A Regular Meeting of the Mayor and Council of the Borough of REGULAR MEETING
Carteret was called to order by Mayor James A. Failace at 7:30
P.M., Municipal Court, Police Facility, 230 Roosevelt Avenue,
Carteret, New Jersey on Thursday, September 20, 2001.
Upon individual roll call, the following were noted present: PRESENT
Councilmember Jack Fazekas
Remy Quinones
Daniel Reiman
" Janet Santoro
Noted absent were Councilmembers Ronald Rios and Alexander
(Buddy) Sohayda.
Also noted present was Borough Attorney Robert Bergen.
The Mayor then asked everyone present to remember the men of Mayor Failace
the armed forces who are traveling to the Middle East and to
remember the former Mayor Sica's sister, Anna Mae Kolibas, who
passed away.
The meeting was opened with a minute of silent prayer and the PRAYER, PLEDGE
OF ALLEGIANCE

Borough Council of the Borough of Carteret held on September 6, Senior Tree Trinmer
2001. It was duly published in the Home News Tribune on & Traffic Maintenance
September 11, 2001 with notice that it will be considered for final Worker
passage after Public Heating to be held on September 20, 2001 at
approximately 7:30 p.m. The Ordinance was posted on the bulletin
board and copies were made available to the general public and
according to law, she read the Ordinance by title.

Mayor Failace said that we were only approving the

Attorney Bergen agreed and said at the Agenda the Council had
authorized the Clerk to ask for further studies. He commented that
they did not need a resolution to put the light up. The Borough has
an annual Electric Bill for all the lighting that we have out in the

not have to do anything.

Upon MMS&C by Councilmembers Fazekas and Reiman and
unanimous affirmative vote of the four (4) Councilmembers

BUILDINGS & GROUNDS: Committee Chairperson Quinones Committees
said she would like to once again express her sympathy to those
who were involved in the World Trade Center tragedy and her
gratitude to the Police and Fire Department, who volunteered their
services and to everyone who participated last week in the
Memorial Ceremony, which turned out to be a success and
certainly she will keep them all in her thoughts and prayers.

FINANCE & ADMINISTRATION: Committee Chairperson
-- Reiman said they had the conception of the Washington Avenue
District, which is a one (1) block area from Cooke to Pershing. It is
part of a $75,000.00 grant was received from the County. We had

the Tax Assessor out to Meridian Square and (inaudible) taxes this
Committees Cont: year. She commented that they approved his resolution for the
Lease Purchase or the Award of Bid for the Mini Bus. We
currently have one out of service and the other one has some
problems and we are working on that. The other item they have is
Green Acres. He has asked the Business Administrator to request
a list of Green Acres property from the State. Progress.
FIRE: Councilmember Santoro spoke in the absence of
Committee Chairperson Rios. She said first they wanted to thank
the Firefighters, Police Officers and the First Aid Squad and OEM
who responded when the World Trade Center collapsed. We did
have people who went into New York, our First Aiders and some
Volunteer Firemen. She thinks there will be more days coming up
that some of our Emergency Personnel will be going into the city
and we want to thank all of them. Also, they want to remind
everyone that this Saturday, September 22"d, the Fire Department
will be sponsoring a Blood Drive, in conjunction with the Board of
Health and the Mayor and Council for the father of Firefighter
Tommy Reynolds and the World Trade Center victims. We are
combining those. We had scheduled the blood drive for the father
of Tom Reynolds and then we combined them and the hours will
be from 9:00 a.m. to l:30 p.m. To kick off the annual Fire
Prevention Program the Fire Department will be visiting all the
Borough Schools next week with the St. Bamabus Safety Trailer.
This is very important to the youngsters in the town. Progress.
PARKS & RECREATION/SHADE TREE - Committee
Chairperson Fazekas said that this Saturday, September 22nd , there
is going to be the Closing Ceremonies for the Girls' Softball. The

festivities wall begxn at twelve o clock. O Septemoer , there is
going to be a Town Yard Sale, so please register at the Clerk's
Office at Borough Hall. In reference to the Park's Department,
with the Carteret Avenue Project, four (4) sections of the sidev~alk
in Carteret Park are replaced. The playground equipment project
that was scheduled for Shorecrest is going to start the first week in
October. Progress.
POLICE - Committee Chairperson Santoro again said thanks to
our Emergency Personnel. On Tuesday, when the tragedy did
occur, our personnel all responded, many volunteering, many
coming into work, ready to make sure the citizens of Carteret were
safe and any emergencies that did come up they were prepared for.
Carteret residents should be very proud of all of them. Also, there
is two (2) policemen that were killed in our town on duty in
Carteret, and we are looking into a dedication to their memory; a
monument and a plaque and we are putting that together. A lot of
people in the town do not realize that this happened right in our
town. She also wanted to thank Councilmembers Rios and Reiman
for putting the ceremony together on Saturday. It was voluntarily
put together in about a day and one half and anyone who attended
that ceremony was made to realize that our town may be made up
of a lot of diversified groups but when a tragedy occurred they all
came together and we all looked for some reasoning why this

happened and it was very important that day to listen to the beliefs Coranittees Cont:
and prayers of everyone involved to help get through this. It
touched everyone whether directly or indirectly. She then thanked
Taqualla Ransdell for Ethnic Day. She said they would be doing
something for her in a future Council Meeting. She commented
they don't get a lot of people to volunteer to help with this because
it is a lot of work and she did it with all the grace and the
enthusiasm and professionalism that should make everybody
proud. We had an excellent time and it was a huge success. She
said they all wanted to thank her for that. Progress.
PUBLIC WORKS: Councilmember Reiman spoke in the absence
of Committee Chairperson Sohayda. He said first of all he thanked
Taqualla Ransdell and Beverly Hedesh for their help on Saturday.
They worked all day on Friday. At Public Works the new Jet Vac
truck is in and will be used around the Borough. Some people on
Lafayette Street are having problem. There is some raw sewage
coming up on the street and we have vacuumed it out. There may
be some illegal connections to a sewer line. It will be checked by
camera this week. The Leaf Bags are available from 9:00 a.m. to
3:00 p.m. at the Recycling Building across from Borough Hall.
Carteret Avenue Walkway Project is ongoing for the next couple
of weeks. Also the Street Paving Project from the County is
ongoing and should be completed in the next two (2) weeks.
Washington and Roosevelt Avenues are ninety per cent done. They
look very good. They are working on some other streets. The
project is going to cost about $300,000.00. The County is doing it
at cost and throwing in the labor. All we are paying for is the cost
of the milling and cost of the materials, of which is about one third
of what it would have cost if it was done outside. We are looking
at about seven or eight hundred thousand dollars savings on this
project.
BOARD OF EDUCATION: Committee Chairperson Fazekas said
as they all knew school had been delayed for the past week due to
construction. They did open and he was told that the Nathan Hale
School is fantastic. Progress.
The Mayor read the following Proclamation into the record: PROCLAMATION

FIRE PREVENTION WEEK
OCTOBER 7-13, 2001
WHEREAS, smoke and poisonous gases are the leading cause of
death in fires and can kill a person long before the flames will; and
WHERAS, underestimating the power of fire and the time it takes
to escape a home fire put people at severe risk of fire death and
injury; and

WHEREAS, developing and practicing a home fire escape plan at
PROCLAMATION least twice a year is critical to escaping a real fire safely; and

WHEREAS, a complete home escape plan includes working
smoke alarms, everyone in the household knowing two ways out of
each room, having an outside location where everyone will meet
upon exiting and memorizing the local fire department's
emergency telephone number; and
WHEREAS, the Fire Prevention Week 2001 theme - "Cover the
Bases-Strike Out Fire!"-emphasizes the extreme importance of not
only having a home escape plan, but physically practicing it
regularly; and
WHEREAS, the fire service of the Borough of Carteret is
dedicated to the safety of life and property from the devastating
effects of fire; and
WHEREAS, the members of the fire service are joined by other
concerned citizens of this Borough, as well as other emergency
service providers and safety advocates, businesses, schools, service
clubs and organizations in their fire safety efforts;
I, JAMES, A. FAILACE, MAYOR OF THE BOROUGH OF
CARTERET, in cooperation with the non-profit National Fire
Protection Association (NFPA) do hereby proclaim the week of
OCTOBER 7-13, 2001
as
FIRE pREVENTION WEEK
this week commemorates the Great Chicago Fire of 1871, which
killed more than 250 persons, left 100,000 homeless and destroyed
more than 17,400 buildings.
I call upon the people of the Borough of Carteret to participate in
fire prevention activities at home, work and school and to execute
"Cover the Bases-Strike Out Fire!" to ensure their safety and the
safety of their families in the event of fire.
Mayor Failace Mayor Failace then thanked the Fire Department, Police, First Aid
and those who were able to assist over in New York and those who
were always ready to assist in this terrible tragedy. He would also
like to commend one of our citizens Carmine who works in
construction and was working in Jersey City at the time and was
able to get over to New York to help out and he thanked the fifty
(50) men that came with him over on the boat. He also visited the
homes of the two (2) citizens of Carteret who are officially lost in
the tragedy and sent the families the heartfelt feelings of himself
and this Council and assured them if there is anything we can do
we would. He said it is just such a terrible time and we will

remember them in our prayers and we need to remember our MaYor Failace Cont:
members of the armed forces who are already there or will travel
there. He also wanted to let us know that he had a meeting today
with Emergency Management, Fire, Police, First Aide, businesses
in Carteret like Kinder Morgan, Ashland Chemical, Amoco, etc.,
just so that he felt comfortable that we are doing everything in our
power to protect the citizens and businesses in Carteret. It was a
very good meeting and he tells us that we have some of the finest
Municipal Services in the state of New Jersey. These guys are
doing a heck of a job and our businesses are doing everything in
their power to ensure the safety of their employees and the citizens
of Carteret. He also met yesterday with leaders of the Asian/Indian
Community in Carteret. He thought it was necessary to do that.
Nick Goldsack was there and the Chief of Police, Fire Officer, etc.,
because we need to help them because they are good hearted
members of our community and they certainly have some concerns
and fears and some of them have been jostled a bit and he thinks it
has been mostly done by young people. In the progress he has
spoke to Doctor Vita and he has assured him that they have done
everything in their power to help and educate our young people. I
thought that went very well. He commented that he thought we
were a very strong community and that he was at the Candlelight
Vigil Friday night, that was put together by a young woman he
only knows as Roxanne and he told her to call her office and he
gave her his card because he wanted to do something for her . It
was phenomenal and this young woman deserves credit. He spoke
highly of how the town pulled together and did so many wonderful
things because of this tragedy. He mentioned that he received a fax
from the League of Municipalities saying they were now only
accepting monetary donations. He asked everyone to pray for the
families. Then he went on to say, for a bit of almost good news, he
has seen a letter from the Department of Community Affairs today.
We had applied for a twenty (20) year no interest loan for the
demolition of our old Sewer Plant and the letter says that they are
going to recommend to the legislature that we do receive this in the
amount of $50,000.00.
Councilmember Santoro mentioned that we should recognize that
it was because of the work of Don Norbut from T&M.
The Mayor said that Don told him last night that Patrick and him
had put together a great package and he feels pretty comfortable
that the first step was the DCA and they approve it.
Upon MMS&C by Councilmembers Reiman and Santoro and PUBLIC DISCUSSION
unanimous affirmative vote of the four (4) Councilmemers present
the meeting was declared open for public discussion.
Jim Mancuso questioned the resolution for the bid for the Mini Mini Bus
Bus, saying that the bus they were going to get had the same
specifications of the one we got going out for bid.

Mini Bus Councilmember Santoro said the bid specs followed the type of

Attorney Bergen said our Purchasing Agent did the bid specs and
and we discussed the bid specs saying it was going to be awfully
difficult to prepare neutral bid specs for a used bus. There are
probably not a lot of them out there, so it is not uncommon to
know that one may be available for certain types of equipment that
meet their needs, but, if you have to go out to bid the bid specs did
not say that was the only bus, Gloria Goodrich advised the bid
specs would go out providing for equivalent or better provisions
then that provided.
Patricia Patricia Rodriquez, 72 Edwin Street, she spoke saying she thanked
Rodriquez the people responsible for Ethnic Day, she had a great time. She
then thanked Officer Weaver who went above and beyond the call
of duty for her son helping to see that the person who carjacked
him was brought to justice. She went on to she wanted her
driveway and curb back in front of her house. She had pictures of
how it was damaged because of street work being done.
Mayor Failace told her they would take care of it.
Chico Basilici, said a few meetings ago he mentioned the
Chico Basilici (inaudible) they had on the end of Washington Avenue, to knock it
out and build a new one and the VFW will take care of the
landscaping.
Mayor Failace told him they would have the engineer look at it.
Dave Crudup, Bergen Street. At the rear of 75 Essex Street
Dave Crudup someone again has dumped, this time a washing machine, a stove,
garbage, etc., in back of this abandoned house. He asked about the
possibility of having the Borough clean it up or having someone
clean up the property. This is the second time.
Councilmember Reiman said Robert Bergen, Esq. and Tony
Neibert were working on going out to bid to knock down the
abandoned home. He then told Mr. Crudup he would call the
Public Works Department on the next day and tell them to clean up
the area.
Stanley Gutowski Stanley Gutowski spoke saying on Sunday at 6:30 p.m., at Liberty
State Park, there is going to be a remembrance for the people of
New Jersey and everyone that is involved in the World Trade
Center Disaster. Tickets are available around different locations of
the state. It will be eliminated to about 15,000 in attendance. He
then mentioned for the Mayor not to be so humble because his son
is going over to Saudi Arabia. He said everyone wished him well.
Mayor Failace told Stanley Gutowski he had understood that the
Governor's Office had put quite a great deal of money up for what
is going on in Liberty State Park and that he was able to get it all
donated and he thanked him for his hard work.

Tom Lang, Colgan Avenue, said he understood when he spoke Tom Lang
with Councilmember Rios at the last meeting, that he had
contacted Brian O'Connor about the spillage and how we were Turnpike
reimbursed, he guessed by the County and the Insurance Company
for the track and he wanted to applaud him for going about and
getting the information. He commented he did not know that was a
standard policy. His next question was that on last Thursday, on
the intersection of Roosevelt Avenue and right off the Turnpike a
truck coming off the Turnpike made a left hand turn and knocked
over a street light. He said Carteret had to close off one main
coming off the Turnpike to make the left and it was done very well
and the traffic flowed safely into Carteret. There was another
patrol car that actually blocked the light and another patrol car was
also there. He asked if they had any sort of policy or if there was
monies we could go after, because he did not feel the Carteret
residents should have to absorb the cost of the police officers. He
thinks the Turnpike, the County and the truck driver's insurance
should pay Carteret something. He commented the County would
have to pay for the light.
Councilmember Santoro said the officers that responded were on
duty at that time. She questioned reimbursement because they are
to respond to emergencies, but, she did say that if reimbursement
was available they will reach out for it.
Mr. Lang said he was mentioning this at this Council Meeting and
maybe by the next Council Meeting he will bring it up again. He
said Councilmember Rios had gotten the information for him,
whether it was one (1) or two (2) meetings later.
Councilmember Santoro said she wasn't aware that the officers
were on overtime and she would check into it. She will let him
know if it had happened before and if so what we had done in the
past and what we can do in the future. She is aware that they can
go to the Turnpike for overtime situations for traffic. She will
check into it with Patrick De Blasio and the Chief and get back to
him.
Mr. Lang said he thought we should be compensated. He then Kolibas Settlement
mentioned the settlement with Mr. Kolibas Sr. and asked if they
can release the amount.
Mayor Failace said no.
Mr. Lang asked if they would ever be able to release the amount.
Attorney Bergen advised the Council that pursuant to the terms of
the contract it will be confidential.
Mr Lang asked if this was a settlement reached out of court.
Councilmember Quinones said yes.

Mr. Lang asked if we had any way of knowing how much that cost
Kolibas
Settlement us.

Attorney Bergen said there are procedures we can make
application for, if you want to make a request for public documents
or pursue a court order. He said very often you advise everybody
to keep the terms of the settlement quiet because very often the
Borough may be negotiating other settlements with other people
with regard to claims and for the attorney that becomes very
difficult to debate why this person got that money and that person
got that money.
Resolution Mr. Lang questioned Resolution~l-304 and asked someone to
:g)1-304 explain what it means, to execute Affidavit of Exemption.
Attorney Bergen said he could explain it to him. He said it appears
in 1943 the Borough sold a piece of property to the estate to a
husband and wife for $1.00 and the deed never got filed. Now the
estate is trying to transfer that piece of property, so in order to have
a proper change in title they need to go back and file that deed and
at the time you file it, based upon the value of that property there is
something called a realty transfer tax. A tax paid on the transfer of
real estate based upon that value of real estate and in this case this
fee should be exempt because the transfer, in this particular case,
was for less than $100.00. It was for actually $1.00 and also because
it is a municipality, so we just need to have authorization for the
Borough Clerk, presently, to execute this Affidavit of Exemption
to cover that deed that was done back in 1943.
Mr. Lang asked about the Communications for a resolution
Election Hours opposing extension of election hours. He said his understanding is
they are opposed to extending the hours.
Mayor Failace said they are opposed to the one for six o'clock.
There was a seven o'clock starting time and they changed it to six
and he believes one of the reasons is that it is already hard enough
to get poll workers at the later time.
Mr. Mancuso spoke saying if there is an accident on a county road
and the police from the town respond, they wait until the county
gets there and the county takes over and releases the people of the
town. This is the way he has always heard it from other towns.
Attorney Bergen asked if Middlesex County had a County Police
Department.
The Governing Body said yes, the Sheriffs Office.
Attorney Bergen asked if they respond to accidents.
Mayor Failace said he has never seen them in Carteret.

There being no further business or discussion, upon MMS&C by ADJOURNED
Councilmembers Fazekas and Quinones and unanimous
affirmative vote of the four (4) Councilmembers present, the
meeting was adjourned at approximately 8:30 p.m.
Councilmember Santoro interrupted saying she had one more Councilmember Santoro
message. In the newspaper, about the Trash Train, it was written
that because of the Attorney General getting involved with the
Linden Mayor, the Commissioner of the DEP is holding off on his
decision, so that is very important.
