resolution # 01-222, he would like CONTINUED) to know the status of the Green Acres Application. He asked if the application has been sent in or not. Mayor Failace said this has not been sent in. He said inaudible) the County. Mr. Gutowski asked so as of fight now it has not gone m. Mayor Failace said not as of yet. JULY 19, 2001 Councilmember Janet Santoro said (inaudible) txvo (2) different grants DISCUSSION as the Mayor explained. She said there is the Green Acres Grant, (CONTINUED) which we are voting on this evening, and there is a second grant for one hundred and fifty thousand dollars ($150,000.) which was Revitalization. Councilmember Santoro said she did fax the Green Acres Grant paperwork to the Freeholder. She said she also sent the other grant paperwork to the Freeholder as well. Borough Attorney Rob Bergen said in regard to Resolution #01-234 which refers to the Redevelopment Area Boundaries, he would like the Mayor to explain it to the people. Mayor Failace said this Resolution is to approve the boundaries of lower Roosevelt Avenue. He said if anyone has any questions on this, please feel free to speak on it. Councilmember Reiman said (inaudible) xvhen you adopt it, then it goes back to the Planning Board and Redevelopment Agency for recommendations. He said the engineer Schoor DePalma put together a plan for lower Roosevelt Avenue (inaudible). Mr. Reiman said by approving the outside boundaries tonight, the application for the tentative plan will be sent back to the Planning Board (inaudible). Borough Attorney Bergen asked Mr. Reiman if there ~vere any written objections regarding the boundaries at the Planning Board. Councilmember Reiman said just so the members of the audience are aware, the Mayor and I sit on the Planning Board as Borough Officials. He said we had a Public Hearing with the Planning Board several months ago and there ~vas no problem with getting approval from them. Mayor Failace said we have not received any complaints. Borough Attorney Rob Bergen asked the Borough Clerk if she had received any written objections. Borough Clerk Kathleen Barney said no. Susan Gaydos a Carteret Resident asked how far does the redevelopment extend. Mayor Failace said it is from Edwin Street to Housing Authority and by the Abattoir. There being no further comments or objections to the Resolutions, the HEARING CLOSED Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Fazekas and Reiman and unanimous affirmative vote of the five (5) Councilmembers present. STANDING BUILDiNGS AND GROUNDS: Committee Chairperson Quinones COMMITTEES said she was trying to put together a Task Force (inaudible) Borough Hall. She said that one of her Colleagues had asked people not to participate so what she decided to do was create a Resident Task Force which will consist of people with similar backgrounds. She said it will be Chaired by former Councilmember Stan Gutowski. Councilmember Janet Santoro ask Borough Attorney Rob Bergen (inaudible) what would they be allowed to do. Borough Attorney Rob Bergen said they can not take any formal action. He said they can not bind the Borough in any way, and their views will be simple advisory. Councilmember Daniel Reiman said he spoke with the Business Administrator and he was under the impression that we were going ahead with (inaudible). He said he thought we were going to ask for a Resolution appointing the members of a Task Force with Councilmemhers Quinones, Santoro and the Mayor, along with the Officials that Councilmember Quinones had mentioned. Councilmember Santoro said when three Councilmembers are appointed to a Committee isn't that similar to the Committees we vote on in the beginning of the year. She said doesn't that need Council approval when we form. Borough Attorney Rob Bergen said he does not think you need a formal Resolution. He said you can decide as a group that you will get together in a Task Force and then maybe appoint the Head Person. Councilmember Quinones said how is her Task Force different from the Ethnic Day Committee, which consists of one Councilmember. Councilmember Santoro responded (inaudible). Councilmembers Quinones and Santoro argued back and forth. 20 JULY 19, 2001 Councilmember Santoro spoke to Councilmember Quinones saying DISCUSSION you only want to see it one ~vay and that's thc Rcmy syndrome and it's ( CONTINUED ) sitting back. She said we want to work forward (inaudible). Councilmcmbcrs Quinones and Santoro argued again. Councilmember Quinones said you dumped this on someone else so you obviously cared a xvholc lot about what you were doing. Councilmember Santoro said that is your opinion and your allegations. She said if you want to move forward and work together on this, she would extend her time and the information she gathered last year when she worked on this Committee. Councilmember Quinones thanked her for her offer, but she said she does not value her opinion or her work ethic and she does not want her participating on her Committee. Councihnember Reiman said he would like to make a motion to appoint a Committee on the rules that Council can have "Special Committees". He said we could have the Business Administrator or Ms. Quinones or The Mayor chair it. Everyone started to speak at once (inaudible). Mayor Failace said the bottom line is, what it comes down to, is they basically don't want the Councilwoman bore (Quinones) to do anything. He said when she called a meeting with the Engineer, the Business Administrator and the Head of the Construction Department, Councilmember Santoro called half of them up and told them not to go. He said (inaudible) they told me she told them not to go. The Mayor asked the Borough Attorney if Councilmembcr Santoro can be brought up on charges. He said she called employees and put them in a very precarious position. Mayor Failace said he feels ethically this is a problem. Borough Attorney Rob Bergen said if you think there is an ethics violation you can file charges. He said but in terms of discipline from the Council there is (inaudible). He said you can not remove anyone. Mayor Failace said he did not intend on removing anyone. He said if they could remove anyone they would have removed me along time ago. He said the bottom line is, he does not see how you could do that to Borough Employees xvho have been asked to come to a meeting by a Council Person and another Council Person tells them no. Councilmember Janet Santoro said she doesn't understand how another CouncilPerson can call them up and give them a directive that they must attend. She said she spoke to the Borough Attorney and asked him if an individual could order an employee to attend or not 21 ULY 19, 2001 ISCUSSION attend. The Attorney informed her that an individual would not have CONTINUED) the authority to do so. Mayor Failace said he could. Councilmember Quinones said she can give an employee a directive. Councilmember Santoro said as far as an employee fearing her, they never had to fear her from the time she ran for Election. They never had to feel intimidated. Those are your tactics not mine. Councilmember Rios asked how many meetings has the Buildings and Grounds Committee had this year. He said he would think this project would fall under the Building Committee. He asked again, how many meetings have there been. Conncilmember Quinones said she wanted to make herself perfectly clear so there is no misunderstanding. She said she has not had any Committee meetings nor does she intend on having any Committee meetings. She said she has managed to do what she needs to do without meetings. Ms. Quinones said most of the members of the Committee, not to mention Councilmembers, choose not to work with her on any other issue so why do they want to work with her on this. Councilmember Reiman said since Ms. Quinones was on that topic, she was invited several times to a Finance Meeting. He said Mr. Goldsack sent down at least one or two memos and he told me he personally invited her to three other meetings dealing with negotiations, recycling and a meeting with several banks. Everyone started to speak at once (inaudible). Councilmember Reiman said he specifically scheduled two meetings after 5:00 P.M. on a Wednesday in February, because Ms. Quinones told him she could not make it during the day. He said we had the meeting, he had Patrick and Nick waiting, and Ms. Quinones never showed up. Mr. Reiman said Councilmember Quinones was invited to every Finance/Administration meeting there was and never showed up for one. He said Ms. Quinones did not have the courtesy to tell him she was not going to be there after the meetings were rescheduled to accommodate her. Councilmember Quinones said it fascinates her how Mr. Reiman can sit here and lie. She said he scheduled his meetings during the day when she works. She said she has a full-time job. She said his job might allow him the flexibility to do that, but hers does not and she conveyed that to him. Councilmember Rios said he would respectively request that the Building Committee Chairmen call a meeting. Councilmember Quinones said she would not do that. He said she has gotten the Community Center open and she has done a number of things. Mayor Failace said the problem is she feels uncomfortable with this Council because this Council does choose to leave her out. He said as a matter of fact Councilmember Reiman put a schedule together last week to give her one of the Town Meetings and he said it was tentative. He said Nick Goldsack was supposed to make up those meetings no one else. Mayor Failace said he called Councilmembers Rios and Sohayda and asked them if they knexv anything about the meeting and they told him no. He said yet the Councilmen (Reiman) told him point blank that thc Council decided that they xvould put these names down. He said and Councibnember Quinones was left out. Councilmembers Reiman and Quinoncs were both speaking at the same time (inaudible). Mayor Failace said when Councilmember Quinones calls a meeting of pertinent employees in the Borough, Councilmember Santoro tells them not to come. Councilmcmbcr Rios said Mrs. Santoro said she did not tell anyone not to come. Mayor Failace said that is a lie. He said he will bring Mr. Rios to at least two (2) of the people and let them tell him. Everyone started to yell at once (inaudible). 23 3LY 19, 2001 TANDING COMMITTEES FiNANCE & ADMINISTRATION: Committee Chairperson Reiman CONTINUED) said the Mayor and some of the Councilmembers attended a meeting on Roosevelt Avenue (inaudible) about bringing the Head Start Program back to Carteret He said at the last Agenda Meeting our Borough Attorney entered into negotiations with the (inaudible). Mr. Reiman said he is looking to hold a meeting next week (inaudible) specifically (inaudible) something that could perhaps turn into a Community Garden. He said we are in the process of renegotiating some of our contracts with Recycables. He said next week he would be scheduling a meeting with the paper and tire company. Councilmember Reiman spoke about the Historic Preservation Committee. He said the Mayor and Council were very supportive of this effort. He said we obtained records and (inaudible) from the Borough attic as well as from the Library. Mr. Reiman went on to speak about some of the historical findings. He said (inaudible) some Engineering costs for the Washington Avenue Grant. Mr. Reiman went on to speak about the Grant and the Project. Councilmember Reiman said there was reference made earlier about a Town Hall Meeting which he and the Mayor attended. He said he takes responsibility for the miscommunication between himself and Ms. Quinones concerning that meeting. He said however, no meeting dates had ever been changed. He said the schedule had been put together by the Business Administrator. Mr. Reiman asked that the Business Administrator put together another schedule for the remainder of the year with the Mayor in attendance at all the meetings and with the Councilmembers who have not attended a meeting yet be scheduled so it is as equal as it could possibly be. Mayor Failace said that is the way it was supposed to be from the beginning. Councilmember Reiman said that was correct. He said however the Business Administrator has not submitted the dates and names yet. FIRE: Committee Chairperson Rios said he hopes to continue the Town Meetings next year. He said the Fire Department has received two hundred (200) free smoke detectors from the New Jersey Division of Fire and Safety. He said if anyone needs a smoke alarm please contact the Fire Prevention Office. Mr. Rios spoke about the Fire Safety Babysitting Course that was given at the Library on July 3, 2001. He said he would like to thank all the Firefighters for the tremendous job that they did at 24 Charles Street. Mr. Rios said their great effort in extinguishing this fire prevented a real tragedy. He said the Policemen and Firemen did a tremendous job. Councilmember Rios said the Fire Department is in the process of changing over all of the hose supply to five (5) inch hoses so this will make us compatible with all of the surrounding communities. He said on Saturday August 11th the Fire Department will be participating in the Health, Safety and Wellness Festival in Chrome Park. He said on August l0th there will be a File of Life Meeting at the Fire Headquarters. Mr. Rios said he would like to thank the children and Heather Platt who was instrumental in working on the Skate Board Park. He said there xvill bca Parks and Recreation meeting next week at the Borough Hall. Mr. Fazekas said thc Summer Concerts are going well and he thanked Beverly Hedesh. He then xvent on to speak about the Skate Park. He said he is seeing something that the Community has put a lot of time into and it is being slowly destroyed. He said this is the Community's responsibility. He said wc need Community awareness when it comes to looking at problems within the parks. He went on to give examples. Mr. Fazekas said Jim Mancuso and Bob Kately have been ~vorking on some areas of park improvements. He said the Mayor had called him in regards to the gates. He said Nathan Hale has twenty-one (21) classrooms, it ranges from Pre-K to Grade 5, it is fully wired and on August 20 we should get a C of O. He said there are new windows being put in the High School, there are Administrative Offices that are being upgraded, and also the wiring (inaudible). He said there will be a new phone system installed however the time frame is not certain. Mr. Fazekas said the track and the parking lot would also be upgraded at the High School. He said Washington (inaudible) has been fully wired and we will be taking a look at the Computer Room. He reported progress. Councilmember Reiman said he would like to add something to Public Works. He asked the newspapers to DISCUSSION please advertise this for us. He said if you sign up the Officers will come and visit you and some of the Councilmembers will also visit you. The Mayor said he would like to thank tbe members of the Fire Department and the Police Department. He said the First Responder is working great. Mayor Failace said it worked personally for his mother-in-law yesterday. Hc said his mother-in-law is alivc today because of it. The Mayor thanked Firefighters Lombardi and McKinney and Officer Hundemann for doing an excellent job. Mayor Failace thmzked Bob Kately for the wonderful job he did on the Monument. He then thanked Heather Platt for her work on the Skate Park. He said he wanted to thank Jim Mancuso for spearheading the project and Stan Gutoxvski for getting five hundred (500) dollars worth of wood donated. The Mayor also thanked the Parks Department for helping out. He then agreed with Councihnember Fazekas in regard to getting the gates back up for insurance purposes. Mr. Failace said the Town Picnic was great. He said Beverly Hedesh does a great job getting these things set up. Jim Mancuso said the Skate Park is still not finished. He said we COMMENTS should be done this week. He said he wanted to thank thc Mayor and Councilmember Santoro who agreed to do this. He also thanked Councilmember Fazekas. He said when it is complete, it will be something to be proud of. Hc said it should be a showplace. Mr. Mancuso thanked Heather Platt for all the art~vork she did, and he 27 JULY 19, 2001 )ISCUSSION thanked the kids who were down there helping. He then asked the [CONTINUED) Borough Attorney what is "Light Duty". He said does that mean that any city employee who gets injured which is not job-related, can put in for "Light Duty". Borough Attorney Rob Bergen said it is my understanding that the Borough does not have a "Light Duty" policy. Jim Mancuso said if you are going to give that money to someone who just put in a grievance (inaudible) legally where do you stand if somebody else does it. Borough Attorney Rob Bergen said (inaudible) have been drafted in this agreement is a request that there be no grievances based upon this one. He said there are a number of things that would block a similar situation. Jim Mancuso spoke about a situation in Union City where the City lost the case. Mr. Mancuso suggested that the Borough Attorney do some research on it. Borough Attorney Bergen said the Borough has no obligation to have a "Light Duty" policy. Mr. Mancuso said he agrees with the Borough Attorney however, if you are setting the precedence anyone in the Borough can turn around and say "I'm injured and I want light duty". Councilmember Reiman said the Police Committee has set the policy that there will be no more "Light Duty". Chico Bascilisi said he wanted to inquire about the Seasonal Employees. He said they cut grass (inaudible) they should be using an edger. He said the grass is splashing all over the road and no one sweeps it up. He asked if they were going to pave the hole on Washington Avenue. He said on the end of Washington Avenue (inaudible), you should do away with that. He said that is a disgrace. He said the Veteran's would be willing to pay for it themselves if the Borough would knock out the wall (inaudible). Councilmember Rios said he has discussed this with the Mayor and Council and we are seriously looking into this. Mr. Bascilisi spoke about the Ordinance concerning the dogs. He said people are not adhering to the Ordinance. He said it needs to be enforced. Mrs. Gaydos asked who owns the property by the Skate Park. She said the bushes are so high they hang over the metal barrier. Robert Kately said the property behind the Skate Park is State owned property. Mrs. Gaydos asked who owns the "Welcome to Carteret" sign. Mayor Failace said we are allowed to use it but we do not own it. 28 JULY 19, 2001 Jim Stone asked about Resolution #243. DISCUSSION ( CONTINUED ) Mayor Failace said it bas not been signed by the Director yet so we can not discuss this now. Borough Attorney Bergen said by the next meeting we should have it. He said after it is executed the Council should be able to explain it and give out a copy. Stan Gutowski, New Jersey Aveuue thankcd Councilmember Quinones for wanting him to serve on her committee. He said whether she was establishing a committee or not he would still be keeping the appointments that werc made for next week in Washington and he would let her knoxv xvhat comes of it. Hc said Councihnember Quinones could do with it as she so chooses to do. He said he could go there as John Q. Citizen and did not think any one could stop him fi-om going and talking about that. He said the second item he wanted to talk about and hc was not going to discuss it but hc felt it was so meaningless, childish and petty. He said he would have thought Councihnember Reiman would havc knoxv better than to do something like this... Councilmembcr Rciman interrupted to say, do something like this, and asked Mr. Gutowski to explain why he called the spccial counsel. Stan Gutowski said be accepts the Counselor's apology and he commended thc News Tribune for not thinking this was ne~vsxvorthy. He said if the Council wanted to continue the investigation as they told the Star-Ledger, the first person they should talk to was him not the newspaper. He said as he told the newspaper he comes to every Council Meeting and every Agenda Meeting. He said the bill ~vas put before the Council and maybe discussed with them or maybe not. He said someone called and told the attorney to call down there and speak to Todd Gel5and so hc felt someone spoke about this, but no one said anything to him. Hc asked why he had to have the newspaper call and ask, why didn't thc Council ask. He asked if they were afraid of him. Councilmember Reiman said "absolutely not". Stan Gutowski said why didn't you ask. Councilmember Reiman told Mr. Gutowski not to flatter himself. He said the Council did not receive that information (inaudible). He said there was one meeting since they had that information. He asked Mr. Gutowski why he would call thc Borough's Special Counsel on police matters and rcprcscnt himself as a Borough Official. Mayor Failace said first of all Mr. Bergen spoke to him a while ago. He said did he say he would take it off the bill saying it was a mistake. Borough Attorney Bergen said yes he took it off. Mayor Failace loudly said, he took it off the bill, it is a mistake. Councilmember Reiman said why was Mr. Gutowski talking to Mr. Gelfand about Borough matters. Stan Gutowski said if you really want to know ask him. Councilmember Reiman said he knew Mr. Gutowski's answer, he heard it and he does not believe it. Mayor Failace asked who Councilmember Reiman heard it from. Councilmember Reiman said he called here to find out about Mr. Stowell or his ~vife, and if that is the case and his wife is ill... Stan Gutowski said so now Councilmember Reiman does not believe Mr. Stowell's wife is ill. Councilmember Reiman said he does not believe Mr. Gutowski called and spoke to him about that and an attorney would bill the Borough for fifteen to twenty minutes worth of time because Mr. Gutowski talked to him about a partner at the law firm. Mayor Failace said he said it was a mistake, Todd Oelfand said it was a mistake, he told the attorney it was a mistake and pulled it off the bill. He asked what the point was. Councilmember Reiman said the point is the question is, he is not worrying about the thirty dollars, the point is that Mr. Gelfand discussed privileged confidential information with Mr. Gutowski and did Mr. Gutowski represent himself as a Borough Official, that was the point. Councilmember Quinoncs said now she thinks he's slighting Todd Oelfand. Mayor Failace said now he is really going way overboard now he is saying the attorney... Councihnember Reiman inte~Tupted and said until today that attorney refused to answer what they discussed. Councilmember Quinones said why do they have to tell Councilmember Reiman about private conversations. Councilmember Reiman said because if it was a private conversation (inaudible, everyone yelling at the same time) if it was private, that is fine, he should not have billed the Borough. Councilmember Santoro said he did bill us for it. Councilmember Reiman said he billed us/'or it. Stan Gutowski said he called Mr. Stowell's office and Mr. Gelfand took the call because Mr. Stowell is now associated with a church. He said Mr. Stowell is a Reverend, so Mr. Gelfand took the call. Mr. Gutowski told the Council how the conversation went on the phone, "Todd how are you, I am trying to reach Gary, I tried all his phone numbers they were all changed can you give me the number? I understand his wife is ill, potentially could be having a heart transplant." Councilmember Rios asked if Mr. Gutowski said he tried at home. Stan Gutowski said he tried his home and Mr. Stowell's numbers have been changed, he asked if there was a problem with him calling Mr. Stowell at home. Councilmember Rios said he was going to say why don't you call him at home. Stan Gutowski said for Councilmember Rios's information, he never called Mr. Gelfand or Mr. Stowell and said hello this is Stan Gutowski, Councilman from the Borough of Carteret. He said they know who he is they know he is not a Councilperson anymore and have not been a Councilperson for a year and a half. Councilmember Reiman said he had a question for Mr. Gutowski and wanted an honest and frank answer. Stan Gutowski said not that Councilmember Reiman would believe it. Councilmember Reiman asked Mr. Gutowski if he ever discussed Borough business at all, no pending cases, no pending litigation in no way. Stan Gutowski said he does not know of a pending case they would have. Councilmember Reiman said he is aware of a pending case they would have because most of these cases stem from when you were on the Police Committee. Stan Gutowski said there was one case that he could be referring to that the Council filed a settlement for, that was the only thing he was involved in. He said he has been called to depositions on behalf of the Borough because of these so-called cases Councilmember Reiman said Mr. Gutowski was involved in. He asked if he needed Councilmember Reiman's permission to go and asked if he should not go and talk to these people. Councilmember Reiman said for a deposition, absolutely not, he does not need Council permission to go to that. 32 JULY 19, 2001 Stan Gutowski said these lawyers contact him and he called them DISCUSSION back. He asked if he should charge tile Borough ~vhen he goes to these (CONTINUED) meetings. Councilmember Reiman said if that were the case that would be all the information Mr. GelPand ,~ ould have to give thc Conncil. Stan Gutowski said he was not talking about Mr. Gelfand, he was talking about every other thing. He said he was talking about Mr. Lynch, when he goes to the other litigation, Mr. McGovern in East Orange or West Orange, the other case that is going on. He asked should he not talk to these people, should he not answer them or not call them back. Stan Gutowski said "that is your solicitor right there". Mayor Failace said solicitor is another word for attorney. Stan Gutowski that is what attorneys call attorneys. Mayor Failace said instead of spending so much time on that Councilmember Reiman should ask the Council woman over there why she did not pay for her medical yet that she (inaudible) in the beginning of the year an she hasn't paid or for Councilmember Sohayda... Councilmember Santoro said the Mayor is going to sit here and play the game that he sits around and criticize the Councilmembers for. She said she felt the Mayor was the king of the master of creating a situation to embarrass and cause chaos in this Council. Mayor Failace asked what chaos does he creates. Councilmember Santoro said it is because the Mayor does not have the guts to sit down and speak to the Council face to face, he runs to the crowd. She said if the Mayor has something to say to the Council she felt he should be a man and say it to their face, don't sit in front of us. Mayor Failace asked when Councilmember Santoro was going to pay the medical bill she owed the Borough. Councilmember Santoro said she would pay as soon as they tell her what she owed. Mayor Failace told Business Administrator Goldsack to send Councilmember Santoro a bill, to make sure she was sent a bill. Councihnember Reiman said, as of today, as of yesterday, the Council still did not have the answer. Mayor Failace said there was no reason to go to thc newspaper with it. He said by thc same token xvhen it comes to the Police Department hc hoped this Council would take a good hard look al auytbing that might be coming up that could cost thc Borough a lot of money and not Cartcret taxpayers bca "cash cow" lbr any attorney. Diane Ronquette asked when Councihnember Fazekas spoke about Nathan Hale School what the classroom size was going to be. Councilmcmbcr Fazckas said he there was twenty-one classrooms in Nathan Hale, he did not say the actual. 35 ULY 19t 2001 DISCUSSION Diane Ronquette asked if he had a number or an average size, how CONTINUED ) many students per class. Councilmember Fazckas said he didn't think they would know that until after registration. Councilmember Reiman said when the Council had the budget meeting with the Board of Education, he thought they were going to have about four hundred and fifty students. Councilmember Fazekas said the maximum would be five hundred they were saying right now, actually he did not know. Diane Ronquette said Monday night at a CCAC meeting one of the firemen were there and they were talking about having CPR Classes that are free to Carteret residents, she asked if Councilmember Rios knew anything more about that as far as dates, or a schedule. Joe Lombardi, Borough Firefighter said himself and Tonuny Reynolds do the CPR Classes which Councilmember Fazekas instituted the program last year. He said they would probably be in November because he was getting married in September and he would not be back until mid October. He said he would call the people to find out exactly what they want whether it be professional rescuer or (inaudible) CPR, it would take some time and he felt it would probably be around November. He said it was (inaudible) to all the citizens of the Borough of Carteret; that was in the agreement last year's Council made. Mayor Failace asked if Councilmember Fazekas took the course. Joe Lombardi said Councilmember Fazekas's wife took the course. Councilmember Fazekas said he did not take the course, he could not do the (inaudible) Unidentified Voice said to be honest O'Connor is taking that at the Firehouse. Councilmember Fazekas said if the Commissioner takes it he would take it. Diane Ronquette asked Councilmember Santoro to stress that the Domestic Violence Team was still accepting applications. She said training wouldn't be until the end of September or the beginning of October. She said Woodbridge is supposed to be training them but they would still be accepting applications. Councilmember Santoro said she could ask Mr. Kately if he would post it on the sign. Diane Ronquette said do the Crossing Guards have placements yet or are they just hired. Councilmember Santoro said the Council hires and Captain Hojecki would place them in their locations which was done by the Police 36 JULY 19, 2001 Depamnent. DISCUSSION ( CONTINUED ) Mayor Failace asked how many new Crossing Guards that was. Councihnember Santoro said four new Crossing Guards at Captain Hojecki's recommendatiou. Diaue Ronquette said (inaudible) she really wanted to thank them for the lot, it was really important. She encouraged Councihnember Fazekas to help tis to get that so the kids could utilize that land through the parks. She said right now they just wanted to do a flowcr garden and next year they were potentially hoping to turn it into a vegetable garden. Mayor Failacc said people havc ccrtainly read in the paper that Carteret is on the map now, he was getting calls from California and all over. He said it was kind of a good thing but he was kind of embarrassed to tell someone he actually saw those lights Sunday morning coming home fi'om a wedding. He said he wasn't drinking he actually did see them and they were pretty strange he said he would ask them to come back next year when he ran for Mayor. He said they have received some (inaudible) from Nicholas Goldsack Busincss Administrator and Nick got from Toni Pottcr in rcfcrcncc to the one point million dollar grant for thc Library to recoup some of the money the town applied lbr last year. He said Tom Potter is asking for approximately ninctccn hundred dollars to fill that out and Nick said it is quite extensive and there is a lot of work that has to be donc and a lot of hours to be put in which has to be done by thc cnd of July. He said ~ve don't have another meeting so the Council needs to approve this. Councilmember Rios asked why this was not brought up at the Agenda Meeting. Business Administrator Goldsack said be did not have the bill until today. Mayor Failace said the Council did not know the extent of how difficult this was to do. Councihnember Rios said he did not like to bring things up at the Council Meetings without discussing it. Mayor Failacc said this was dated the seventeenth and Nick got it. He said he thought they were looking for one point five million dollars and felt they should do it and not play around with it. Ho said it was tip to the Cotincil and asked Borough Attorney Bcrgcn to tell him what they have to do, just approve it if they chose to or... Borough Attorney Bergen said thcy could make a motion, it was his understanding he knew that grant program and the application because they have applied for somc of it and it has to be in by July 31st. He said this has to be done by a cellified architect and you get up to twenty five percent grant money back and it may be something the Council xvould want to consider. He said because of the time limit the Council could just do a motion and a voice vote, they could do a ratifying Resolution at the next meeting, but that could be up to the 37 ULY 19, 2001 ~ISCUSSION Council whether they want to authorize him to do the work or not. He CONTINUED ) said someone had to attend the meeting from the Borough. Business Administrator Goldsack said the architect attended for the Borough. Mayor Failace said it was up to the Council. Councilmember Rios asked if they could give the audience a little more detail about this whole thing. Mayor Failace said last year they attempted to apply and were able to apply to get money back for the three point whatever they spent on the Library. He said there is an opportunity of a one point five million dollar grant out there they could get back against the cost of building the Library. He said the Business Administrator gave this to him and he has copies for the rest of the Council. Councilmember Rios asked what the criteria was if we received this money what would the Council be able to apply it to. Mayor Failace said they would pay down the debt and build a new Borough Hall. Councilmember Reiman said that would pay down the debt on the bond and free up some available (inaudible) Councilmember Rios said he would go on the recommendation and make a motion to amend the Agenda to get this done. Councilmember Santoro said she second it. Borough Clerk said it was not a Resolution, it is only a motion. Mayor Failace said they would memorialize a Resolution on this at the next meeting. MOTION TO RATIFY Upon MMS&C, by Councilmembers Rios and Santoro a motion was RESOLUTION made to ratify the Resolution at the next meeting. Upon individual roll call vote, Councilmembers Fazekas, Quinones, Reiman, Rios and Santoro voted in the affirmative. Councilmember Sohayda was noted absent. RESOLUTION #01-245 RESOLUTION #01-245 was introduced by the Mayor and referred to CLOSED SESSION the Council for action. Upon MMS&C, by Councilmembers Reiman and Rios RESOLUTION #01-245 "RESOLUTION TO GO INTO CLOSED SESSION" was adopted.
