Mayor Briggs called the regular meeting of the City Council to 2. order at 7:30 P. M. Mr. Bill Carnes of the Temple City Southern Baptist Church, 5221 El Monte Ave., Temple City, gave the invoca- tion substituting for Rev. Ray Perkins who was unable to attend. 3. Mayor Briggs then led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Beckley, Harker, Merritt, Tyrell, Briggs ABSENT: Councilmen -None ALSO PRESENT: City Attorney Martin, Public Works Director Pizzorno, Asst. City Manager Recupero, City Manager Koski 5. APPROVAL OF MINUTES: Regular meeting of May 7, 1968 Councilman Merritt corrected the above minutes as follows: (1) page 5, 7th paragraph "stated he agreed with what" should be corrected to read "stated he agreed pretty much ": and (2) page 7, 2nd paragraph, line 3, reads "bars as other cities" corrected to read ''brs and the problems as other cities ". There were no further corrections and Councilman Merritt moved to approve the minutes of May 7, 1968, as corrected, Councilman Beckley seconded, and the motion was carried with Councilman Harker abstaining as he was absent for most of the meeting. UNFINISHED BUSINESS: 6. ORDINANCE NO. 68 -266: 1st read. Re Amendments to Temple City Zon- ing Code regarding uses in M-1 and C -2 zones and residential zones. City Attorney Martin presented Ordinance No. 68 -266 for 1st read- ing, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 9202, 9390 and 9410 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO ZONING REGULATIONS. Councilman Tyrell moved to waive further reading of Ordinance No. 68 -266, Councilman Merritt seconded, and the motion was carried unanimously. No further action was taken as this was the first reading of the ordinance. NEW BUSINESS: 7. SET PUBLIC HEARING: Curb, Gutter & Driveway Approach, Daines Dr., south side between Baldwin & Nadine Public Works Director Pizzorno advised that this improvement has been requested and recommended a public hearing be set. Coun- cilman Tyrell moved to set the above for public hearing on June 4, 1968, at 7:30 P. M., Councilman Harker seconded, and the motion carried unanimously. 8. RESOLUTION NO. 68 -821: Warrants & Demands City Manager Koski presented Resolution No. 68 -821 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $19,320.91, DEMAND NOS. 11133 THROUGH 11186. Councilman Harker moved to adopt Resolution No. 68 -821, Councilman Beckley seconded, and the motion was carried unanimous- ly 9. COMMUNICATIONS: City Manager Koski advised there were no communi- cations to consider at this time. Council Minutes, May 21, 1967, page 2 10. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: _James Phillips, 10036 Daines Dr., asked for information regarding possible improvement of Daines Dr., whereby he and several other property owners would dedicate frontage for street purposes. He stated the various property owners had different information and he requested clarification of what was proposed. Public Works Director Pizzorno advised that there are five parcels that have not dedicated property for street purposes on Daines Dr. There is a dangerous safety hazard at the comer and the City owns this property and is interested in putting in curb and gutter. Also there are three property owners who wish to put in curb and gutter at the same time. Over 60% of the block have signed and want to get curb and gutter in and this would require condemna- tion on three parcels. Mr. Phillips stated if he dedicated the City would pay him 50 per lineal foot, would take care of his lawn sprinkler system and set back his water meter. Also he felt the City should buy his property instead of him dedicating it to the City. His property is 80 ft. wide and dedicating 30 ft. deep he felt he should be reimbursed approximately $2500. Councilman Tyrell advised the Council was not here to bargain with him as far as his property is concerned and the City does not have funds to do so. He stated Mr. Phillips did not have to dedicate and donate the land, and the City did not have to go ahead with the improvement. Mr. Phillips was also concerned with the amount of traffic already existing and about the increase if the street were widened. Mary Phillips, 10063 Daines Dr., was also concerned with the traffic and asked the Council to consider making Daines a one way street, and.;she fel,t s idewa-lks should be i'nsta'11ed;om, the north side of Daines as a safety measure for children going to and from Live Oak Park. She felt the people on the north side should cooperate in the sidewalk program if the people on the south dedicate for the street widening. She also asked re the taxes if decreased when donating the land. She was advised that the Traffic Commission had reviewed the problems and did not recommend Daines Dr, for a one way street which would inconvenience many people in the area. Also that unless the property is reassessed there would be no increase in taxes. Also, if the improvement was made, that the increase in value would offset the donation of the land so the taxes should remain about the same. Mr. Phillips stated if donating the land to the city, he did not feel he should pay one red cent for the cost of the curb and gutter. Mayor Briggs advised him that the curb and gutter would benefit him, that the program is cooperative with a rebate to him of 50 per lineal foot which would make it in the area of $1.50, while the City pays for the engineering costs and the paveout at a cost of between $5. and $6. Russ Bailey, 10030 Daines Dr., asked about the 30 ft. dedica- tion and was advised 18 ft. was for street purposes and 12 ft. for parkway. He also asked about sidewalks and was advised the City has a cooperative program for this installation also, which was explained to him. City Manager Koski stated if more than 50% of the block had curb and gutter installed,the City can initiate proceedings where the property owner would have to pay for all improvements. Council Minutes, May 21, 1968, page 3 Jos. Kriskovic, 1022 Daines Dr., stated he had donated his land and he favored the widening and improvement. At this time Parky Parkhurst, 9651 Olive, expressed his apprecia- tion to the City for having been selected to represent the City at the Annual Senior Citizens Recognition Day hosted by the County, 11. MATTERS FROM CITY OFFICIALS: The City Manager presented a request from Bob Feagans of the Black Watch for use of Live Oak Park on Thursday, May 30, from 1 to 4 P. M. for a non - profit baseball game, with any proceeds to be used to help Little People of America, Inc. The Council unanimously approved the request. City Manager Koski presented a request for the removal of a tree on the west side of Oak Ave. approximately 150 ft. south of Las Tunas Dr. at Ralph's new shopping center. The Park Superintendent recommended removal as the tree is infested.with termites. Councilman Merritt moved to approve the request, Councilman Tyrell seconded, and the motion carried unanimously. City Manager Koski presented a recommendation for the purchase of radio communications equipment for Truck 105 (Aerial Tower) at a cost of $658.28. Councilman Tyrell moved to approve, Councilman Beckley seconded, and the motion was unanimously carried. Councilman Merritt asked if there had been any problems with the seismic survey and was advised there had been none reported. Councilman Merritt also asked about the use of vacant store windows advertising out -of -town bakeries and was advised that at the present time the City has no control of this, but it will be covered under provisions of the proposed sign ordinance. Councilman Merritt also felt campaign headquarters should be made aware of our ordinance covering political signs and stickers. Councilman Tyrell stated for the record that Temple City was out- standing in attendance at the Contract Cities Seminar which fully justifies the cost incurred. Councilman Tyrell also complimented City Attorney Martin on the paper he presented at the Seminar stating it was extremely well done and it justifies the City's faith in him as an outstanding example of a City Attorney. Mayor Briggs stated he attended a meeting of the Alhambra Board of Realtors and many Temple City realtors were in attendance. In accordance with their request he proclaimed the week of May 19 -25 as Realtor Week. Mayor Briggs commented upon the anniversay on May 25, of the incorporation of the City in 1960, and presented a proclamation calling upon all citizens to celebrate the 8th birthday of the City. Councilman Merritt advised the Council that City Manager Koski had made a very worthwhile presentation at the Kiwanis Club on the progress of the City since incorporation. 12. ADJOURNMENT: Councilman Tyrell moved to adjourn, Councilman Merritt seconded, and the motion carried unanimously. Council adjourned at 8:30 P.M.
