PUBLIC HEARING JOHNSON VARIANCE, TITLE 11 FORMATTING CHANGES PRESENT: Chairman Dan Garren; members Rob Geray, Roy Hobbs, Mike Taylor, Bette Lovinus, and Clerk Robyn Keyes. VISITORS: Mayor Andersen, Dee Johnson, Bruce Satterfield, Brenda Hyde and her son. Chairman Garren asked if anyone had questions or concerns regarding last month's minutes, no one did. PZ member Taylor made a motion to approve October's minutes. PZ member Geray seconded the motion. All were in favor. Motion carried. Chairman Garren recognized citizens from the floor. Mayor Andersen said he wanted to thank the Planning and Zoning Commission for all of their hard work and efforts. He explained that the Commission did not get paid for the time they were serving on the board, so he gave each member $100 thank -you check for their dedication. The Mayor also congratulated PZ member Geray for his election to the Council. The Mayor asked Clerk Keyes to create a record of each member's terms in office. The Mayor left the meeting. Previous Action Items. Clerk Keyes said she was still waiting to hear back from Steve Serr with Bonneville County Planning and Zoning regarding acceptance of the proposed impact boundary increase. Chairman Garren said there was nothing scheduled for the agenda for next month and asked the Commission if they wanted to take the month off. They agreed to take December off. Public Hearing. A public hearing was held for Dee Johnson. Mr. Johnson was asking for a variance for his side setback so he could build a storage shed on the property line adjacent to an abandoned ditch easement. After holding the hearing and reviewing the request, the Commission recommended to the Council to approve the Johnson's request for a variance. See appendix A for hearing minutes. Public Hearing. A public hearing was held for the formatting changes to Title 11 of the Code Book. After holding the hearing and reviewing the information, the Commission recommended to the Council to approve the Title 11 formatting changes. See appendix B for hearing minutes. PZ member Geray made a motion to adjourn; PZ member Lovinus seconded the motion. Adjourned at 7:50 p.m. 1 APPENDIX A PUBLIC HEARING 6:45 P.M. JOHNSON VARIANCE REQUEST PRESENT: Chairman Dan Garren, Members; Roy Hobbs, Rob Geray, Mike Taylor, Bette Lovinus, and Clerk Robyn Keyes. VISITORS: Dee Johnson, Bruce Satterfield, Brenda Hyde and her son. Chairman Garren welcomed everyone, went over the procedure for the public hearing, and turned the time over to Mr. Johnson. PZ member's Geray and Hobbs recused themselves from the hearing due to the fact they were personally acquainted with Mr. Johnson. Mr. Johnson explained that he wanted to construct a 24 x 16 shed along his eastern property line. Johnson would like to place the east side of his shed on the property line and use the right-of- way between his property line and the row of trees as an entrance to the shed therefore giving him adequate distance between the shed and the existing garage. The shed would be placed two (2) feet further back than the front setback of the house and it would have the same exterior siding as the house as required by the covenants in Ashwood Acres. Mr. Johnson explained that he side setback was adjacent to an easement for an abandoned ditch, and adjacent to the ditch easement was the regular easement for the street. Johnson said the shed would not interfere with the line of vision for traffic at the corner. Chairman Garren asked if anyone in favor of the request would like to speak. Bruce Satterfield said he lived next door the Johnson's and he had no objections with the request. Satterfield also agreed that the shed would not interfere with visibility and traffic. Chairman Garren asked if anyone neutral or against the request would like to speak, no one responded. Chairman Garren closed the public portion of the hearing and turned the time over to the Commission members. PZ member Lovinus asked what type of foundation the shed would be on. Mr. Johnson said either a concrete pad or foots depending on what the building inspector required. Chairman Garren asked what the distance was from Johnson's side property line to the edge of 55`h. Johnson said the distance was about 35 feet. Garren explained that if the County or the City needed the easement area the shed would possibly need to be removed at the homeowner's expense. Johnson said he understood. PZ member Lovinus, and Taylor agreed with Garren: since the easement was vacated by the irrigation company the request was reasonable and they recommended the Council approve. 2 APPENDIX B PUBLIC HEARING 7:00 P.M. TITLE 11 FORMATTING CHANGES PRESENT: Chairman Dan Garren, Members; Roy Hobbs, Rob Geray, Mike Taylor, Bette Lovinus, and Clerk Robyn Keyes. VISITORS: None Chairman Garren said no changes had been made since the last meeting so he suggested the members voted. Clerk Keyes said the Attorney had made one change which was to remove the setback requirements for patio homes that the Commission added to the R-2 zone. PZ member Taylor made a motion to approve the Title 11 formatting changes with the attorney's change. PZ member Hobbs seconded the motion. All were in favor. Motion carried. 3 PUBLIC NOTICE The City of Iona's Planning and Zoning Commission has scheduled a public hearing on the evening of November 9, 2011 at 7:00 P.M. at the Iona Community Center, which is located at 3548 North Main Street, Iona, Idaho. The purpose of the hearing is to consider formatting changes to Title 11 of the City Code Book. A second public hearing is scheduled for the evening of November 15, 2011 at 7:30 P.M. at the Community Center with the City Council for final approval if so recommended by Planning and Zoning. If approved, Title 11 Zoning of the Iona City Code will be reformatted for consistency throughout each chapter. If you have any comments concerning this request, they will be considered at the public hearing. Comments may be made in writing, but must be received by the City Clerk seven days prior to the public hearing.
